RE: APPROVAL OF PRELIMINARY PLAN FOR WEST HILL-N-PARK, THIRD
FILING
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , on the 30th of May, 1984 , the Preliminary Plan of
West Hill-N-Park, Third Filing, was submitted to the Board of
County Commissioners of Weld County, Colorado for approval in
accordance with the Subdivision Regulations of Weld County, Colo-
rado, and
WHEREAS , the Board of County Commissioners had evidence
presented in support of the approval of said Preliminary Plan,
and no evidence was presented in opposition to the approval of
the Preliminary Plan for the following described real estate,
to-wit:
Part of the SWa of Section 26 , Township 5
North, Range 66 West of the 6th P .M. , Weld
County, Colorado
WHEREAS , the Board of County Commissioners heard all of the
testimony and statements of those present, has studied the re-
quest of the applicant and the recommendations of the Weld County
Planning Commission and all of the evidence presented in this
matter, and having been fully informed, is satisfied that the
submitted Preliminary Plan conforms in all respects with the
requirements of Section 5 of the Weld County Subdivision Regu-
lations , and that approval of said Preliminary Plan would be in
the best interest of Weld County.
NOW, THEREFORE , BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the Preliminary Plan
of West Hill-N-Park, Third Filing, be, and hereby is , approved
subject to the applicants complying with the following require-
ments in the final plan application: 1) a plan showing a mini-
mum spacing of five-hundred (500) feet apart for fire hydrants;
2) additional information about storm water detention, as re-
quested by the County Engineering Department in a memo dated
May 1 , 1984; 3) plan for improving 47th Avenue, as requested by
the County Engineering Department in a memo dated May 1 , 1984;
4) plan for constructing an emergency access easement across
outlot "F" extending Lassen Court to Carlsbad Drive; 5) infor-
mation explaining the formation of an entity responsible for
enforcement of covenants , maintenance of parks , buffered areas,
and landscaped areas; 6) information detailing an erosion con-
trol plan as requested by the Greeley Soil Conservation Service
in a letter dated May 4 , 1984; and 7) a plan for landscaping of
parks and the entire area of West Hill-N-Park, Third Filing.

Dear Rod :
At its meeting on May 8 , 1984 , the Greeley Planning Commission reviewed
the request by Roy Lundvall for a preliminary plan for West Hill ' n Park
Third Filing on property located northeast of 47th Avenue and County
Road '52. The Commission recommended no objections to the preliminary
plan subject to the following :
1 . Lassen Court being extended to the north to connect with Lake
Mead Drive . This will alleviate concerns with the length of the
Lassen Court cul-de-sac and relieve poor circulation ,
particularly for emergency vehicles , in the southwest part of the
subdivision .
2 . An entity responsible for the maintenance of the landscape
buffers , parks , and tot lots needs to be formed . These areas do
not conform with public park design and the City of Greeley would
not be interested in purchasing or accepting maintenance for
these parcels .
3 . The streets within the subdivision should be constructed to City
standards to include curb , gutter , sidewalk , and paving .
4 . Fire hydrants within the subdivision should conform to City
spacing standards which would be a maximum of 500 feet between
hydrants .
5 . Both 47th Avenue and County Road 52 are designated in the Greeley
Comprehensive Plan as arterial streets . If this subdivision was
located in the City , the City would collect $385 with the

development of each lot to be used by the City in constructing
arterial streets . For this third filing of West Hill ' n Park ,
the City would collect $74, 690 in arterial street fees . The
County should ensure that the developer of this subdivision or
subsequent lot developers be responsible for an equivalent
contribution toward development of arterial streets .

Subject Hill-n-Park - 3rd Filing Preliminary Plan
We met with John Shupe and Mike Thomas regarding the above mentioned project
on May 9, 1984. We discussed the following:
1. 47th Avenue Improvements
Mr. Shupe and Mr. Thomas recommended construction of a two lane paved road
from County Road 52 to Casa Grande Drive and would consider extending the
road with gravel to Mesa Verda Drive. This road would be 24 feet of pave-
ment and 6 foot shoulders lying entirely within the 50 foot wide platted
right-of-way.
We recommend that the road be paved its entire length to Mesa Verda Drive
and that a fence with a locked gate be installed north of the Mesa Verda
Drive intersection. The gate would allow access to power line facilities
for maintenance while discouraging cross country vehicular traffic. Our
recommendation at the meeting was actually a barricade and has since been
revised as above.
The pavement section should be determined from soil samples and accepted
engineering design procedures . The details of the section could be
determined during the design phase.
2. Lassen Court Extension to Carlsbad Drive
There does appear to be adequate emergency routes through the subdivision,
however, the driver would needto be familiar with the area. We can see
where an emergency crew could have difficulty responding to the area of
Scottsbluff Court should the driver not know the specific route to use.
We, therefore, recommended that Outlet "F" at least be constructed in a
manner which would allow for through emergency traffic.
3. Interior Roads
We do not object to 38 foot wide streets with valley gutters . We recommend
that Mesa Verda Drive be fully constructed.
4. Drainage
We requested that the relationship between not having detention and meeting
the City of Greeley detention requirements be developed in future submittals .
We would like to see what the direct effect on peak runoff values would
be as a result of the request not to supply detention facilities .

