RESOLUTION
RE: APPROVAL OF USE BY SPECIAL REVIEW FOR OIL AND GAS PRODUCTION
FACILITIES - LUNDVALL OIL AND GAS COMPANY
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , the Board of County Commissioners held a public
hearing on the 16th day of November, 1983 , at the hour of 2 : 00
o'clock p.m. in the Chambers of the Board for the purpose of
hearing the application of Lundvall Oil and Gas Company, c/o
Elmer Lundvall, 1770 25th Avenue, Greeley, Colorado 80631, for
a Use by Special Review for oil and gas production facilities on
the following described real estate, to-wit:
Part of the S2 SEa and the NA SEa, Section
10 , Township 5 North, Range 66 West of the
6th P.M. , Weld County, Colorado
WHEREAS, Section 24. 4 . 2 of the Weld County Zoning Ordinance
provides standards for review of said Use by Special Review, and
WHEREAS , the Board of County Commissioners heard all of the
testimony and statements of those present, has studied the re-
quest of the applicant and the recommendations of the Weld County
Planning Commission and all of the exhibits and evidence pre-
sented in this matter, and having been fully informed, finds
that this request shall be approved for the following reasons :
1. The submitted materials are in compliance with the
application requirements of Section 24. 7 of the Weld
County Zoning Ordinance.
2 . It is the opinion of the Board of County Commissioners
that the applicant has shown compliance with Section
24 . 4. 2 of the Weld County Zoning Ordinance as follows :
a. The proposal is consistent with the Weld County
Comprehensive Plan policies and the residential
zone district location. The subject site is
located on the Aims Community College campus.
b. The attached Operation Standards will make the
proposal compatible with existing and future
development of the surrounding area as permitted
by the existing zoning and with future develop-
ment as projected by the Comprehensive Plans of
the City of Greeley. The Comprehensive Plans
indicated residential development for this area.

RE: USR - LUNDVALL OIL AND GAS COMPANY
c. The Greeley Planning Commission recommended
conditional approval in a meeting on October 11,
1983 . These conditions are addressed in the
Operation Standards.
d. The proposal is consistent with the intent of
the residential zone district and is provided for
as a Use by Special Review.
e. The Use by Special Review Operation Standards
provide adequate protection of the health, safety
and welfare of the neighborhood and the County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the application for
a Use by Special Review for oil and gas production facilities
on the herinabove described parcel of land be, and hereby is,
granted subject to the following conditions :
1. The adoption of the attached Operation Standards for
the Use by Special Review.
2 . The plat for the Use by Special Review Permit shall be
recorded at the Clerk and Recorder' s Office prior to
any additional drilling or issuance of building permits.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 16th day of
November, A.D. , 1983.

OPERATION STANDARDS

Lundvall Oil & Gas Co.
1. The permitted use shall be an oil and gas production facilities as
described and located in the submitted application materials and plat
maps on file with the Department of Planning Services.
2. The proposal shall comply with the Use by Special Review Operation
Standards listed in Section 24.6 et seq. , of the Weld County Zoning
Ordinance.
3. The proposal shall comply with the Use by Special Review Design Standards
listed in Section 24.5 et seq. , of the Weld County Zoning Ordinance.
4. The tank battery cluster shall be designed and landscaped to meet the
following minimum standards:
- The tank batter cluster shall be located as identified on sheet 2 of
the Use by Special Review map;
- The tank battery site shall be bermed to contain the total volume of
one (1) three hundred (300) barrel tank;
- A six (6) foot chain link fence with a three (3) strand barb wire
top shall enclose the tank battery cluster area;
- The body of all tank batteries shall be painted in earth tone
colors. The tank batteries shall be maintained in a neat and
orderly manner through periodic painting and maintenance;
- Spruce and evergreen trees shall be planted around the tank battery
site at intervals of twenty (20) feet. The trees shall be located
ten (10) feet from the chain link fence. The trees shall be a
minimum height of three (3) feet below the top of the tank battery
at the time of transplanting;
- The tank batteries shall be placed on a one and one-half (1') foot
gravel pad, three (3) feet below ground level;
- Fencing and painting shall be completed thirty (30) days after the
installation of the first tank battery. Landscaping can be delayed
until April 15, 1984, (Spring Planting Season) to insure survival
and growth of trees.
5. Only hydraulic type pumps shall be used in conjunction with the oil and
gas production facilities.
6. The proposal shall comply with all applicable City of Greeley Ordinances
pertaining to oil and gas uses.
7. Drilling mud must be disposed of on sandy soils or in pits, either
on-lease or with the permission of the property owner whose land is
impacted by the deposition of the drill mud off-lease.
8. Production water must be disposed of by re-injection at an approved site
or by trucking it to an authorized brine water receiving facility.
9. Noise standards as delineated in C.R.S. 25-12-101 et seq. , must be
maintained.
10. A fugitive dust abatement program of watering the haul roads shall be
implemented to suppress the dust caused by vehicle movement in the Use by
Special Review area.
11. A "Special Transport" permit is required for moving oil rigs on County
roads.

