IN THE MATTER OF THE REPEAL AND RE-ENACTMENT, WITH AMENDMENTS, OF CERTAIN
SECTIONS AND THE ADDITION OF CERTAIN SECTIONS TO THE INDIVIDUAL SEWAGE
DISPOSAL SYSTEM REGULATIONS, WELD COUNTY ORDINANCE NO. 9-A, AS AMENDED BY WELD
COUNTY ORDINANCE 9-B.

BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF WELD COUNTY, COLORADO: —
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested

with the authority of administering the affairs of Weld County, Colorado, and
whereas, the Board of County Commissioners has the power and authority under
the Weld County Home Rule Charter and Article 10 of Title 25, CRS 1973, to adopt individual sewage disposal system regulations for all areas of the
County of Weld, and 0.

WHEREAS, the Board of County Commissioners of Weld County, Colorado, has
previously adopted Ordinance No. 9, with subsequent amendments, the Weld tm
County Individual Sewage Disposal System Regulations, establishing a
comprehensive set of rules and regulations pertaining to individual sewage
disposal systems, and
WHEREAS, the Colorado Department of Health, Planning and Standards
Section, Water Quality Control Division, in a letter of March 31, 1983, has
indicated that these amendments and additions are in compliance with the
Individual Sewage Disposal System Guidelines of May 16, 1979, and
WHEREAS, the Weld County Board of Health, in actions taken on December 7,
1982; January 25, 1983; and March 22, 1983, recommended approval of the
amendments and additions to the Individual Sewage Disposal System Regulations,
and
WHEREAS this Board finds and determines that the adoption of the
amendments and additions to the Individual Sewage Disposal System Regulations
are in the best interests of the health, safety, and welfare of the citizens
of the County of Weld.
NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of
Weld County, Colorado, that the following sections of the Weld County

Individual Sewage Disposal System Regulations, Weld County Ordinance 9-A, as
amended by Weld County Ordinance 9-B, be repealed and re-enacted, with
amendments, or added as follows: (amended or added sections of the
regulations are denoted by all capital letters) :
Section II shall be amended by the addition of a new
Section 2.27 which shall read as follows:
2.27 FOOD CHAIN CROP: THOSE CROPS GROWN FOR TABLE
USE WHICH INCLUDES ONIONS, POTATOES, AND SALAD
VEGETABLES. THIS DOES NOT INCLUDE WHEAT, CORN, `
BARLEY, OR OTHER GRAINS.
The former sub-sections 2.27 through 2.60 shall be
re-numbered consistent with the addition of the new
subsection 2.27.
The former sub-section 2.51 shall be repealed and
re-enacted, and re-numbered to read as follows: ^ 'h
2.52 SEWAGE TREATMENT WORKS: A system or facility
for treating, neutralizing, stabilizing of sewage,
which system or facility has a design capacity to —
receive more than 2,000 gallons of sewage per day,
THE DISPOSAL OF WHICH IS BY MEANS OTHER THAN A SUBSURFACE ABSORPTION SYSTEM. The term "sewage _
treatment works" includes appurtenances such as = --

interceptors, collection lines, outfall and outlet
sewers, pumping stations, and related equipment.
The following denominated sub-sections of Section III
shall be repealed and re-enacted to read as follows:
3. 1 General Sanitation Requirements: The owner of
Ci
any structure where people live, work, or
congregate shall insure that the structure
contains an adequate, convenient, sanitary
toilet and sewage disposal system in good
working order. Under no condition shall sewage
or effluent be permitted to be discharged upon
the surface of the ground, or into Waters of the
State, unless the sewage or effluent meets the
minimum requirements of this regulation or the
water quality standards of the Colorado Water
Quality Control Commission, whichever are
applicable. Any person who is aware of a
malfunctioning septic system is encouraged to
report the location of the system to the
Department.
A. ALL SEWAGE DISPOSAL SYSTEMS WHICH ARE
DESIGNED TO UTILIZE A SUBSURFACE ABSORPTION
SYSTEM SHALL REQUIRE A PERMIT FROM THIS
DEPARTMENT.
3.3 PERMIT APPLICATION REQUIREMENTS:

1. A permit fee, AS SET BY SEPARATE _.
ORDINANCE OF THE BOARD OF WELD COUNTY
COMMISSIONERS, shall be required of
applicants for new individual sewage
systems, payable at the time of
application to the Weld County Health
Department. Permit fees are ` r
nonrefundable. Permit applications

are non-transferrable. The issuance
of a permit does not denote approval
of any zoning requirements.
2. A permit fee, AS SET BY SEPARATE -_
ORDINANCE OF THE BOARD OF WELD COUNTY
COMMISSIONERS, shall be charged for
the alteration or repair of an
existing individual sewage disposal
system, except where an entire
absorption field is required. Such a
new area will require a complete site
evaluation and payment of a permit fee
AS SET BY SEPARATE ORDINANCE OF THE
BOARD OF WELD COUNTY COMMISSIONERS.
However, under conditions of
alteration or repair, the applicant =
must fill out the application for an
Individual Sewage Disposal System
Permit and a final inspection of the
completed repairs or alterations must
be made by the Health Officer with
proper notice as specified in
Section 3.9 by the applicant.
3. A permit fee, AS SET BY SEPARATE
ORDINANCE OF THE BOARD OF WELD COUNTY
COMMISSIONERS, shall be required of
applicants for any system that
requires only a vault or holding tank
with no leaching area. An application
for an Individual Sewage Disposal
System permit must be completed by the
owner and a final inspection must be
made by the Health Officer with proper
notice as specified in Section 3.9 by
the applicant.
4. Any addition to a structure which will
or is likely to result in expanded
leaching of an existing system shall
require approval by the Department and
may require expansion of the
individual sewage disposal system or
parts thereof. No fee shall be
charged unless an entire new
absorption area is required.
5. Owners of sewage disposal systems
which are required by the conditions
of their permit to submit effluent
samples to the Department, shall pay a
fee, AS SET BY SEPARATE ORDINANCE OF
THE BOARD OF WELD COUNTY
COMMISSIONERS, for each sample taken
by an employee of the Department. Any
owner or occupant may request the
collection and testing of an effluent
sample at the above fee which may be
done at the option of the Department,
or may have an approved engineering

firm or laboratory collect and test
the samples and submit the results to
the Department.

3.7 If both a building permit and an individual -

sewage disposal permit are issued for the same =
property and construction is not commenced prior
to the expiration date of the building permit,
the individual sewage disposal permit shall
expire at the same time as the building permit.
If an individual sewage disposal system permit
is issued for property on which no building riM
permit is required, the individual sewage
disposal permit shall expire one year after its
issuance if construction is not commenced. Any •
change in plans or specifications after the
permit has been issued invalidates the permit
unless approval is secured from the Health
officer or his designated agent, for such -
changes. Expired permits can only be renewed by _ _...
payment of THE PERMIT FEE and only if:
a. There has been no change in the plans and
specifications of the proposed system as _
set out in the original application; and

b. The surrounding land, its use or zoning, P
have not changed so as to cause the :E
original application not to be acceptable
under these regulations.
The property owner shall be responsible for the
proper installation and maintenance of an
individual sewage disposal system and for the
abatement of any nuisance arising from its
malfunction or failure.
3.9 When construction of a sewage disposal system
has been completed, the System Contractor or
owner shall notify the Department, and a
representative of the Department shall make a
final inspection WITHIN 72 HOURS, or at an
agreed time, after receipt of notice,
Saturday-Sundays and holidays excepted.
3.21 Regulations of Systems Contractors
A. Systems Contractor Licensing Requirements
1. No person, except as in (2) below,
shall install, engage in the
installation of, or repair an
individual sewage disposal system
unless he holds a valid Systems
Contractor License. Employees of a
validly licensed Systems Contractor
shall not be required to be licensed.
The initial fee for a Systems
Contractor License shall be AS SET BY
SEPARATE ORDINANCE OF THE BOARD OF
WELD COUNTY COMMISSIONERS. License
shall expire on December 31 of each

year and shall be renewed within 30
days prior thereto, and an annual
renewal fee, AS SET BY SEPARATE •

COMMISSIONERS, shall be charged the ri

fee established for new licenses upon
reapplication.
2. Any landowner of record may install an r_
individual sewage disposal system for
his own private use, not to exceed one
(1) per year, without obtaining a
Systems Contractor License. Said
landowner's installation shall be
subject to inspection by the
Department as herein provided and
otherwise completed in accordance with
these regulations.

