Upon review of my case files and computer, an active Zoning Violation (ZCV07-01049)was noted. This
violation was initiated due to the storage and operation of a commercial business and equipment without
first obtaining the necessary Weld County Zoning Permits. This case was presented to the Board of
County Commissioners through the Violation Hearing process on December 11, 2007, where the Board
referred the Violation to the County Attorney's Office, but delayed legal action for 60 days.
This application if approved, will correct the violation. If for any reason, this application is denied, the
commercial vehicles, equipment and all operations shall be immediately removed from the property;
otherwise, the Violation Case will proceed accordingly.

The Weld County Public Works Department has reviewed this proposal; this project falls primarily under the
purview of the Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section
23. Our comments and requirements are as follows:
COMMENTS:
Weld County Strategic Roadway: (December 2002) WCR 13 is classified by the County is a Strategic
Roadway, which requires a 140-foot right-of-way at full build out. There is presently a 60-foot right-of-way.
This road is maintained by Firestone. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-
90), the required setback is measured from the future right-of-way line. (WCRs 7, 9.5, 11, 13, 22, 24, 27, 37,
49 and 74)
EQUIREMENTS:
Firestone has jurisdiction over all access to this portion of WCR 13. Please contact the town of Firestone to
verify the access permit or for any additional requirements that may be needed to obtain or upgrade of a
current permit.
The applicant shall indicate specifically on the plat the type of right-of-way/easement and indicate whether it is
dedicated, private, or deeded to provide adequate access to the parcel.
Storm Water Drainage:
All storm water detention facilities shall be designed to detain the storm water runoff from the fully developed
USR from a one-hundred-year storm and release the detained water at a rate not to exceed the rate of a five-
year storm falling on the undeveloped site. (Weld County Code Ordinances 2001-1; 2003-10, and 2006-7). All
storm water must be detained on site and follow the requirements per Weld County Code 24-7-130 D and
Ordinance 2006-7. Since no new construction is required for this USR Public Works will waive the above
requirement and require the applicant to detain the fully developed USR area from a ten-year storm and
release the detained water at a rate not to exceed the rate of a five-year storm falling on the undeveloped site.
The applicant shall also provide Water Quality Capture Volume in addition to the detention requirement. The
detention pond shall capture all impervious areas, buildings, parking lots etc. delineated as part of this USR
stormwater runoff. It shall be located to gravity flow into the County borrow ditch, it shall be properly protected
to prevent erosion and failure.
Final drainage construction and erosion controls plans (conforming to the final drainage report) stamped,
signed, and dated by a professional engineer license in the State of Colorado shall be submitted with each
"plan.
Provide 2' contours for the site and a minimum of 200' beyond the property boundaries.
Ilichis area is NOT in FEMA Flood Zones.
Parking lot and internal drives:
Explain in detail what type of proposed surface will be installed for the driveways and parking lots.
A stop sign shall be placed at the intersection of WCR 13 and the access into the USR facility to stop
eastbound traffic entering onto the WCR 13.
Place signs to indicate where the semi-trucks and trailers are to park.
The right-of-way or easement into the site shall be a graded and drained road to provide an all-weather
access.
Striping will be required on asphalt surfaces to define parking stalls for employees and visitors and for semi
truck parking on asphalt surfaces. Signs shall be installed to direct traffic flow and parking.
Stop blocks will be required to be installed for all employee and visitor parking where a constructed element is
not present to help prevent vehicles from rolling after being parked.
Parking lots shall conform to all standards of the American with Disabilities Act.
Utilize the existing agricultural, oil and gas, and ditch roads that are necessary for your agricultural operation.
"Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or
become established as a result of the proposed development, the applicant/landowner shall be responsible for
controlling the noxious weeds.

Dear Ms. Hatch:
I have reviewed the submitted material pertaining to the Site Specific Development Plan and
Special Review Permit for the storage of concrete materials and garaging of equipment at 11621
Weld County Road 13 (Case Number: USR-1652, Case Name: JAR Holdings LLC). The Fire
District does not object to the storage of materials on the property or to the use of the existing
pole barn for storage of equipment provided that the building will not be used for repair or
hazardous activity. It does not appear that any new construction is proposed at this time.
• Any new buildings shall be designed and constructed in accordance with the provisions of the
International Fire Code, as ratified by the Weld County Commissioners. All plans for future
construction must be submitted to the Fire District for review and approval prior to the issuance
of building permits. Water supply for fire protection must be provided for any new structures
built on the property.
Fire apparatus to the storage areas and building appears adequate as shown on the plans
submitted. All apparatus access roads designed and maintained to support the imposed loads of
fire apparatus(75,000 pounds), must have a surface that provides all-weather driving capabilities.