12. The Use by Special Review shall be limited to the plans shown hereon and
governed by the Standards stated above and all applicable Weld County
regulations. Any material deviations from the plans and/or Standards, as
shown or stated above, shall require the approval of an amendment of the
Permit by the Weld County Planning Commission and the Board of County
Commissioners before such changes from the plans and/or Standards are
permitted. Any other changes shall be filed in the office of the
Department of Planning Services.
13. The property owner and/or operator of this operation shall be responsible
for complying with all of the above stated standards. Noncompliance with
any of the above stated standards may be reason for revocation of the
Permit by the Board of County Commissioners.

I hereby certify that pursuant to a notice dated October 24, 1983, and duly
published in the La Salle Leader on November 3, 1983, a public hearing was
held for the purpose of considering the request from Lundvall Oil and Gas
Company for a Use by Special Review for oil and gas production facilities. Russ Anson,
Assistant County Attorney, read this request into the record. Rod Allison,
Planning Department representative, read the favorable recommendation of the
Planning Commission the recommenced conditions and Development Standards.
Elmer Lundvall came forward to answer questions of the Board. Mr. Lundvall
answered in the affirmative when asked if he believed the Standards to be
proper. After a short discussion, Commissioner Martin moved to approve this request
and to include the conditions and Development Standards. Commissioner
Brantner seconded the motion and it carried unanimously.

1. The permitted use shall be an oil and gas production facilities as
Aescribed and located in the submitted application materials and plat
maps on file with the Department of Planning Services.
2. The proposal shall comply with the Use by Special Review Operation
Standards listed in Section 24.6 et. seq. , of the Weld County Zoning
Ordinance.
3. The proposal shall comply with the Use by Special Review Design Standards
listed in Section 24.5 et. seq. , of the Weld County Zoning Ordinance.
4. The tank battery cluster shall be designed and landscaped to meet the
following minimum standards:
- She tank batter cluster shall be located as identified on sheet 2 of
the Use by Special Review map.
- The tank battery site shall be bermed to contain the total volume of
one (1) three hundred (300) barrel tank.
- A six (6) foot chain link fence with three (3) strand barb wire top
shall enclose the tank battery cluster area.
- The body of all tank batteries shall be painted in earth tone
colors. The tank batteries shall be maintained in a neat and
orderly manner through periodic painting and maintenance.
- Spruce and evergreen trees shall be planted around the tank battery
site at intervals of twenty (20) feet. The trees shall be located
ten (10) feet from the chain link fence. The trees snail be
minimum height of three (3) feet below the top of the tank batter)
at the time of transplanting.
- The tank batteries shall be placed on a one and one-half (11/2) fpot
wncrete pad, iDtrr-and--one=half- (412)._f + h ----gr d---Ievez. ^ {
- Fencing and painting shall be completed thirty (30) days after the
installation of the first tank battery. Landscaping can be delayed
until April 15, 1984 (Spring Planting Season) to insure survival and
growth of trees.
5. Only hydraulic type pumps shall be used in conjunction with the oil and
gas production facilities.
6. The proposal shall comply with all applicable City of Greeley Ordinances
pertaining to oil and gas uses.
7. Drilling mud must be disposed of on sandy soils or in pits, either
on-lease or with the permission of the property owner whose land is
impacted by the deposition of the drill mud off-lease.
8. Production water must be disposed of by re-injection at an approved site
or by trucking it to an authorized brine water receiving facility.
9. Noise standards as delineated in C.R.S. 25-12-101 et. seq. , must be
maintained.
10. A fugitive dust abatement program of watering the haul roads shall be
implemented to suppress the dust caused by vehicle movement in the Use by
_Special Review area.
11. A "Special transport" permit is required for moving oil rigs on County
roads.
12. The Use by Special Review shall he limited to the plans shown hereon and
governed by the Standards stated above and all applicable Weld County
regulations. Any material deviations from the plans and/or Standards, as
shown or stated above, shall require the approval of an amendment of the
Permit by the Weld County Planning Commission and the Board of County
Commissioners before such changes from the plans and/or Standards are
permitted. Any other changes shall be filed in the office of the
Department of Planning Services.
13. The property owner and/or operator of this operation shall be responsible
for complying with all of the above stated standards. Noncompliance with
any of the above stated standards may be reason for revocation of the
Permit by the Board of County Commissioners.

