HomeMy WebLinkAbout820618.tiff RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION NO. 536 - TENNIS MEADOWS WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, it has been determined by the Board of County Commis- sioners at a public meeting held in the Chambers of the Board, that the division into two parcels of land, as shown on the plat known as Recorded Exemption No. 536, being the property of Tennis Meadows, described as part of Lot 3, in the Northeast quarter of the Southeast quarter of Section 9 , Township 5 North, Range 65 West, being more particularly described as follows: Attached exhibit "A" is incorporated herein by reference does not come within the purview of the definition of the terms, "subdivision" and "subdivided land" , pursuant to its authority under Section 30-28-101 (10) (d) , CRS 1973 , as amended. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commis- sioners that the hereinabove described parcel of land owned by Tennis Meadows be, and hereby is , exempt from the definition of the terms "subdivision" and "subdivided land" . BE IT FURTHER RESOLVED by the Board that this approval is conditinal upon the applicant showing the dedicated thirty (30) foot right-of-way on 17th Street. The above and foregoing resolution was, on motion duly made and seconded, adopted by the following vote on the 17th day of February, A.D. , 1982 . The parcel of land on which this request is being made is described as part of Lot 3, NEo SEa, Section 9, T5N, R65W of the 6th P.M. , Weld County, Colorado. This property is located adjacent to and east of the city of Greeley. The property contains a total of 4.8 acres, more or less, in the "I-1" (Industrial) zone district. The request is to split the property into parcels of 2.77 acres, more or less, and 2.02 acres, more or less. The applicant will continue to own the proposed Lot "A" , which has the tennis court improvements. The applicant wishes to sell the proposed Lot "B", which is unimproved. Based upon the submitted information and policies of the County, the Department of Planning Services staff recommends the request be approved for the following reasons: 1. The request complies with Section 9-2 C. of the Weld County Subdivision Regulations submission requirements. 2. The request complies with Section 9-2 E. of the Subdivision Regulations as follows: - The 4.8 acres, more or less, under consideration will allow industrial and related uses to be predominant uses. The use will be compatible with existing and surrounding industrial, agricultural, commercial and residential uses. These facts also support the proposal as being consistent with the intent clause of the above mentioned zone districts. C' '0618 Board of County Commissioners February 17, 1982 Page 2 - The proposal was reviewed by the city of Greeley and was determined to be in compliance with their long- range comprehensive plan. - The proposed land division is in compliance with Section 1-3 of the Weld County Subdivision Regulations and the Weld County Comprehensive Plan; therefore, the proposed use is not inconsistent with efficient and orderly developments. - The proposal does not exist in an overlay district area. - The proposed lots meet the minimum lot size requirements for land division. - A letter from the Weld County Health Department indicates an adequate means for the disposal of sewage. - The North Weld Water District will service the site. - The proposed lots are not part of a recorded exemption within the last five (5) years. CONDITIONAL STATEMENT: 1. The Department of Planning Services staff recommendation for approval is contingent upon the applicant dedicating thirty (30) feet of right-of-way on the property adjacent to 17th Street. The dedication was requested by the city of Greeley Planning Commission for future improvements along 17th Street. Also enclosed is a copy of the Land Contract and a copy of the Title Insurance Policy on said transaction. Tennis Meadows , a General Partnership, owns Lot A which is outlined *ith red lines on the attached sketch but has an encumbrance to Alice B. Smith on Lot B which is out- lined with green lines on the attached sketch. The part- nership is desirous of deeding said Lot B to Alice B. Smith in lieu of foreclosure. The parcel that the partnership will retain is approx- imately 1.84 acres and has access via 17th Street dedicated right-of-way which has been the case for the past six years . Other information is provided on the enclosed application . It should be noted that the parcel outlined in blue on the enclosed sketch has been made a part of property known as 1025 E. 18th St. (also outlined in blue) . (Pending ) Further, it should be noted that Lot B as defined in this application is legally described in the Title Insurance Policy as Parcel 2 , and the parcel that will remain under the ownership of Tennis Meadows is defined as Parcel 1.