We have reviewed the plat, geologic site report and our previous
review of West Hill-N-Park subdivision. This area may be affected
by compacting soils. If the irrigation ditch in the central ,
western portion of the site is still active, seasonally shallow
ground water levels may affect some of the area. To adequately
determine subsurface conditions at the site and foundation designs
for the development, we continue to recommend that a soils and
foundation investigation be completed prior to construction.
If this recommendation is followed, we have no objection to
approval of this application.

POSSIBLE ISSUES SUMMARIZED FROM APPLICATION MATERIALS:
The criteria for review is listed on Pages 23, 24 and 25 of the Weld County
Subdivision Regulations. A copy of the review criteria is included with your
information packet. The Utility Board Coordinating Committee reviewed and
approved the Preliminary Plan on April 26, 1984. The City of Evans has
first right of annexation based upon an agreement between Greeley and Evans.
The City of Evans has no objections to the Preliminary Plan. The City of
Greeley has not reviewed the Preliminary Plan at the time this packet was
prepared. The Engineering and Planning Departments are meeting with the
applicant on May 9, 1984 to discuss improvements for 47th Avenue right-of-way
and streets within the subdivision. Please review the design standards listed
in Section 8 of the Weld County Subdivision Regulations beginning on Page 40.
The Department of Planning Services staff has not received any objections to
this proposal.

G. The copy of the Preliminary Plan filed with the Planning
Department shall be available for public viewing. Any affected
person may submit verbal or written comments to the Planning
Commission regarding the Preliminary Plan, stating their reasons
for supporting or objecting to the Preliminary Plan pursuant to
these regulations, on or before the date of the Planning
Commission Hearing.
H. A Utilities Review Advisory Committee shall consist of the Weld
County Engineer or a representative of the Weld County Department
of Engineering and such other representatives of utility agencies
as appointed by the Board. The Utilities Review Advisory
Committee shall meet as often as required to review and make
recommendations concerning any preliminary plans and final plats
pending before the Planning Commission.
I. Planner
The Planner shall ensure the completeness of the Preliminary Plan
submission and shall insure its conformance with the
111 Comprehensive Plan and good subdivision design practices. The
Planner shall make a report of his review of the Preliminary Plan
to the Planning Commission.
5-4 Approval or Disapproval - Preliminary Plan
A. A Preliminary Plan shall be approved by the Planning Commission
la unless it finds that the Preliminary Plan fails to meet the
requirements specified herein or that the proposed preliminary
plan is detrimental to the public health, safety, or general
welfare as set forth in this Section as follows:
(1) Health, Safety, and Welfare
Before approving the Preliminary Plan, the Planning
Commission shall determine that the subdivision:
(a) Will be served by a public water system or, if less
than ten lots, will have sufficient well water
available per lot, both physically and legally, for the
foreseeable needs of the subdivision or development,
and will not cause an unreasonable depreciation of an
existing water supply as evaluated by the State
Engineer. Evidence regarding water supply: quality,
quantity, and dependability. Evidence may include:
evidence of ownership or right of acquisition of or use
of existing and proposed water rights; historic use and
estimated yield of claimed water rights; amenability of
existing rights to a change in use; evidence that
public or private water owners can and will supply
water to the proposed subdivision stating the amount of
water available for use within the subdivision and the
feasibility of extending service to that area; evidence

