RE: APPROVAL OF USE BY SPECIAL REVIEW FOR A GRAVEL PIT OPERATION -
BUCKLEN EQUIPMENT COMPANY
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , the Board of County Commissioners held a public
hearing on the 18th day of August, 1982 , at the hour of 2 : 00
o' clock p.m. in the Chambers of the Board for the purpose of hear-
ing the application of Bucklen Equipment Company, 804 North 25th
Avenue, Greeley, Colorado 80631 , for a Use by Special Review for
a gravel pit operation, on the following described real estate,
to-wit:
Part of the SW4, Section 31 , Township 6 North,
Range 65 West of the 6th, P.M. , Weld County,
Colorado
WHEREAS , Section 24 . 4 . 2 of the Weld County Zoning Ordinance
provides standards for review of said Use by Special Review, and
WHEREAS , the Board of County Commissioners heard all of the
testimony and statements of those present, has studied the request
of the applicant and the recommendations of the Weld County Plan-
ning Commission and all of the exhibits and evidence presented
in this matter, and having been fully informed, finds that:
1 . The submitted materials are in compliance with the appli-
cation requirements of Section 24 . 7 of the Weld County
Zoning Ordinance;
2. It is the opinion of the Board of County Commissioners
that the applicant has shown compliance with Section
24 . 4 . 2 of the Weld County Zoning Ordinance as follows:
a) The proposed operation is in compliance with the policies
of the Weld County Comprehensive Plan; the Weld County
Extraction Plan; and the Mineral Resources, Volume II ,
the Weld County Extraction Plan states that the parcel
shall be accomodated in non-irrigated areas. The
parcel in question is non-irrigated.
b) The design and controls proposed in the operation and
the attached Operation Standards will minimize impacts
on surrounding uses and the area to the greatest extent
possible and provide adequate protection of the health,
safety and welfare of the inhabitants of the area and
the County.

c) The proposed operation is in compliance with the pro-
vision of Section 31 . 4 . 1 of the Weld County Zoning
Ordinance for Uses by Special Review in the Agricultural
District.
d) These determinations are based, in part, upon a review
of the information submitted by the applicant, other
relevant information regarding the request and the res-
ponses of the referral entities which have reviewed
this request.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the application for a
Use by Special Review for a gravel pit operation on the hereinabove
described parcel of land be, and hereby is , granted subject to the
following conditions:
1 . The attached Operations Standards being recommended and
approved for this request.
2 . The following note being placed on the Special Use Permit
Plat:
NOTE: The Mined Land Reclamation Board has the authority
to issue permits for mining and reclamation acti-
vities. Activities related to mining and reclama-
tion are, therefore, under the jurisdiction of the
Mined Land Reclamation Board; however Weld County
has jurisdiction of those matters outlined in the
Operation Standards.
3 . The Operations Standards being placed on the Use by Special
Review Plat. The Use by Special Review Plat shall be de-
livered to the Department of Planning Services.
4 . The applicant shall submit a revegetation plan using per-
ennial grass species and approved by Soil Conservation Ser-
vice. Any major change in the revegetation plan approved
by the Mined Land Reclamation Board shall be presented to
the Department of Planning Services staff for placement
in the file record.
5. This condition applies to those shallow wells located within
1 , 000 feet of the Bucklen Equipment Company gravel pit
under this Special Use Permit. This condition applies
to Bucklen Equipment Company, Inc. , its successors , assigns,
operators, and subcontractors who may be performing the
gravel mining operation at this particular gravel pit.
It shall be the responsibility of Bucklen Equipment Company,
Inc. , to designate at least two (2) ground water monitoring
wells to be located in the general area comprising of the
gravel pit and those shallow wells of residential properties
located in the vicinity of the subject property. Ground
water level reports must be submitted to the Weld County
Planning Department prior to any excavation at the site
and at three-month intervals thereafter by Bucklen Equipment
Company. Bucklen Equipment Company, Inc . , hereby authorizes
any Weld County employee to examine the ground water moni-
toring wells to determine the accuracy of said records.

The owners of shallow wells located within 1 , 000 feet of
the subject gravel pit shall be afforded the opportunity
to participate in data collection pertaining to ground
water levels in this defined area. In order to partici-
pate, well owners must meet the following criteria:
Well owners submit to Weld County complete
reports, on forms provided by the Planning
Department at the same frequency as required
of Bucklen Equipment Company, Inc. A copy
of the report form is attached hereto and
incorporated herein by reference.
Data collected will be available for public inspection
at the Planning Department during regular working hours .
The Planning Department shall notify, by mail , all land-
owners of record within 1 , 000 feet of the perimeter of
the subject property of this condition. Such landowners
must notify the Planning Department within sixty (60)
days of their intention to participate in the procedure
stated above in order to be eligible to participate in
the reporting procedures.
Should the data collected indicate that excavation or
pumping of water from the gravel pit adversely affects the
level of water in shallow wells of those properties within
1 , 000 feet of the permit area, Bucklen Equipment Company,
Inc. , must either cease its operations of pumping water
from the gravel pit or institute some method of restoring
the affected wells to the normal level .
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 18th day of
August, A.D. , 1982 .

OPERATION STANDARDS
1 The uses permitted on this site shall include the extraction of sand and
gravel material as described in the application materials on file with the
Department of Planning Services.
2. No excavation or processing of materials shall be permitted nearer than ten
(10) feet to the boundary of adjacent property, easement or irrigation
ditch or right-of-way, nor nearer than 125 feet to any existing residence,
unless by written agreement to the owner or owners of such adjacent property
consent to a lesser distance and the Commission approves such lesser distance.
3. The road in the southwest corner of phase five (5) leading to northwest "C"
Street shall not be used to haul sand and gravel material.
4. All extraction operations shall be conducted during the hours of daylight,
except in cases of public or private emergency, or to make necessary repairs
to equipment. This restriction shall not apply to the operation of administra-
tive and executive offices or repair facilities if located on the property.
5. The Use by Special Review area shall be maintained in such a manner so as
to prevent soil erosion, fugitive dust and growth of noxious weeds. The
site shall be maintained in such a manner as to present a neat and well
kept appearance.
6. Insurance - The operator shall furnish evidence they are insured to the
extent of not less than $100,000.00 against liability for any negligent act
or omission by the operator from the operation, maintenance, extraction,
and/or production of the sand and gravel and shall include all activities
connected with or incidental thereto.
7. The slope on the gravel pit bank shall be a minimum ratioyi of five (5) to
one (1) as requested by the Soil Conversation Service.
8. An air emmissions permit shall be obtained from the Colorado Department of
Health, Air Pollution Control Division, for the mining activity.
9. Noise Standards as specified in Section 25-12-103 of the Colorado Revised
Statues 1973, as amended, must be maintained.
10. A National Pollution Discharge Emmission System permit is required to
discharge waste water to waters of the State.
11. No stockpiling shall be allowed in the Use by Special Review area which
would as a result alter the historic drainage pattern causing damage to the
adjacent properties or County road right-of-ways.
12. The request shall comply with the operation policies of Section 44.4 of the
Weld County Zoning Ordinance.
13. Operations Standards for Uses by Special Review, Section 24.6 et. seq. of
the Weld County Zoning Ordinance shall be complied with.
14. The Use by Special Review shall be limited to the plans shown hereon and
governed by the Standards stated above and all applicable Weld County
Regulations. Any material deviations from the plans and/or Standards, as
shown or stated above, shall require the approval of an amendment of the
Permit by the Weld County Planning Commission before such changes from the
plans and/or Standards are permitted. Any other changes shall be filed in
the office of the Department of Planning Services.
15. The property owner and/or operator of this operation shall be responsible
for complying with all of the above stated Standards. Noncompliance with
any of the above stated standards may be reason for revocation of the
permit.

16. Prior to starting excavation, a six (6) foot chain link fence with
security barbed wire strands shall be set-up, maintained and located
in such a manner to fence, from adjoining property owners, extraction
phases 3, 4, 5 and the two (2) water surfaces immediately east and
west of the gravel operation.
17. The subject property shall be posted to clarify no hunting or shooting
of firearms is allowed on the property. The owners of the property
shall not allow shooting of firearms on the property.

This condition applies to those shallow wells located within 1,000 feet of the
Bucklen Equipment Company gravel pit under this Special Use Permit. This
condition applies to Bucklen Equipment Company, Inc. , its successors, assigns,
operators, and subcontractors who may be performing the gravel mining
operation at this particular gravel pit.
It shall be the responsibility of Bucklen Equipment Company, Inc. , to desig-

