SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW (USR)
QUESTIONNAIRE
1. Of the 42.5 acres, this site proposes to construct on approximately 16.91 acres with three
buildings (office and two shop buildings), other structures (fueling station and covered
parking),paved driveway and parking area, and graveled roads and parking. The specific use
of the developed portion of the site will be as a construction business, with the buildings and
parking located adjacent to County Road 13. The proposed access onto County Road 13 is
near the very northwest property corner and is the only access onto the site. The site also
proposes to leave approximately 25.59 acres as agricultural along the eastern and southern
edges of the site, away from the main access onto the site. This application is for the
construction of all the facilities mentioned above, including the proposed future expansion of
the shop building as shown on the site plan attached as part of this submittal.
2. This proposal intends to be consistent with the Weld County Code, Chapter 22
(Comprehensive Plan). Per conversations with Weld County Planning staff, this site must
submit an application as a"Use by Special Review,"that will follow the planning process
procedures.
3. This proposal intends to be consistent with the Weld County Code, Chapter 23 (Zoning) and
the zone district it is located. This site is zoned Agricultural, and will remain partially
agricultural, with a construction business built on the portion of land adjacent to Weld
County Road 13. It is the intent to follow the standards and requirements in Chapter 23,
Division 4, Uses by Special Review. We understand that an expansion or enlargement of the
site from that shown on the site plan or a change of use will require a County approved
addendum to the Special Review Permit.
The following are notes with regards items within Chapter 23:
• A letter of intent to serve the site by the Little Thompson Water District(LTWD) will be
supplied as part of this application. Preliminary fire flows have been provided to LTWD.
Final design of the site will include coordination with the Johnstown Fire Protection
District and LTWD requirements. Water plans will be provided as part of the final
construction documents after preliminary approval of the site plan.
• This site proposes a septic system and will not require sewer service from an outside
entity. SCS soil reports for the types of soils found on this site are included with this
application. For the first USR submittal, a geotechnical report will not be completed.
When the site plan is preliminarily approved by the Planning Commission, a geotechnical
report will be obtained complete with pavement, foundation, and septic design.
• This site proposes a stormwater detention pond for the developed portion of the site (not
the agricultural portion) that will detain the developed 10-year and 100-year storms and
release at 10-year and 100-year historic rates. Final design of the detention and
stormwater facilities will be after preliminary approval of the site plan as part of the final
construction documents. However, preliminary location is shown on the site plan
contained within this submittal.
• 70' right-of-way from Weld County Road 13 centerline will be provided. All parking is
contained within the site.
• Landscaping will be provided for the site to act as screening from adjacent properties.
• Construction documents will follow Weld County Standards
4. Areas around the site are currently mostly agricultural with residences generally located
along the main county roads. The site is within Y2 mile of Highway 34, a major corridor
between Greeley and Loveland. There is rapid development stretching from I-25 and
continuing easterly along Highway 34 and running south to the Big Thompson River. There
is also extensive development occurring south of Big Thompson River. There is major
development proposed just %2 mile west of the site, east of Larimer County Road 3.

d. The following is a description of the building size and location:
• The proposed office building is a 2-story building plus basement with approximate
dimensions of 85' x 60'. This building is located adjacent to the proposed parking lot
and Weld County Road 13.
• The proposed shop building is approximately 160'x80' (to be expanded to a total of
235' x 80') and is located behind and south of the proposed office building.
• The proposed 25' x 50' fueling station is located north of the shop building and east
of(behind)the office building.
• A second (smaller) 30' x 50' shop building is located near the northern property
boundary.