3.22 Regulations of Systems Cleaners
A. No person shall engage in the cleaning of
sewage disposal systems or the
transportation of sewage to a disposal site —
unless he holds a valid Systems Cleaner
License. Employees of a validly licensed
Systems Cleaner shall not be required to be Lji
licensed. The initial fee for a Systems
Cleaner License shall be AS SET BY SEPARATE
ORDINANCE BY THE BOARD OF WELD COUNTY
COMMISSIONERS. Licenses shall expire on
December 31 of each year and an annual
renewal fee, AS SET BY SEPARATE ORDINANCE
BY THE BOARD OF WELD COUNTY COMMISSIONERS,
shall be charged. A license which lapses
because of failure to renew or is revoked
shall be subject to the fee established for
new license upon reapplication.
B. Standard of Performance for Systems
Cleaners
3. A LICENSED HOLDER SHALL DISPOSE OF THE
COLLECTED SEWAGE ONLY BY THE FOLLOWING
METHODS.
a. BY DISPOSAL IN A MUNICIPAL SEWAGE
TREATMENT COLLECTION SYSTEM BY
AGREEMENT AND APPROVAL OF THE
PLANT MANAGER OR RESPONSIBLE
PARTY.
b. BY DISPOSAL AT A SITE DESIGNATED
AND RECOMMENDED BY THE BOARD OF
HEALTH AND APPROVED BY THE WELD
COUNTY BOARD OF COMMISSIONERS.
c. BY LAND APPLICATION IF APPLIED IN
COMPLIANCE WITH ALL OF THE
FOLLOWING REQUIREMENTS.
(1) THE LICENSED SYSTEMS CLEANER
MUST MAKE ARRANGEMENTS WITH
THE LAND OWNER TO INSURE

THAT ALL SLUDGE IS
INCORPORATED INTO THE SOIL
BY PLOWING OR DISKING WITHIN
12 HOURS OF THE TIME OF -APPLICATION.
(2) THE LICENSED SYSTEMS CLEANER
MUST MAKE ARRANGEMENTS WITH
THE LAND OWNER OR FARM -
MANAGER TO INSURE THAT FOOD
CHAIN CROPS SHALL NOT BE
GROWN WITHIN 18 MONTHS OF
THE LAST APPLICATION OF SLUDGE. ='

(3) LAND APPLICATION AND
SUBSEQUENT TILLAGE SHALL NOT
CONFLICT WITH REGULATIONS
REGARDING THE PLOWING OF
FRAGILE GRASSLANDS.
(4) SITE REQUIREMENTS FOR LAND
APPLICATION.
(a) SURFACE SLOPE SHALL BE 0 TO
8 PERCENT. —
(b) SLUDGE SHALL NOT BE APPLIED
IN DRAINAGE AREAS WITHIN ONE
MILE UPSTREAM OF DIRECT
DIVERSION OF SURFACE WATER
FOR PUBLIC WATER SUPPLIES. -- rt-
(c) SLUDGE SHALL NOT BE APPLIED
WITHIN 200 FEET OF SURFACE
WATER OR AN EXISTING STREAM
BED INCLUDING PERENNIAL OR
INTERMITTENT STREAMS.
(d) SLUDGE SHALL NOT BE APPLIED
WITHIN 100 FEET OF A
DOMESTIC WATER SUPPLY WELL.
(e) PROTECTION OF GROUNDWATER -
THE SEASONAL HIGH GROUND-
WATER TABLE SHALL NOT BE
WITHIN 5 FEET OF THE SURFACE
OF THE LAND.
The following denominated subsections of
Section IV shall be repealed and re-enacted to read
as follows:
SECTION IV: GENERAL TECHNICAL REQUIREMENTS
4. 1 Calculation of Sewage Flow
Where values can be obtained by measurement of flow
and strength of waste from existing facilities, those
values shall be used. For new facilities, Table I
may be used as an average flow guide. Maximum flow
shall be considered at 150 percent of average flow
and shall be the basis for design purposes OF THE
PRIMARY TREATMENT FACILITY unless otherwise
established by evidence satisfactory to the Health
Officer. For calculating the flow for multiple

family dwellings and mobile homes, use a figure of _
3.5 people per dwelling unit or at least 2 persons
per bedroom. In no event may the system be designed -
so that the anticipated maximum daily sewage flow _ -
exceeds the capacity for which the system was

