Street Greeley, Colorado 80631 Re: Recorded Exemption #498 Dear Commissioners : The attached application, plat and related items are in reference to a request from James Tull for "The Miller 640" for a recorded exemption. The parcel of land is described as part of Section 17, T2N, R67W, Weld County, Colorado. The land is located approximately 3/4 mile northeast of Firestone adjacent to Casagrande Estates. The applicant wishes to sell 10 acresfrom a 254.9 acre parcel . The 10 acre parcel is intended to be sold as a residential lot similar to the lots in Casagrande Subdivision. Based upon the information submitted and the adopted policies in the County, the Department of Planning Services Staff recommends the request be approved for the following reasons . 1. The request conforms to the intent clause of the Recorded Exemption Procedure (Section 9-2 of the Weld County Subdivision Regulations) , the intent clause of the Agricultural Zone District (Section 3.3.A. of the Weld County Zoning Resolution) . 2. The adjacent land uses are not intensive agricultural uses and the proposed use will be compatible with the uses in the subdivision. 3. The town of Firestone has no objections to the proposed lot split. However, the Tri-area Planning Commission has requested that the covenants for Casagrande Subdivision be applied to Lot A. It is the opinion of the staff that this is not a condition that can be applied by the County to this application. Planning Dept. 915 Tenth Ave. Greely, Colo. 80631 Dear Sirs: The purpose of this letter is to give you information that will hopefully justify reasons for granting a recorded exemption for a ten acre parcel of land from the remaining 252.979 acre section of land that was a part of Casa Grande Estates. The parcel of land that I wish to purchase is adjacent on two sides to homes that are built on lots of approximate- ly the same size, and 4 mile south of the southwest corner of the lot of interest, and on the same side of the road, there are additional homes all of which are on lots of sim- ilar in size. (see diagram) The land is not presently used for agriculture nor is this particular piece suitable for the same as approximate- ly 1 /3 of this parcel has surface water (boggy) and has traces of alkali in the soil. Additionally, the house must be built on the northwest corner as it is the only area which would be suitable due to this water problem, therefore it would be im- possible for anyone to try to redev.de this parcel in the future. The lot size is consistant to that of the surrounding homes and it will not interfere with present or future agri- culture in any way. There are numerous water taps available from Central Weld Water for this parcel and the remaining 242.979 acres of land. All other utilities are available and would present little if any additional burden, and there are no known prob- lems with septic systems and. I have already tested the percula- tion and also had my contractor check the same. I have also been told that the city limits of Firestone have been extended to approximately i mile from this prop- erty.
