RE : APPROVAL OF SERVICE PLAN FOR THE PROPOSED LEFT HAND
WATER DISTRICT .
WHEREAS, the Board of County Commissioners of Weld
County, Colorado , pursuant to Colorado statute and the Weld
County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado , and
WHEREAS , Left Hand Water Supply Company is seeking to
form the Left Hand Water District , and
WHEREAS, the Board of County Commissioners of Weld
County, Colorado held a public hearing on the 26th day of
March, 1980 at the hour of 2 : 00 o ' clock p .m. in the Chambers
of the Board of• County Commissioners for the purpose of
considering the service plan of the proposed Left Hand Water
District. The proposed district contains portions of the
lands generally located within the following area:
Sections 1 , 2 , 3 , 5 , 6 , 8 , 9 , 10 , 11 , 12 ,
13 , 14 , 15 , 21 , 22 , 23 , 24 , 26, 27 , 28 ,

WHEREAS , the Board has considered the criteria outlined
in Section 32-1-205 , CRS 1973 , which specifically states
that :

"32 -1- 205 . Service plan criteria. (1) The board
of county commissioners may disapprove the service
plan submitted by the petitioners of a proposed
special district upon satisfactory evidence that :
(a) There is insufficient existing and projected
need for organized service in the area to be
serviced by the proposed district ; or
(b) The existing service in the area to be served
by the proposed district is adequate for present
and projected needs ; or
(c) Adequate service is, or will be, available to
the area through municipal annexation by other
existing municipal or quasi-municipal corporations
within a reasonable time and on a comparable
basis ; or
(d) The proposed special district is incapable of
providing economical and sufficient service to the
area within its proposed boundaries ; or
(e) The area to be included in the proposed
district does not have, or will not have , the
financial ability to discharge the proposed
indebtedness on a reasonable basis ; or
(f) The facility and service standards of the
proposed district are incompatible with the
facility and service standards of adjacent muni-
cipalities and special districts ; or
(g) The proposal is not in substantial compliance
with a master plan adopted pursuant to section 30 -
28-110 , C.R. S. 1973 ; or
(h) The proposal is not in compliance with any
duly adopted county, regional , or state long-range
water quality management plan for the area.
WHEREAS , the Board finds that there has not been suf-
ficient evidence to show that any of the aforementioned
criteria for disapproval contained in Section 32 -1-205 , CRS
1973 , exist .
WHEREAS, the Board deems it advisable to approve the
service plan for the proposed Left Hand Water District.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado that the service plan
for the proposed Left Hand Water District be , and hereby is ,
approved.
The above and foregoing Resolution was , on motion duly
made and seconded, adopted by the following vote on the 26th
day of March, A.D. , 1980 .

The following business was transacted:
I hereby certify that pursuant to a notice dated February 20, 1980
and duly published February 21, 28 and March 6, 1980 in the Platteville
Herald a public hearing was held. for the purpose of considering the
service plan of the proposed Left Hand Water District. Said hearing is
- a continuation of the March 12,. 1980 scheduled hearing.
Mr. Anson made the record and reviewed for the Board the Colorado
Statute governing this request. He read to the Board the criteria
they may use in making theiridetermination.
Mr. lonn read the Planning Commission' s favorable recommendation.
Mr. Jimmie Joe Honaker, attorney for the proposed. Left Hand Water
District, introduced David Coleson, manager and Alva Dodd, director
for the Left Hand Water Supply Co. Mr. Honaker explained that the
presently operating Left Hand Water Supply Co. wishes to change its
legal form to a statutory water district. Mr. Honaker continued by
describing the current and proposed service area and the advantages
this request holds for the applicant.
Gary West, Circut Rider Manager, for the Towns of Firestone and Erie was
present and 'listed his concerns with said request. The concerns Mr. West
has are with the Boulder County portion of the proposed water district.
He has no problems with the area located in Weld County.
No one was present in opposition to the request.
Commissioner Roe made a motion to approve the service plan of the proposed
Left Hand Water District. Commissioner Dunbar seconded the motion and
it carried unanimously.

The following business was transacted:
I hereby certify that pursuant to a notice dated February 20, 1980 and
duly published February 21, 28, and March 6, 1980 in the Platteville Herald
a public hearing was held on the request of LEFT HAND WATER DISTRICT for
a proposed SERVICE PLAN.
The applicants attorney, Jimmie Joe Honaker, was not present.
Mr. Anson stated Mr. Honaker had been in contact with him and wished to
postpone this hearing. Mr. Honaker had not had ample time to give notice
to all taxing entities within three miles of the proposed district. Said
notice is required by State statutes.
Gary West, representing the Towns of Erie and Firestone, was present.
Mr. West stated Erie and Firestone had not been notifyed by the water
district of this hearing.
The Chairman called a recess to contact Mr. Honaker to assist the Board
in determining a date for the continuation of this hearing.
The Chairman reconvened the meeting and noted that Mr. Honaker was
enroute to the hearing.
Commissioner Steinmark made a motion to table this matter until completion
of the next scheduled hearing for today, DOC # 80-12, Geological Hazards
and Floodplains. Commissioner Carlson seconded the motion and it carried
unanimously.
The Chairman reconvened the hearing for DOC # 80-17 , Service Plan of the
Proposed Left Hand Water District.
Mr. Honaker was now present and requested a continuation of this hearing.
Discussion was held concerning the date for the continuation hearing.
The Chairman called a recess to check the Boards schedule.
The Chairman reconvened the hearing.
Commissioner Carlson made a motion to continue DOC #80-17 until 2 : 30 PM
on Wednesday March 26, 1980. Commissioner Steinmark seconded the motion
and it carried unanimously.

NOTICE is hereby given of a hearing before the Board of County
Commissioners of Weld County, Colorado, on the 12th day of March,
1980 at the hour of 2:00 P. M. in the Weld County Commissioners
hearing room, first floor, Weld County Centennial Center, 915 10th
Street, Greeley, Colorado, for the purpose of considering the
service plan of the proposed Left Hand Water District. The notice
is given pursuant to the Special District Control Act, Section 32-1-201,
et seq. , CRS 1973, as amended.
Copies of the Service Plan are on file at the Office of the Clerk
to the Board of County Commissioners located on the 3rd floor, Weld
County Centennial Center, 915 10th Street, Greeley, Colorado and
may be inspected during regular business hours.
Within 20 days after the completion of the hearing, the Board of
County Commissioners will consider the approval of the Service Plan.
All interested parties under the law will be afforded an opportunity
to be heard at said hearing. •

REQUEST BE FOR THE FOLLOWING REASONS :
The Department of Planning Services staff is unable to make a
recommendation at this time . The staff has not had adequate time
to review the additional document submitted Monday afternoon, March 3.
We have also been unable to review the following documents requested
in a meeting with Mr. Dave Coleson and Mr. Jim Honaker on February
21 , 1980.
The staff feels that the following documents are
necessary in order to adequately review the service plan in accordance
with the provisions of the state statutes:
1. a letter from Brock, Cordle and Associates , Certified Public
Accountants specifically addressing the financial capability
of the proposed district, •
2. a letter from a public health department or other water testing
agency describing the quality of the company' s existing water supply,
3. a letter from an engineering firm describing the adequacy of the
existing facilities in comparison with adjacent municipalities and
facilities , and
4. a letter from an engineering firm describing the districts plans to me
the needs of expected future expansion,
The Department of Planning Services also requests a list of all
taxing and other special districts and municipalities for proper
notification with regard to the provisions of the statute (and
as discussed February 21, 1980) .

Dear Commissioners:
The Town of Erie would have several concerns with the proposal
to form a water district under the provisions of CRS 32-1-201.
These concerns are as follows:
1. Although the proposal by Left Hand denies the intention of
levying a tax upon the district lands for capital improve-
ments, this remains their right under the statute. Their
district boundries include approximately 900 acres of land
within the corporate limits of the Town of Erie. This
opens the possibility of "double taxation" because under
present Town ordinances, the land would not be eligible for
service by Left Hand, but could be taxed by Left Hand for
the "availability of service" and for plant capacity to
service other district lands.
2. Left Hand has not approached the Town of Erie in recent
years regarding a service area agreement such as I under-
stand they may have with the cities of Boulder and Longmont.
The Town does service several water taps outside the corpor-
ate limits of the Town and within the present Left Hand
service area. I feel that such agreements should be approved
prior to the incorporation of the District. Again this could
avoid the "double taxation" question.
3. It is my understanding that any Northern Colorado Water Con-
servancy District water supplied by Left Hand cannot be co-
mingled with con-Conservancy District water. This means that
a seperate wastewater treatment system would be required to
treat any wastewater produced by the users of Left Hand water.
This would add a considerable expense to the residents of Erie,
if Left Hand were permitted to supply water to the portion of
Erie in Boulder County or areas serviced by the Erie Water and
Sanitation District. Because of the Town's Management Agency
responsibilities under the DRCOG 208 Plan, this is of great
concern to the Town.
4. I believe that the full effects of this proposal should be
assessed against the "201" plans adopted by the Erie Water
and Sanitation District and other sanitation districts in the
general area as well as the "208" plans for the region. I 'm
sure you are aware that the provision of domestic water is
the key for all future growth on the Front Range. I believe
the growth this proposal could foster should be fully assessed
before it is approved.