concerning the potability of the proposed water supply
for the subdivision.
(b) Will be served by a public sanitation system or on-lot
sewage disposal system that will not result in water
pollution. In making this latter determination, the 's
Planning Commission shall consider: the amount of
rainfall received by the area; the relation of the land
to flood plains; the nature of soils and subsoils and 1
their ability to adequately support waste disposal; the 1
slope of the land and the effect of effluents; the
presence of streams as related to effluent disposal; 1
the applicable health and water resources department
regulations.
(c) Will not cause soil erosion, soil instability or
reduction in the capacity of the land to hold water so 1
that it results in an unstable, unhealthy or dangerous
condition affecting human life or structures.
(d) Will not cause air pollution based on state health
department standards. In making this determination 1
they shall consider the elevation of land above sea
level; land topography; prevailing winds or the absence
thereof; local and regional airsheds; increase in
sources or quantity of emission, as well as quality of
such, and such other items as are deemed pertinent.
(e) Will not cause unreasonable highway congestion or
unsafe conditions with respect to use of the highways
existing or proposed; will not cause unreasonable
burden on the ability of a school district to provide
educational services• •i11 place - able
burden on the ability of the local governments to
provide water, sewage, fire, police, hospital, solid
waste disposal and other services.
(f) Will not have an undue adverse effect on the scenic or
natural beauty of the area, aesthetics, historical
sites or rare and irreplaceable natural areas; will not
have an undue adverse effect on wildlife and their
habitat, and on the preservation of agricultural land.
B. Data and Investigations
The Planning Commission nay conduct such investigations,
examinations, test and site evaluations as they deem necessary to
verify information contained in the application. An applicant
shall grant the Planning Cc—ission, or their agents, permission
to enter upon his land for these purposes.

The Planning Commission shall review the Preliminary Plan at a
regularly scheduled public meeting. Within ten (10) days after
the Planning Commission has made a final recommendation as to the
Preliminary Plan approval or disapproval, the Planning Commission
shall send written notification of its review and its
recommendations concerning the Preliminary Plan to the Board.
D. Burden of Proof
The burden of proof shall be on the subdivider to show the
reasonableness of his plan, the lack of adverse effect, and
compliance with the elements of the public health, safety, and
general welfare as set forth in Section 5-4-A.
E. Board Hearing
The Board shall hold a hearing on the Preliminary Plan at a
regularly scheduled Board meeting within ten (10) days of receipt
of transmittal of the Planning Commission recommendation. If the

authorize the subdivider to proceed with the Final Plat, subject
to such terms, conditions or modifications as the Board

F. Plan Disapproval and Reapplication
Disapproval of a Preliminary Plan shall contain in writing the
specific reasons for disapproval. A subdivider may, within six
(6) months, resubmit his plan application which shall include an
affidavit to the Planning Commission and Board that the
deficiencies in the previous application have been corrected
without paying additional fees. A review of the reapplication
shall follow the same review as outline in these regulations for
a new application. Any reapplication after six (6) months will
require a new fee.
SECTION 6 FINAL FLAT
6-1 Submission Requirements
Copies of all required material shall be officially submitted to the
Planning Department by the subdivider (or his authorized
representati•.e) . No Final Plat shall be approved by the Board until
the subdivider has complied with the requirements and submitted the
supporting documents as provided herein. Final Plats shall be
submitted for approval within twelve (12) months of the date a

COMMENTS:
Access to the property is from WCR 52 (49th Street) , a paved arterial. The access off
of WCR 52 is through West Hill-N-Park, First Filing. There are two accesses planned
off of WCR 33 (47th Avenue) right-of-way. WCR 33 at this location is an undeveloped
arterial street. There is an existing overhead power line located in the center of
WCR 33 right-of-way. The following asphalt streets are in place: Kings Canyon Drive,
Carlsbad Drive, Lassen Court, Everglade Court and Yosemite Drive. Water and sewer
lines exist as utilities on the property. The slope of the property is slight and
varies at different locations.

Dear Milt:
I have reviewed the Weld County Planning Services referral from Roy Lundvall
for a Preliminary Plan-Mobile Home Park Subdivision to be located in part of
the 5W3, Section 26, T5N, R66W, Weld Co. , Colorado; approximately one mile
west of Evans; north of 49th St. and of 47th Ave. (proposed); to be known as
West Hill N Park, third filing.
Soils in the area are consistant with planned activity. None of the soils in
the area are considered to be Prime Farmland or High Potential Dry Cropland.
The preliminary plan is submitted with a very detailed drainage plan which is
consistant with SCS standards and will be tested to meet City of Greeley
standards due to site location and proximity to City of Greeley. It was men-
tioned in the drainage plan that erosion protection should be provided at the
entrance to the Ashcroft Draw. It is suggested that in the final plan, details _
of erosion control be shown for evaluation of adequacy.
All information as provided in the preliminary plan seems consistant with the
planned activity. I would recommend approval of this application with the
inclusion of the above comment.

