RE: APPROVAL OF RECORDED EXEMPTION NO. 535 AND VACATION OF RECORDED
EXEMPTION 278 - DAVID AND ROBERT HELDT
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Commis-
sioners at a public meeting held on the 10th day of February, 1982
in the chambers of the Board, that the division into two parcels of
land, as shown on the plat known as Recorded Exemption No. 535,
being the property of David and Robert Heldt, described as part
of the South half of the Northwest quarter of Section 18 , Township
6 North, Range 67 West of the 6th P.M. , Weld County, Colorado, being
more particularly described as follows:
Attached exhibit "A" is incorporated herein
by reference
does not come within the purview of the definition of the terms,
"subdivision" and "subdivided land" , pursuant to its authority
under Section 30-28-101 (10) (d) , CRS, 1973, as amended.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commis-
sioners that the hereinabove described parcel of land owned by
David and Robert Heldt be, and hereby is, exempt for the definition
of the terms "subdivision" and "subdivided land" .
BE IT FURTHER RESOLVED by the Board of County Commissioners that
Recorded Exemption No. 278, approved on July 26, 1977, as shown on the
attached exhibit "B" , be and hereby is, vacated.
The above and foregoing resolution was, on motion duly made and
seconded, adopted by the following vote on the 10th day of February,
A.D. , 1982.

Re: Recorded Exemption 535
Dear Commissioners:
The attached application, plat and related items are in reference to a
request from David and Robert Heldt for a vacation of recorded exemption
#278, and the approval of a new recorded exemption. The parcel of land on
which this request is being made is described as part of the S 1/2 of the
NW 1/4 of Section 18, T6N, R67W of the 6th P.M. , Weld County, Colorado.
This property is located approximately two (2) miles northwest of the town
of Windsor. The property contains approximately 20.9 acres of Class II,
III, VI, and VII irrigated soils and Class IV and VII non-irrigated soils.
The request is to split the property into parcels of 2.687 acres and 18.217
acres, more or less.
As indicated in a letter dated January 3, 1982, it is the applicant's
desire to purchase 17 acres of land that adjoins their farm, so that they
can run their livestock on part of the land and grow feed on the remainder
of the parcel. There is presently a set of improvements on the 2.687 acres
and a proposed residence for the 18.217 acres.
Based on submitted information and policies of the County, the Department
of Planning Services staff recommends the request be approved for the
following reasons:
1. The request complies with Section 9-2 C. of the Weld County
Subdivision Regulations for submission requirements.
2. The request complies with Section 9-2 E. of the Subdivision
Regulations as follows:
- The 18.217 acres, more or less, under consideration will allow
agricultural and related uses to be the predominant uses. The
use will be compatible with the current "A" Agricultural zoning
of the property and the surrounding agricultural uses. The facts
also support the proposal as being consistent with the intent
clause of the Agricultural District.

- The proposal is in compliance with Section 1-3 of the Weld County
Subdivision Regulations; therefore the proposed use is consistent
with efficient and orderly developments.
- The proposal does not exist in an Overlay District Area.
- The proposed lots meet the minimum size requirements for land
division for the Agricultural District as stated in Section 9-2
E. (e) of the Subdivision Regulations.
- The proposed lots will have proper access to an existing public
road.
- A letter from the North Weld County Water District dated January
18, 1982 indicates an adequate supply of water.
- A letter from the Weld County Health Department dated January 25,
1982 indicates an adequate means for the disposal of sewage.
The proposal will vacate recorded exemption #278 and will provide for this
recorded exemption as the only action for a recorded exemption within the
last 5 (five) years on this property.
