Hello.
I received the last two referrals from Public Works and the City of Longmont. There are some
matters that need to be addressed and I will be sending Jacqueline Hatch a copy of this letter to
• acknowledge that everyone is aware of these issues.

• The first matter is from Public Works. For anyone living off of Weld County Road 1, you
need to be aware that "WCR 1 is a major arterial road, which requires a 140-foot right-of-way at full
build out. There is presently a 60-foot right-of-way. This road is maintained by Weld Country.
Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback
is measured from the future right-of-way line. 2007 traffic counts indicate 5,433 ADT on CR-1
between SH-66 and WCR 28."

I asked Jacqueline about the right of way requirement and the compensation that might
accompany the difference if Longmont did annex Section 30. Her reply was 'Weld County is
requiring the 140 of right of way to be shown on the plat as future right of way. The 140 of right of
way is just an acknowledgement that the property owner is aware that the road will be widened at
some point and when that time comes separate agreements will be made with the property owner."
Second,public works points out that all properties are limited to one access per legal parcel.
If you have a second access you need to apply for an access permit through the Colorado
Department of Transportation (CDOT). Mr. Bergland, as per our conversation June 30, 2008, I
need your letter regarding this issue no later than July 15th. See attached memos for more details of
• these matters.
The third concern is from the City of Longmont. They are requiring no new septic systems
be installed. If you need new sewer service it should be "obtained from St. Vrain Sanitation District
for the east half of Section 30 and from the City of Longmont in the west half of Section 30". The
City of Longmont referral letter regarding this issue is also enclosed for more detailed information.
I asked Jacqueline about the maintenance or replacement of septic systems and her reply was
"If the existing systems need to be repaired/replaced and public septic is located within 400' of the
property the property owner will need to connect into the public system. This is a note that will be
placed on the plat regarding it. 'In accordance with the Weld County Code, if a sewer line exists
within four hundred (400) feet of the property line and the sewer provider is willing to serve the
proposed structure, a septic permit cannot be granted by the Weld County Department of Public
Health and Environment'."
I have received many phone calls regarding mineral ownership. I have done extensive
• research to fmd the mineral owners and have found the following property owners information:

SIGN the mineral acknowledgment form, it is not necessary. Just return the Noxious Weed and
Building Division forms. For those of you who have already signed and sent them in, don't worry
about it, we will simply shred the document. If you do know who the mineral owner is to your
property, please let me know. I might need this information in the future. If you don't know, you
can contact your title company and research your title commitments for exception on mineral
rights information. .
Just an FYI,Weld County's renewal of their IGA (Inter-Governmental Agreement)with
Longmont was automatically done June 2008.

Greetings to you all.
I have had the opportunity to talk with a few of you regarding the weed control issue. A fair number
• of you appear reluctant to sign;a smaller number appear ready to refuse to sign the agreement.
As you may or not understand, the weed control notice is simply an acknowledgement that you

• have read the requirements of the Longmont Conservation District's weed control ordinances and
understand you will be responsible to follow the ordinances. Practically speaking, since you are not
(yet) within the city limits, any weed control will be the responsibility of Weld County. You will need
to insure that any weeds on the A and B lists as found on Weld County's web site are eradicated.
You must also realize that Weld County and the city of Longmont do have their inter-governmental
"cooperatives;" however, again you should realize that the practical aspects of weed control will be
Weld County.
We cannot force you to sign and return the acknowledgements;however,your refusal to do so at this
time will only serve to potentially defeat our efforts,particularly since we are working on such a tight
time schedule.
At this time you all at least acknowledge that you've received the noxious weed control notice. I will
copy Jacqueline Hatch of Weld County so she knows the status of this requirement.

I hereby acknowledge that any and all new construction and/or additions will require a
building permit and must adhere to the current code compliance requirements as put forth
by the Weld County Building Department as stated:

1. A building permit shall be obtained prior to the construction or change of use of any structure.
2. A plan review is required fur each building for which a building permit is required. Two complete
sets of plans are required when applying for each permit. Residential building plans may be
required to bear the wet stamp of a Colorado registered architect or engineer.
3. Buildings shall conform to the requirements of the codes adopted by Weld County at the time of
permit application. Current adopted codes include the 2006 International Residential Code;

This evaluation is based on a final treatment capacity for a 2 bedroom residence.
Based on all available data,it cannot be determined if the field is adequately sized for the structure served.
There were no visible signs of failure at the time of the inspection.
Be advised,neither the County of Weld nor any of its agents or employees undertake or assume any
liability to the owner of the above property,to any purchaser of the above property or to any lending agency
making a loan on the above property or in the report.
This inspection was conducted for the purpose of determining compliance with current regulations and for
detecting health hazards observable at the time of inspection. This does not constitute a warranty that the
system is without flaw or that it will continue to function in the future. Inspectioas requested during
periods of mow cover and high soil saturation may be of questionable value to potential buyers due to
adverse conditions. Evaluations based on Statements of Existing(S.O.E.)relies on information the

• Here are the applications for Section 30's zoning change from residential to agricultural. As per our
conversation on April 15th, Section 30 has opted to go with the new application process. We are
looking forward to working with Weld County on this issue and hope that this process goes as

the Certificates of Conveyance that you required as part of the application submittal. Once we