We have reviewed the above mentioned referral and offer the following
comments :
1. The plat shows two access points to 47th Avenue which at present does
not exist. The applicant should address his intentions in the construction
of this road.
2. The applicant proposes no storm water detention for this project. The
analysis of Ashcroft Draw presented in the drainage report appears to
be reasonable. Based on the engineers conclusion that the runoff will
not adversly effect downstream portions of the basin, we do not object
to the lack of detention faclities at this time. We do, however, feel
that further study is needed for future submittals . Our main concern
in reviewing the request is what the effects of no detention are compared
to supplying detention. This specific question has not been addressed
in the drainage report. We would further recommend that the City of
Greeley be consulted on this request.

was a preliminary plan that indicated a high pressure gas line running

field check and searched the records at Stewart Title Company and cannot
find any evidence or record of a gas line across West Hill N Park. I
also contacted Greeley Gas, Western Slope Gas, and Colorado Interstate

Gas, they all stated that they had no knowledge of a line across Hill

We have examined the data available for the Hill N Park lagoons and have
determined the lagoons have adequate capacity to treat the wastewater from
the West Hill N Park Third Filing. The third filing is for 194 lots and
using the average number of people per household for the City of Greeley
from the 1980 census of 2.54 persons, gives us an estimate of 493 people
in the filing. Then assuming an average of 100 gallons per person per
day, the expected wastewater flow from the area would be approximately
50,000 gallons per day. As previously noted, the design capacity of the
lagoons is 0.500 million gallons per day (MGD) . Current flow rates are
approximately .150 MGD which means there is currently a reserve capacity
of .350 MGD. Applying a design flow of 50,000 from the third filing to
this reserve capacity would leave a revised reserve capacity of .300
MGD. With the flow from the third filing, the lagoons would be at 40%
of capacity.
The discharge permit for the lagoons requires that engineering and financial
planning for expansion be initiated whenever throughput and treatment
reaches 80 percent of design capacity; and whenever 95 percent of design
capacity for throughput and treatment is met, construction of the expansion
will begin. As the houses in the third filing are connected to the treatment
system, you will need to monitor the lagoons to see if and when these
milestone capacities are reached and further action is required.

capacity of the Hill N Park lagoon system. If you have any further questions ,

COVENANTS FOR WEST HILL-N-PARK
1. Each lot in the subdivision shall be occupied for residential purposes by a mobile or
modular home, or conventional homes built on site.
2. No mobile home located on a lot may be other than of factory origin and may not be more
than five years old on the date it is located on a lot.
3. Any mobile home located on a lot shall be of dimensions no less that 12 fcct by 46 feet.
4. Each mobile home located in a lot shall be set back at least 25 feet from any street
right-of-way.
5. Each lot on which a mobile home is located shall be fenced as follows:
A. The entire rear portion of each lot•
B. Side fences shall come within 25' of curbs;
C. Street frontage shall be unfenced:
D. Style of fence required shall be elcar type chain link fence similar to type installed
on Trot Fifteen (15) , in Block One (1) , Hill-N-Park. (No wooden fences) .
6. No basement house, tent shack, garage, barn or trailer, prefabricated structure or any
out-building shall be occupied or used as a residence. Temporarily or permanently.
7. All caipurts and patios or additions to mobile homes shall be of factory origin.
8. No automobile repair or salvaging trade or business are permitted on any lot• and no
storage of any unlicensed vehicles, boats, campers, trucks. or cars is allowed on any lot.
9. A concrete driveway shall be installed on each lot within one year of the purchase thereof.
10. No lot shall he used for open storage of construction materials or any other material.
except during the construction of any authorized improvement.
11. No noxious or offensive trade or activity shall be conducted upon any lot.
12. No animals of any kind shall be raised, bred or kept upon any lot for commercial purposes.
13. No mobile home, patio, carport or other addition to a mobile home shall he located any
nearer than 10 feet to the rear lot line and 5 feet from side lot line and no more than
one mobile home may be placed on any one lot.
14. In no event shall any portion of any mobile home or other structure be erected over any
easement for utilities or otherwise.
15. No lot as platted shall be subdivided for the purpose of making two or more lots. No
more than one mobile home shall be permitted on any one lot.
16. Easements for utilities and maintenance thereof are reserved as shown on the recorded plat.
17. Natural drainage associated with any lot shall not be altered so as to drain onto the
adjacent properties.
18. All trash, garbage, lumber and other household debris shall not be allowed to accumulate
for more than 7 days before disposal. Each property owner shall be responsible for the
proper storage and disposal of trash, garbage and household debris in accordance with the
current rules of the county health department.

19. All dogs, cats and other domestic pets shall be confinded to the individual property
owner's premises.
20. Each lot shall be accompanied by a voting and assessable membership in the Hill-N-Park
Property Owner's Association. Said association shall be responsible for the maintenance
of all parks, lot parks, buffer zones, storage areas and other areas designated for the
use of all residents of the Hill-N--Park Subdivision.
21. All of the above described covenants shall be effective until April 1, 1998.
