RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL
ACTION AGAINST ANTONIO ESTRADA FOR VIOLATION OF THE WELD COUNTY
CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Antonio Estrada, ZCV#0800018, is allegedly in violation of the Weld County
Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 13th day of May, 2008, a public hearing was held before the Board of
County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Antonio Estrada, property owner, was present at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said violation
to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon
such referral until July 13, 2008, to allow adequate time for the property owner to remove the
commercial vehicles and equipment, remove or demolish the mobile home,and to restore, remove
or screen the noncommercial junkyard from all adjacent properties and public rights-of-way to bring
the subject property into compliance and for an inspection of the property by the Department of
Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that ZCV#0800018 be, and hereby is, referred to the Weld County Attorney's
Office for legal action against Antonio Estrada to remedy the violation of the Weld County Code,
and any other persons occupying the properties,any persons claiming an interest in the properties,
and any persons acting in active concert with the identified parties, with an instruction for delay of
action upon such referral until July 13, 2008, to allow adequate time for the property owner to
remove the commercial vehicles and equipment, remove or demolish the mobile home, and to
restore, remove or screen the noncommercial junkyard from all adjacent properties and public
rights-of-way to bring the subject property into compliance.

adjacent properties and public rights-of-ways.
Any household trash shall be completely removed (Screening is not an option for household trash).
RECOMMENDATION
The Department of Planning Services recommends this case be referred to the County Attorney's Office
for immediate legal action.

01/15/2008 Property Inspected Upon a visual inspection of the property, the following
items were noted: multiple derelict vehicles, pallets,
wood, cinder blocks, fencing materials, tow truck, dump
truck, tires, truck toppers, automobile parts, a deck for a
mobile home and miscellaneous debris. I also noted a
mobile home out behind the stick built house. It appears
as though they are operating an auto repair business. No
pictures were taken during this inspection.
03/12/2008 Office Visit Mr. Estrada came into the SW Weld Office to discuss his
options. We briefly discussed his Noncommercial
Junkyard. He still claims that there are no commercial
activities ran from this site. Michelle explained that he
could apply for a Recorded Exemption for the mobile
home or it would need to be removed.
03/26/2008 Property Inspected Upon a visual inspection of the property, the following
items were noted: No obvious visible progress. Still
numerous vehicles, fencing materials, automobile parts,
wood, brick/stone and miscellaneous debris. The mobile
home is still out back. See pictures dated 03/26/08.

use the special review permit process to develop.

It is the intention of this office to assist and cooperate with you without imposing undue hardships;
however, we have no discretion in this matter if you fail to correct this violation. You have until
02/29/2008, to correct this zoning violation. Failure to do so will result in this office scheduling the
violation before the Board of County Commissioners to consider whether to refer the violation to the
County Attorney's Office for legal action.

Dear ESTRADA ANTONIO:
It has come to the attention of the Department of Planning Services staff that the uses on your property may
not be in compliance with the Weld County Code, Chapter 23. The potential noncompliance(s)with the
Weld County Code are as follow:
during a visual inspection, I noted the following items which the Weld County Code
considers part of a NONCOMMERCIAL JUNKYARD: multiple DERELICT VEHICLES,
pallets, wood, cinder blocks, fencing materials, tow truck, dump truck, tires, truck toppers,
automobile parts, a deck for a mobile home and miscellaneous debris.
I also noted the presence of a mobile home. The Weld County Code allows 1 (one)
Principle Dwelling Unit per parcel. In this case, the stick built house would be considered
the principle dwelling unit. Therefore, the mobile home shall be removed from the property.
Lastly, it the commercial business, vehicle and equipment storage shall be removed or
appropriately permitted.