• The proposed covered 30' x 350' covered parking is located south of the smaller shop
building.
e. There will be no animals on this site. The portion of this site reserved for agriculture will
be for crops.
f. Kind of vehicles and frequency of access:
The following make one trip in/out in the morning and one in/out in the evening

g. Per conversation with LTWD, Johnstown Fire Protection District provides fire protection
to the site.
h. There is no existing potable water service to the site. Little Thompson Water District will
provide potable water service for the structures and office building landscaping. The
property has 1/6 share on Big Thompson Ditch and Manufacturing and 1/4 share of
Farmer's Ditch. The ditch water will be used for irrigating the remaining farm ground and
as much of the landscaping as possible that can be watered by flood irrigating.
i. There is no existing sewage disposal system on the site. A septic system is proposed for
the development.
j. Items to be stored include pipe and appurtenances, construction equipment,
trucks/trailers, truck and equipment parts, and construction tools.
6. The landscaping concept for the proposed Gerrard Yard project is guided by three goals:
• Provide attractive, ornamental plantings around the public entry area and office
building;
• Provide effective screening from the adjoining property and from Weld County Road
13; and
• Manage water demand from plant materials through careful plant selection and
appropriate siting.
The ornamental plantings along the parking lot entry aisle and around the foundation of the
building should compliment the architecture of the proposed building. This area is depicted
as Area A on the landscape plan submitted as part of this application package. Since building
design information is not yet available, it is not possible to design the landscaping for this
area. Landscaping will comply with Weld County codes and requirements and will feature a
combination of deciduous and evergreen trees and shrubs and perennial plantings. Some
accent plantings of annual color may be included as well. Low water plant materials should
be selected and irrigated using either a drip or subterranean irrigation system.
Screen plantings north of the proposed parking lot, along the north property line are
proposed. This screen planting will extend approximately 250' easterly of Weld County
Road 13. A dense planting of evergreen screen trees is proposed. For visual interest, this
screen mass will be punctuated with groupings of small, flowering deciduous trees. The trees
in this area will be flood irrigated with raw water. Low water plant materials will be selected.
Screening will be consistent with Weld County codes and standards.
Screen plantings along Weld County Road 13 (WCR 13) will be installed along the frontage
of the property. A significant width of additional right of way for WCR 13 will be dedicated
in association with this development proposal. When WCR 13 is constructed, the entire right
of way will be improved. No landscape area exists within the typical street section. A 15'
utility easement will parallel the right of way and lie adjacent to it. Trees should not be
planted in this expanded right of way or easement area as they will be lost in the future when
construction of the street and utilities occurs. Therefore, screen tree plantings for this site are
proposed between the back of the utility easement and the proposed parking lot. Limited
shrub plantings could be planted in the western edge of utility easement if they don't
encroach too far into the easement and interfere with future utility installations. Again, low
water plant materials should be utilized. Irrigation could be provided using either potable
water and a subterranean or drip system, or potentially(depending on site grading) using raw
water flood irrigation.
7. The development of this site is not intended to be short term, nor are any of the operations
proposed to be phased out. Therefore, there are no proposed reclamation procedures for the
termination of the Use by Special Review activity. If the land mass occupied by the
construction shop and yard is decreased, the landowner may request a partial vacation. If
additional construction is proposed for the site other than that shown on the site plan and
other than ordinary repairs and maintenance, an amendment to the Special Review Permit
will be submitted.
8. This site proposes a stormwater detention pond for the developed portion of the site (not the
agricultural portion) that will detain the developed 10-year and 100-year storms and release
at 10-year and 100-year historic rates. Flows will be directed via overland flow to the pond
without the use of storm sewer(except for necessary culverts). Offsite runoff will be routed
around the buildings. Water quality will be provided in the detention pond. Stormwater
release out of the pond will be through an outlet structure and storm pipe that directs flow in
a southeasterly direction along the railroad tracks. Flow from the site is historically directed
southerly to the railroad tracks where it follows the tracks and ultimately to the Big
Thompson River. Locations of culverts that cross the tracks outside of this site were not
located. A culvert will also be designed at the proposed access
9. Construction will begin as soon as approval and permits are received. Construction is
estimated to take 4-5 months with landscaping complete after construction.
10. A dumpster for common waste will be stored in a trash enclosure with weekly service. Used
oil will be stored in a tank and used as heating fuel for the shop.