Dear Mr . Allison:
I am enclosing a request to modify the application for use by
special review to include three wells on the Aims College
property, one of which has been drilled and two of which are
proposed. The application for use by special review is
applicable in all respects to the three wells because all
property is owned by Aims Junior College District and Lundvall
Oil and Gas Company is the lessee of the total owned property.
The only change will be the additional well site locations which
are depicted upon a milar map which will be delivered to you in
a few days by Elmer E. Lundvall. In all other respects the
application and supporting information is the same.
I am also enclosing the names and addresses of all persons who
own property 500 feet distant from the peripheral boundaries of
the Aims Junior College District property. This list was pre-
pared by Stewart Title of Greeley. I might mention that each of
the well site locations is more than 600 feet from the Aims
Junior College boundary line . As you are aware, it seems as
though the interpretation of the regulations should be that the
applicable parcel is the actual well site location rather than

all of the Aims Junior College District property; however, in
order to expedite this, we went ahead and incurred the substantial
expenses incident to obtaining the names of all people owning
property within 500 feet of the Aims property.
The milar map to be delivered to you also shows the location of
the above-ground tank batteries which will be utilized in
connection with the production. If necessary, we would like the
location of the tank batteries to be included within the
application for use by special review to avoid the necessity of
requiring special review consent at the time the tank batteries
are to be constructed.
If you have any questions or if there need be any further
information furnished, please advise me. Additionally, I would
appreciate your advising me of the dates that the City of Greeley
Planning Commission will review the application and the date of

AMENDED STATEMENT AND INFORMATION IN SUPPORT OF
DRILLING AN OIL AND GAS WELL ON PROPERTY OF
AIMS JUNIOR COLLEGE DISTRICT
Pursuant to the procedural guide for use by special
review application, Lundvall Oil and Gas Company submits the
following :
The proposed oil and gas wells are located on property
of Aims Junior College District which is presently utilized for
farming purposes . As reflected on the attached survey, the wells
and tank battery locations are 660 feet from all property boun-
daries . Aims Junior College District selected the drill sites
and placed the same so that it would not interfere with develop-
ment of the property nor interfere with existing uses . The wells
are also set back from property lines sufficiently far that it
swill not interfere with surrounding property. Although the pro-
perty is zoned R-1, the intended use of the property and all
surrounding property is for public school structures owned and
operated by Aims Junior College District -which makes the opera-
tions more private in nature than public, as in the case of deve-
lopment with immediately adjacent property owners . It should
also be noted that this property is likely to be annexed into the
City of Greeley within a reasonable period of time and that the
development proposed is consistent with City of Greeley ordinan-
ces and regulations . In further support of this application, it
is submitted :
( a) That the proposed oil and gas development is con-
sistent with the Weld County Comprehensive Plan.
(b) That the proposed development is a permitted use
within the District.
(c) The proposed development is compatible with
existing surrounding uses in that the present use
is agricultural and the development only minutely
affects the agricultural production . Further , the
-development is sufficiently set back from
surrounding properties as to not interfere with
their existing uses .
(d) The development of the proposed oil and gas wells
are identical with a prior oil and gas well drilled
within the City of Greeley and does not interfere
with the City' s comprehensive or master plans.
(e) The oil and gas wells are gas driven and there is
therefore no need for pumping facilities . The well s
ites will have no significant equipment. The only
significant above-ground equipment will be storage
batteries which will be set back from existing

