We have no objections to the proposal, however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be incorporated into the permit as conditions that must be met prior to operation: 1. A stormwater discharge permit may be required for a development/redevelopment/construction site where a contiguous or non- • contiguous land disturbance is greater than or equal to one acre in area. The applicant shall inquire with the Water Quality Control Division (WQCD) of the Colorado Department of Public Health and Environment at www.cdphe.state.co.us/wg/PermitsUnit if they are required to obtain a stormwater discharge permit. Alternately, the applicant can provide evidence from WQCD that they are not subject to these requirements. We recommend that the following requirements be incorporated into the permit as conditions that must be met prior to the issuance of the Certificate of Occupancy: 1. An individual sewage disposal system is required for the proposed Worship Room building and shall be installed according to the Weld County Individual Sewage Disposal Regulations. 2. The septic system is required to be designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Regulations. • EXHIBIT 1 2008-0447 We recommend that the following requirements be incorporated into the permit as • development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. 4. Fugitive dust and fugitive particulate emissions shall be controlled on this site. 5. This facility shall adhere to the maximum permissible noise levels allowed in the Commercial Zone as delineated in 25-12-103 C.R.S., as amended. • 6. Adequate handwashing and toilet facilities shall be provided for employees and congregation members of the facility. 7. Sewage disposal for the facility shall be by septic system. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. 8. The facility shall utilize the existing public water supply. (Left Hand Water District) 9. Comments made during this stage of the review process may not be all-inclusive, as revised materials will have to be resubmitted and other concerns or issues may arise during further review The Weld County Public Works Department has reviewed this proposal. This project falls primarily under the purview of the Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Our comments and requirements are as follows: COMMENTS AND REQUIREMENTS: Weld County Strategic Roadway: (December 2002) WCR 7 is classified by the County is a Strategic Roadway, which requires a 140-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning 03-1-90), the required setback is measured from the future right-of-way line. Lowell Lane is a major arterial road, which requires a 140-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. Access: Access is onto an existing road/drive not maintained by Weld County. The applicant shall indicate specifically on the plat the type of right-of-way/easement that exists. Off-street parking spaces including the access drive shall be surfaced with gravel, asphalt, concrete or the equivalent and shall be graded to prevent drainage problems. Each parking space shall be equipped with wheel guards or curb blocks when necessary to prevent vehicles from extending beyond the boundary of the space and from coming into contact with other vehicles, walls, fences or planting. Storm Water Drainage: Drainage Report: The drainage report must be stamped by a Professional Engineer licensed to practice in the State of Colorado. The drainage report must consider the following: o All stormwater must be detained on site and follow the requirements per Weld County Code 24- 7-130 (D) and Ord. 2096-7. All stormwater detention facilities shall be designed to detain the • stormwater runoff from the entire fully developed site from a one-hundred-year storm and release the detained water at a rate not to exceed the rate of a five-year storm falling on the undeveloped site. o Offsite runoff flows onto the site must be managed through the site, and contours shall be shown on the site plan for a minimum of 200' from the property line, or as far as necessary to • show the entire offsite contributing area. Please show how flow from basins D1 and D3 will be conveyed into the detention pond, and include these discharges in the detention pond size calculations as inflow contribution. All proposed channels must be designed to be stable under USDCM (UD&FCD 2001) criteria. Please add cross-section details to the construction drawings and include side slope, 100-year water surface elevation, 100-year energy grade line, max depth, and 1.0 foot of freeboard. Please prove all outlet control pipes shall not surcharge the detention pond. Downstream tailwater can force backwater onto upstream detention ponds. Please redesign the roadway culvert crossing to show appropriate tailwater as input, and recalculate upstream headwater. This headwater is also the downstream tailwater condition on the outlet pipe for the detention pond. Please make sure the outlet pipe does not create a higher water surface elevation than the orifice plate causes. Please verify with engineering calculations. Please profile all pipes and include proposed and existing grade, 100-year HGL and EGL, slope, diameter, material, and riprap protection with. All pipe hydraulic and riprap sizes must be supported with engineering calculations. Please size the overflow spillway for offsite flow and onsite discharge, assuming a fully plugged condition and a 100-year storm event. Please add a detail drawing to the construction drawings for the emergency overflow spillway. The applicant must take into consideration storm water quantity capture and provide accordingly for best anagement practices. onstruct ditches/swales to direct onsite flows to the storm water/water quality pond. Please specify a seed mix from Weld County Drainage Addendum for revegetation of the entire site. This seed mix shall be reproduced on the Drainage/Erosion Control sheet in the construction drawings. This area IS NOT in a FEMA Regulatory floodplain or floodway. Recommendation The above requirements are prerequisites and shall be fulfilled prior to recording the Final Plat. USR-1630 1. A building permit is required prior to any new construction or change of use of the existing building. 