The following business was transacted:
I hereby certify that pursuant to a notice dated July 12 , 1982 ,
duly published July 15 , 1982 in the LaSalle Leader , a public
hearing was held on the request of Bucklen Equipment Company for
a Use by Special Review for a gravel pit operation . The Planning
Commission recommended that the request be approved with conditions
and standards . Mr . Bucklen agreed with all the standards and conditions
with one exception. He disagreed with the standard which requires
the chain link fencing . He was of the opinion , that anyone can
get on the wrong side of a fence , should they be injured and need help
it will be more difficult with the fencing to assist the injured person .
Mr. Bucklen stated that he is expanding his gravel mining operation
onto the parcel that he purchased two years ago . He was unable to
determine the lengh of his extraction plan because it is affected by
the ecomony . Virginia Scheel , an adjacent landowner , commented on
the two petitions that have been filed in opposition to this request .
Ms . Scheel stated that. the adjacent landowners are in opposition to
this request because they are fearful that their domestic water wells
will dry up . Several of the adjacent landowners listed their objections
and concerns regarding this request . Some of the issues raised besides
the domestic water supply were the additional truck traffic , accesses ,
breeding of insects , safety factor , septic tanks , and easements .
The Assistant County Attorney , R . Russell Anson , stated that the land-
owners must prove who is draining their domestic water supply , utilize
the court process and possibly the judge will determine who shall
be responsible for said loss . The Board of County Commissioners
agreed that the biggest concern is the domestic water supply loss .

Several adjacent landowners again commented on their rights in conjunction
with their domestic water well supply . The flow of the underground
water supply was discussed by the Commissioners . After additional
discussion, Commissioner Kirby made a motion to continue this matter
for three weeks to August 18 , 1982 , at 10 : 00 A. M . , so the Commissioners
can make anon site inspection , study the legal ramifications , and
at that time additional testimony will be limited to the domestic water
supply. Commissioner Steinmark seconded the motion . It was a consensus
of the Board that Mr . Bucklen does not have to halt his operation pending
the action on August 18 , 1982 . The motion carried unanimously .

Dear Sirs:
The enclosed analysis report dated July 2, 1982 prepared by
Leonard Rice Consulting Water Engineers of Denver, Colorado given
me by James Lauer of Flatiron Paving is being submitted to the Board.
In addition to information on the Ketler well, it contains a
map and data showing #19932 a well located 23 Avenue & C Street NW,
closest well to our proposed pit. Though not all information may be
pertinent to our exact location, I feel this report will aid the Board
members in their efforts to attain a better understanding and overall
view of the many factors that can attribute to the supply of ground
waters and wells.
By Mr. Bucklen's request, Ed Lesh of Lesh Drilling, Ault, Colorado
will offer his knowledge and experience in this area by answering any
questions the Board members may have at the up coming meeting to be
held August 18, 1982.

This letter describes the results. of an investigation made in
response to a problem with a well owned by Bill Ketler. The
well is located at 3029 C Street , Greeley, Colorado . It is 82
feet deep and was drilled prior to 1952 . The well is one of
three located on the property and has been used for domestic
purposes . The well has not been registered with the State ,
therefore , no permit records are available . In the fall of
1981 , the water level in the well dropped below the pump
intake and the pump started pulling air. Since that time , the
well has yielded no water. The other two wells on the
property are about 300 feet to the north. Both of these wells
are shallower and both will yield water.
A problem has also developed with a well owned by Edward Rody
of 2836 C Street . Mr. Rody ' s well is located at his house and
has been used for domestic purposes . This well was drilled in
1961 , is 123 feet deep and yields 1 gpm. Depth to water was 5
feet when the well was completed . The water level in the well
started dropping in the fall of 1981 . The well is not dry ,
but can only be pumped for 10 to 15 minutes before the pump
starts to pull air. The pump must then be shut off and a 15
to 20 minute wait is required to allow the water level to
rise above the pump intake. To determine why these wells are
drying up , we defined the local ground-water system and
looked for any land use changes , including Flatiron' s pit ,
which might have adversely affected the system. Pertinent
information was obtained from the State Engineer ' s Office and
from conversations with the residents who live in the
affected area . Two site visits to the area were made on May
13 and June 10 , 1982 . During the visits Ketler' s wells were
inspected, all ditches and creeks in the area were visited
and recent land use changes were noted.