Gentlemen:
Lundvall Oil and Gas Company commenced drilling a test well on
property owned by Aims Junior College District . At the time of
commencement of drilling , it was not known that the property had
been zoned R-1 by the County. Prior to commencement of drilling ,
there had been substantial research and planning done by Aims
College for selection of a drill site and the leasing of the pro-
perty and operation of the oil and gas well has been previously
determined by Aims Junior College District to be in its best
interest and to not interfere with its operations as a public
school . Although this request is not supported by all of the
information requested in the procedural guide , we request that
the Board of County Commissioners temporarily allow continued
operations based upon undue hardship. For your information, the
well is partially drilled and the drilling rig must maintain its
present location to keep mud circulation in the drilled hole .
The applicant is willing to pursue the application for special
review permit and provide all required information at a later
date . It is , however , urgent that the drilling by permitted to
continue .
The operation on the Aims property is significantly different
from operations on smaller tracts in that the well setback and
the size of the Aims property is sufficient to preclude any
harm, injury or damage to surrounding property or the owners

thereof . It is therefore inconceivable that that County would
find any basis on which to deny the permit . In any event , if the
permit were not granted , the risk of loss would be on the appli-
-cant .
For your information , a title search of the public records has
been made and all of the mineral rights are owned by Aims , and
Lundvall Oil and Gas Company is the lessee of all minerals .

STATEMENT AND INFORMATION IN SUPPORT OF
DRILLING AN OIL AND GAS WELL ON PROPERTY OF
AIMS JUNIOR COLLEGE DISTRICT
Pursuant to the procedural guide for use by special
review application, Lundvall Oil and Gas Company submits the
following:
The proposed oil and gas well is located on property of
Aims Junior College District and is presently utilized for
farming purposes . As reflected on the attached survey, the well
site is 660 feet from all property boundaries . Aims Junior
College District selected the drill site and placed the same so
that it would not interfere with development of the property nor
interfere with existing uses . The well is also set back from
property lines sufficiently far that it will not interfere with
surrounding property. Although the property is zoned R-1, the
intended use of the property and all surrounding property is for
public school structures owned and operated by Aims Junior
College District which makes the operations more private in
nature than public , as in the case of development with imme-
diately adjacent property owners . It should also be noted that
this property is likely to be annexed into the City of Greeley
within a reasonable period of time and that the development pro-
posed is consistent with City of Greeley ordinances and regula-
tions . In further support of this application, it is submitted:
(a) That the proposed oil and gas development is con-
sistent with the Weld County Comprehensive Plan.
( b) That the proposed development is a permitted use
within the District .
( c) The proposed development is compatible with
existing surrounding uses in that the present use
is agricultural and the development only minutely
affects the agricultural production. Further , the
development is sufficiently set back from
surrounding properties as to not interfere with
their existing uses .
(d) The development of the proposed oil and gas well is
identical with a prior oil and gas well drilled
within the City of Greeley and does not interfere
with the City' s comprehensive or master plans .
(e) The oil and gas well is gas driven and there is
therefore no need for pumping facilities . The well
site will have no significant equipment . The only
significant above-ground equipment will be storage
batteries which will be set back from existing
developments a distance sufficient to preclude
health , safety or welfare damage .

Our comments are as follows :
1 . Drilling mud must be disposed of on sandy soils or in pits,
either on-lease or with the permission of the property owner
whose land is impacted by the deposition of the drill mud
off-lease.
2. Production water must be disposed of by re-injection at an
approved site or by trucking it to an authorized brine water
receiving facility.
3. Noise standards as delineated in C. R.S. 25- 12- 101 et. seq.
must be maintained.
4. Fugitive dust emissions in the drilling stage from vehicle
movement must be minimized with dust abatement procedures
(usually : water the haul roads periodically to suppress the
dust) .
