Home My WebLink About20082881.tiff RESOLUTION RE: APPROVE MINERAL QUIT CLAIM DEED AND AUTHORIZE CHAIR TO SIGN - FARFRUMWURKIN, LLLP WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS,the Board has been presented with a Mineral Quit Claim Deed from the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Public Works, to Farfrumwurkin, LLLP, with further terms and conditions being as stated in said Mineral Quit Claim Deed, and WHEREAS, after review, the Board deems it advisable to approve said Mineral Quit Claim Deed, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Mineral Quit Claim Deed from the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Public Works, to Farfrumwurkin, LLLP, be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign said Mineral Quit Claim Deed. Also attached are copies of the documents he refers to in his letter. It is clear in my mind that there was never an intention for Weld to get the minerals under these purchased rights-of-way. I base this on the original agreement and deeds, copies of which are attached. The quit claim deed to Farfrumwurkin LLLP you are considering today will assist that company in dealing with Kerr-McGee. Since we own the minerals and there is no lease on one of the parcels, we asked to become a working interest owner. They responded back and said that we had given up our mineral rights, by not reserving back the oil and gas minerals, when we quit claimed a portion of the ground to Weld County for the WCR 3 Y4 rd. right of way. The agreement in question was drafted by Weld County through Leon Sievers and recorded at rec # 3061579-81 and was signed by David E. Long Chairman. In speaking with Leon, he said that it was not their intention to receive the minerals and he has since spoken with Bruce Barker the county attorney regarding the matter. He requested that I send you a letter requesting that a quit claim be drafted up to return the minerals, in the event that the agreement did in fact transfer them to Weld County in the first place. It appears in question whether they were transferred or not, but to clarify for Kerr McGee, could you authorize a quit claim back to us. Bruce Barker is in the loop on this, so if you could get the proper approval and inform Bruce, so that he can prepare the documentation so we can clear this matter up, it would be most appreciated. t cerely J n P.