A Site Specific Development Plan and Special Review permit for a Use by Right, an accessory, or a Use by
Special Review use in the Commercial or Industrial Zone District (Parking and Storage for a Concrete Company)
in the A (Agricultural) Zone District.
1. A building permit shall be obtained prior to the construction of any new building and the change of use of the
existing building from private garage to commercial storage for a concrete company.
2. A plan review is required for each building for which a building permit is required. Plans shall include a floor
plan. Plans shall bear the wet stamp of a Colorado registered architect or engineer.
• Buildings shall conform to the requirements of the various codes adopted at the time of permit application.
Currently the following has been adopted by Weld County: 2006 International Building Code; 2006 International
Mechanical Code; 2005 International Plumbing Code; 2005 International Fuel Gas Code; and the 2005 National
Electrical Code and Chapter 29 of the Weld County Code.
4. The change of use will probably be classified as anS-1 (storage) occupancy. On site inspections will
determine if any concealed electrical wiring will need to be uncovered. The building including any existing or new
bathrooms shall be accessible to persons with disabilities. Fire resistance of walls and openings, construction
requirements, maximum building height and allowable areas will be reviewed at the plan review. Setback and
offset distances shall be determined by the Zoning Ordinance.
5. Building height shall be measured in accordance with the 2006 International Building Code for the purpose of
determining the maximum building size and height for various uses and types of construction and to determine
compliance with the Bulk Requirements from Chapter 27 of the Weld County Code. Building height shall be
measured in accordance with Chapter 23 of the Weld County Code in order to determine compliance with offset
and setback requirements. Offset and setback requirements are measured to the farthest projection from the
building.
6. Provide a letter of approval from Firestone Fire protection District before issuance of a building permit.
7. There are two historical building permits on record. One has final status and the building permit for the
proposed storage building was expired by the Board of County Commissioners.

Environmental Health Services has reviewed this proposal for parking of vehicles and
storage of materials for a concrete company. The site is served by a commercial well
(permit - 276596) and an individual sewage disposal system (permit - G-950307).
Employees use the residence on site for restroom and drinking water purposes. No
maintenance of equipment or vehicles is performed on site. The shop is utilized for
storage of equipment, such as generators.
We have no objections to the proposal, however, we do recommend that the following
conditions be part of any approval:
• We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1 . The applicant shall submit a dust abatement plan for review and approval, to the
Environmental Health Services, Weld County Department of Public Health &
Environment.
2. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
3. In the event washing of vehicle will occur on site the applicant shall ensure that
any vehicle washing area(s) shall capture all effluent and prevent discharges
from the washing of vehicles in accordance with the Rules and Regulations of the
•
• Water Quality Control Commission, and the Environmental Protection Agency.
Vehicle washing areas should be designated on the plat.
4. In the event the applicant intends to utilize the existing septic system at the
home, for employee use, the septic system shall be reviewed by a Colorado
Registered Professional Engineer. The review shall consist of observation of the
system and a technical review describing the systems ability to handle the
proposed hydraulic load. The review shall be submitted to the Environmental
Health Services Division of the Weld County Department of Public Health and
Environment. In the event the system is found to be inadequately sized or
constructed the system shall be brought into compliance with current
Regulations. Alternately, the applicant can install a new septic system in the
shop for employee use which shall be installed according to the Weld County
Individual Sewage Disposal Regulations.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
• 2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. The applicant shall operate in accordance with the approved "waste handling
plan".
5. The facility shall be operated in accordance with the approved "dust abatement
plan" at all times. The facility shall have sufficient equipment available to
implement dust control as required by the Weld County Department of Public
Health and Environment.
6. Any vehicle washing area(s) shall capture all effluent and prevent discharges in
accordance with the Rules and Regulations of the Water Quality Control
Commission, and the Environmental Protection Agency.

7. This facility shall adhere to the maximum permissible noise levels allowed in the
•
Commercial Zone as delineated in 25-12-103 C.R.S., as amended.
8. Adequate handwashing and toilet facilities shall be provided for employees and
patrons of the facility, at all times.
9. Sewage disposal for the facility shall be by septic system. Any septic system
located on the property must comply with all provisions of the Weld County Code,
pertaining to Individual Sewage Disposal Systems.
10.A permanent, adequate water supply shall be provided for drinking and sanitary
purposes.
11.If applicable, the applicant shall obtain a stormwater discharge permit from the
Colorado Department of Public Health & Environment, Water Quality Control
Division.
12.The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.
Additionally, please note the following:
1. This application is proposing a well as its source of water. The applicant should
• be made aware that while they may be able to obtain a well permit from the Office
of the State Engineer, Division of Water Resources, the quantity of water
available for usage may be limited to specific uses, i.e. commercial use only, etc.
Also, the applicant should be made aware that groundwater may not meet all
drinking water standards as defined by the Colorado Department of Public Health
and Environment. We strongly encourage the applicant to test their drinking
water prior to consumption and periodically test it over time.

Right, an Accessory use, or a Use by Special Review in the Commercial or Industrial

Dear Ms. Hatch:
This referral does not appear to qualify as a "subdivision" as defined in Section 30-28-
101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 memorandum to
county planning directors, this office will only perform a cursory review of the referral information and
provide comments. The comments do not address the adequacy of the water supply plan for this
project or the ability of the water supply plan to satisfy any County regulations or requirements. In
addition,the comments provided herein cannot be used to guarantee a viable water supply
• plan or infrastructure,the issuance of a well permit, or the physical availability of water.
According to the referral information a well will be used to provide water for domestic and
irrigation uses at the site. The referral information did not clarify the permit no. for the well or provide
a detailed description of the proposed uses of the well. Without this information our office cannot
properly evaluate the referral to determine if the well is properly permitted to serve the proposed uses.
Therefore, prior to providing comments the applicant must specify the well permit no. for all wells on
the property and provide a detailed description of the proposed uses of those wells.