Introduction
The Ketler well is located in the southwest 4 of the
southwest 4 of Section 36 , Township 6 North, Range 66 West
( Figure 1 ) . The well is approximately 4 , 100 feet south of the
Cache La Poudre River, approximately 3 , 700 feet southeast of
the Flatiron pit , approximately 4 , 500 feet southeast of the
Mobil pit and approximately 3 , 500 feet northeast of the Best
Way Permit . The Greeley No . 3 Ditch trends east-west about
1 , 600 feet south of the Ketler well . A spillway for carrying
excess storm runoff runs north-south along the east side of
35th Avenue between 10th Street and the Cache La Poudre
River. A low-yield spring contributes water to this spillway
at the intersection of C Street and 35th Avenue .
The vicinity of the Ketler well has , until recently, been
predominantly rural . Agriculture has been the dominant land
use since the area was first settled. With the aid of
irrigation, corn, sugar beets and alfalfa have been
successful cash crops . Livestock grazing, especially cattle ,
has also been an important land use . To the north and west , a
number of gravel mining operations mine the alluvial gravels
of the Cache La Poudre River. The City of Greeley continues
to expand and urbanization has claimed much of the land to
the south and west . To the south of C Street almost all of
Section 1 , T5N, R66W has undergone a transition from
agriculture to urban land use . To the southwest , the
northeast 4 of Section 11 has been developed since 1979-80 .
This area , about 160 acres (Figure 1) , was farmed and
irrigated by the Predalve family until 1978 . Corn was grown •
on the sandy soils which overlie the Laramie Formation. A
substantial amount of irrigation is necessary to successfully
grow corn in sandy soils . The land was sold by the heirs of
the Predalve family in 1978 or 1979 and the land was zoned
and developed commercial . A shopping center and related
development now occupies the land . The south 1 of Section 2 ,
T5N , R66W ( Figure 1 ) has also been taken out of agriculture.
This area is now residential .
Only a small amount of land is still irrigated in the area. A
small alfalfa field adjacent to the Ketler property on the
west is presently being irrigated . In addition, a small
alfalfa field to the east of the Ketler property is being
irrigated . The amount of water applied to these fields is not
known. According to Mr. Ketler, the water level rises in the
two shallow wells north of the problem well whenever the
field to the west is irrigated . The water level in the deep
well has not responded to the application of irrigation
water. These are the only known irrigation areas in the
immediate vicinity of the Ketler well .

Hydrogeology
The surficial geology in the area to the west of Greeley is
complex. The surface is comprised of alluvial deposits and
the Cretaceous Laramie Formation (Figure 1 ) . The surface in
Sections 35 and 36 , T6N, R66W is comprised entirely of
flood-plain deposits . These deposits consist primarily of
sand and gravel with minor amounts of clays . Geologic logs
from wells 78370 and 78858-A, located in the southeast corner
of Section 35 , T6N , R66W indicate that the flood plain
deposits are approximately 50 feet thick. One mile to the
east , in the Southeast corner of Section 36 , the flood-plain
deposit is approximately 25 feet thick, as indicated by the
geologic log of well 19932 . The North i of Section 1 T5N ,
R66W is covered by flood-plain deposits and the South 1 with
terrace deposits . Terrace deposits consist mainly of arkosic
gravel and sand with frequent lenses of sandy clay . Terrace
deposits between Fort Collins and Greeley rarely exceed 35
feet in thickness (Hershey, 1964) . To the southwest in
Sections 2 and 11 , T5N, R66W the Laramie Formation forms the
surface.
This formation consists of silty lenticular sands ,
carbonaceous and gypsiferous shales and coals . The Laramie is
non-resistant to erosion and , as such, is poorly exposed. The
soils that develop on the Laramie are very sandy . This
formation underlies the alluvial deposits throughout the area
west of Greeley. It ranges from 60 to 400 feet in thickness .
The top of the Laramie Formation is about 25 feet below the
surface in the immediate vicinity of the Ketler well . This is
indicated by the geology log of well 15830 which is located a
few hundred feet to the southeast of the Ketler well . Here
the Laramie consists mainly of interbedded sandstones and
shales . The sandstone beds and the shale beds average about 3
to 6 feet in thickness .
It is difficult to determine which aquifer the Ketler well
and the Rody well are developed in because no geologic log
exists for either well . However, based on the depths of both
wells and the log of well 15830 , they are probably developed
in the Laramie Formation. The Laramie yields small to
moderate quantities of soft alkaline water to stock and
domestic wells . Yields are primarily from the sandstone beds .
Ground water in the alluvium and the Laramie Formation flows
northeastward towards the Cache La Poudre River. This is
shown by arrow on Figure 1 . This flow direction was found
from plots of depth to water data contained in well permit
records (Table 1 ) . Flow direction is also confirmed by the
fact that the two shallow Ketler wells are affected by the
application of irrigation water to the alfalfa field to the
west . Both of the shallow wells are probably developed in the
flood-plain deposits . Due to the lithology of the Laramie

