RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION NO. 665 - MAX AND DORIS SERAFINI WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, it has been determined by the Board of County Com- missioners at a public meeting held in the Chambers of the Board, that the division into two parcels of land, as shown on the plat known as Recorded Exemption No. 665 , having been requested by Max and Doris Serafini , described as parts of Sections 7, 17 and 18 , Township 2 North, Range 68 West of the 6th P .M. , Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A" , said plat to be recorded, does not come within the purview of the definition of the terms , "subdivision" and "subdivided land" , pursuant to its authority under Section 30-28-101 (10) (d) , CRS 1973, as amended, and WHEREAS, this request is to divide the property into parcels of 240 acres and 2 acres, more or less , to allow the applicants to transfer title on the larger parcel and retain the improvements on the smaller parcel . NOW, THEREFORE , BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the hereinabove de- scribed parcel of land be, and hereby is , exempt from the de- finition of the terms "subdivision" and "subdivided land" . BE IT FURTHER RESOLVED by the Board that this approval is conditional upon the applicant submitting a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be drawn in accordance with the requirements of Section 9-2C. (4) of the Weld County Subdivision Regulations . The parcel of land on which this request is being made is described as Parts of Sections 7, 17 and 18, T2N, R68W of the 6th P.M. , Weld County, Colorado. The property is located approximately 3 miles southeast of Longmont on WCR 202. The property contains approximately 242 acres of Class I (prime) , Ile (prime) , IIs (prime) , IIIe, VIw irrigated and IVe nonirrigated soils. The request is to divide the property into parcels of 240 acres and 2 acres, more or less. The Serafinis would like to transfer title on the larger parcel and retain the improvements on the proposed smaller parcel. Based upon the submitted information and policies of the County, the Department of Planning Services staff recommends the request be approved for the following reasons: 1 . The request complies with Section 9-2C. of the Weld County Subdivision Regulations submission requirements; and 2. The request complies with Section 9-2E. of the Subdivision Regulations as follows: - The 242 acres, more or less, under consideration will be compatible with the existing surrounding land uses and with future development of the surrounding area as permitted by the existing zoning. The proposal is also consistent with the intent of the "A" Agricultural Zone District on which it is located. - The proposal was reviewed by the city of Longmont and was found to comply with their long-range Comprehensive Plan. 841005 Board of County Commissioners Page 2 - The proposal is in compliance with Section 1-3 of the Weld County Subdivision Regulations and the proposed land division complies with the Weld County Comprehensive Plan. Therefore, the proposed use is consistent with efficient and orderly development. - The proposal does not exist in an over]ay district area. - The proposed lots meet minimum lot size requirements for land division. - The Left Hand Water Supply Company has indicated adequate water service is available for this proposal. - The proposed lots are not part of a recorded exemption within the last five (5) years. - The two lots proposed will have adequate access from WCR 201. The Department of Planning Services staff recommendation for approval is conditional upon the following: 1. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. Max Serafini , General Partner Gentlemen: The following is respectfully submitted for your consideration in response to those application requirements detailed under Section IV (B) of the "Procedure Guide for Recorded Exemption Application" : 1 . The subject original parcel (a 242 acre farm) has been under continuous ownership by E. Max Serafini and Doris Ann Serafini (Cottonwood Farms Ltd. is 100% owned by the Serafinis) since February 28, 1977. The property has been utilized for agricultural production. The single-family residence on this farm is occupied by an immediate family member, son Jay Serafini . The applicant has recently entered into a sales agreement to transfer title to this parcel , but desires to retain a small portion (2.125 acres) of the acreage which includes the residence and outbuildings for continued residential use. The balance of the original parcel will remain in agricultural production use. Therefore, the purpose of this Application for Recorded Exemption is to allow the subdivision of the original parcel into two lots , such that the smaller lot with the improvements may be excluded from the sale transaction and the existing residential use be continued. 2. This proposal is consistent with the Weld County Comprehensive Plan in that a major premise of said plan was to provide for the preservation of the rich natural resource of agriculturally productive land in the County. The subject original parcel is located in an A-(Agricultural ) District. Upon approval of this application, the predominant land use will remain agricultural and therefore in conformity with the intent of the District. The use of the smaller lot will be a single family unit which is specifically allowed under Section 31 .2.2 of the Weld County Zoning Ordinance. 4. The land use in the surrounding area is predominantly agricultural , with single-family residences on some of the individual parcels. The resultant use from approval of this application would represent no change from the existing use. 5. The future development of the surrounding area is limited to those Uses Allowed by Right and Uses by Special Review detailed in the Weld County Zoning Ordinance for the A District. The permitted uses under this application are Uses Allowed by Right and are therefore compatible. The subject property is in excess of three miles from any municipality and not subject to a master plan thereof. 6. As the application provides for no change from the existing land use, the approval of such would not inhibit efficient and orderly development at such time in the future as conditions change and further development is desirable. 7. A portion of the subject parcel is located within the Weld County Flood Hazard Overlay District. This application complies with the Overlay District Regulations in that: a. The permitted uses conform to the requirements of the Underlying Zoning District. b. A building permit is not requested with this application. c.
