SUBJECT: Follow-up site visit at the request of Commissioner Masden
This memorandum is a follow-up to the site visit performed on December 10, 2007 [see attached
memorandum of the proceedings]. On this date, Mr. and Mrs. Duane Oster(property owners), Ted
Oster(relative), Planning Director Honn, Commissioner Masden and Planner Caruso met on site for
the purposes of evaluating the current site condition. The situs address is 22243 County Road 53,
Kersey, CO 80644.
During this meeting the Oster's responded to staff inquiries regarding lack of screening. Mr. Duane
Oster, herein referred to as Duane, explained that over time, due to health issues of his own, the site
had become excessive in regards to stacking of pallets and storage of materials and equipment.
Duane relayed that he has cleaned up the site substantially but due to traffic concerns and a limited
site he would prefer not to screen the property to avoid potential accidents on County Road 53. He
stated that he would use wood which is used to make the pallets as a screening measure to avoid
negative impacts to surrounding properties.
During this meeting Duane asked about the feasibility and requirements to construct a three-sided
building adjacent to County Road 53 and in the center of the property. Director Honn stated a
building permit would be required with an electrical permit being required if the building would be
serviced with electricity. Director Honn also stated setbacks from the County Road right-of-way will
be required.
Planner Caruso stated that investigation of the setbacks will occur as soon as possible and Planning
Staff will contact Duane to relay what the current required setbacks are.
After further discussion between the property owner, Director Honn and Commissioner Masden
occurred it was agreed upon that no further action from Weld County will occur at this time in regards
to screening.
Planner Caruso noted the existing cargo container on-site during the previous site inspection and by
Direction of Director Honn neither building permit will be required nor an electric permit for the
electricity visually noted as being connected to the cargo container. A follow-up for the three (3)
semi-trailers being used for storage, current Weld County Code allows two (2) semi-trailers to be
used for storage, will also not be required.