Formation, it is unlikely that ground water in the overlying
alluvium is a significant portion of the recharge to the
lower Laramie Formation. Ground water contained in sandstone
beds overlain by shale beds is probably under partial
artesian pressure. The sandstone beds appear to be recharged
primarily in the outcrop areas . The primary recharge sources
for the alluvium and the Laramie Formation are percolation of
applied irrigation water, seepage from canals and
precipitation . Figure 2 is a schematic representation of the
local hydrogeologic system. The recharge to the Laramie
Formation occurs in the area indicated in Figure 2 . Ground
water then flows northeast through the -Laramie Formation to
discharge in the Cache La Poudre River. The Ketler well
intercepts ground water enroute from the recharge area to the
river. It is likely that the Ketler well tapped a sandstone
aquifer that is under partial artesian pressure. However,
this cannot be confirmed because no well records exist .
Conclusions
The Laramie Formation underlies the alluvium in the Greeley
area . To the southwest of Greeley, in Sections 2 and 11 , T5N,
R66W the Laramie forms the surface deposit . It is easily
eroded at the surface and sandy soils are formed on top of
it . Aquifers within the Laramie are recharged at the outcrop
area .
The primary recharge sources for the Laramie Formation are
percolation of applied irrigation water, seepage from canals
and precipitation. Land that is taken out of irrigation and
developed as commercial property ceases to be a recharge
area . This appears to be the problem with the Ketler well .
Recharge to the Laramie in the vicinity of the Ketler well
occurred where the formation intersected the land surface in
Sections 2 and 11 , T5N , R66W . Recharge was cutoff by the
commercial development of the property in 1979-80 and
"downstream" wells began to dry up .
The northeast 4 of Section 11 was taken out of irrigation and
commercially developed in 1979-80 . This area has ceased to
provide a recharge source to the Laramie Formation. The south
1/2 of Section 2 has been residentially developed and this area
no longer provides a recharge source (Figure 1 ) . Both of
these areas have been out of irrigtion for at least 32 years .
The area in Section 2 was developed prior to the area in
Section 11 . In addition, since the spillway has been
installed along the east side of 35th Avenue between 10th
Street and the Cache La Poudre, little runoff has been
allowed to percolate into the ground water system.

There is no evidence that the alluvial deposits which overlie
the Laramie Formation are drying up. Wells in the area that
are developed in the flood plain or terrace deposits are
presently yielding water. Both of the shallow Ketler wells
are yielding water. Drilling a new well into the alluvium
might be a solution to Mr. Ketler ' s problem. However, a more
detailed study of the local hydrogeologic system would be
necessary to make that determination .
The Flatiron pit is located in Section 36 to the northwest of
the Ketler and Rody wells . Ground water flows from southwest
to northeast in the area, as indicated on Figure 1 . Based on
the information presented above , it seems unlikely that
dewatering at the Flatiron pit could affect the Ketler well .
Calculations indicate that the radius of the cone of
influence created by dewatering the pit is about 1 ,650 feet .
This is based on a drawdown of 10 feet and a hydraulic
conductivity value of 250 gpd/ft . The Ketler well is about
3 ,600 feet to the southeast of the pit . This is well beyond
the radius of influence of the pit .
Based on the above information, it is our professional
opinion that the Ketler and Rody wells dried up because the
recharge area for the Laramie Formation to the southwest was
eliminated. This occurred because the land was taken out of
irrigation and commercially and residentially developed. The
activities at the Flatiron pit had no effect on the Ketler or
the Rody well .

Operation Standards will minimize impacts on surrounding uses and the
area to the greatest extent possible and provide adequate protection
of the health, safety, and welfare of the inhabitants of the area and

Wilbur Wafel moved that the Planning Commission forward USR-513:82 :28
to the Board of County Commissioners with the recommendation for
approval. He is in sympathy with these people. As he looks at the maps
there is as much as two-hundred feet or more between them and the proposed
gravel pit . He thinks that with the Development Standards,as outlined,
that this can be a safe operation and the gravel is needed. He feels
that most of the property owners appearing before the Planning Commission
today agree with that premise. There are other gravel pits in the area
so he does not feel it will change the neighborhood. This would include
the added Development Standards (1/16) that states prior to starting
excavation, a six (6) foot chain link fence with security barbed wired
strands shall be set-up, maintained, and located in such a manner to
fence, from the adjoining property owners, extraction phases 3,4,5 and
the two water surfaces immediately east and west of the gravel operation.

The Chairman asked the secretary to poll the members of the Planning
Commission for their decision regarding the original motion. Wilbur
Wafel - yes. In regard to the chain link fence, if anybody was to go
around the countryside where he travels, most gravel pits and mined
areas that are fenced are fenced with chain link fences rather than
privacy fences and they are for security purposes and this is an accepeted
method of securing a piece of property. Therefore, that is his reason
for making his motion read a chain link fence. Bette Kountz - yes;
Ed Reichert - yes; Bill Diehl - yes; Fred Otis - yes; However, he would
like his specific comments to the County Commissioners to state he would
prefer there be a privacy fence to screen the unsightly gravel pit from
the residential area. He feels this is as important as security and if
it is well maintained it should do that. So he favors the motion
generally, but he prefers there be a privacy fence.

THE DEPARTMENT OF PLANNING SERVICE'S STAFF RECOMMENDS THAT THIS REQUEST BE
approved FOR THE FOLLOWING REASONS:
1. The submitted materials are in compliance with the application
requirements of Section 25.7 of the Weld County. Zoning Ordinance.
2. It is the opinion of the Department of Planning Services staff that
the applicant has shown compliance with Section 25.8 of the Weld
County Zoning Ordinance as follows:
a. The proposed operation is in compliance with the policies of
the Weld County Comprehensive Plan; the Weld County Extraction
Plan; and the Mineral Resources, Volume II, the Weld\County
Extraction Plan states that the parcel shall be accomodated in
nonirrigated areas. The parcel in question is nonirrigated.
b. The design and controls proposed in the operation and the
attached Operation Standards will minimize impacts on surrounding
uses and the area to the greatest extent possible and provide
adequate protection of the health, safety, and welfare of the
inhabitants of the area and the County.
c. The proposed operation is in compliance with the provision of
Section 31.4.1 of the Weld County Zoning Ordinance for Uses by
Special Review in the Agricultural District.
d.' These determinations are based, in part, upon a review of the'
information submitted by the applicant, other relevant information
regarding the request and the responses of the referral entities
which have reviewed this request.
The Department of Planning Services staff recommendation for approval is
conditional upon the following:
1. The attached Operations Standards being recommended and approved
for this request.
2. The following note being placed on the Special Use Permit
Plat:
NOTE: The Mined Land Reclamation Board has the authority to
issue permits for mining and reclamation activities.
Activities related to mining and reclamation are, therefore,
under the jurisdiction of the Mined Land Reclamation
Board; however Weld County has jurisdiction of those
• matters outlined in the Operation Standards.
3. The Operations Standards being placed on the Use by Special
Review Plat. The Use by Special Review Plat shall be delivered
to the Department of Planning Services.
4. Prior to the Use by Special Review approval by the Board of County
Commissioners the applicant shall submit a revegetation plan using
perennial grass species and approved by Soil Conservation Service
Any major change in the revegetation plan approved by the Mined Land
Reclamation Board shall be presented to the Department of Planning -
Services staff for placement in the file record.

OPERATION STANDARDS
1 The uses permitted on this site shall include the extraction of
sand and gravel material as described in the application materials
on file with the Department of Planning Services.
2. No excavation or processing of materials shall be permitted nearer
than ten (10) feet to the boundary of adjacent property, easement
or irrigation ditch or right-of-way, nor nearer than 125 feet to
any existing residence, unless by written agreement to the owner or
owners of such adjacent property consent to a lesser distance and
the Commission approves such lesser distance.
3. The road in the southwest corner of phase five (5) leading to
northwest "C" Street shall not be used to haul sand and gravel
material.
4. All extraction operations shall be conducted during the hours of
daylight, except in cases of public or private emergency, or to
make necessary repairs to equipment. This restriction shall not
apply to the operation of administrative and executive offices or
repair facilities if located on the property.
5. The Use by Special Review area shall be maintained in such"a manner
so as to prevent soil erosion, fugitive dust and growth of noxious
weeds. The site shall be maintained in such a manner as to present
a neat and well kept appearance.
6. Insurance — The operator shall furnish evidence they are insured to
the extent of not less than $100,000.00 against liability for any
negligent act or omission by the operator from the operation,
maintenance, extraction, and/or production of the sand and gravel
and shall include all activities connected with or incidental
thereto.
7. The slope on the gravel pit bank shall be a minimum ratio of five
(5) to one (1) as requested by the Soil Conversation Service.
8. An air emmissions permit shall be obtained from the Colorado Department
of Health, Air Pollution Control Division, for the mining activity.
9. Noise Standards as specified in Section 25-12-103 of the Colorado
Revised Statues 1973, as amended, must be maintained.
10. A National Pollution Discharge Emmission System permit is required
to discharge waste water to waters of the State.
11. No stockpiling shall be allowed in the Use by Special Review area
which would as a result alter the historic drainage pattern causing
damage to the adjacent properties or County road right-of-ways.
12. The request shall comply with the operation policies of Section
44.4 of the Weld County Zoning Ordinance.
13. Operations Standards for Uses by Special Review, Section 24.6 et.
seq. of the Weld County Zoning Ordinance shall be complied with.
14. The Use by Special Review shall be limited to the plans shown
hereon and governed by the Standards stated above and all applicable
Weld County Regulations. Any material deviations from the plans
and/or Standards, as shown or stated above, shall require the
approval of an amendment of the Permit by the Weld County Planning
Commission before such changes from the plans and/or Standards are
permitted. Any other changes shall be filed in the office of the
Department of Planning Services.
15. The property owner and/or operator of this operation shall be
responsible for complying with all of the above stated Standards.
Noncompliance with any of the above stated standards may be reason
for revocation of the permit.

