RESOLUTION
RE: ACTION OF THE BOARD CONCERNING PROBABLE SHOW CAUSE HEARING
FOR WELD COUNTY DISPOSAL, INC. - SPECIAL USE PERMIT NO. 454
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Department of Planning Services has submitted
a request to the Board of County Commissioners that the Board
consider scheduling a Show Cause Hearing for Weld County Disposal,
Inc. to determine whether the owner/operator is in compliance
with the Development Standards of Special Use Permit No. 454 , and
WHEREAS, the Department of Planning Services has presented
certain facts which indicate that Weld County Disposal, Inc. is
in violation of certain Development Standards of Special Use Per-
mit No. 454, and
WHEREAS, the property on which the violations are said to
be occurring is described as Part of the NWQNW4, Section 12 ,
Township 1 North, Range 66 West of the 6th P.M. , Weld County,
Colorado, and
WHEREAS, the Board, after hearing testimony from the Depart-
ment of Planning Services and testimony from representatives of
Weld County Disposal, Inc. , finds that there is sufficient
probable cause to schedule a hearing to Show Cause as to whether
or not Special Use Permit No. 454, held by Weld County Disposal ,
Inc. , should be revoked for failure to comply with the Develop-
ment Standards.
WHEREAS, the Board shall hear evidence and testimony from all
interested parties at said Show Cause Hearing.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that a Show Cause Hearing
be scheduled to determine whether or not Special Use Permit No.
454 , held by Weld County Disposal, Inc. , should be revoked for
failure to comply with Development Standards.
BE IT FURTHER RESOLVED, that the issues to be considered
by the Board are as follows:

BE II FURTHER RESOLVED by the Board that the date for the
Show Cause Hearing shall be May 11, 1983, at 2 : 00 o' clock p.m.
and shall be held in the first floor hearing room of the Weld
County Centennial Center.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 11th day of

The following business was transacted:
I hereby certify that pursuant to a notice dated April 1-8, 1983, duly published
on April 21, 1983, in the La Salle Leader, a public hearing was held for the pur-
pose of considering the revocation of especial Use Permit #454 _for Weld County
Disposal, Inc. Mr. Morrison, Assist-ant County Attorney, read this proposal into
the record. Mr. Morrison said that Mr. McKnight wished to present a request to
the Board. Mr. McKnight came forward and stated that his attorney was not able
to be present today because of bad weather conditions which prevented him from
flying in to Denver, therefore, he requested that this h-wring he postponed
until a later date. Thomas Quamnen, Deputy District Attorney representing Weld
County, stated that he was opposed to a continuance because certain witnesses
would be unavailable until June 1, 1983. After further discussion, Commissioner
Martin said a-Resolution was passed which stated that if one commissioner was
absent, the applicant had the option to take a _chance on a tie vote or postpone
the hearing until there is a full quorum. After more discussion, Mr. McKnight
. requested a continuance. Commissioner Johnson moved to continue this hearing
to June 1, 1983. Commissioner Brantner seconded the motion and it carried
unanimously.

Development Standards
1. She water and oil fluids recycling and disposal site granted by this
Special Use Permit on the hereon described parcel is limited to the
facilities shown hereon. Said facilities shall be:
a. 600 square loot (minimum) structure built in -accordance with
the Uniform Building Code and utilized as an office and -a
residence by an employee for the control, operation and security
of the facility;
b. Eight 300 1±arrel tanks;
c. One circulating pump and motor;
d. One 8 foot and 20 foot heat and filtering vessel.
e. Four bentonite sealed lagoons as shown hereon. The lagoons
may include an aeration system as part of the operation.
The dimensions of the lagoons shall be as follows:
Pond A - 83,0DD square feet 1.9 acres
Pond B - 82,000 square feet 1.9 acres
Pond C. - 312,600 square feet 8.2 acres
Pond _D - 233,900 square feet 5.4 acres
f. Settling pit screened with one inch wire mesh.
g. _Concrete sump divided by cement petitions into three (3)
separate holding tanks. Additionally, ari uses permitted
by right in -Section 3.3 o₹ the Weld County Zoning Resolu-
tion are allowed within the Special Use Permit area.
2. Access to the Special Use Permit area is limited to one access point
shown hereon. The access shall -have the approval of the Weld County
Engineering Department. The access shall be constructed in accordance
with the recommendations and/or requirements of the Weld County Engineer-
ing Department. All private interior roads shall be graveled.
3. The Special Use Permit area shall ±e -maintained in such a manner so as
to prevent soil erosion, fugitive dust, and the growth of noxious weeds.
4. All phases of the operation shall comply with all County and State -Health
Standards and Regulations pertaining to air -quality, water quality, noise
emission, and sanitary disposal systems. Representatives or members of
the Weld County Health Department, Weld _County Department of Planning
Services Staff and/or Colorado -Department of Health -shall be granted
access onto the site at any reasonable time in order to insure the
operations carried out on the site comply with all applicable Weld County
and State Health Regulations.

5. Upon cessation of operations at the site all structures shall be removed
to 30 inches below grade and all ponds or pits shall be filled and
graded so as to conform with the surrounding terrain. The Special Use
Permit area shall be reclaimed to a farmable state within six (6) months
of the operations. The property shall be seeded in wheat or alfalfa
or other appropriate ground cover approved by the Soil Conservation
Service.
6. Storage of oil field drilling and associated equipment shall not be
permitted within the Special Use Permit area.
7. Parking on Weld County Road 12 and 35 will be prohibited. Parking will
only be allowed within the property -described hereon.
8. The settling pit as shown hereon shall be screened with a one inch
wire mesh to prevent wildlife gaining access to the pit. All lagoons
shall have flagging devices place no more than 20 -feet apart to dis-
courage birds from landing on the water surface. These flagging
devices shall be installed by the owner/operator within three (3)
months of approval of this Special Use Permit by the Board of County
Commissioners and shall be maintained in good repair throughout the
life of the operation.
9. To prevent seepage to the groundwater, all pits, lagoons, and other
excavations containing water at any time shall be lined with bentonite
or other impervious material as per State and County Health Department
guidelines within six (6) months of approval of the Special Use Permit
by the Board of County Commissioners. Construction of the lagoons
and embankments shall be in accordance with the design as shown hereon
or other design specifications from a registered professional engineer.
Those specifications shall be subject to review and approval by the
Weld Lounty Health Department and Colorado Department of Health. The
freeboard allowance for all dikes designed to retain water or other
fluids shall be as specified by the Weld County Health Department
and/or Colorado Department of Health.
10. There shall be a minimum of six (6) groundwater wells to monitor
possible leakage from the evaporation ponds and other pits on the
property. The Weld County Health _Department and State Health Depart-
ment shall have access to these wells at all times to determine
possible contamination of the groundwater. The wells shall be installed
as per Weld County Health Department guidelines for depth to groundwater
table.
11. The operator shall provide measuring devices in all lagoons which will
not -damage the bentonite lining. Said devices shall be easily accessible
and easily visible to the Colorado Department of Health and Weld Lounty
Health Department.

12. The Weld County Health Department shall be given notice within a
24 hour period of use of the emergency lagoon by the operator of the
site. Such use must be a true emergency and not for normal storage
of water or normal operations of the site. The provision does not
exclude the operator from keeping 12 to 18 inches of water in the
emergency lagoon to prevent the bentonite lining from drying out.
13. An access road shall be constructed and maintained around the peri-
meter of each lagoon such that there is adequate access for a vacuum
truck to skim oil from all areas of the lagoons.
14. The Special Use Permit shall be limited to the plans shown hereon
and governed by the Development Standards stated above and all applic-
able Weld County Regulations. Any material deviations from the plans
and/or Development Standards as shown or stated above shall -require
the approval of an amendment to the Special Use Permit by the Planning
Commission and the Board of County Commissioners before such changes
from the plans and/or Development Standards shall be permitted. Any
other changes from the plans and/or Development Standards shall be
filed in the office of the Department of Planning Services.
15. The property owner and/or operator of this operation shall be responsible
for complying with all of the above stated Development Standards. Non-
compliance with any of the above stated Development Standards may be
reason for revocation of the Special Use Permit by the Board of County
Commissioners.

