Further, the proposed type of develop- ment, governed by Protective Covenants, as amended by the Board, will preserve the agri- cultural nature of the land while allowing resi- dential use of the land. A public hearing was conducted on October 4 , 1984, at 2:00 P.M. , with the following present: Commissioner Norman Carlson, Chairman - Excused Commissioner Jacqueline Johnson, Pro-Tem Commissioner Gene Brantner Commissioner Chuck Carlson - Excused Commissioner John Martin Also present: Acting Clerk to the Board, Mary Reiff Assistant County Attorney, Lee D. Nbrrison and Bruce Parker Planning Department Representative, Rod Allison The following business was transacted: I hereby certify that pursuant to a notice dated August 27, 1984, and duly pub- lished August 30 and September 19, 1984, in the La Salle Leader, a public hearing was conducted to consider the Final Plan for a Planned Unit Development Subdivision (7 residential homesites and the raising, breeding, showing and shoeing of horses) , submitted by William Ray Adams, Sr. Assistant County Attorney Lee Morrison read this request into the record. Rod Allison, Planning Department representative, read the favorable recommendation of the Planning Commission into the record, stating that the applicant has met Conditions 1 and 2. Mr. Allison also stated that the Planning Staff recommends that Conditions 3, 4, 5 and 6 should be placed as notes on the Final Plat for this Planned Unit Development Subdivision. After a question from Commissioner Brantner discussion was held concerning the value of having those notes on the Final Plat and concerning previous actions concerning this request. Mr. Adams came forward to present his request and to answer questions of the Board. Linda McKenna came forward to make comments, stating that she is waiting to buy a lot in this area. Let the record reflect that Lee Morrison is no longer present. After discussion, Commissioner Martin moved to approve the Final Plan for this Planned Unit Development Subdivision. Commissioner Brantner seconded this motion and it carried unanimously. Prior to this hearing, the Board considered the request of William Ray Adams, Sr. for the vacation of Weld County Road right-of-way at the extreme North edge of this subdivision. The request was to vacate a 30 foot wide right-of-way extending • across the North end of the Wi, Section 14, Township 1 North, Range 66 West of the 6th P.M. for the purpose of maintaining a private access roadway. Mr. Morrison explained this request to the Board. Commissioner Martin moved to vacate said Weld County Road right-of-way. Commissioner Brantner seconded the motion and it carried unanimously. Lupton reviewed this request and recommends approval in a memo dated May 9, 1984; S-233:84:5 William Ray Adams, Sr. A final Planned Unit Development Plan Subdivision Part of the 141/2, Section 14, T1N, R66W of the 6th p.m. , Weld County, Colorado June 5, 1984 Page 2 - The Final Planned Unit Development plan conforms with the Performance Standards outlined in Section 35.3 of the Weld County Zoning Ordinance, subject to conditions as listed below; - No overlay districts affect the Final Planned Unit Development Plan. These determinations are based, in part, upon a review of the information submitted by the applicant, other relevant information regarding this request and responses of referral entities which have reviewed the request. The Planning Commission recommendation for approval is conditional upon the following: 1. Prior to scheduling the Final Planned Unit Development Plan for a public meeting before the Board of County Commissioners. the Final Planned Unit Development Plat shall be amended to show a common -open -space horse riding trail easement across the southern property lines of lots 1, 3, 5, 6 and 7. The open-space easement shall be a minimum of fifteen (15) feet in width. A note shall be placed on the plat explaining the intent of the open-space easement and that its use shall be available to all lots within the Planned Unit Development. The warranty deeds to all lots within the Planned Unit Development shall reference the common-open-space requirements of the Final Planned Unit Development Plan. Evidence of an organization established solely for the ownership and maintenance purposes of the open-space area shall be noted on the Final Planned Unit Development plat along with protective covenants. The covenant regarding open space shall run to the benefit of all lots within the Planned Unit Development District and be enforceable by owners of said lots or the Board of County Commissioners of Weld County. 