COUNTY OF WELD, STATE OF COLORADO
OFF-SITE ROAD IMPROVEMENTS AGREEMENT
THIS AGREEMENT made and entered into this day of , 2006, by
and between the County of Weld, State of Colorado, hereinafter called "COUNTY" and GERRARD
FAMILY LIMITED PARTNERSHIP LLLP hereinafter called "GERRARD", 1739 S. County Road 13C,
Loveland, Colorado 80537.
WHEREAS, GERRARD has acquired a Land Use Permit from the COUNTY for an Industrial Zone
District (construction business with two shop buildings, an office, and outdoor storage) in the (Agricultural)
Zone District on approximately 42 acres, (USR-1584) located in the SW %a of Section 18, Township 5 North,
Range 67 West of the 6`h P.M. Weld, Colorado.
WHEREAS, the operation facility generates an increase of heavy vehicle traffic, and
WHEREAS, the existing COUNTY roads that serve the operation facility shall require increased
maintenance and improvement due to the increase in heavy vehicle traffic, and
WHEREAS, COUNTY and GERRARD have reviewed maintenance and improvements proposals
put forth by GERRARD and both parties agree that such improvements will enhance the accessibility and
safety of the roads that serve said operation facility.
NOW, THEREFORE, in consideration of the mutual covenants and conditions hereinafter set, forth,
COUNTY and GERRARD mutually agree as follows:
Truck Traffic
A. All heavy trucks shall utilize Weld County Road (WCR) 13, (Strategic Roadway) north to
U.S. Highway 34 (truck route) for ingress/egress to the operation facility.
Improvements
B. GERRARD shall provide a pavement design and road construction plans for the entire truck
route within the Weld County Road maintenance area for review and approval by the Public
Works Department. Pavement shall be required from the Union Pacific Railroad crossing
north to U.S. Highway 34, approx. 2800' feet as shown on the plot plan, Sheet 01, dated
7/14/2006.
C. GERRARD shall complete the Off-site Improvements Agreement associated with the
proposed operation facility and as outlined in this agreement prior to commencement of truck
traffic.
1. GERRARD shall start working on truck route improvements within six (6) months of
signed agreement and be completed in approximately six (6) months from the start of the road
construction.
D. GERRARD will provide testing services and inspection for the construction of the
improvements. The COUNTY will only provide oversight. A registered professional
engineer, registered in the State of Colorado, shall provide the COUNTY with a letter that
certifies the proper installation of the improvements.
E. GERRARD shall pay 100% of the improvements on WCR 13 from Union Pacific Railroad
crossing north to U. S. Highway 34. See attached Exhibit.
F. The safety improvements shall include: construction of adequate turning radii at the main
entrance on to WCR 13; and paving 24 feet in wide with four foot gravel shoulders from the
Union Pacific Railroad crossing to U.S. Highway 34.
G. The engineering design and construction plans shall be the responsibility of the GERRARD.
The applicant shall provide the COUNTY with construction drawings that detail the required
improvements. The plans shall consist of, at a minimum, main entrance intersection layout
and grading, cross section, approach road, adequate turning radiuses, Great Western Railroad
Crossing, and a geometric recommendation on depth of additional asphalt overlay to
accommodate heavy truck traffic. These plans will require approval by the Public Works
County Engineer or his representative. A registered professional engineer, registered in the
State of Colorado, must prepare the construction plans. The plans, when reviewed and
approved, will constitute a section of this agreement. They will be attached hereto and
referenced as Exhibit"A".
H. GERRARD shall warrant and guarantee WCR 13 improvements for a period of one year after
completion and acceptance of said improvements as being completed in accordance with the
engineering design and construction plans by the Weld County Public Works County
Engineer or his representative.
