HomeMy WebLinkAbout810772.tiff RESOLUTION RE: APPROVAL OF SITE PLAN - LOT 9 , ALTHEN-BOYER COMMERCIAL UNIT DEVELOPMENT - TOM FOSTER AND RON VAUGHT WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on March 23, 1981, the Board of County Commis- sioners of Weld County, Colorado heard the application of Tom Foster and Ron Vaught for approval of the Site Plan for Lot 9 , Althen-Boyer Commercial Unit Development, located in part of the Southwest Quarter of Section 23, Township 1 North, Range 68 West of the 6th P.M. , Weld County, Colorado, and WHEREAS, the Weld County Department of Planning Services has recommended approval of said Site Plan for Lot 9 , Althen- Boyer Commercial Unit Development subject to the following: 1. The applicants providing on-site water storage of 25,000 gallons for fire pro- tection purposes in accordance with the recommendations of the Dacono Fire Pro- tection District. 2 . The applicants amending the site plan map to show the location of the water storage tank. 3. The Development Standards for the site plan. 4 . The permitted uses on the hereon described property within the Commercial Unit Development shall be those uses as listed in the Commercial Zone District of the Weld County Zoning Resolution adopted by the Weld County Board of County Commissioners. Any changes of use on a lot which has been approved in a final site plan review shall be subject to review again for the new use. 2. Agricultural production will be permitted. If agricultural production is not pursued on all or any protion of the Commercial Unit Development that portion not in agricultural production shall be maintained in a manner so as to prevent fugitive dust, erosion, growth of noxious weeds. Nonornamental ground cover shall not exceed 12 inches in height. 3. Use of property shall comply with all County and State Health Standards and Regulations pertaining to air quality, water quality, noise emission, and disposal systems. 4. Maximum height of buildings shall be 40 feet. Minimum front setback shall be 50 feet. Side and rear setbacks shall be in compliance with Weld County requirements for commercial zoning. 5. Access to the property shall be limited to one from the private interior road as shown hereon. 6. Lighting shall be of the mercury vapor type. Lighting plan, when developed shall be submitted to the County, the State Highway Department, and all affected power and utility companies for approval . 7. Signs shall be limited to one ( I ) for Lot 9. Signs shall conform with State Highway recommendations regarding lighting size and be in compliance with the requirements of the Weld County Zoning Resolution. B. The recommendations of the Subsurface Rock Stability Report by Fox and Associates, Inc. dated January 4, 1974, and addendum report dated January 22, 1974, shall be incorporated in the design and construction of any structures placed or built on Lot 9. Information pertaining to "kip loadings" of piers shall be submitted to the Director of the Building Inspection Division prior to the issuance of any building permit for construction within Lot 9. 9. All fire protection facilities, including hydrants, or water storage tanks shall be located in accordance with the recommendations of the Dacono Area Fire Protection District. 10. The site plan shall be limited to the plan submitted and governed by the Development Standards stated above and applicable Weld County regulations. Any material deviations from the plans and/or Development Standards, as shown or stated above shall require the approval of an amendment to the site plan by the Planning Commission and the Board of County Commissioners before such changes from the plans and/or Development Standards shall be permitted. Traxler : R & T Construction wishes to establish a mechanical contracting office and shop on the above mentioned site . We will be conducting the installation of plumbing and heating systems in schools , bank buildings and other commercial and industrial buildings . We also install process piping in water treatment plants , sewage treatment plants and process food systems in various types of food processing plants . We plan to have no more than six people employed at our shop and office location. Truck traffic will consist mostly of just pickup trucks with an occasional truck. and trailer. Ninety percent of our materials are delivered straight from our supplier to the jobsite . We will store materials such as fittings , valves , copper pipe , tools and office supplies inside our shop . Outside there will be steel pipe , cast iron water main, soil pipe along with our back- hoe , tamper, field office trailer, and field office storage van. The recommendations of the Subsurface Rock Stability Report by Fox and Associates, Inca dated- January 4 , 1974 and addendum report dated January 22 , 1974 , shall be part of the Development Standards. • 12 . It is intended to use the water storage area both as a reservoir for fire protection and a storage area for drainage. A detailed drainage plan shall be submitted to the County Engineer for approval at the time the site plan is reviewed by Weld County. 13 . All fire protection facilities, including hydrants , shall be located in accordance with the recommendations of the Dacono Area Fire Protection District as defined by letters from such District dated April 20, 1976 and April 7, 1974 and on file with the Weld County Department of Planning Services. Compliance will be reviewed at the time of the site plan review. 14 . The redefined area is shown by the stippled pattern on Plate 2 (attached) , and the following remarks pertain to only that part of the S/2 of the SW/4 of Section 23. - The positions of the mine workings (entries , drifts, haulage ways, etc.) shown on Plate 2 are approximate. They have been copied from the final survey map of the Washington Mine. If we assume that the final survey map is a correct representation of the actual workings , then the following remarks are believed to be correct. We believe that Lot Numbers 1 through 10 are safe for a light industrial type • of development. This opinion is based on the fact that the coal pillars between the workings are indicated to be intact by the records at the State Mine Inspector's office. However, care must be exercised in designing and positioning foundations for all structures to be constructed on Lot Numbers 1 , 2, 3, 4, 5, and 7. If by the nature of the proposed structure or by the nature of the equipment or materials to be contained therein, the loading will be in excess of 3000 psf for any part of the structure, we recommend that the specific site be drilled and tested for rock stability in accordance with the