Explain, in detail, the proposed use of the property. RESPONSE: The Use by Special Review area (34 Acres) will be used to maintain and repair construction equipment for Connell Resources, Incorporated (CRI). CRI is a heavy highway construction and site contractor. The property will be used as a maintenance facility for those pieces of equipment utilized in the work performed by CRI. There will be three (3) structures located on the site for the regular maintenance and upkeep this equipment requires: • 6,325 sf Machine Repair Shop • 16,827 sf Vehicle Shop/Maintenance Facility • 1,200 sf Wash Bay In addition to generous setbacks from property lines, the site will have three to seven foot tall earth berms to isolate any of the minimal noises generated on-site and visually screen on-site activities. Maintenance Facility yard areas will be surfaced with gravel or recycled asphalt as a housekeeping and erosion control measure. Dust control will be achieved by using water trucks with spray bars when appropriate. Areas beyond the limits of the Use by Special Review shall be maintained as farmland. 2. Explain how this proposal is consistent with the intent of the Weld County Code, Chapter 22 'Comprehensive Plan). RESPONSE: 22-1-120: Private Property Rights: The comprehensive plan supports preservation of the right • for citizens to own and utilize their property so long as use is balanced with the responsibility of protecting community health, safety, and welfare. This development will not pose a risk to community health, safety or welfare. 22-1-150 and 22-2-1 10: The comprehensive plan allows for conversion of agricultural land in areas around existing municipalities and where adequate services are available. In addition, Industrial development is encouraged because of its economic benefits so long as adequate public facilities and services can be provided. The Use By Special Review area falls just outside the Town of Windsor urban growth boundary and just outside of the Town of Windsor East Side Industrial Sub-area Plan. The proposed use is compatible with future land use maps for this area: • South of the Property: Heavy industrial zoning • West of the Property: Light Industrial All surrounding parcels, including this property, are currently in Weld County. The following entities are able to serve this site: • Windsor-Severance Fire Protection District • North Weld County Water District (for Use by Special Review area) • On-site septic system Transportation: The comprehensive plan encourages industrial development close to major traffic corridors. This parcel is within 0.5 miles of highway 392. While the site has direct access to highway 392 from the adjacent County Road 23, Connell Resources intends to direct their traffic to Highway 392 via Eastman Park Drive and Highway 257. • Connell Resources USR 1606—Maintenance Facility September 25, 2007 Page 1 • • SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW QUESTIONNAIRE • 22-2-70: The comprehensive plan requires a minimum lot size of 80 acres for viable farming operations. This Use by Special Review (approximately 34 acres in size) is a portion of an 187 acre parcel. 22-2-140: The Comprehensive Plan encourages Industrial Development oriented towards transportation facilities and with minimal conflicts with other land uses. This property is located along the Colorado and Southern Railroad. Heavy Industrial uses exist across the railroad tracks to the South. This proposed use provides a buffer between the heavy industrial uses to the South and the residential uses to the North. The comprehensive plan identifies the need to accommodate new industrial development within planned industrial areas. A portion of the larger property is partially located in the East Side Industrial Sub-area of Town of Windsor and the Use by Special Review abuts the Eastern most edge of the Industrial Zone District. The Comprehensive Plan promotes industrial development located appropriately to surrounding land uses. This property is across the railroad tracks from heavy industrial uses and as such provides a buffer between to the residential area just. The Comprehensive Plan promotes use of visual and sound barrier landscaping to screen open storage areas from residential uses or public roads. This development proposes significant berming and landscaping along its perimeter, which effectively meets this goal. • 3. Explain how this proposal is consistent with the intent of the Weld County Code, Chapter 23 fZoninq) and the zone district in which it is located. RESPONSE: The property is currently zoned A (agriculture) in Weld County. The following discussion summarizes code requirements and how this development proposes to meet said requirements: Operational Standards (Section 23-2-250): • Noise (Sec. 25-12-101) —This development intends to meet Weld County standards and requirements. • Air Quality (Colorado Air Quality Control Commission) —The proposed development will meet Colorado Air Quality Control standards as required. • Water Quality (Colorado Water Quality Control Commission) —The proposed development will meet Colorado Water Quality Control standards as required. • Lighting: The proposed site lighting shall fully comply with Weld County Requirements and Standards. A photometric plan for site lighting is provided in the plot plan drawing set. This proposed use is in compliance with the Accessory Use requirement for A zone district (Sec.23-3-30): gross floor area of all buildings shall not exceed 4% of the total lot area. The proposed buildings cover 2%of the Use by Special Review area. Bulk requirements (Section 23-3-50) criteria have been met or exceeded: • Lot Size: This Use by Special Review is located within Parcel C. Parcel C is 187 acres in size. • Setback: The minimum setback of 20' is exceeded. The closest building to a property • line is the Wash Bay, located 83 feet East of the property line. Connell Resources USR 1606—Maintenance Facility September 25, 2007 Page 2 SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW QUESTIONNAIRE • • Offset: The minimum offset of 3 feet or 1 foot for each 3 feet of building height. Buildings are spaced 80' or 100' apart from one another. The Wash Bay structure is the closest to a property line and is located 83' from the closest point on the property line. • Animal Units: No animal units are proposed with this use. • Building/Structure: To the applicant's knowledge the building locations all exceed the distance requirements of 250'from a tank battery and 150' radius to a wellhead. • Landscape: Proposed landscaping, including significant berming, is carefully thought out and effective in creating buffer for existing and future adjoining land uses. • Lighting: Site lighting will comply with Weld County code requirements. A photometric plan is provided with this submittal for review and approval. Future Land Uses/ Development Surrounding the Site: The land to the West, North and East are zoned A in Weld County. An area to the Northeast is zoned E (Estate). The land to the South is zoned 1-3 (industrial). The portion of Lot C of this property West of the Section line is within the Town of Windsor East Side Industrial Sub-area. Town of Windsor shows this Western portion of Lot C within the Windsor GMA and maps the area as future industrial use/zoning along with the area immediately West and Northwest of this property. The Town of Windsor also shows the land immediately to the Southwest, South and Southeast as heavy industrial on their future land use map. 4. What type of uses surround the site? Explain how the proposed use is consistent and compatible with surrounding land uses. • RESPONSE: Immediately to the South are Heavy Industrial uses: a bottle plant, ethanol plant, and Kodak further to the Southwest. To the East, West, and North are agricultural lands. Two lots immediately to the Northwest have residences with various sheds and other structures. To the North and Northeast is a residential neighborhood with approximately 20 single-family lots. This site plan has been carefully designed to minimize impacts of traffic, noise, and glare through appropriate site design and buffering. The maintenance yard is fully enclosed with a six (6) foot tall chain-link fence, which is then surrounded by significant berming with a mixture of deciduous and evergreen tree and shrub plantings. The proposed structures are at such great distances from adjacent uses that there are no glare issues. Connell Resources routinely sprays areas paved with gravel to keep dust to a minimum. Noise levels are relatively low and should not impact surrounding properties. Even though glare, dust, and noise are not anticipated to be nuisance issues to neighbors,the proposed buffers between property lines should reduce any potential light, noise or operational activities 5. Describe, in detail, the following: a. How many people will use the site? RESPONSE: There are seven (7) employees that will work on-site at the vehicle shop/maintenance building. There are six (6) employees that will work on-site at the machine/repair shop. Fifteen (15) parking spaces are provided for on-site employees. This allows for the addition of two (2) more employees on-site in the future. In addition to the thirteen (13) on-site employees, other employees could be on and off the site on any given day. These may include: • Connell Resources USR 1606 —Maintenance Facility September 25, 2007 Page 3 • • SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW QUESTIONNAIRE • • Foremen /Supervisors (25) - driving company pickups that may come to the maintenance building to pick up small supplies to take to job sites or to fuel their vehicles. The number of foremen that come to this facility on any given day depends entirely on their specific needs and the projects they are working on. Some of them may visit more than once and some of them may not come at all. • Fuel trucks (2) - that come in to load fuel at the fuel island. These other employees are normally working in the field and will not use marked