2. A plan review is required for each building for which a building permit is required. Plans shall bear the wet stamp of a Colorado registered architect or engineer. Two complete sets of plans are required when applying for each permit. The building will be classified as an A-3(church). An automatic sprinkler system is required when the occupant load is 300 or more. Based on the square footage and lack of floor plan the occupant load exceeds 300.A fire alarm system is required. • 3. Structures shall conform to the requirements of the various codes adopted at the time of permit application. Currently the following has been adopted by Weld County: 2006 International Building Code; 2006 International Mechanical Code; 2006 International Plumbing Code; 2006 International Fuel Gas Code; and the 2005 National Electrical Code and Chapter 29 of the Weld County Code. 4. New structures will require an engineered foundation based on a site-specific geotechnical report or an open hole inspection performed by a Colorado registered engineer. Engineered foundations shall be designed by a Colorado registered engineer. 5. Fire resistance of walls and openings,construction requirements, maximum building height and allowable areas will be reviewed at the plan review. Setback and offset distances shall be determined by the Zoning Ordinance. 6. There exists the possibility of contamination and pollution of the District's potable water system due to the acts and/or omissions of its users or other parties who may cause back- siphonage and cross-connections to occur. In the case of any premises where there is a well • or other auxiliary water supply, the District's water system must be protected by an approved air-gap separation or an approved reduced pressure principle backflow prevention assembly. Any person, entity, association, or corporation which makes, installs, maintains or allows any such cross-connection which may cause back-siphonage and which may degrade the acceptable water quality of the District's water system shall be subject to prosecution under section 25-1-114, C.R.S. To reduce the possibility of cross-connection and back-siphonage, the District shall implement the following: 1. Notification. All new customers shall be presented with information and warnings regarding the possibility of contamination and pollution due to cross-connections and back- siphonage, and the schedule of compliance set forth in paragraph 2.2. All existing customers shall be periodically reminded of the schedule of compliance set forth in paragraph 2.2 2. Backflow Devices. 2.1 Commercial and Industrial. On or before January 1, 1992 all commercial and industrial users shall have installed an approved backflow prevention device of a type and size approved by the District, and which meets or exceeds the standards established by the Colorado Department of Health standards and specifications and which has been certified by the Foundation for Cross-Connection Control at the University of Southern California. Any unapproved backflow prevention device which is currently installed shall be replaced with an approved device at the time it fails an operational test. • 2.2 Residential. On or before January 1, 1994, all residential users shall have installed a backflow prevention device of a type and size approved by the District. 2.3 Installation Regulations. Left Hand water District shall incorporate into its engineering standards such installation regulations for backflow devices which are promulgated by the Colorado Department of Health and which are consistent with this policy. 2.4 Enforcement of Backflow and Cross-Connection Policies It is the customer's responsibility to maintain their backflow prevention devices, and to see that their devices are tested at least annually by a State certified backflow inspector. The results of the test shall be provided to the District by the customer within 20 days after inspection. If evidence of installation of a backflow device is not received after customer notification, or if notice of satisfactory "passing" inspection is not received by the District within the annual anniversary of the previous inspection, the following actions will be taken by the District: 1. A reminder notice will be sent by the District. The first notice will allow a 60 day period for compliance and note all fines and actions that may result from noncompliance. 2. If no response is received within the 60 day period, a fine of $150 will be imposed on the 61st day following notification, and a second notice will be sent. 3. The second notice will have a 30 day period for compliance. If no response is received following the second notice, a fine of $300 will be applied on the 31st day. • 4. If no action is taken to bring the backflow status into compliance after the second notice, a third notice with a term of 30 days will be issued, and service to the tap will be discontinued if no action is taken before the end of that period. The Fire District does not object to the building or addition, provided the applicant is able to meet the requirements of the Fire District. All applicable codes must be met, as they pertain to fire department access, water supply for fire protection and building construction. Based on my review, I have the following comments: • • Fire department access will be acceptable provided the building (new and existing) is protected throughout with an automatic fire sprinkler system. Fire apparatus access roads must be designed and maintained to support the imposed loads of fire apparatus (75,000 pounds). • There currently is not an adequate water supply for fire protection at this location. Should the building be provided throughout with an automatic fire sprinkler system the required fire flow is 1,500 gallons per minute, measured at a residual pressure of 20 pounds per square inch for two hours. What that means is that the applicant would need to provide a minimum of 180,000 gallons of on-site storage and a fire pump to supply at least one fire hydrant and the fife sprinkler system. The Fire District has made the applicant aware of this requirement.