4.3 Performance of Soil Percolation Tests
A. Location Soil percolation tests shall be performed in at —
least SIX (6) test holes in the area in which
in co
the absorption system is to be located, spaced
uniformly over the proposed site, except there —
shall be no less than one (1) test hole in any
twelve hundred (1200) square foot area of the
absorption system. If an application is for a
system which does not utilize a soil absorption =
system, but which employs a dispersal system,
the Health Officer may waive the requirement of -=
percolation tests upon request by the applicant m *
supported by an adequate subsoil and bedrock
report and by a showing that the tests are not -
essential to the proper design of the system and -
that the absence of test data involves no danger
to the public health.
B. Dimensions
1. The percolation test holes shall be from
four (4) to twelve (12) inches in width or
diameter, and shall be terminated at the
depth of the proposed absorption system or
to a depth of at least 30 inches. All test
holes shall be flagged.
2. THE BOTTOM AND SIDES OF THE HOLE SHALL BE
SCRATCHED WITH A KNIFE BLADE OR
SHARP-POINTED INSTRUMENT, IN ORDER TO
REMOVE ANY SMEARED SOIL SURFACES AND TO
PROVIDE A NATURAL SOIL INTERFACE INTO WHICH
WATER MAY PERCOLATE. ALL LOOSE MATERIAL
SHALL BE REMOVED FROM THE HOLE. TWO INCHES
OF COARSE SAND OR FINE GRAVEL SHALL BE
ADDED TO PROTECT THE BOTTOM FROM SCOURING
AND SEDIMENT.
C. Procedure
1. Percolation test holes shall be filled with
water to a depth of 14 inches or more at
least 8 hours prior to but no greater than
24 hours prior to making the water
percolation test, and shall be refilled
with water if necessary to a depth of at
least 14 inches prior to THE PERCOLATION
TEST. THIS PROCEDURE SHALL INSURE THAT THE
SOIL IS GIVEN OPPORTUNITY TO SWELL, THEREBY
SIMULATING ITS CONDITION WHEN USED AS AN
ABSORPTION AREA.
2. IF WATER REMAINS IN A TEST HOLE AFTER THE
OVERNIGHT SWELLING PERIOD, ITS DEPTH SHALL
BE ADJUSTED TO APPROXIMATELY THE LOWER

TWENTY-FIVE PERCENT DEPTH OF THE -n w
PERCOLATION TEST HOLE. THE DROP IN WATER
LEVEL SHALL BE MEASURED FROM A FIXED ' C
REFERENCE POINT OVER A THIRTY MINUTE _" .._.
PERIOD. THIS DROP SHALL BE USED IN < r
CALCULATING THE PERCOLATION RATE FOR THAT -
HOLE.
3. IF NO WATER REMAINS IN A HOLE AFTER THE
OVERNIGHT SWELLING PERIOD, CLEAR WATER
SHALL BE ADDED TO BRING THE DEPTH OF WATER -
IN THE HOLE TO APPROXIMATELY THE LOWER
TWENTY-FIVE PERCENT DEPTH OF THE -
PERCOLATION TEST HOLE. THE DROP IN WATER
LEVEL SHALL BE MEASURED FROM A FIXED
REFERENCE POINT AT A MINIMUM OF FIFTEEN
(15) MINUTE INTERVALS UNTIL TWO CONSECUTIVE
IDENTICAL MEASUREMENTS ARE OBTAINED. THE
FINAL MEASUREMENT SHALL BE USED TO
CALCULATE THE PERCOLATION RATE FOR THAT
HOLE.
4. IN SANDY SOILS (OR OTHER SOILS IN WHICH THE
FIRST SIX INCHES OF WATER SEEP AWAY IN LESS
THAN THIRTY MINUTES, AFTER THE OVERNIGHT
SWELLING PERIOD) , THE WATER LEVEL SHALL BE
ADJUSTED TO APPROXIMATELY THE LOWER
o
TWENTY-FIVE PERCENT DEPTH OF THE _
PERCOLATION TEST HOLE. THE TIME INTERVAL
BETWEEN MEASUREMENTS SHALL BE TAKEN AS TEN
MINUTES AND THE TEST RUN FOR ONE HOUR. THE
DROP THAT OCCURS DURING THE FINAL TEN
MINUTES IS USED TO CALCULATE THE
PERCOLATION RATE.
5. IN ALL CASES WATER SHALL BE ADDED TO THE
PERCOLATION TEST HOLE AS REQUIRED TO
MAINTAIN A MINIMUM DEPTH OF SIX (6) INCHES.
6. THE FINAL AVERAGE PERCOLATION RATE SHALL BE
REPORTED IN UNITS OF MINUTES PER INCH.
D. Calculation
The field percolation rate shall be the average
rate of the percolation tests after A MAJORITY
OF THE PERCOLATION TEST HOLES EXHIBIT TWO
CONSECUTIVE IDENTICAL MEASUREMENTS. A rate
faster than five minutes per inch or a rate
slower than 60 minutes per inch shall render the
location unsuitable for an absorption system.
However with percolation rates faster than five
minutes per inch in sandy soils, systems may be
permitted. The field percolation rate shall be
used in calculating the absorption area required
for the proposed system.
Sites with unsuitable percolation rates shall
necessitate additional soil evaluation and
design by a Registered Professional Engineer if
any absorption area is to be proposed. In no
event shall the calculated absorption area be
less than that area required for systems with
percolation rate of five minutes per inch.
E. Performance of Percolation Tests
1. The percolation test shall be performed by
or under the supervision of a registered

