SUBJECT: llika. 8 Site Inspection at request of potential applicant, Ted Zigan
On October 1, 2007 County staff was contacted by Ted Zigan regarding the requirements to
expand the business located at 17459 County Road 25; Platteville, CO 80651. Planning
Staff concluded that the addition of employees, a 4,000 sq. ft. building and additional trips
per day as requested by Mr. Zigan would be an amendment to the existing Use by Special
Review, USR-798. An amended Use by Special Review application would be required.
Subsequent conversation with Mr. Zigan occurred with the number of additional employees
and trips per day being lowered. Planning staff reiterated that the proposed changes are an
amendment to the existing Use by Special Review and an amendment to USR-798 would
be required.
Following the determination by staff and informing Mr. Zigan of staffs determination Director
Honn was contacted by the potential applicant. Director Honn asked Planner Caruso to
coordinate an on-site inspection of the property.
An on-site inspection at 17459 County Road 251 Platteville, CO 80651 occurred on Friday,
January 4, 2007. Attendants included Mr. Zigan, Director Honn and Planner Caruso. Mr.
Zigan presented the changes to Director Honn and Planner Caruso. Mr. Zigan stated that
he would like to add one additional employee, up to twenty(20) additional trips per day and
a 4,000 sq. ft. building.
Planner Caruso asked if the current business, located on the west side of the property
would cease to exist. Mr. Zigan stated that business would continue. Director Honn noted
that the new building would be in a different part of the Use by Special Review and that may
require an amendment to the USR-798.
Planner Caruso stated staff has historically required that the applicant be approved by the
Weld County Board of Commissioner's and a plat of the amended Use by Special Review
be recorded before construction of the proposed building or addition of employees or truck
trips. However, if Director Honn would release building permits early staff may conclude
that receiving the application be sufficient with the stipulation that construction of buildings
would be at the applicant's risk. Director Honn and Planner Caruso thanked Mr. Zigan and
asked that he submit a map of the proposed changes.

Upon receipt of the map, submitted by Mr. Zigan a meeting between Director Honn and
Planner Caruso occurred. During the review of the previously approved Use by Special
Review and proposed changes Director Honn concluded that USR-798 Development
Standard number seven (7), approved by the Weld County Board of County Commissioners
on August 19, 1987, which states "The Use by Special Review area shall be limited to the
plans shown herein and governed by the foregoing Standards and all applicable Weld
County Regulations. Any material deviations from the plans or Standards as shown or
started shall require the approval of an amendment of the Permit by the Weld County
Planning Commission and the Board of County Commissioners before such changes from
the plans or Standards are permitted. Any other changes shall be filed in the office of the
Department of Planning Services" constituted that an amendment to the existing Use by
Special Review would be required.
Planner Caruso concurred but also stated the addition of employees, truck trips per day and
4,000 sq. ft. building, not the location of the building in-and-of-itself, required an amendment
to the existing Use by Special Review.
Director Honn notified Mr. Zigan that Planning Staff would require an amendment to the Use
by Special Review before building permits would be released for the proposed 4,000 sq. ft.
building.
