CONDITIONS OF APPROVAL
1) This well shall be used rn such a way as to cause no matenal injury to existing water rights. The Issuance of this permit does not ensure that
no injury will occur to another vested water right or preclude another owne. of a vested water right from aeek,ng relief in a civil court action.
2) The construction of this well shall be In compliance with the Water Well Construction Rules 2 CCR 402-2,unless approval of a variance has
been granted by the State Board of Examiners of Water Well Construction and Pump Installation Contractors in accordance wen Rule 18
3) Approved pursuant to CRS 37-90.137(4)and the findings of the State Engineer dated it.e/ a.rc 3, 2ele-l7 for use of an existing well
constructed under permit no.255953.
4) The use of ground water from this well is limited to domestic, industrial,commercial,lawn and garden irrigation,and domestic animals.
5) The pumping rate of this well shall not exceed 15 GPM.
8) The average annual amount of ground water to be appropriated shall not exceed 5.5 acre-feet.
7) Production Is limited to the Laramie Fox Hills aquifer.
8) The entire length of the hole shall be geophysicelly logged as required by Rule 9 of the Statewide Nontributary Ground Water Ryles.
9) the owner shall mark the well in a conspicuous place with well permit number(s), name of the aquifer,and court case number(s)as
appropriate. The owner shall lake necessary means and precaullcns to preserve these markings.
10) A totalizing flow meter must be installed on this wall and maintained in good working order. Permanent records of all diversions must be
maintained by the well owner(recorded al least annually)and submitted to the Division Engineer upon request.
11) Thls well ehali be located no more than 200 feet from the location specified on this permit.
12) Pursuant to CRS 37-g0-137(9)(b)and the Denver Basin Rules,no more than 98%of the nontributary ground water withdrawn annually abet!
be consumed and the well owner shall demonstrate to the reasonable satisfaction of the State Engineer that no more than 98%of the water
withdrawn will be consumed.
13) This well is subject to administration by the Division engineer in accordance with applicable decrees,statutes,rules,end regulations.
14) The issuance of this permit hereby cancels permit no.265953.
15) This well shall be constructed at least 800 feel from any existing well,completed in the same aquifer,that is not owned by the applicant.
NOTE:The ability of this wall to withdraw its authorized amount of water from this non-renewable aquifer may be less than the 100 years

To Whom It May Concern:
This letter is to oppose the zoning change request of Gib Smith. This parcel of land is
zoned Agricultural and has been since before Mr. Smith's purchase of said property.
This property is adjacent to our property and to US Highway 85. We would oppose any
zoning request that would create an eyesore, not only from our physical perspective, but
also from the view as one would see when traveling down Highway 85.
Agricultural land tends to be the "greenbelts" of a rural community. One only has to
travel down Interstate 25 to see the visual effects of poor decisions regarding zoning
allowances. We don't believe this is the image that Weld County wants to portray.
We hope you will take this opposition under advisement as you consider Mr. Smith's
request.

The Sheriffs Office recommends the following improvements for this business:
2. Mail distribution for the home and business should be limited to as few locations as possible
with a central drop off location within the property. It should be developed so that employees do
not have to cross a county road to obtain their mail.
3. A permanent sign should be placed at the entrance to the property that meets the planning and
zoning standards and is approved by the county commissioners, detailing the name of the
business, address, and a graphical presentation of the roadways within the property. There
should be a plan developed to maintain this sign.
4. If the roadways within this property are not maintained or adopted by the county, individuals
residing on this property should be made aware that the Sheriffs Office will have
limited traffic enforcement powers in regard to traffic complaints.
5. A plan should be developed to maintain roadways on the property, especially during
inclement weather conditions for emergency vehicles.
6. If there are oil or gas production facilities within this property,they need to be fenced off in
order to mitigate the potential for tampering. These facilities are known to create an attractive
nuisance for young people. Tampering not only creates a significant danger to safety but also of
environmental damage with extensive mitigation and clean-up costs.
7. If you intend to name any of the roads on the property you should be present these names to
the Sheriffs Office for approval. This will eliminate duplication of street names within the county.
If you do name any of the roads they will need to be properly marked with clearly visible
reflective signs.
The Sheriffs Office lacks the ability to absorb any additional service demand without the resources
recommended in the multi-year plan provided to the Weld County Board of County Commissioners or as
indicated by growth not considered at the time the plan was developed. I have no other comments on this
proposal.

Dear Ms. Martin:
Kerr-McGee Oil & Gas Onshore LP, a wholly owned subsidiary of Anadarko
Petroleum Corporation, filed a protest letter dated January 24, 2007 with the County with
respect to oil and gas interests that underlie the thirty-five acre parcel in the E/2 of the
NE/4 of Section 7, Township 2 North, Range 66 West that is the subject of the
application for a Site Specific Development Plan and Special Review Permit filed by Gib
Smith with the County.
Anadarko E&P Company LP and Anadarko Land Corp. own the coal mineral
interests that underlie the Property.
Since the time that Kerr-McGee filed the protest letter, a representative for Kerr-
McGee has had an opportunity to discuss the matter with the Applicant. In light of the
discussion and at this time, Kerr-McGee wishes to withdraw the protest that it filed to the
application.