professional engineer or by a competent
technician of the local health department
unless the tests were previously performed _: M.
by a registered professional engineer and
the results thereof submitted with the _
application for the permit.
2. If the applicant demonstrates to the
satisfaction of the Health Officer that the

system is not dependent upon soil _ -
absorption, the requirement for percolation
tests may be waived.
4.4 A TEST PIT OR TRENCH FOR THE EXAMINATION OF THE SOIL
PROFILE MUST BE PROVIDED TO A DEPTH OF EIGHT (8) FEET
OR TO BEDROCK, WHICHEVER IS LESS, TO DETERMINE
CONFORMANCE WITH 4.6 OF THESE REGULATIONS. - A
A. THE TEST PIT SHALL HAVE MINIMUM HORIZONTAL
DIMENSIONS OF THREE (3) FEET IN WIDTH AND SIX
(6) FEET IN LENGTH.
B. TO ALLOW ENTRY AND EXIT, AT LEAST ONE WALL OF
THE TEST PIT SHALL HAVE A MAXIMUM SLOPE OF
FORTY-FIVE (45) DEGREES FROM HORIZONTAL, OR A -LADDER MUST BE PROVIDED.
4.5 Alternative soil tests in lieu of test pit
examination.

Alternate tests may be approved by the Health Officer
when adequate and sufficient scientific evidence
shows that such a test will provide proper date from
which CONFORMANCE WITH 4.6 OF THESE REGULATIONS MAY
BE DETERMINED.
4.6 A suitable soil shall meet the following criteria:
A. A MINIMUM DEPTH OF FOUR (4) FEET BETWEEN THE
BOTTOM OF THE PROPOSED ABSORPTION FIELD AND A
MAXIMUM SEASONAL GROUNDWATER TABLE, BEDROCK, OR
A PERCHED WATER TABLE, AS INDICATED BY THE
PRESENCE OF CRYSTALS OR SALTS, OR CHEMICALLY
REDUCED IRON IN THE SOIL EXPRESSED BY SOIL
MOTTLING OR GLEYING.
B. Has the capacity to adequately disperse the
designed effluent loading as determined by a
field percolation rate of between 5 minutes per
inch and 60 minutes per inch or by other
approved soil tests.
C. Does not exhibit inhibition swelling
characteristics.
D. Does not visibly exhibit a jointed or fractured
pattern of an underlying bedrock.
E. Is not consolidated.
F. Acts as an effective filter within its depth for
the removal of pathogenic organisms.
4.7 Disinfection of effluent (when required)
A. Disinfection shall be introduced into the
effluent by an automatic proportioning device.

B. A contact basin shall be provided for
disinfection of effluent which meets the
following requirements: ha op
1. A minimum of 60 minutes detention time.

2. A free residual chlorine (or equivalent) of
1.0 ppm tested at the exit of the effluent
z
pipe of the basin. -
3. Thorough mechanical mixing or a basin —
having a length to width ration of 40: 1 =
with a sharp crested wire spanning the
entire width of the basin outlet. Other
designs shall be approved when proof of
their effectiveness is submitted for an z
acceptable design.
The following denominated portions of subsection 5.4
shall be repealed and re-enacted to read as follows:
5.4 General requirements for disposal of effluent into an
absorption field area:

C. Absorption Area:
1. Table IV shall be used for determination of
the minimum absorption area required per
bedroom for a one or two family dwelling.
In other type uses, the minimum absorption
trench area in square feet (A) shall be
determined as a function of the estimated
MAXIMUM quantity of sewage flow in gallons
per day (Q) and the percolation rate in
minutes per inch (T) , according to the
formula:

Note: Where the percolation rate is found
to be faster than five (5) minutes per inch
in sandy soils the value for "T" for use in
this formula shall be five.
2. Seepage bed absorption area minimums shall
be calculated at 1.3 times the calculated
absorption area required for absorption
trenches.
3. THE ABSORPTION AREA SO CALCULATED SHALL BE
INCREASED BY NOT LESS THAN AN ADDITIONAL
TWENTY (20) PERCENT IF WASTES FROM A
GARBAGE GRINDER ARE DISCHARGED INTO THE
SYSTEM.

4. Where absorption systems are to be
installed in new fill material, the fill
must be designed or tested by a Registered
Professional Engineer. In addition, the
fill material shall consist of well-graded
soil with a percolation rate between 10 and
30 minutes per inch, free of heavy sod or
other organic material, trash, frozen

material or debris. Backfill shall be
deposited in layers not exceeding 6 inches
in thickness, and each layer shall be
compacted by means of mechanical tampers, _
pneumatic rollers or other similar means.
The degree of compaction and density for
tilled areas shall be 85 percent of maximum
density at optimum moisture content. _ -
Compaction tests shall be performed and the

results thereof transmitted to the Health _
Officer. ' N.
D. DISTRIBUTION BOX: ALL SUBSURFACE ABSORPTION SYSTEMS SHALL BE EQUIPPED WITH A DISTRIBUTION
BOX WHICH SHALL BE INSTALLED LEVEL ON
UNDISTURBED SOIL, COMPACTED SOIL, OR ON A
CONCRETE SLAB POURED IN PLACE TO PROVIDE EQUAL
DISTRIBUTION OF SEPTIC TANK EFFLUENT TO EACH
LINE. FOR TESTING PURPOSES, AN ADEQUATE AMOUNT
OF WATER SHALL BE PROVIDED TO CHECK THE LEVEL OF
THE INLET AND OUTLET LINES.
1. DISTRIBUTION BOXES SHALL HAVE REMOVABLE
COVERS.
2. EACH LATERAL SHALL BE CONNECTED SEPARATELY
TO THE DISTRIBUTION BOX. - -
3. THE INVERTS OF ALL OUTLETS SHALL BE AT THE
SAME ELEVATION AND THE INLET INVERT SHALL
BE AT LEAST ONE (1) INCH ABOVE THE OUTLET
INVERTS. THE OUTLET INVERTS SHALL BE AT
LEAST THREE (3) INCHES ABOVE THE BOTTOM OF -
THE DISTRIBUTION BOX.
4. THE DISTRIBUTION BOX SHALL BE WATERTIGHT
AND ALL PIPES SHALL BE GROUTED OR CEMETED.

IN THE DISTRIBUTION BOX. THE BAFFLE SHALL
BE SECURED TO THE BOTTOM OF THE BOX,
EXTENDING VERTICALLY TO A POINT LEVEL WITH
THE CROWN OF THE INLET PIPE, AND SHALL BE
PERPENDICULAR TO THE INLET.
Subsection 5.5 shall be repealed and re—enacted to
read as follows:
5.5 ABSORPTION TRENCHES
A. At least two trenches of near equal length shall
be constructed with a length not exceeding 100
feet; a width not exceeding 3 feet; and a depth
not exceeding 3 feet to the bottom of the
excavated trench. Only one trench will be
required if the system required total area does
not exceed 200 square feet. There shall be a
minimum (horizontal measurement) of 6 feet of

undisturbed earth between adjacent trenches.
Any dimensional change from these specifications
require approval from the Health Officer. A
disposal line shall be provided for each trench
and shall be surrounded by clean, washed, graded y ,:
gravel or rock or similar aggregate. The ., .w
material may range in size from one and a half _
inch to two and a half inches. The material
shall extend from at least two inches above the
top of the pipe, level across the trench, to at
least six inches below the bottom of the pipe.
The top of the gravel shall be covered with _
untreated building paper, a two inch layer of
hay or straw, or a similar pervious material to _
prevent the gravel from becoming clogged by the - -
earth backfill. An impervious covering shall _
not be used, as this interferes with
evaportranspiration at the surface. There shall "
be at least 12 inches of backfill placed over
the trench which shall be graded to promote _
runoff water from the disposal area. No trees

