RE: APPROVAL OF RECORDED EXEMPTION NO. 559 - MELVIN AND WILBERT
THOUTT
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners at a public hearing held in the Chambers of the Board,
that the division into two parcels of land, as shown on the plat
known as Recorded Exemption No. 559, being the property of Melvin
and Wilbert Thoutt, described as part of the SE4, Section 21,
T5N, R64W of the 6th P.M. , Weld County, Colorado, being more
particularly described in the plat which shall be provided by the
applicants and known as Exhibit "A" , said plat to be recorded,
does not come within the purview of the definition of the terms,
"subdivision" and "subdivided land" , pursuant to its authority
under Section 30-28-101 (10) (d) , CRS 1973, as amended.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the hereinabove described
parcel of land owned by Melvin and Wilbert Thoutt be, and hereby
is, exempt from the definition of the terms, "subdivision" and
"subdivided land" .
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 19th day of
July, A.D. , 1982.

Re: Recorded Exemption #559
Dear Commissioners:
The attached application, plat and related items are in reference to a
request from Melvin and Wilbert Thoutt for a recorded exemption. The
parcel of land on which this request is being made is described as the
SEo, Section 21, T5N, R64W of the 6th P.M. , Weld County, Colorado.
The property is located one-half (z) mile southeast of Kersey on WCR 55
The property contains approximately 155 acres of Class IIs, Ills, IVe and VIe
irriaged and IVe and VIe nonirrigated soils.
The request is to divide the property into parcels of 152.0 acres and -.
2.5 acres, more or less. There are two existing residences on the 2.5
acre, more or less, parcel. The recorded exemption would separate the
improvements from the farm ground. If the recorded exemption is approved
the applicant would proceed with a subdivision exemption to separate the
residences on the 2.5 acre parcel.
Based upon the submitted information and policies of the County, the
Department of Planning Services staff recommends the request be approved
for the following reasons:
1. The request complies with Section 9-2 C. of the Weld County
Subdivision Regulations submission requirements.
2. The request complies with Section 9-2 E. of the Subdivision
Regulations as follows:

- The 155 acres, more or less, under consideration will
allow agricultural and related uses to be the predominant
uses. The uses will be compatible with existing surrounding
agricultural uses. These facts support the proposal as
being consistent with the intent clause of the agricultural
zone district.
- The proposal was reviewed by the town of Kersey with no
objection.
- The proposal is in compliance with Section 1-3 of the
Weld County Subdivision Regulations and the proposed land
division complies with the Weld County Comprehensive
plan; therefore, the proposed use is consistent with
efficient and orderly development.
- The proposal does not exist in an overlay district area.
- The proposed lots meet minimum lot size requirements for
land division.
- The Weld Central Weld County Water District has indicated
adequate water service is available for this proposal.
- The proposed lots are not part of a recorded exemption
within the last five (5) years.
- The two lots proposed will have adequate access from
Weld County Road 55.
- The Weld County Health Department has indicated, that
both lots will have adequate sewage capacity.

RECORDED EXEMPTION
SUPPORTING STATEMENTS
1. With the use of a quarter section pivot sprinkler system the
corner areas are not useable by the sprinkler, thus leaving the
corners open for other uses .
2 . This area will remain Agriculture and will be consistent with
the Weld County Comprehensive Plan .
3. This proposal will not affect any Agricultural use due to the
corner location of non useable ground by a quarter section pi-
vot sprinkler.
4 . The uses permitted will be compatible with the surrounding
Agricultural land uses .
5. The uses permitted will be compatible with the future develop-
ment of the surrounding area as permitted by the existing Agri-
cultural zone and with future development as this area will re-
main Agricultural .
6 . This application does not exist within any Overlay District Area.
7. The minimum size of this lot will not be less than one (1) acre.
8. This application meets minimum acreage requirements.
9. The lot proposed will not be inconsistent with efficient and
orderly development of the area.
10. The lot resulting shall be accessible from Weld County Rd. 55.
11 . A letter of water service from C.W.C.W.D. for water supply is
attached.
12. The lot will have a septic tank for disposal of sewage in com-
pliance with requirements of the Weld County Health Department.
13 . The proposed lot is not a part of any previous recorded exemp-
tion and not part of a subdivision .
14 . This request does not evade the requirements and Statement of
Purposes of the Weld County Subdivision Regulations.
15. Since the uses permitted are compatible with the surrounding area
(Agriculture) , there is no danger to the health, safety and wel-
fare of the inhabitants of the neighborhood and the County.