Securi
Prior to commencement of construction of the WCR 13 improvements, GERRARD shall
provide the COUNTY security in the form of a performance bond, letter of credit or other
financial mechanism conforming with COUNTY policy on collateral for improvements to
roads or highways. The amount of such security shall be 100% of the estimated cost. The
letter of credit shall specify that fifteen percent (15%) of the total Letter of Credit amount
cannot be drawn upon and will remain available to Weld County until released By Weld
County.
Maintenance
J. Upon completion of the one-year warranty period described in Paragraph H above, the
COUNTY shall assume full responsibility of the maintenance on WCR 13 from GERRARD's
Union Pacific Railroad crossing north to U. S. Highway 34. Nothing herein shall be
construed to relieve GERRARD or any third-party from normal liability to the COUNTY for
the cost of damages to the aforementioned roadways that may be caused by the negligence or
unlawful acts of GERRARD or a third-party.
r.CDOT Improvements
K GERRARD shall address all the Colorado Department of Transportation (CDOT) access
issues at the intersection of U.S. Highway 34 and WCR 13.
1. Prior to the start of the operation facility, the COUNTY AND GERRARD will
document the existing condition of the roadways. This effort will ensure that
GERRARD will not be held responsible for existing roadway damage, if any.
2. Failure of either party to perform any of its respective obligations hereunder by reason
of acts of God, strike, or acts of any governmental agency or authority having
jurisdiction over matters set forth hereinshall excuse timely performance of such
obligations, but shall not excuse the performance of such obligations as soon as
reasonably practical. The parties may, however, mutually consent to excuse a party
from performing any obligation, in whole or in part, upon a showing that performance
has been rendered impracticable by reason of FORCE MAJEURE.
3. This Agreement may not be assigned in whole or in part by either party hereto without
the written consent of the other party. Such consent will not be reasonably withheld,
conditioned, or delayed.
4. If any clause or provision of this Agreement is illegal, invalid, or unenforceable, then
it is the intention of the parties that the remainder of this Agreement shall not be
affected.
5. Should GERRARD sell its operation, cease operating, file bankruptcy, or in any way
release ownership and responsibility of the permitted property, this Agreement as set
forth herein, shall continue in full force with the property's successor. If the
aforementioned release should occur, GERRARD shall give a minimum notice of
ninety (90) days to the COUNTY before the date of transfer.
6. All construction and material controls for a project will be in accordance with the
current Standards Specifications for Road and Bridge Construction, as supplemented
or revised, provided by the Colorado Department of Transportation. During
construction, signage shall be posted in accordance with the most current Manual on
Uniform Traffic Control Devices.
7. It is expressly understood and agreed that enforcement of the terms and conditions of
this Agreement, and all rights of action relating to such enforcement, shall be strictly
reserved to the undersigned parties, and nothing contained in this Agreement shall
give or allow any claim or right of action whatsoever by any other person not included
in this Agreement. It is the express intention of the undersigned parties that any entity
other than the undersigned parties receiving services or benefits under this Agreement
shall be deemed an incidental beneficiary only.

8. Indemnification: To the extent authorized by law, GERRARD agrees to indemnify,
save, and hold the COUNTY harmless from and against any and all claims, damages,
losses, and judgments, which may be suffered or incurred by the COUNTY as a
consequence of any breach by GERRARD of its obligations and duties set forth in this
Agreement on those portions of the haul route described in this Agreement. In the
event that any dispute shall arise under this Agreement, the prevailing party in such
dispute shall be entitled, in addition to any other relief to which such party may be
granted, to recover its reasonable attorney's fees and court costs incurred in
connection with the resolution of such dispute.
9. By entering into this Agreement, the parties do not intend, either expressly or
implicitly, to create a joint venture or partnership. Except as provided herein, neither
party shall have the right or authority to act for, or on behalf of, or to enter into, any
obligations which are binding on the other party of this Agreement.
10. All notices to be given under this Agreement shall be in writing and delivered in
person, or mailed by certified or registered U.S. Mail, or sent by a nationally
recognized overnight delivery service, to the party to receive such notice at the
following addresses:
