RE: AUTHORIZATION FOR CHAIRMAN TO SIGN MINED LAND RECLAMATION
TRANSFER OF PERMIT AND SUCCESSION OF OPERATORS REQUEST -
GEISERT PROPERTY
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, on October 25, 1978, the Mined Land Reclamation
Board granted Richard H. and Francis M. Geisert Permit Number
78-210 to conduct a surface mining operation, and
WHEREAS, Richard H. and Francis M. Geisert wish to assign
said permit to the Board of County Commissioners of Weld County,
Colorado as successor operator, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado wishes to become successor operator under Permit Number
78-210 with the conditions as stated in the Agreement attached
hereto and incorporated herein by reference, and
WHEREAS., the Board of County Commissioners shall submit a
request to the Mined Land Reclamation Board to be recognized as
the successor operator under Permit Number 78-210.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that a request be submitted
to the Mined Land Reclamation Board for approval of the transfer
of Permit Number 78-210 and succession of operators to the Board
of County Commissioners of Weld County, Colorado.
BE IT FURTHER RESOLVED by the Board that the Chairman be,
and hereby is, authorized to sign said request.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 6th day of
December, A.D. , 1982 .

REQUEST FOR TRANSFER OF PERMIT AND SUCCESSION OF OPERATORS
I.
RECITALS
A. On nrtnher 75 , 1978 the Mined Land Reclamation
Board or Division of the Colorado Department of Natural Resources
("the state") granted to Richard H and Francis M. Geisert
address
("permittee") permit number 7R.,.210 ("the permit") pursuant
to which permittee has been conducting a surface mining operation in
the County of Weld , State of Colorado.
B. Permittee wishes to assign the permit to Weld County
Board of County Commissioners address P. O. Box 758
Greeley, Colorado 80632
, as successor operator ("suc-
cessor") and successor wishes to become successor permittee under the
permit.
C. Successor understands that the reclamation plan ("the plan")
required by the permit and by applicable state laws and regulations has
not been completed and is willing to assume full responsibility for
the completion of the plan.
II.
AGREEMENTS
Permittee and successor hereby agree, for their own benefit and for
the benefit of the state, such agreements to be effective ipso facto
upon the approval by the state of the transfer of the permit from
permittee to successor, as follows:
1. Successor has inspected the mining and reclamation operations
to its entire satisfaction and is fully aware of the condition thereof.
Successor understands and accepts all of the conditions of the permit.
2. Successor will complete the reclamation plan, and hereby assumes
liability for completing such plan as to all areas heretofore disturbed
as well as to all areas hereafter disturbed. Successor will perform all
of the obligations of the permittee under the permit which have not
heretofore been performed by permittee.

bond and surety heretofore filed by the permittee effective upon the
release of the latter bond and surety.

4. Successor represents to the state that to the best of its know-
ledge, information and belief it is not in violation of any of the pro-
visions of the Colorado Mined Land Reclamation Act or the Colorado Surface
Coal Mining Reclamation Act with respect to any other operation conducted
by it in the State of Colorado. .
Permittee and successor hereby request the state to consent to the
assignment of the permit, to recognize successor as successor operator

Re: Annual discharge permit administration fee for state fiscal year 1982/83

At a" public hearing held on September 13, 1982, the Water Quality Control
Commission adopted the fee schedule for processing and administering discharge
permits for fiscal year 1982/83 which extends from July 1 , 1982 to June 30, .
1983. In accordance with the revisions mode in the fee schedule, your annual
administrative fee for FY 1982/83 will be $ -2 �,. -O6
The bill for the annual fee will be sent to you in January, 1983; permit
regulations require that it be paid within 30 days of receipt. We are noti-
fying you now of the fee assessment se that you can budget appropriately.
You will note an increase over the amount paid last year. This is due in
large measure to the withdrawal of state or general fund support for the permit
program. The provisions of the state budget or Long Bill for this year
(FY 1982-83) clearly indicate that the program is to become user-supported.
Consequently, the General Assembly has withdrawn the supplemental support that
was available last year and the fees have risen proportionately. We fully
expect that the fees will stabilize at this level , and that any future increases
will be tied to annual inflation rates.
It is important to point out that the figure cited above applies only to
the annual administrative fee. if your permit must be renewed, amended , inac-
tivated, or you request a variance, a separate processing and issuance fee
will be charged based on hourly rates of $40.00 for technical and administra-
tive work, and $17.00 per hour for clerical work. Please understand that
issuance fees and annual fees cover different operations and are therefore
calculated and billed separately.
If your address has changed, or the annual fee bill should be sent to an
address other than the one used above, please notify us at your earliest con-
venience so that we can make the appropriate corrections. If you have any
questions about the billing, please contact Bill. McKee of our staff at
extension 4380.

This is in response to the Performance Warranty Bond. Accord-
ing to Section 34-32-117 , (1) (E) of the "Colorado Mined Land
Reclamation Act" , as amended, county governments may substitute
a written guarantee in lieu of surety.
Weld County is, hereby, guaranteeing that the affected land will
be reclaimed in accordance with the term of Permit No. 78-210 .