2. Prior to scheduling the Final Planned Unit Development Plan before the Board of County Commissioners, the Weld County Engineering Department shall approve all points of access serving the lots within the Planned Unit Development District and accept for maintenance that portion of Weld County Road Ten (10) abutting lots two (2) and four (4) of the Planned Unit Development District. 3. Major utilities are present on the western boundary of this proposal: Amoco gas pipelines, Amoco petroleum pipelines, and a high powered transmission line. Country Estates, a rural large lot subdivision, exist to the south. This rural subdivision can be identified by the presence of horses, dogs and stored cars. Mathews Avenue has 25 or more residences and 2 mobile homes. Tate Avenue has 19 or more residences and 2 mobile homes. There are 64 platted lots in Country Estates. Adjacent to the proposal is the Dougan Compressor Station for Panhandle Eastern Pipeline Co. (SUP 468). The gas compressor station runs 24 hours a day with three 4,000 horse power engines. Such notification shall be mailed, first class, not less than ten (10) days before the scheduled public hearing. Such notice is not required by Colorado State Statute and is provided as a courtesy to the owners and lessees of the mineral estate on or under the parcel. Inadvertent errors by the applicant in supplying such list or the Board of County Commissioners in sending such notice shall not create a jurisdictional defect in the hearing process even if such error results in the failure of a surrounding property owner to receive such notification. 28.4.2. 1.6 The Board of County Commissioners shall hold a CI public hearing to consider the application and to take final action thereon. The Board shall make a decision on the application within sixty (60) days of the initial hearing date. In making a decision on the proposed PUD Plan, the Board shall consider the recommendation of the Planning Commission, and from the facts presented at the public hearing and the information contained in the official record, which includes the Department of Planning Services case file, the Board of County Commissioners shall approve the request for the PUD Plan unless it finds that the applicant has not met one or more of the applicable requirements or conditions of Sections 28.4.2. 1.6, 28.5 and 28.6. The applicant has the burden of proof to show that the standards and conditions of Sections 28.4.2. 1.6, 28.5 and 28.6 are met. The applicant shall demonstrate: 28.4.2. 1.6. 1 That the proposal is consistent with the Weld County Comprehensive Plan. 28.4.2. 1.6.2 That the proposed PUD Plan conforms to the PUD District in which it is proposed to be located. 28.4.2. 1.6. 3 That the USES, BUILDINGS, and STRUCTURES which would be permitted shall be compatible with the existing or future DEVELOPMENT of the surrounding area as permitted by the existing zoning, and with the future DEVELOPMENT as projected by the COMPREHENSIVE PLAN or MASTER PLANS of affected municipalities. 20-63 11 28.4.2. 1.6.4 That there has been conformance with the Performance Standards outlined in Section 35.3. 28.4.2. 1 .6.5 That there has been compliance with the Weld County Zoning Ordinance, Section 50, Overlay Districts if the proposal is located within any Overlay District identified by maps officially adopted by Weld County. 28.4.2.1.6.6 That there has been compliance with the submittal requirements of the PUD Plan, and that the PUD Plat and the Supporting Documents satisfy the legitimate concerns of the Board. No PUD Plan shall be finally approved by the Board until the applicant has submitted an Improvements Agreement or Contract approved by the Board which sets forth the form of improvements guarantees. Any such Agreement or Contract shall be made in conformance with the Weld County Policy on Collateral for Agreements. 28.4.2.2 After the Board of County Commissioners makes its final decision, a resolution setting forth the Board's decision shall be drafted and signed. A record of such action and a copy of the resolution shall be kept in the files of the Clerk to the Board. 28.4.2.3 The Board shall arrange for the Office of the Weld County Clerk and Recorder to record the resolution and the proposed PUD Plan if it is approved. No building permit shall be issued until the PUD Plan has been recorded. 28.5 PUD (PLANNED UNIT DEVELOPMENT) APPLICATION REQUIREMENTS. The purpose of the application is to give the applicant an opportunity to demonstrate through written and graphic information how the proposed change of zone to a PUD District and any subsequent PUD Plan complies with the standards of this zoning ordinance. Any number of units or acres may constitute a PUD for the purpose of determining eligibility in the submission of a PUD District application. These soils are susceptible to wind erosion, are not suitable for dryland farming and "blowout" con- ditions can occur if the natural plant community is damaged by overgrazing. The production of the existing plant community is estimated to be capable of supporting one animal unit on each 35 acre tract on a year round basis. If 3 animals are allowed on each tract, the tracts will be severely overgrazed and supplemental feeding will be required. The grass production can be improved only by not allowing grazing during the plant growing season for several years and then restricting grazing to take only half of the annual grass growth. The transmittal letter for the proposed development states an improvement of livestock breed- ing and grass production is expected. There are no covenances, however, which will require or promote this. Other rural developments such as Sunny Acres, Green Acres and Aristocrat Ranch- ettes have not achieved these lofty goals so our conclusion is this development will also not achieve an improvement. We realize that people must have a place to live but 35 acres per home is an extravagance we cannot afford. Agricultural land must be preserved for the production of food and fiber when- ever possible. We are resolute in our belief this development will be an unproductive use of the land and will have a very high potential for increasing erosion. This development will take agricultural land and break it into units too small to function for agricultural production but too large to maintain as residential lots. There will be one of two things that will occur with these tracts; the owner will have his allotted three animals and the area will be severely overgrazed with the accompanying wind erosion or the land will be abandoned from use except for the yard area around the dwelling. This is a waste of land which we request you to not allow. We are concerned about this development and request that we be kept informed of its progress. The location of the project and the seven subdivided lots is shown in Figure-1. It is our understanding that the proposed development entails subdividing approximately 280 acres with seven separate lots ranging in size from 35 acres to 42 acres. The proposed water supply plan will be from individual exempt wells supplyingwater for in-house purposes only. The proposed wastewater treatment is P P P P through the use of septic systems. Based on an average occupancy of 3.5 persons per residential unit (per lot), a water supply of 100 gallons per person per day, we estimate the water supply requirements per unit to be 0.382 acre-feet per year (127,750 gallons per year or 0.25 gallons per minute). The property lies within the partially saturated outcrop area of the Arapahoe aquifer and is covered with a 2-feet to 15-feet layer of eolium (wind blown sand, silt, and clay). There are no prominent alluvial systems (river or stream gravels) from which to obtain water. The Arapahoe aquifer can maintain yields of greater than 100 gallons per minute (gpm) within the Denver Basin proper, but because this area is near the aquifer outcrop (3 miles to 4 miles) , a more reasonable estimate is 10 gpm to 30 gpm. For your purposes, a well which maintains a sustained yield of 2 gpm to 5 gpm is sufficient if the proper storage facilities are incorporated. Wells drilled to depths ranging from 250-feet to 400-feet should produce enough water to meet the proposed water requirements. If the drilling is done with air and water rather than mud, the depth to the first water encountered should be noted along with the yield, and if possible, the static water level. If the yield appears to be sufficient, continue drilling another 100-feet (for purposes of well-bore storage) and again test for yield. If the yield is not sufficient, continue drilling to 400-feet and test the well every 100-feet. MR. ROY MATHEWS January 4, 1983 - 1468/1 Page Two The quality of water in this area are extremely variable and dependent on local environments, but due to the nearness to the aquifer outcrop, we suspect dissolved-solids concentrations which may be high in sulfate, sodium, and iron. We recommend, at such time when the wells are drilled, water samples be tested to insure the suitability of the water for domestic purposes. In conclusion, we believe that adequate water supply,_provided from individual wells`dYtrte'd 6 eacF site, can be maintained to meet the in-house water requirements for the proposed development.