parking areas during their visit to the maintenance facility as they will be in and out. b. How many employees are proposed to be employed at this site? RESPONSE: There will be approximately 13-15 employees who work at this site on a regular basis. c. What are the hours of operation? RESPONSE: The hours of operation are Monday- Friday, 7:00am-5:OOpm, and occasional weekends. d. What type and how many structures will be erected (built) on this site? RESPONSE: There are three structures proposed: a vehicle shop/maintenance building; a machine repair shop; and an enclosed wash bay. What type and how many animals, if any, will be on this site? • RESPONSE: No animals will be housed or raised on this property. What kind (type, size, weight) of vehicles will access this site and how often? RESPONSE: On an average day the following types of vehicles could come to the site for repair or maintenance: Y ton — 1 ton pick-ups (5); service trucks—26,000 lbs and under(5); fuel trucks—50,000 lbs (4); tandem trucks—50,000 lbs (4); tractor-trailer- 80,000 lbs (4); lowboy trucks w/ load— 160,000 lb (2 times per week). g. Who will provide fire protection to the site? RESPONSE: Windsor-Severance Fire Protection District. h. What is the water source on the property? (Both domestic and irrigation) RESPONSE: Water for the Use by Special Review area will be provided by North Weld County Water District. Irrigation water will be provided from an existing on-site raw water source. i. What is the sewage disposal system on the property? (Existing and proposed) RESPONSE: There is no existing sewage disposal system on the property and no municipal facilities within one mile of the site. Wastewater from the proposed development will be handled by an on-site septic system. Flows from the proposed truck wash bay will be handled by an on-site lagoon system. Both of these systems are in the design phase and will be permitted by the appropriate agency prior to construction. • j. If storage or warehousing is proposed, what type of items will be stored? RESPONSE: No long term storage is proposed on this site. Construction equipment will be onsite while it is being worked on or repaired including HMA pavers, rollers, graders, scrapers, track-hoes, excavators, loaders, or other highway construction equipment. 6. Explain the proposed landscaping for the site. The landscaping shall be separately submitted as a landscape plan map as part of the application submittal. RESPONSE: The landscaping has been designed to provide year round interest through a mixture of evergreen trees, flowering ornamental trees, deciduous shade trees and shrubs. The perimeter landscape creates effective buffers between the proposed maintenance yard (the fenced in area with the 3 buildings) and future/existing development adjacent to these areas. Extensive landscaping and buffering is provided between this proposed development and the residential lots to the North. All berms include a diversity of plantings to create an aesthetically pleasing environment as well as providing additional buffering and screening. Berm heights proposed are as follows: • 4'-7' berm North of the fenced Maintenance yard (South of existing residential property North of the site). This berm extends 900 lineal feet East of the Maintenance Yard. • 3'-6' berm West of the fenced Maintenance yard (along the future WCR 23) • 4'-6' berm South of the fenced Maintenance yard and North of the private access road. • Connell Resources USR 1606—Maintenance Facility September 25, 2007 Page 5 SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW QUESTIONNAIRE • 7. Explain any proposed reclamation procedures when termination of the Use by Special Review activity occurs. RESPONSE: No reclamation procedures are anticipated at this time. 8. Explain how the storm water drainage will be handled on the site. RESPONSE: Storm-water runoff for the developed portion of the site will be routed to a proposed on-site detention facility. The detention pond will release at the historic 5-year runoff rate. The detained release will follow historic drainage patterns east to the Poudre River. Extended water quality detention will be provided in the proposed detention facility. 9. Explain how long it will take to construct this site and when construction and landscaping is scheduled to begin. RESPONSE: It will take approximately six months to complete the construction of initial building and facilities. 10. Explain where storage and/or stockpile of wastes will occur on this site. RESPONSE: Used oils will be accumulated in approved, above ground storage tanks. The tanks will have overfill monitoring systems and will be in double containment. The facility will have an approved and functional Spill Prevention, Control and Countermeasure (SPCC) plan • that meets 40 CFR Part 112. Used vehicle lead-acid batteries will be accumulated in a weather-protected area outside, but immediately adjacent to one of the maintenance facilities. No more than 40 batteries would be accumulated at any time.