or shrubs shall be placed closer than six feet
to the trench. The bottom of the trench shall
be excavated level. Four foot depth of suitable _
soil below the bottom of the trench is required.
Machine tamping, rolling or hydraulic compaction —
of final cover shall not be permitted, however, — _
hand tamping may be allowed where necessary to
stabilize the soil to prevent erosion or the -- c
intrusion of extraneous water. A DISTRIBUTION -
BOX SHALL BE INCLUDED IN THE ABSORPTION TRENCH
SYSTEM, AND SHALL MEET REQUIREMENTS OF
SUBSECTION 4.5 D. TRENCHES SHALL FOLLOW THE -
GROUND CONTOUR SURFACE SO THAT VARIATIONS IN
TRENCH DEPTH SHALL BE MINIMIZED.B. Perforated plastic distribution lines of three
or four inch diameter shall be fitted with tight
joints and the perforations shall be laid such
that an even distribution of effluent over the
trench system will occur. (Note: each
perforated pipe segment shall be so placed that
effluent will be equally dispersed downward into
the gravel from each row of perforations per
segment.) The terminal ends of lines shall be
capped unless looped or air-vented.
C. FOR SLOPES BETWEEN FIFTEEN (15) AND TWENTY-FIVE
(25) PERCENT, ABSORPTION TRENCH SYSTEMS MUST BE
DESIGNED BY A REGISTERED PROFESSIONAL ENGINEER,
WHO SHALL PROVIDE A DETAILED ENGINEERING DESIGN
IN RELATIONSHIP TO ELEVATION, AND SHALL INSPECT
AND APPROVE CONSTRUCTION OF THE SYSTEM. THE
BOARD OF HEALTH SHALL REVIEW AND CONSIDER SUCH
PLANS FOR APPROVAL. ABSORPTION TRENCHES ON
SLOPES IN EXCESS OF TWENTY-FIVE PERCENT ARE NOT
PERMITTED.
Subsection 5.6 shall be repealed and re-enacted to
read as follows:
5.6 SEEPAGE BEDS
A. Seepage beds shall be constructed with a length
not exceeding 100 feet, a width greater than 3
feet and a depth not exceeding 3 feet to the
bottom of the excavated trench. Any dimensional
change from these specifications requires
approval from the Health Officer. A 12-inch

layer of 11 inch to 21 inch washed gravel, rock
or other similar material shall be distributed
evenly and level over the entire bed, with
distribution lines set at a depth to insure at

least six inches of gravel below and two inches
of gravel above each line. A cover of untreated
building paper, a two-inch layer of straw, or a
similar pervious material shall be placed on top
of the gravel. After final inspection, backfill
shall be placed over the bed to minimum depth of
12 inches. The final cover shall be graded to % :
promote drainage runoff away from the disposal
area. In the case of an above ground system, _

such as a mounded system, an impervious berm
shall constructed to prevent lateral flow of
waste discharge outside of the absorption field.
No trees or shrubs shall be placed closer than 6 —
feet from the system. A 4-foot depth of z
suitable soil below the bottom of the bed is

B. The outer-most dispersal lines in the bed shall
be placed no less than 18 inches and no more
than 36 inches from the outside bed walls. For each 6 feet, or part thereof, in bed widths,
there shall be one disposal line extending the
length of the bed. Such pipelines shall be so
spaced as to distribute the effluent evenly over
the entire bed area and shall meet the
requirements of 5.5B. A DISTRIBUTION BOX SHALL
BE INCLUDED IN THE SEEPAGE BED SYSTEM, AND SHALL
MEET THE REQUIREMENTS OF 5.4D, 1 through 6.C. THE MAXIMUM SLOPE ON WHICH A SEEPAGE BED IS
PERMITTED IS EIGHT (8) PERCENT.
Subsection 5.7 is repealed and re-enacted to read as
follows:

Ordinance is for any reason held or decided to be invalid or unconstitutional,
such decision shall not affect the validity of the remaining portions. The
Board of County Commissioners hereby declares that it would have passed this r
Ordinance, and each and every section, subsection, paragraph, sentence, clause
and phrase thereof irrespective of the fact that any one or more section,
subsection, paragraph, sentence, clause and phrase might be declared to be
unconstitutional and invalid.
This Ordinance shall become effective thirty days (30) after the final
passage of this Ordinance.

