The zoning change will be consistent with the policies of the Weld County Code,Chapter 22, due to the fact that the newly created parcels will be used as single family residences,not a commercial or industrial sites. 2.The parcel is zoned A-Agriculture as are the other properties in Black Hollow Acres. None of the properties have access to irrigation water,therefore, farming or raising crops is not an option. Pursuant to Weld County requirements,the zoning will change to E-Estate for the newly created lots. It is emphasized that the land use will not change as both properties will simply have single family homes. 3.The newly created lot will be serviced by a new septic system,and a propane tank. 4. The newly created lot will be serviced by North Weld water. 5. Based on information provided by Soilogic and CTL Engineering,the subject site does not have moderate or severe limitations for construction. CTLITHOMPSON Hin October 24, 2006 Mr. Jason Slater 8567 Weld County Road 86 Fort Collins, Colorado 80524 Attention: Mr. Slater Subject: Mineral Resource Investigation Report Lot 12, Black Hollow Acres 1" Filing Weld County, Colorado Project No. FC03923-115 This letter presents the results of our mineral resource investigation for your property, including discussion of site conditions, geology and discussion of our opinion regarding the potential for mineable mineral resources under the site. We have also reviewed a geotechnical subsurface investigation report prepared by Soilogic, Inc. under Project No. 05-1023, dated September 23, 2005 that you provided. We understand the property is to be divided into two lots, requiring a resubdivision process through Weld County. The purpose of the mineral resource statement is to evaluate the likelihood of mineable mineral deposits on the site. We reviewed geologic and topographic maps, reviewed geologic literature, and visited the property to determine the likelihood of mineable resources on the site. The scope of work did not include investigation of mineral rights, testing for radon gas, environmental assessment, or chain-of-title research. PHYSICAL SETTING We conducted a site visit on October 18, 2006. The 30±-acre property is located east of Fort Collins, west of Weld County Road 19 on the north side of Weld County Road 86 in the Southeast Quarter of Section 33, Township 8 North, Range 67 West of the 6'" Principal Meridian in Weld County, Colorado. The lot has an existing rural residence and outbuildings located at the south end. The remainder of the property is pasture. We observed no visual evidence of past or present mining activities on or adjacent to the property. The vegetation included native grasses and weeds. GEOLOGY The geology of the site was evaluated by reviewing available maps and by a field reconnaissance. Generally, the site lies over a thick accumulation of sediments in the Cheyenne and Denver Basins, which are a significant source of fossil fuels in the area. The basins were formed as a result of tectonic activities, such as the Laramide Orogeny that occurred during the Cretaceous Period to early Cenozoic. During this time, sediments that were eroded from the uplifting mountains were carried to and deposited in ancient deltas, swamps, beaches and seas east of the mountain front. Fossil fuels originated from organic matter that was trapped at depth in the sediments. A geologic map by Shelton and Rogers (1987) indicates the Transition Zone of the Pierre Shale is the closest geologic formation to the surface at this site. The Transition Zone of the Pierre Shale consists of up to 2000 feet to 3000 feet of shale, claystone, siltstone and sandstone. The Pierre Shale is not considered to be a source of significant fossil fuels. The report by Soilogic indicates claystone was encountered at approximately 2 feet below the surface at the existing house. MINERAL RESOURCES We have reviewed available literature and published geologic maps, and examined the site for evidence of mineable mineral resources. Under certain circumstances nearly any natural resource can be considered a mineable resource. For this investigation, we have considered the following mineral resources: • energy fuels such as fossil fuels and uranium; • precious and semi-precious minerals and metals such as gold, silver, copper, and diamonds; and • industrial or construction materials such as silica, limestone, aggregate, building stone, sand and gravel, and landscaping materials. In order for a mineral deposit to be mineable, it must also meet economic requirements and the method of extraction must be feasible. The expenses, logistics, and aesthetic implications of the actual location must all be considered. We have considered these factors and discuss each of the potential mineable resources in the following paragraphs. Energy Fuels. Energy fuels include oil and gas, coal, oil shale and uranium deposits. A map of oil and gas fields of Colorado by Scanlon (1983) does not indicate active oil and gas fields in the immediate project vicinity. The nearest filed is Black Hollow field, located a few miles east of the property. No oil or gas facilities were observed on or adjacent to the property. The Pierre Shale is not known to be a significant source of uranium. The Fox Hills Formation located east of the site is a potential source of uranium in the area, however, no evidence of recent or past mining activity for uranium was observed in the immediate vicinity. A map of coal production and distribution in Colorado by Jones, Schultz and Murray (1978) indicates the project site is outside the recognized coal regions and field boundaries. We believe the probability of development of economically mineable deposits of energy fuels from this site are so remote as to be negligible. JASON SLATER LOT 12,BLACK HOLLOW ACRES 15T FILING 2 CTL I T PROJECT NO.FC03923-115 r Precious Metals. The near surface geology does not include metamorphic or intrusive igneous deposits that would be consistent with precious metal mineralization. We believe the probability of development of economically mineable deposits of precious metals from this site are so remote as to be negligible. Sand, Gravel, Aggregate and Quarry Aggregate. We examined a resource map and atlas by Schwochow, Shroba and Wicklein (1974) that shows regional aggregate classification and occurrences of sand and gravel. The map indicates there are no probable aggregate resources on and adjacent to the subject property. Therefore, we believe the probability of development of economically mineable deposits of sand, gravel and aggregate from this site are so remote as to be negligible. The Pierre Shale is not known to be a source of dimension stone or other quarry stone. We believe the probability of development of economical deposits of quarry stone from this site are so remote as to be negligible. CONCLUSIONS Our review of geologic maps, published reports, aerial photographs, our examination of the site, and our geologic analysis indicate the potential for economically mineable resources on the site is so remote as to be negligible. LIMITATIONS The opinions presented in this report were developed from review of topographic and geologic maps, information gathered during our review of previously published reports, reasonably ascertainable public and historic records and our site observations. Should additional surface, subsurface or chemical data become available, the conclusions and recommendations contained in this report shall not be considered valid unless they are modified or approved in writing by our office. We believe this investigation was conducted in a manner consistent with that level of care and skill ordinarily exercised by members of the geologic and engineering profession currently practicing under similar conditions in the locality of the project.