type and amount of loading anticipated. By exercising this type of caution, we believe that no structures will ever be subjected to structural damage caused by subsidence at the Washington Mine workings shown in the stippled area on Plate 2. First of all I stated that we would need a guarantee that the , • lake will at all points in time contain the minimum requirement of 25,000 gallons of water. If such requirements were to fail • we would then need an on sight storage tank or other arrangements. I was on the sight today and looked over the possibility of the line to the dry hydrant as I explained it to you. First of all the elevation of the water as compared to the elevation of the ' proposed developement sight is going to have the water pipe at least 20 to 25 feet in the ground at the sight, plus a riser to the fire department connection. We only safely plan on lifting the water a maximum of 20 feet when needed with a pumper. I see the lift as too high. Also the depth of the lake is not nearly as deep as I was to believe and the request that I made that the end strainer on the dry hydrant be at least 24 inches below the top water level at it's lowest point and at least 24 inches from the bottom of the lake will be nearly impossible to meet with the present water level. Another problem I see is the amount of moss and silt in the lake and this coupled to the shallow depth of the water the suction intake on the line will plug before any apreciable amount of water can be obtained for fire fighting in the case of need. The roadway of course will have to be given a sufficient base to asure it' s being capable of year around usage, which we have agreed upon. \\N2v3141516 , p,. If you can maintain the water required in the lake at all times and can run the line to the point of the fire department connec- tion as stated and have the water flow to the bottom of the riser in the attached drawing of a dry hydrant connection, by gravity flow, and NOT have the lift at the connection to beF�4nore than a maximum of 20 feet, and have sufficient depth of the water at the point of intake as explained and shown on the drawing, and be in clear enough water to prevent the clogging of the suction strainer while being pumped out, I will accept the lake as a sufficient method of storage and the dry hydrant will work for the proposal. As I stated I want the owners of the property and yourself to be informed as to the problems that can occur if the water supply yz was to fail in the future, such as we would then demand that an additional supply be installed to allow the occupancy to continue as I told you at our meeting. After my tour of the sight, I sincerely doubt the feasibility of the lake being used, But if the lot elevations were changed or a survey could show that the elevation of the water in comparison to the fire department connection were to be satis- factory, I could live with the proposal. Zoning Administrator Vickie Traxler; Regarding the application for the site plan proposal of Foster and Vaught, Lot 9, Althen-Boyer C.U.D. in Weld County at approx- imately WCR 6 and I-25 frontage road. As you know from our previous letters of April 20, 1976 and April 7, 1974, that we felt the need for water mains and hydrants or sufficient on site storage of water. supply for fire fighting. We also agreed to let the three existing buildings be construct- ed and attempt to use the lake or reservoir on the property for on site storage. There was to be a dry hydrant and line into the water in the lake and a road to the area for us to use for fire trucks to draft the water and relay. As of this date the water supply is not sufficient and does not maintain a level at which we could reach it for fire fighting if needed. The Road has been worked on and is only partially accept- able. We feel that the on site water supply is not now adequate or has not ever been, due to the shallow depth of the water at the point where we need it . Also the distance from the lake to the lot in question is excessive and we feel we need to have water in lines or satisfactory storage tanks for fire protection of this area. We have in the past week had a fire in the area where we had to call on tankers from the mutual aid stations at Longmont Rural, Brownsville, and Erie to haul water for fire suppression. This is nice to have this assistance, but it is not fair for them to have to transport water for an area that should have it' s own and on top of that we are pulling the fire protection equipment out of the areas mentioned to protect an area that they are not responsible for. cont; DACONO, COLORADO 80514 • Lot 9 Althen Boyer cont; Also I cannot justify the need to add taxes to support our district in the purchase of additional water tankers just to be able to protect a small area of the entire district, and this is what we would have to do if we continue to let rural areas expand without water or water lines on site. Using the plan sent me, I see an office area of 1200 square feet, and a warehouse area of 5000 square feet, for a total of 6200 square feet of building. I do not have anticipated heights of the two parts of the structure, but estimated 12 feet for the office and 20 feet for the warehouse. This gives me an anticipated 114,400 cubic feet of building, plus vehicles and possible fuel supplies on site. Assuming the buildings will house only the types of supplies given in the application, we will need not less than 22,600 gallons of on site water storage for the fire fighting in the buildings and somewhat more for the vehicles and fuel storage etc. The total need of 25,000 gallons of on site storage is not excessive as we see the plan at this time. As I have stated in the previous letters, I prefer to have the area install fire hydrants located on not less than 6" mains and this will become a needed requirement as this area grows and it is showing that it will. Also the uniform fire code adopted by the Board of Directors of the Dacono Fire Protection Sistrict requires; Section 13,313 (e) Fire Hydrants and hard surfaced roads shall be installed before construction is begun above ground level, or before combustible materials are stockpiled . Fire Hydrant shall be tested and charged ready for fire department use and access roads shall include all streets, public parking lots or other vehicular areas shown on the final developement plan, including street signs. It is for the above reasons that I request the following plans be considered for this area; 1 . That the 6" water mains be installed and a fire hydrant located not more than 600 feet from the buildings in question, said hydrant charged and tested prior to construction, or 2.