Discussion focused on the following points:
1 . There is no legal requirement for public hearings ; however, the
Water Quality Control Division does hold public hearings although
notification of these hearings is not always widespread. It would
be desirable to devise better methods for notifying the public of
hearings regarding site applications.
2. Altering the order of approval by various boards (i .e. , sending
a site application to the Planning Commission before it conies to
the Board of Health) in order to save time would be beneficial .
3. The Board of Health should consider only public health facets of
site applications , and information and recommendations should be
obtained from appropriate department heads.
As a result of this discussion , Steve Sears moved that the Board of
Health direct Dr. Wooley to send a memo to the commissioners expressing
its concerns in this area and stating its willingness to participate in
a work session at the commissioners' convenience if they wish; seconded
by Tom Baur. MOTION CARRIED.
UPDATE ON SEPTIC REGULATIONS
George Vargulich distributed copies of the current and proposed septic
regulations and led the Board through the proposed changes (see minutes
documentation) . He requested the Board' s consideration of the changes for
approval , after which they will be presented to the County Commissioners.
Steve Sears moved approval of the revisions ; seconded by Mike Deutcher.

Dr. Wooley stated that he had already discussed this conversation with
Dr. Baldwin, who agreed that this would be a satisfactory arrangement.
At this point Barbara Steffens arrived. After a brief review of business
already discussed, voting began.
Mary Henneck moved that the four contracts--Air Pollution , Radiological ,
TB , and Headstart--be approved ; seconded by Mary Tuck. MOTION CARRIED.
Ed Baldwin moved approval of the agenda for the January 25 meeting and
the minutes for the December 7, 1982 , meeting; seconded by Mary Henneck.

B. Revisions in Individual Sewage Disposal Regulations
George Vargulich presented the revisions. Two handouts were
distributed (see minutes documentation) . The first, a letter from
John Farrow, State of Colorado public health engineer, stated that
changes need to be made in Weld County' s sewage disposal regulations.
In Section 5. 4. C. 1 , Line 4 , the word average should be changed to
maximum to agree with state guidelines . In addition , a paragraph
(3) was added under 5. 4. C. to provide for an increase in area if
a garbage grinder is used.
A second change was suggested by Lee Morrison , Assistant County
Attorney, regarding fees. Everywhere a specific dollar amount appears
in the regulations, the amount has been deleted and replaced with
the phrase "as set by separate ordinance of the Board of Weld County
Commissioners." This gives the opportunity to change the fees without
reprinting them. Mr. Vargulich requested that the Board approve these
changes.
Approval of the changes was moved simultaneously by Mary Henneck and
Barbara Steffens ; seconded by Mary Tuck. MOTION CARRIED.
At this time George reported that he , Ron Stow, Wes Potter, Dr. Wooley ,
and John Farrow, Colorado Department of Health public engineer, met
recently in a worksession with the County Commissioners to discuss a
complaint received by one of the commissioners about the requirement that
an eight-foot test hold be dug before installing a septic system. The
purpose of the test hole was explained, and the fact that this had been a
requirement of the state since 1973 was delineated. It was decided at
the worksession that several different methods of providing a test hole
will be accepted : ( 1) digging a hole specifically for the purpose ,

D. Revisions to Existing Septic Regulations - 3.22, Sludge
Wes Potter presented revisions to the septic regulations regarding
guidelines for system cleaners. Wes distributed copies of the
revised regulations . Currently the regulations state that cleaners
may dispose of sewage only at a site designated by the Weld County
Commissioners and by the Board of Health. Wes explained that neither
Larimer nor Boulder county allows any surface application or site
designation for this purpose. City facilities have difficulties
processing the amount that cleaners dump at once. The State of
Colorado has no regulations or statutes involving the surface
application of sludge. These factors led to the need for Weld
County to establish regulations regarding surface application of
sewage (see minutes documentation) . Mr. Potter reviewed these
regulations , and discussion focused on the following points:
1. In response to a concern about plowing and/or disking
sewage into the ground during the winter months, it was
stated that, even in the coldest weather, there are
usually places that are still aerable. It is the responsi-
bility of the cleaner to see that this regulation is met .
2. Rather than spending time trying to make sure that cleaners
follow the regulations , it will be the attitude of the
Environmental Health Division to observe and let the
cleaners become familiar with the regulations. Then if
it appears that enforcement is needed, it will be provided.
3. It was clarified that most sludge is biodegradable material .
There is no risk of long-term contamination at dumping sites .

E. Discussion of Switchboard Problems
Dr. Wooley explained that the switchboard is operated by agreement
with the Human Resources Department. A Health Department employee
is assigned in the morning, and an HRD employee is assigned in the
afternoon. There are many problems associated with this arrangement
including lack of proper training for those operating the switchboard
and lack of proper supervision when the HRD employee is on duty.