5. Incorporation of Left Hand into a Water District could pose
additional problems for Weld County with spin-offs for the
Town of Erie. With the imposition of another taxing author-
ity which also has the ability to supply domestic water, the
County will be faced with additional pressures from develop-
ers to convert present farmland into residential development.
Such pressures would undoubtedly come from areas presently
designated to remain in agriculture by the Boulder County
Comprehensive Plan, areas which heretofore were not likely
candidates for development because of unavailability of water.
Water which could be provided through the taxing authority
and if the property is being taxed to support the development
of water, I feel the property is entitled to receive it. The
spin-off for the Town is in increased demands for other serv-
ices, schools, recreation, etc. prompted by the additional
growth.
6. Special District status could enhance Left Hand's ability to
obtain state and federal financing for expansion to accommodate
growth. From the fiscal standpoint that is a good deal for
Left Hand, however, it may encourage them to unnecessarily
expand plant and service capacity and therefore feed unwise
growth.

approve the service plan of a proposed district upon satisfactory
evidence that it does not comply with one or more of the criteria
enumerated in subsection (1) of this section. Final approval shall
be contingent upon modifiaction of the service plan to include
such changes or additional information as shall be specifically
stated in the findings of the board of county commissioners.
(3) The findings of the board of county commissioners shall
be based solely upon the service plan and evidence presented at
the hearing by the petitioners, planning commission, and any
interested party.

record in water service without interruption and as regards the water quality
{ from the existing treatment facility, the State of Colorado has twice com-
mended Left Hand for processing water which rates second or third in the

TO WHOM IT MAY CONCERN:
The Left Hand Water Company is located approximately three (3) miles north of Boulder
City Limits. The Company currently supplies domestic water to the northeast portion
of Boulder County and southwest Weld County,
The Boulder County Health Department has inspected the Left Hand Water Supply Company,
according to records, since 1965. However, this letter will only address the status of
the Left Hand Water Supply Company for the past five (5) years.
Within the last five (S) years, Left Hand has continually provided quality water to
their users. The Company has replaced water lines for reasons-other'than "old lines".
The Boulder County Health Department works in conjunction with the State Health Depart-
ment on inspection of all community water supplies in Boulder County. At times, our De-
partment has received complaints regarding Left Hand Water as to its quality. So far
these complaints have not been justified for one reason or another.
A total of seven samples per month are taken from different areas on the distribution
system and culture tested at the Boulder County Lab. To date, this Department has
had no unsafe samples. This is mainly due to the quality of personnel employed at the
Left Hand Water Supply Company and their high regard for supplying quality water.
The Company has good communication with Local and State agencies regarding suspect
problems within their service area. Prior to any decision that would possibly effect
the quality of water, notification is given to the Local and State agencies for com-
ments and recommendations.
This department is grateful to the personnel of the Left Hand Water Supply Company for
their interest in maintaining a high quality of water and to continually increase the
technology of the p ant.

Left Hand Water Supply Company (the Company) is in the process
of attempting to reorganize as a special district to be named Left Hand
Water District (the District) . We understand that all of the assets and
liabilities of the Company will be assumed by the District. Additionally,
we understand that the District will continue to operate essentially in
the same manner as the Company has operated.
The Company has furnished you with copies of its financial
statements as of and for the years ended December 31 , 1973 through Decem-
ber 31, 1979. The financial statements demonstrate that the Company has
operated profitably during that period.
Left Hand Water Supply Company has been in existance since
1962. Since 1962 it has been able to discharge its indebtedness on sched-
ule and appears to have complied with all other conditions required by
the terms of the debt agreements.
We are currently not aware of any reason which would lead us
to believe that the District will not be able to discharge its indebted-
ness in the future in the same manner as the Company has in the past.

NOTE 1 - SUMMARY OF SIGNIFICANT ACCOUNTING POLICIES
Property, Plant and Equipment. Property, plant and equip-
ment are recorded at cost except for certain water rights and
subdivision water lines which were contributed by developers,
subdividers and members . These contributed assets are recorded
at the estimated market value on the date of transfer.
The provision for depreciation is computed using the
straight-line method over the estimated useful lives of the
assets. The lives used are as follows:

Buildings and leasehold improvements 7 to 50
Equipment 3 to 10
Expenditures for maintenance and repairs are charged to opera-
tions as incurred. Property replacements and betterments which
extend the lives of assets are capitalized and subsequently de-
preciated.
Amortization. Initial organization costs consisting of var-
ious legal fees and supplies were being amortized using the
straight-line method over 50 years prior to 1979. As is further
discussed in Note 5 the Company began to reorganize as a special
district during 1979. Accordingly , management felt the useful
life of these organization costs terminated in 1979 and the re-
maining balance was charged to amortization expense in that year.
Costs incurred in 1979 relating to the formation of the special
F district are recorded as organization costs as of December 31 ,
1979. These have not been amortized during 1979 and will not be
until operations are begun as a special district.

Contributions in Aid of Construction. Contributions of cash
u and property to the Company by developers, subdividers and mem-
m bers are treated as additions to members ' equity and not as in-
come. Substantially all contributions received in 1979 and 1978
consisted of cash.

Farmers Home Administration. Substantially all assets owned
mw by Left Hand Water Supply Company are mortgaged to the Farmers
Home Administration in connection with loans which totalled

The annual payments due January 1 , 1980 were made in December,
1979.
In 1974, the Farmers Home Administration authorized $468 ,000
to be loaned to the Company for transmission and distribution
system enlargement. Of this authorization, $375,000 has been
used. The Company intends to use the remaining $93 ,000 to finance
transmission and distribution system construction in 1980.
In 1976, the Farmers Home Administration authorized $935,000
in additional loans. Of this authorization, $784,000 has been
used. The Company intends to use the remaining $151 ,000 to fi—
nance other transmission and distribution system construction
to be started in 1980.
The loan agreements provide that if the Company can obtain
financing from other sources at reasonable rates and terms and
a similar periods of time, the Farmers Home Administration can
w require the Company to refinance all or part of the outstanding
indebtedness.

Note Payable. The note payable in the amount of $89,285
arose as a result of the purchase of water rights from an indi-
vidual . The note is collateralized by the water rights purchased.
The note requires annual principal payments of $17,857 plus in-
terest at 8%. The last payment is due April 11 , 1984.

w NOTE 3 - COMMITMENTS AND CONTINGENCIES
The Company leases office and storage facilities in Niwot,
Colorado from The Colorado and Southern Railway Company under an
agreement requiring annual rental payments of $109. The agreement
further provides that the lease may be terminated by either party
on thirty days' notice.

NOTE 4 - RESTRICTED CASH
Cash in the FmHA reserve accounts is restricted for use in
meeting reserve requirements of the mortgages payable to the
Farmers Home Administration. The loan agreements with the Farmers
Home Administration require the Company to make an annual minimum
reserve deposit of $28,767. A deposit of $33,716 was made in
1979. Similar deposits will be required in future years until the
reserve account balance equals $343 ,800. Disbursements from re-
stricted accounts require the approval of officials of both the
Farmers Home Administration and the Company.
NOTE 5 - RESTRICTED WATER RIGHTS
During 1979, the Company entered into an agreement with
a housing developer under which water rights with a market value
of $126 ,825 were transferred to the Company. If the developer
is unable to obtain approval from various governmental entities
for a proposed housing development, the water rights revert to
the developer. If the development is approved, the Company will
record the acquisition of these water rights as a partial payment
of the membership fees the developer would then be required to
pay. As of December 31 , 1979 these water rights are reported as
restricted assets and the related liability is reflected in other
current liabilities. When the development is approved the water
rights will be reported in land and water rights and the lia-
bility will be eliminated and members equity increased.
NOTE 6 - REORGANIZATION OF THE COMPANY
During 1979, the Company began the process of reorganizing
as a special district under the laws of the State of Colorado.
This process should be completed during 1980. When the final
approval of the formation of the special district is given by
ithe courts, all of the assets of Left Hand Water Supply Company
will be transferred to the new District. The District will also
assume all of the liabilities of the Company.

NOTE 7 - MEMBERSHIP FEES
u The members of the Company consist of individuals and enti—
m ties which own property that is served by the Company. Member—
ship fees are the assessments made by the Company when it agrees
to provide water to the prospective members. These fees consist
of money and water rights (or money approximating the then cur-
rent value of water rights). When the fees are received, addi-
u tions to equity are recorded. Membership in the Company transfers
wwith the title to the property which is being served.
