RE: ACTION OF THE BOARD OF COMMISSIONERS REGARDING VIOLATION VI#0100259
AGAINST GUADALUPE AND ROSE CHAVEZ FOR VIOLATION OF THE WELD COUNTY
CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Guadalupe and Rose Chavez, VI #0100259, are allegedly in violation of the
Weld County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 9th day of December, 2008, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Guadalupe and Rose Chavez were not present or represented at said hearing,
although all parties were notified of said hearing by Department of Planning Services staff, and
WHEREAS, the Board deems it advisable to bring legal action against those individuals
named above to correct said violation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Weld County Attorney be, and hereby is, authorized to proceed with
legal action against Guadalupe and Rose Chavez to remedy the violation of the Weld County Code,
and any other persons occupying the properties,any persons claiming an interest in the properties,
and any persons acting in active concert with the identified parties.

conducted in compliance with the performance standards contained in Sections 23-3-340,

23-3-330.6.1 Any USE of a research, repairing, manufacturing, fabricating, processing,
assembling or storage nature may be conducted in the 1-3 Zone District.
23-3-330.C Accessory Uses. The following BUILDINGS, STRUCTURES and USES may
be allowed in the 1-3 Zone Districts so long as they are clearly incidental and accessory to
the Use Allowed by Right. Such BUILDINGS, STRUCTURES and USES must be
designed, constructed and operated in conformance with the performance standards set
forth in Sections 23-3-340, 23-3-350 and 23-3-360 below.
23-3-330.C.4 One (1) MOBILE HOME when USED as living quarters for caretakers or
security personnel responsible for maintaining or guarding the property, subject to the
provisions of Section 23-4-220 of this Chapter.
23-3-330.E Site Plan Review Required. No land, BUILDING or STRUCTURE shall be
USED, changed in USE or type of occupancy, DEVELOPED, erected, constructed,
reconstructed, moved or structurally altered or operated in the 1-3 Zone District until a Site
Plan Review has been approved by the Department of Planning Services. It shall be
necessary that the applicant in the 1-3 Zone District certify and state that the performance
standards and district requirements that are applicable to the DEVELOPMENT and USES
of property zoned 1-3 have been or shall be complied with according to the intent of Article
II, Division 3 of this Chapter. This shall be accomplished through the Site Plan Review
application process. Uses listed in Subsection D above as Uses by Special Review in the
1-3 Zone District shall be exempt from the Site Plan Review process and shall make
application for approval of a permit in accordance with the requirements and procedures

As I previously indicated I have been unable to locate permits for the current used occurring on the
above mentioned property, including, but not limited too, multiple mobile homes, auction yard,
COMMERCIAL JUNKYARD and whatever uses are on this property. In order to determine what
permit is required, we will need an outlined list of all activities and storage items on this property. If you
have any questions that you would like to discuss with a Planner, an appointment must be scheduled
with Kim Ogle, Planning Manager at 970-353-6100 Ext. 3540. To better serve you please bring this
letter with you.
RECOMMENDATION
The Department of Planning Services recommends this case be forwarded to the County Attorney's
Office for immediate legal action.

08/22/2003 Phone Call Mr. Chavez called. He stated that he bought the
property with the mobile homes already on it. I told him
that they needed to be permitted or removed. He said a
"caretaker" lives in one of them and another guy lives in
the other one. I told him that he would have a very hard
time keeping both of them, but he needed to talk to a
planner. I also told him that because his property is
zoned 1-3 and there is a business being operated on the
property, at a minimum, he would need a Site Plan
Review, but again, he needs to speak with a Planner.
He indicated that he was going to try to clean the
property up a little bit and he would try to get to the
South West Weld Office on a Tuesday or Thursday.
08/20/2008 Phone Call Lupe Chavez(303-472-1513) called me. He said he had
just received my letter and wanted to know what it was in
referrence too. I explained this was in regards to the
property on Hwy 85 and the intersection of CR 4. He
said yes. I explained that the site has changed business
operations and as such now requires a Site Plan Review.
He said but I'm zoned Industrial there. I said I realize
that, but you still need a Site Plan Review permit at a
minimum. He said his tenant(Steve Miller) holds
auctions there every 3 months or so. He said all that
junk there is his. He said he was wanting to get the
property cleaned anyway. I explained that the first step
was to schedule a Pre-Application meeting. He asked if I
would fax that to him (303-536-9961 fax number). I told
him that I would.

