Our comments and requirements are as follows: COMMENTS: Weld County Roadway: WCR 1 is a major arterial road, which requires a 140-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. The applicants shall utilize the existing residential access to these parcels. Direct access from a public road will be limited to one (1) per legal parcel, except as further limited or restricted by zoning or subdivision regulations. Additional accesses may be approved by the Department of Public Works or the Board of County Commissioners. This policy shall apply to all new and existing accesses within the unincorporated areas of the County. The change of zone proposes a change from the R-I zone(low density residential)to the A zone (Agricultural),The City provided a letter in January 2008 responding to notices of inquiries for these properties.A copy of this letter is attached for your reference, • The Longmont City Council did discuss this referral at its June 24,2008 meeting;sewer service and water quality were of concern to Council,The City understands that this rezoning would eliminate the public sewer requirement that these properties are currently subject to.Because of the proximity to Union Reservoir,the City has concerns with these rezoning requests and the possible effects on water quality. Although many of the properties are already developed and use septic systems,the City is concerned about possible additional septic system and potential effects on water quality.Even with the A zoning,the City requests that no new septic systems be installed, Sewer service should be obtained from St.Vrain Sanitation District in the east half of Section 30 and from the City of Longmont in the west half of Section 30,where practical. A building permit shall be obtained prior to the construction or change of use of any structure. 2. A plan review is required for each building for which a building permit is required. Two complete sets of plans are required when applying for each permit. Residential building plans may be required to bear the wet stamp of a Colorado registered architect or engineer. 3. Buildings shall conform to the requirements of the codes adopted by Weld County at the time of permit application. Current adopted codes include the 2006 International Residential Code; 200361nternational Building Code; 2006 International Mechanical Code; 2006 International Plumbing Code; 2006 International Fuel Gas Code; 2008 National Electrical Code and Chapter 29 of the Weld • County Code. 4. Each residential building will require an engineered foundation based on a site-specific geotechnical report or an open hole inspection performed by a Colorado registered engineer. Engineered foundations shall be designed by a Colorado registered engineer. 5. Fire resistance of walls and openings, construction requirements, maximum building height and allowable areas will be reviewed at the plan review. Setback and offset distances shall be determined by the Zoning Ordinance. 6. Building height shall be measured in accordance with the 2006 International Building Code for the purpose of determining the maximum building size and height for various uses and types of construction and to determine compliance with the Bulk Requirements from Chapter 23 of the Weld County Code. Building height shall be measured in accordance with Chapter 23 of the Weld County Code in order to determine compliance with offset and setback requirements. When measuring buildings to determine offset and setback requirements, buildings are measured to the farthest projection from the building. The application is to change the zoning from residential (R-1)to agricultural (A)zoning on 25 properties. All of the parcels are served by Left Hand Water District and Individual Sewage Disposal Systems. This department has reviewed our files to determine which properties have septic permits. The following properties do not have septic permits on file: 13722 WCR 1, 13610 WCR 1, 13853 WCR 3 and 13754 WCR 1. We recommend the following condition to be added to the approval for the four properties indicated above: 1. All septic systems located on the property shall have appropriate permits from the Weld County Department of Public Health & Environment. The Environmental Health Division of the Weld County Department of Public Health & Environment was unable to locate a septic permit for the septic system located on the parcel.
