RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL
ACTION AGAINST ROSCOE ELLIOTT FOR VIOLATION OF THE WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Roscoe Elliott,VI#0100136, is allegedly in violation of the Weld County Code,
and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 9th day of December,2008, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Roscoe and Rachelle Elliott, property owners, were present at said hearing,
and
WHEREAS, the Board of County Commissioners deems it advisable to refer said violation
to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon
such referral until April 9, 2009, to allow adequate time for the property owners to completely
screen the junkyard from all adjacent properties and public rights-of-way, and to grant the
Nonconforming Use to include the entire property, with the exception of the oil wells set-backs on
the north end of the site, and the residential portion on the south end of the site,to bring the subject
property into compliance and for an inspection of the property by the Department of Planning
Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that VI #0100136 be, and hereby is, referred to the Weld County Attorney's
Office for legal action against Roscoe Elliott to remedy the violation of the Weld County Code, and
any other persons occupying the properties,any persons claiming an interest in the properties, and
any persons acting in active concert with the identified parties,with an instruction for delay of action
upon such referral until April 9, 2009, to allow adequate time for the property owners to completely
screen the junkyard from all adjacent properties and public rights-of-way, and to grant the
Nonconforming Use to include the entire property, with the exception of the oil wells set-backs on
the north end of the site, and the residential portion on the south end of the site,to bring the subject
property into compliance.

REMEDY
My records indicate that on July 11, 2008, I spoke with Rachelle and faxed her a Nonconforming Use
application. At that time, Rachelle indicated that she was offially leaving for maternity leave in like 1/2
an hour. She said she would get the application filled out and turned in within a month or so (upon her
return).
Since you have pulled the expansion of the salvage yard back to the limits as shown on aerial maps,
as soon as the Nonconforming Use has been approved, my violation case will be closed. Hopefully by
scheduling this hearing out until December 9, 2008, this will give you more than enough time to
complete and submit the Nonconforming Use application as we previously discussed.

07/01/2008 Property Inspected During an on-site inspection with Rachelle and Mr. Elliot,
the following items were discussed. They have removed
the expansion of the NCU portion of the property. We
briefly discussed the proposed road going through. We
also briefly discussed the fact that they want to install a
new office (I told them to submit a letter to Jacqueline
explaining that the new road was not within their control
and the fact that the new road is being installed will
negate their current access). Rachelle said she would
be in touch with Jacqueline. I also explained that they
would still need to complete and submit the NCU
application. Rachelle said she was due in a few weeks.
07/11/2008 Phone Call I called and spoke to Rachelle (303-833-3501). I
advised her that I still needed them to complete and
submit the NCU application. She asked me to fax
(303-833-5645) it to her her. I faxed it. She advised me
that today was her last day of work before maternity
leave, but if she couldn"t get it done today, she would try
to work on it next week.

The Department of Planning Services' staff will be recommending that the Board of County
Commissioners authorize the County Attorney to proceed with legal action to remedy the

Substitution of USES

As we discussed, please let me know how you wish to proceed before then end of this time
period (listed below). We discussed several options:
1.) Remove the vehicles located north of the existing Nonconforming Use (NCU) boundary
(approximately 100 feet north of side road to the east) as shown in the aerial photos which
would bring the property back into compliance with the existing NCU on site.
2.) Proceed with a Use by Special Review application, of which the first step would be to
have Dacono fill out our Notice of Inquiry form (let us know if you need or want this).
3.) We spoke about a Recorded Exemption, but it sounds like water would be an issue.
4.) Pursue annexation into Dacono and proceeding through their process.

not be in compliance with the Weld County Code, Chapter 23. The potential noncompliance(s) with the
Weld County Code are as follow:
While it is apparent that part of your business would be considered a "Nonconforming Use"
as it existed prior to the adoption of the Weld County Code in 1969. It is also apparent that
the business has substantially expanded. For your convenience I have included a copy of
an aerial photo (labeled#1) taken in 1969 showing the pre-existing boundaries of your
business; however as you can see in the second map (labeled#2), the business has
expanded beyond the boundaries established prior to the adoption of the Weld County
Code.
Therefore there are 2 options to bring the property into compliance:
1.) The business can be reduced to fall within the established parameters (see map
labeled #2). or
2.) A Use by Special Review(USR) application can be completed and submitted to the
Department of Planning Services for the expansion of a Nonconforming Use.

the western boun,dary of the Town of Dacaro. -
Mr. Elliott oten an auto wrecking and selvage yard which is a naroonfaodng
use. Mr- Elliott wishes to canetnict a building on the property far as office
and repair and storage of parts. Mr. Elliott is requesting that the Board Ye a
grant this extension of a nonconforming use to allow him to contract the -..:
