Petition for Vacation of Right-of-Way Located on a Parcel of Land Located in SW1/4

A public hearing was conducted on Wednesday, December 17, 2025, at 9:00 a.m., with
the following present:
Commissioner Perry L. Buck, Chair
Commissioner Scott K. James, Pro-Tern
Commissioner Jason S. Maxey
Commissioner Lynette Peppier
Commissioner Kevin D. Ross
Also present:
Acting Clerk to the Board, Houstan Aragon
County Attorney, Bruce Barker
Department of Public Works Representative, Don Dunker
The following business was transacted:

I hereby certify that pursuant to a Notice dated December 5, 2025, a public hearing was
conducted to consider the request of Steven and Amy Brehon, for a Petition for Vacation
of Right-of-Way located on a parcel of land located in the SW1/4 of Section 7, Township 4
North, Range 65 West of the 6th P.M., Weld County, Colorado.
Don Dunker, Department of Public Works, presented a brief summary of the petitioner's
request. Mr. Dunker stated that a different portion of the right-of-way was recorded on the
Quit Claim Deed. Mr. Dunker entered the favorable recommendation of the department
into the record and displayed images of the right-of-way and surrounding views. He stated
there were no conflicts presented throughout the referral process, nor were there
responses from the surrounding landowners.
No public testimony was offered concerning this matter.
Commissioner Maxey moved to accept the petition and authorize the vacation of
right-of-way, based on the recommendation of the Department of Public Works. The
motion was seconded by Commissioner James and it carried unanimously. There being
no further discussion, the hearing was completed at 9:40 a.m.

The Board of County Commissioners of Weld County, Colorado, approved the above
