HomeMy WebLinkAbout20081824.tiff RESOLUTION RE: APPROVE INTERGOVERNMENTAL AGREEMENT FOR FIELD OFFICER TRAINING COLLEGE CREDIT PROGRAM AND AUTHORIZE CHAIR TO SIGN-AIMS COMMUNITY COLLEGE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with an Intergovernmental Agreement for the Field Officer Training College Credit Program between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Weld County Sheriffs Office, and Aims Community College, commencing January 1, 2008, and ending December 31, 2009, with further terms and conditions being as stated in said agreement, and WHEREAS, after review, the Board deems it advisable to approve said agreement, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Intergovernmental Agreement for the Field Officer Training College Credit Program between the County of Weld, Statq of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Weld County Sheriff's Office, and Aims Community College be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign said agreement. AI • INTERGOVERNMENTAL AGREEMENT BETWEEN THE WCSO AND AIMS FOR FIELD OFFICER TRAINING COLLEGE CREDIT PROGRAM THE INTERGOVERNMENTAL AGREEMENT ("IGA") is made by and between the Board of County Commissioners of Weld County by and on behalf of the WCSO (hereinafter referred to as the "WCSO"), whose address is 915 10`h Street, Greeley, CO 80631, and Aims Community College (hereinafter referred to as "Aims"), whose address is 5401 W. 20`h Street, Greeley, CO 80634. WITNESSETH: WHEREAS, the WCSO runs field officer training Program ("Training Program") on a continuous basis throughout the year, and WHEREAS, each Training Program provides college-level teaching for the enrolled officers who attend the classes, and WHEREAS, the WCSO and Aims desire through this IGA to enable each Training Program to provide college credit for the enrolled officers who attend the classes, and WHEREAS, the WCSO and Aims also desire through this IGA to establish a method and procedure whereby the WCSO may pay Aims the cost of the college credits on a per-credit per-officer basis, and Aims may reimburse the WCSO for the time spent by the WCSO Lead Instructor. NOW, THEREFORE, FOR AND INCONSIDERATION of covenants and agreements below appearing, the parties agree as follows: I. DEFINITIONS For the purpose of this IGA, the following terms and definitions shall apply: A. "Basic Academy" means a group of classes which provide the new officer with the skills and abilities to perform his/her job functions. B. "Field Training Phases" means an "on the job"training program utilizing a one to one training philosophy in which a senior, specially trained, officer is paired with a new officer to teach job duties. C. "Training Program" means a course of instruction, documented through lesson plans approved by Aims Community College, which enable officers to perform their duties. 1 2008-1824 D. "WCSO Lead Instructor" means a Weld County Employee authorized by Aims Community College to oversee the instruction of the Sheriffs Office training academies and the participation of students in those academies. The lead instructor will also be accountable to assure the submission of grades to Aims Community College and the adherence to lesson plans throughout instruction. II. CREDIT FOR TRAINING PROGRAM AND COST PER CREDIT-HOUR A. Credit for Training Program. The Training Program provided by the WCSO will consist of one (1) Basic Academy and four(4) Field Training Phases. The Basic Academy will be awarded six (6) credit hours. The Field Training Phases will be awarded 11 credit hours. Aims shall provide evidence of the awarding of the credit upon proper documentation to Aims by the WCSO Lead Instructor of the names of the officers entitled to such credit. B. Cost Per Credit-Hour. The cost for the credit for Training Program shall not be less than the current Aims' catalog tuition rate for in-District students. III. WCSO LEAD INSTRUCTOR TIME AND RATE OF REIMBURSEMENT A. Reimbursement for WCSO Lead Instructor Time. The WCSO will be reimbursed by Aims for the time spent by the WCSO Lead Instructor on a per class basis. B. Rate of Reimbursement. Reimbursement shall be the current Aims' part-time instructor rate per credit hour, pro-rated according to enrollment, figuring that this sum is for a Training Program for 12 persons. IV. PAYMENT AND MISCELLANEOUS PROVISIONS A. Payment. The WCSO shall pay to Aims within 30 days following the completion of the Training Program the total cost of all of the credit-hours received by the officers being trained. Aims shall pay to the WCSO the amount for reimbursement of the WCSO Lead Instructor time within 45 days following the completion of the Training Program and upon confirmation of the time spent by the WCSO Lead Instructor. B. Termination. This IGA may be terminated without cause by either the WCSO or Aims upon sixty (60) days' written notice. Upon termination, any funds provided by the Aims Community College shall be prorated and returned to the college. Notice shall be given to the WCSO Commander or the Aims designee as appropriate. 2 C. Location. The location of the Training Program shall be the Weld County Sheriffs Office at 1950 "O" Street, Greeley, or at such other location as designated by the WCSO Lead Instructor. D. Entire Agreement. This IGA contains the entire understanding of the parties with respect to the subject matter hereof, and all other understandings or agreements shall be deemed merged into this IGA. Amendments of this IGA may be made only in writing and signed by all parties hereto. E. Relationship of the Parties. It is mutually agreed and understood that nothing contained in the IGA is intended or shall be construed as in any way establishing the relationship of co-partners or a joint venture between the WCSO and Aims or as construing the college, including its officers, agents, volunteers and employees, as an agent of the WCSO. Aims shall not represent that the WCSO Lead Instructor is an employee or agent of the college in any capacity. The WCSO Lead Instructor shall not represent that he/she is an employee or agent of Aims in any capacity. The WCSO Lead Instructor shall remain solely an employee of the WCSO. F. Third Party Beneficiaries. None of the terms or conditions in this IGA gives or allows any claim, benefit, or right of action by any third person not a party hereto. Any person other than the WCSO or Aims receiving services or benefits under this IGA is only an incidental beneficiary. Nothing in this IGA shall be deemed as a waiver of immunity or liability limits granted to the County and the Aims under the Colorado Governmental Immunity Act. G. Notices. Any notice provided for in this IGA shall be in writing and shall be served by personal delivery or by certified mail, return receipt requested, postage prepaid, at the addresses set forth above, until such time as written notice of a change is received from a party wishing to make a change of address. Any notice mailed and/or served as set forth above, shall be deemed delivered and effective upon receipt or delivery. V. TERM The terms of this IGA shall be for one year, beginning on the 1st day of January , 2008, and shall continue through the 3lstday of December , 2009. The parties may agree thereafter to renew this IGA for additional one year periods. VI. PRESERVATION OF IMMUNITY. Nothing in the IGA shall be construed (i) as a waiver by either party of immunity provided by common law or by statue, specifically including the Colorado Governmental Immunity Act, Section 24-10-101. et.seq. C.R.S., as it may be amended 3 t from time to time; (ii) as creating as assumption of any duty or obligation with respect to any third party where no such duty previously existed; or(iii) as creating any rights enforceable by such third parties.