Section 31 Tounshin 6 North Range 65. Total acres 20.52 Proposed
mine 19 acres. Located midway between North 21st and 25th Avenues. West
boundry North 23rd Avenue at 300 to 800 block. This particular area has
been rained by Greeley Sand and Gravel Co Inc. from 1959 through 1979.
Surrounding gravel pits include flatiron Paving to the north snd Ramseur
Brothers northeast across the Cache La Poudre River. East is a pit now
owned by Weld County. Enclosed Legal Description, Deed aid Surrey.

Drawing #2. Mining Method: Dewatering, dragline excavation. Water
-liversion, impoundment settling pond and outlet as indicated by arrows on
nap. Major disturbance. One to four years estimated for each of five
phases. The first four phases of four to six acres each and the fifth
phase one acre, contingent on the status at that given time of the Donner
lease. Purchase agreement states Charles or Tillie Dormer shall hold lease
as long as they have residence on p_m perty. Residential zoning line diagonally
splits the property including mobile home area located in the southwest corner.
Grading of bank to expected water line will be at a 3;1 ratio. Mining
production rate will be closely related to demand and volume of sales as
dictated by the economy. Enclosed Donner Lease Agreement, Weld County

EXHIBIT E & F RECLAMATION PLAN
Drawing #3. At completion of excavation, affected area shall be merged
with existing water ponds thus forming one larger pond. Average bank elevation
4657 to water surface 4648.5 is 8z feet. This sloping bank will be topsoiled
for natural seeding of sand dropseed, cheatgrass and witchgrass that permiates
the present area. During past years elm and cottonwood trees have randonlly
seeded themselves on the banks of the other existing water ponds.
Primary use for private recreation and fish and wildlife habitation.

EXHIBIT G WATER INFORMATION
Wet mine will directly affect surface of ground water systems.
Dewatering operations cause northeast flow. In 1975 when the pond behind
the office was reexcavated, a neiboring well primarily used for cattle
and irrigation purposes had to be deepened. However the particular site
of this proposed excavation is not expected to have any effect on that well.
Water flow rate: 1500 gallons per minute at beginning of excavation to
4,000 gallons per minute at end of excavation period. Annual volumes: 10 MGD.
National Pollutant Discharge Elimination Systems (NPDES) #C0-0001376
currently on inactive status per letter April 29, 1981 Gary Broetsman
Director Water Quality Control Division.
EXHIBIT H WILDLIFE INFORMATION
COpenland and wetland wildlife. Native pheasant and duck. Population
very sparce with no endangered species. Openland mostly consists of rodent
and insects. Surrounding water ponds provide an occasional landing of water-
fowl, however not sustained for more than a day or two. We have donated
the use of three of our ponds to Colorado State University, Department of
Fishery & Wildlife Biology, Professor and chairman Steven A. Flickinger
for their three year uartisapation in a Federal research study on'largenouth
bass. We have expressed our desire to cooperate in this project and others
extending into the future. The operations of this proposed pit is not
expected to interfer with this ongoing research project.
EXHIBIT I & J SOIL & VEGFTATI ON INFORMATION
Soil: Aquolla and aquents, gravelly substratum, nearly level bottom
land in flood plain area. Topsoil 1 to 4 feet, gravel underneath. Aqualls
not suited to crops as is current condition. Vegetation: Succession weeds
and grasses. U S Department of Agriculture, Soil Conservation Service,

Sloping banks to proper ratio and removing banks between existing
ponds will ba accomplished in operating and nnining costs as nine pro--
greses. Thereby separate costs are difficult to distinguish. Estimate:
$7,000.00 projected on future costs of equipment and manrolrer hourly
rates.