• The pre-application request is the preliminary review of a land use proposal. Pre-application reviews are required
prior to beginning the application process; however, this review is not an application.
• Pre-application reviews are held with the Weld County Departments of Public Works and the Public Health and
and Environment. The second and fourth Friday of any given month pre-applicant reviews are held in the
Southwest Service Center office at 10:30 a.m., 11:30 a.m., 1:00 p.m., 2:00 p.m. and 3:00 p.m. Pre-Application
reviews are held Thursday of any given week in the Greeley office. To be on the pre-submittal agenda, the request

23-3-330.C Accessory Uses. The following BUILDINGS, STRUCTURES and USES may be
allowed in the 1-3 Zone Districts so long as they are clearly incidental and accessory to the
Use Allowed by Right. Such BUILDINGS, STRUCTURES and USES must be designed,
constructed and operated in conformance with the performance standards set forth in Sections
23-3-340, 23-3-350 and 23-3-360 below.
23-3-330.C.4 One (1) MOBILE HOME when USED as living quarters for caretakers or security
personnel responsible for maintaining or guarding the property, subject to the provisions of
Section 23-4-220 of this Chapter.
23-3-330.E Site Plan Review Required. No land, BUILDING or STRUCTURE shall be USED,
changed in USE or type of occupancy, DEVELOPED, erected, constructed, reconstructed,
moved or structurally altered or operated in the 1-3 Zone District until a Site Plan Review has
been approved by the Department of Planning Services. It shall be necessary that the
applicant in the 1-3 Zone District certify and state that the performance standards and district

In an effort to close out some older open violations, I ran across this case. As I previously
indicated I have been unable to locate permits for the current used occurring on the above
mentioned property, including, but not limited too, multiple mobile homes, auction yard,
COMMERCIAL JUNKYARD and whatever uses are on this property. In order to determine
what permit is required, we will need an outlined list of all activities and storage items on
this property. If you have any questions that you would like to discuss with a Planner, an
appointment must be scheduled with Kim Ogle, Planning Manager at 970-353-6100 Ext.
3540. To better serve you please bring this letter with you.
It is the intention of this office to assist and cooperate with you without imposing undue hardships;
however, we have no discretion in this matter if you fail to correct this violation. You have until
09/04/2008, to correct this zoning violation. Failure to do so will result in this office scheduling the

Upon review of our records, I was unable to find any permits allowing the uses occurring on the
property. Furthermore, I was able to find evidence that a small portion of Rocky Mountain Ready
Mix was addressed through their application for a Use by Special Review(USR-1373). Please see
the enclosed Site Plan Review application. To bring your property into compliance a completed
Site Plan Review application shall be submitted to the Department of Planning Services
addressing both any and all commercial activities and mobile homes. For questions, I would
suggest that you speak to one of our"On-Call" Planners. We have to locations open to the public.
Our main office is located at 1555 N. 17`h Avenue, Greeley, Colorado, Where, we have an "on-
call" planner, Monday or Wednesday from 8:00 a.m.-4:00 p.m. or Friday from 12:00-4:00 p.m.
Our other office(the Southwest Weld Office)is located at 4209 CR 24.5, Longmont, Colorado. At
our Southwest office, a planner is available Tuesday or Thursday from 8:00 a.m. - 4:00 p.m.,
excluding 12:30-1:30. You do not need to call to schedule an appointment, because individuals
