HomeMy WebLinkAbout20080160.tiff RESOLUTION RE: ACTION OF THE BOARD OF COMMISSIONERS REGARDING VIOLATION ZCV#0701079 AGAINST RICHARD AND CYNTHIA STALCUP FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Richard and Cynthia Stalcup, ZCV#0701079, are allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 11th day of December, 2007, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, at which time this matter was continued to January 8, 2008, to allow adequate time for the property owners to submit a completed Use by Special Review application. WHEREAS, on the 8th day of January, 2008, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Richard and Cynthia Stalcup were not present or represented at said hearing, although all parties were notified of said hearing by Department of Planning Services staff, and WHEREAS, the Board deems it advisable to refer said case back to the Department of Planning Services, due to the property owners submitting a Use by Special Review application. No pictures were taken during this inspection. 07/23/2007 Phone Call Linda Owens (303-833-4040) called. She said she no longer owns that property. She said she signed a deed in March of 2007. I advised her that it did not appear to be recorded. After more digging, I was able to find the deed Rec#3462733. I forwarded information to Lin Dodge for the Assessor's Office and changed the paperwork in the file. I also resent letter to the Stalcup's. 07/24/2007 Phone Call Richard Stalcup called (303-332-1436 - cell). He said he was unaware that they needed a permit. He stated it was just him and his wife operating the business. I asked how many commercial vehicles are associated with the operation of this business. He said he has: 2 boom trucks, 2 dump trucks, a chipper and a backhoe (which he also uses for personal use on his property). I advised him the difference between a Home Occupation and a Use by Special Review. He said you better send me the USR application. I told him that I would get it out in the mail and after he had a chance to review it, please come in and meet with one of our on-call planners. He said he would. I told him that I would send him a 60 day instead of my standard 30 day letter. He said thank-you. 08/20/2007 Office Visit Mr. Stalcup came into the SouthWest Office to discuss his violation case. I pulled in Michelle Martin (Planner). • She advised that this property was in Firestone"s IGA, so she filled out a Notice of Inquiry and gave it to Mr. Stalcup. I advised him to keep me in the loop and let me know the minute he found anything out. He said he would. ((See copy of Notice of Inquiry in file)). 11/13/2007 Phone Call Richard Stalcup called. He stated that they finally heard back from Rebecca Toberman with Firestone and she told them that Firestone did NOT want to annex. He stated that he asked her for that in writing (per my request) and she explained to him that their attorney"s told them not to put anything in writing. 11/14/2007 Phone Call I forwarded Kim Ogle Mr. Stalcup"s message. Kim advised me to contact Mr. Stalcup (which I then did on 11/14/07 @ 1311). I advised Mr. Stalcup that he should throughly document the phone conversation with Ms. Toberman and submit that documentation with his USR application. I then asked him how he was coming. He stated that his mother became ill so they were actually in Kansas helping out with his father. He said they expected to return next week. I explained that their hearing was scheduled for 12/11/07, but if they submitted the USR application prior to the 11th, the hearing would be cancelled. He said he wasn"t sure how he was going to come up with the funds to submit the USR application. I explained that we did not have the authority to waive the USR fees. He stated that he just wasn"t sure how they were going to come up with the money. I wished them a safe trip back.
