RE : APPROVAL OF RECORDED EXEMPTION NO. 515 - STEVEN BUCKNER
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County
Commissioners of Weld County, Colorado, at a public meeting
held on the 30th day of September, 1981 in the Chambers of
the Board that the division into two parcels of land as shown
on the plat known as Recorded Exemption No. 515 , being the
property of Steven Buckner, described as part of the Southwest
Quarter of Section 18, Township 4 North, Range 68 West of the
6th P.M. , Weld County, Colorado, being more particularly
described on the attached plat which is incorporated herein
by reference and made a part hereof, and said parcel does
not come within the purview of the definition of the terms,
"subdivision" and "subdivided land" , pursuant to its authority
under Section 30-28-101 (10) (d) , CRS 1973 , as amended, and
WHEREAS, the Board of County Commissioners finds that
this particular division of land is not within the purposes
of the Weld County Subdivision Regulations and the Board
desires to exempt this particular division of land from the
definitions of "subdivision" and "subdivided land" pursuant
to its authority under Colorado statutes and Section 2-1A(3)
of the Weld County Subdivision Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners that the hereinabove described parcel of land
owned by Steven Buckner be, and hereby is, exempt from the
definition of the terms "subdivision" and "subdivided land" .
The above and foregoing Resolution was, on motion duly
made and seconded, adopted by the following vote on the 30th
day of September, A.D. , 1981.

Dear Commissioners:
The attached application, plat, and related items are in reference to a
request from Steven Buckner for a recorded exemption. The parcel of
land on which this request has been made is described as part of the
SW14, Section 18, T4N, R68W of the 6th P.M. , Weld County, Colorado. This
property is located 1' miles east of Berthoud. The property contains
approximately 20 acres of Class II and III irrigated soils. The request
is to split the property into parcels of 9.6 acres and 10.3 acres.
Mr. Buckner wishes to create two parcels neither of which has an existing
residence located on it.
On August 5, 1981 the Board of County Commissioners granted Mr. Buckner
a lot size variance. At that time the Department of Planning Service's
staff submitted a recommendation for denial. Nothing has been received
which would change that position. Copies the August 5, 1981 Resolu-
tion and prior staff' s letter are attached.

County, Colorado , pursuant to Colorado statute and the Weld
County home Rule Charter, is vested with the authority of

Dear Commissioners:
The attached letter and related materials are in reference to a request
for a lot size variance by Mr. Steve Buckner. The parcel of land is
described as part of the SW1, Section 18, T4N, R68W of the 6th P.M. , Weld
County, Colorado. This property is located one mile east of Berthoud.
The property contains approximately 20 acres of Class II and III irrigated
soils. The request is to obtain a variance from the minimum lot size
requirement, Section 9-4 A. (6) , so that they may make application for a
recorded exemption. If this lot size variance is granted, Mr. Buckner
will proceed with an application for a recorded exemption to divide the
property into two parcels of approximately 10 acres each.
Based upon the information submitted and the adopted policies in the County,
the Department of Planning Service's staff recommends this request be
denied for the following reasons:
1. This request does not comply with the Weld County Comprehensive
Plan in that it would promote nonagricultural use of agricultural
land and it would encourage urban encroachment on rural land use.
2. This request is not in conformance with the intent clause of the
Agricultural Zone District (Section 3.3.A. of the Weld County
Zoning Resolution) which states:
"Intent — The intent in establishing the "A" Agricultural Zone
District is to allow all agricultural regulated uses in those
areas in which agricultural is and should continue to be the
predominant land use. This district is intended to discourage
encroachment of incompatible uses upon the agricultural land in
a district, to encourage agricultural uses as the highest and
best use of the land in the district as compared with other
uses in conflict therewith, and to provide for the orderly
expansion of urban growth in conformance with the Weld County
Comprehensive Plan."

The request would not be encouraging agricultural uses as the
highest and best uses, it would not be providing for the orderly
expansion of urban growth, and it would be promoting the continual
division of agricultural ]and into smaller, less economic parcel
_ices.
3. lhis' ;ecuest is not in compliance with the intent clause of the
recorded exemption procedure (Section 9-2 of the Weld County
Subdivision Regulations) . Said clause states:
"The intent in establishing the recorded exemption procedure
is to provide, in accordance with the Weld County Comprehen-
sive Plan, a means whereby nonproductive agricultural lands
may he developed for higher and more productive uses insofar
as such uses are compatible with surrounding agricultural uses
in areas where such land divisions are proposed (Revised 4-17-74) ."
The 20 acre parcel is productive agricultural land. The parcel
has Class II and III irrigated soils which is considered prime
agricultural land. By further splitting the parcels for
residential purposes, the land would essentially be removed
from agricultural production.
The Department of Planning Service's staff recognized that Mr. Buckner
does have an existing lot with a potential building site and that the
existing neighborhood contains several ten and twenty acre tracts. However, H

will be placed on the County by further subdividing the parcel and thereby Fie