SITE DESCRIPTION AND OPERATION
The operation to be conducted on the subject facility consists of
an oil field fluids (saline formation water) recycling and evaporation
pond system. The evaporation pond method of disposal is necessary in
the Weld County area because the more conventional inj6ction well
disposal method is prohibited for geological reasons.
The oil waste fluids accepted at the site are transported in by
tanker trucks serving Weld County's petroleum exploration and develop-
ment companies. The transported liquids are discharged into a concrete
sump that physically separates the formation water from the petroleum
hydrocarbons. The hydrocarbons are then pumped to one of the 3 (300
barrel capacity) steel tanks for further refining and commercial
treatment. The formation water is pumped into Evaporation Pond A.
Refer to Plate I for evaporation pond locations. From Evaporation
Pond A, the formation water is further distributed into one of the
remaining Evaporation Ponds B or C.
The recovered liquid hydrocarbons that have accumulated in the 300
barrel steel tanks is refined and upgraded utilizing a mobile 300
gallon tanker equipped with a Heater Treater and Filtering System.
This mobile system replaces the existing stationary heating and
filtering vessel located approximately 100 feet east of the storage
tanks . The smaller screened pit located south of the storage tanks
functions as a temporary oil holding structure and safety feature in
the event the heater treater system malfunctions. Trapped oil
contained in this holding structure will be recycled through the tanks,
mobile heater and filtering system for proper processing.

A total of 3 evaporation ponds are presently in use. One
future pond is being proposed. Evaporation Ponds A and B have been
formally approved for operation under a previous Special Use Permit
Amendment. Evaporation Pond C is presently operating having been
authorized conditionally in the form of a resolution issued
October 22, 1980 by the Weld County Commissioners. Evaporation Pond
D is proposed for future use. Prior to actual construction and use
of Pond D, a geotechnical investigation and engineering design will be
completed . Future plans may incorporate a spraying system capable
of increasing the evaporation loss and extending the operating life of
the facility.
Of the three existing ponds in use, Evaporation Ponds A and C have
been lined with bentonite. Evaporation Pond B is unlined. However,
it is presently being evacuated by pumping the stored water into
the adjacent lined Pond C, located to the east. When Evaporation Pond
B is pumped dry, it will be lined with bentonite in the same manner
as the previously constructed lined ponds.
An existing building located near the site's access functions
as an office and living quarters for a 24 hour security guard. Employees
will number two or three, with one or two persons working varied shifts
as the need dictates.
The vehicle traffic volume will range from 0 to 25 tankers per day
depending upon the quantity of drilling activity in the area. There
will be no oil field drilling equipment stored on the property. Parking
will be provided for employees and trucks loading and unloading. All
on-site roads will be graded and gravel surfaced.

The oil containment pond located immediately south of the three
storage tanks is presently screened with a one inch wire mesh to
prevent migrating game fowl from lighting thereon.
A minimum two foot free board will be maintained for all evapora-
tion ponds . In addition, all ponds will be skimmed whenever necessary
to keep the surface free of oil accumulation.
Oil field fluids will emit a minimum amount of odor either in.
storage or in processing. The higher noise level will merely be a
result of ingressing and egressing transport trucks.
There is no water supply need or requirement for the site operation .
Domestic water for use in the office/dwelling is provided from an exist-
ing domestic well drilled on the site. The existing water well and in-
dividual septic system were designed and installed consistent with stan-
dards promulgated by the Weld County Health Department.
The entire 40 acre site is presently fenced along the perimeter.
A livestock crossing and a security gate have been constructed at the
site entrance.
It is our understanding that to date, all building and excavation
permits have been obtained and all fees paid to the Weld County Building
Inspection Department.

Dear Mr. Winters :
I have discussed with the owners of Weld County Disposal Inc. some of the
problems we talked about on August 20, 1982. We are taking the following
action:
1 . We will take action to drill the test wells required by the permit
if not already drilled. If any wells have silted in we will re-drill them.
We will also drill , or re-drill , them in such a way as to inhibit silting
in the future.
2. We will check with our Engineers to determine the status of the
-emergency pit to insure compliance. The pit has not been used for water
dumping.
3. We will also check on the status of the overflow dike and the measuring
devices.
4. I have discussed with our employee the necessity of keeping oil skimmed
off the pits and to maintain a six foot (6' ) freeboard on the lagoons. He
will also check on any seepage around the settling pond.
I will contact you later to give you an update on the progress of these •
changes.

Gentlemen:
On August 20 , 1982, a meeting was held with Mr. James Smith, attorney
for your operation, to discuss remedial actions to be taken at the facility.
A letter was then received from Mr. Smith, on August 25, 1982, which outlined
several items discussed during the meeting. The major items to be addressed
in a subsequent report were:
1. Drill or re-drill wells on site as required by the special land
use permit.
.2. Determine the status of the "emergency" pit to insure compliance
with the amendment to the "Notice of Violation and Cease and Desist
Order" issued April 16, 1980.
3. Evaluation of the concrete lined settling pond to see if there is
potential for seepage from this pond. If seepage is occurring then
the consultant was to make a proposal for controlling and clean-up
of the contamination. '
4. Maintenance of the six foot freeboard.
At present no reports have been received by this office pertaining to
these topics. It -is therefore requested that a response to this letter be
submitted within fifteen working days from receipt of this letter.

following:
1 . By the time you receive this letter the re-drilling of
wells on the site will either be completed or substantially
completed.
2. Our engineers are in the process of finalizing specifications
for completing the "emergency" pit. They are also evaluating
any potential for seepage from the concrete pond.
3. Our manager has been talked with regarding maintenance of
the six foot freeboard.
We are attempting to comply with your requirements. Some of the requirements
are very costly and time consuming. However, we feel we are making progress.

indicate that the water well owned bzz (Jr. Tim Trostel and located approximately
1/8 mile east of Weld County Disposal, inc. , contained elevated levels of
several inorganic chemicals. A copy of the laboratory ,nvxlyses performed is
attached for yo10' reference.

never been definitely identified, the types of contaminants detected and the

relationship between the two. On 20, 1981 representatives of this
Division, Weld County Planning and the Weld County Health Department met with
the attorney for Weld County Disposal, Inc. to discuss future actions necessary
to further identify the source of contamination in the Trostel well and any
corrective measures which could be implemented. The following actions were
agreed uson by the parties at this meeting.

Ron Stow, Weld County Health Department, accompanied me on this inspection.
The purpose of this trip was to check for compliance with Development Standards
approved for USP-454:80:44.
Evaporation Pond "A" had a visible layer of "oil like" substance over the
surface. There was a hose line running from the concrete sump to Pond "A". Skimming
of oil from the top on Evaporation Pond "A" was not evident at the time of inspection.
There was no evidence that the owner/operator was maintaining a minimum of
six (6) wells on the property. There was only one (1) that we were able to find.
There still remains a question as to whether or not Emergency Evaporation
Pond "B" was builtto design specifications. Two photographs of Evaporation Pond
"A" were taken, One of the photographs clearly show the oil substance on top of
the water.

thereafter as the agenda of the Board of County Commissioners permits,
the Board of County Commissions of Weld County will hold a probable
cause public hearing pursuant to Section 81 of the Weld County Zoning
Ordinance. This meeting will take place in the Commissioners

A field inspection o₹ the oilfield=fluids recycling and disposal site
was completed on January 12, 1983: The inspection revealed that this
operation does not comply with Development Standards #9, 10 and 13 of
the approved Special Use Permit Case #454:80:44
If it is determined at the above mentioned public hearing that Special
artment DServices staff shall schedule a "show cause" public hearing
Use Permit Case Number 454:80:44 is not in compliance, the eP
of Planning
to consider revocation of the Special Use Permit.