44.2.2.6: The location of all proposed operating structures, parking
areas, ingress and egress, stockpile areas, and circulation routes can
be clearly seen on aerial map included with Exhibit D.
Proposed nine would add two trucks moving from excavation area to
crusher and wash plant site within the boundry of the property. Current
movement of mobile equipment would continue stockpiling aggregate and
delivery of product to public. With the decline in volume of sales
during the past two years, truck traffic has been reduced substanially.
In renewing production we estimate an increase of traffics however it will
not equal the high volume of the year 1979.
With approval of this permit we welcome the cpportmity and responsibility
of manufacturing a quality product for our community in leau of purchasing
some rock for resale and selling sand from our depleating stockpile.
OPERATION POLICIES
No excavation or processing of sand and gravel nearer than.10 feet
to the boundry of adjacent property nor nearer than 125 feet to any existing
residence.
Operation shall be conducted during the hours of daylight except in
case of public or private emergency, or to make necessary repairs to
equipment.
Weeds shall be cut or trimmed as may be necessary to preserve a
reasonably neat appearance and to prevent seeding on adjoining property.
Noise level is not expected to exceed prior operations in the years
between 1958 to 1979. Dust will be controlled through the use of a water
truck as is currently provided on roads around the office and entrance to
the business.
Property has barb wire fence surrounding except for boundry of the
Cashe La Poudre river. Locked gate on dead end North 21st Avenue. Entrance
gates closed on North 25th Avenue after business hours and on weekends.
Property insurance currently under Flood & Peterson, Northern Insurance
Company. Policy dates 7-1-81 to 7-1-82.

research on largemouth bass and black crappie. The interest you have
shown in the outcome and the free rein that you have given Jim in the

with you on fishing regulations to maintain a balanced community of
fish. Any new ponds that you might dig and want to similarly donate
to fishery research would be valuable to my long range goal of learning
enough about fish management in gravel pit ponds to write an. extension
bulletin that would be available to anyone wanting recreational fishing
in gravel pit ponds .

Dear Mrs. Bucklen:
The following is information which you requested regarding existing soil
and vegetative composition on a proposed sand and gravel pit located in
the Wi SW4 Sec. 31, T 6 North, R 65 West, Weld Co. , Colorado.
The soils at this site consist primarily of aquolls and aquents with a
gravelly subsurface located at approximately 48 inches of depth. The
surface texture of these soils varies from loam to clay and is character-
ized by very poor drainage qualities. This often results in a build-up of
Calkaline salts at or near the soil surface.
Existing vegetation consists, for the most part, of primary succession weeds
dominated by kochia and russian thistle, as well as primary and secondary
succession grasses such as cheatgrass, stinkgrass, and sand dropseed. A full
list of plants found on the site and the subsequent range condition can be
found on the attached CO-ECS-1, Range Condition Inventory.
Production on the site is approximately 450 lbs. of air dry ,forage per acre
per year compared to possible production figures of 2500 to 3000 lbs. per
acre per year if the site were in good or excellent condition.

In compliance with the provisions of the Federal Water Pollution Control
Act , as amended (33 U. S.C. 1251 et. seq; the "Act") , and the Colorado Water
Quality Control Act (25-8-101 et. seq. , CRS , 1973 as amended)
Greeley Sand and Gravel Company,
is authorized to discharge from their Gravel Mining Operation ,
located adjacent to North 23rd Avenue and the Cache la Poudre River on the.
Northwest side of Greeley, Weld County, -Colorado,
to the Cache la Poudre River,
in accordance with eTfluent limitations , monitoring requirements and, other
conditions set forth in Parts I , II , and III hereof.
This permit shall become effective thirty (30) days after the date of
receipt of this permit by the Applicant. Should the Applicant choose to
contest any of the effluent limitations , monitoring requirements or other
., -- conditions contained herein , he must comply with Section 24-4-104 CRS 1973 and
the Regulations for the State Discharge Permit System. Failure to contest any
such effluent limitation , monitoring requirement , or other condition is consent
to the condition by the Applicant.
This permit and the authorization to discharge shall expire at midnight ,
March 31 , 1982.
