RE: APPROVAL OF PRELIMINARY PLAN FOR THE BLUFFS SUBDIVISION.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, on the 23rd day of January, 1980, the Preliminary
Plan of The Bluffs Subdivision was submitted to the Board of
County Commissioners of Weld County, Colorado for approval in
accordance with the Subdivision Regulations of Weld County,
Colorado, and
WHEREAS, the Board of County Commissioners heard all of the
testimony and statements of those present, and
WHEREAS, the Board of County Commissioners had evidence
presented in support of the approval of said Preliminary Plan
for the following described real estate, to-wit:
Part of the Southwest Quarter of Section
31, Township 5 North, Range 65 West of
the 6th P.M. , Weld County, Colorado being
more particularly described as follows:
Beginning at the Southwest Corner of Block
8, McCutcheon's Addition to the Town of
LaSalle, and considering the West line of
said Block 8 of McCutcheon's Addition to
bear North 36°00 '00" East, with all other
bearings contained herein relative thereto;
Thence North 54°00 '00" West, 60.00 feet;
Thence North 49°44 ' 00" West, 870.70 feet;
Thence North 50°03 ' 00" West, 140 .00 feet
to the True Point of Beginning;
Thence continuing North 50°03 '00" West,
209.20 feet;

WHEREAS, the petitioner was present, and
WHEREAS, the Weld County Planning Commission has recommended
approval of the Preliminary Plan with the following conditions:
1. A proposal for the maintenance of the outlot and
drainage area around the cul-de-sac at the end
of Latham Drive until annexation by the Town of
LaSalle.
2. The Improvements Agreement submitted with the
Final Plat application shall include the costs
of excavating and back-filling all public rights-
of-way for those areas in the proposed landfill
area.
3. The applicant numbering the lots in accordance
with the Weld County Subdivision Regulations.
4. The applicant submitting a legal instrument which
will be recorded stating that Lot 29 shall not be
occupied until such time as the sewer line is
moved from Lot 29 to the lot line between Lots 28
and 29 to connect with sewer service at manhole
B3 and final connection is complete with the
remaining sewer lines in the subdivision.
5. The applicant submitting plans for Lot 19 which
shall contain 6, 500 feet of buildable site west
of the sewer easement such that the residence
can be constructed within the required Weld
County residential district setbacks. The
developer may adjust lot lines or move the sewer
line to achieve the required acreage.
6. The following notes shall be placed on the Final
Plat for the subdivision:
a. The area surrounding the cul-de-sac at the
end of Latham Drive shall be labeled as an
outlot and identified as to its purpose.
b. No building permits for those Lots identi-
fied on the landfill site shall be granted
until the plans are submitted for excavation
and fill of the foundations for the residences
and garages and the plans have been approved
by the Weld County Building Inspections Divi-
sion. (The plans to accompany the building
permit shall be in accordance with the Subsoil
Investigation Report for the Linder Subdivi-
sion, Project No. 791, MTL 0174 prepared by
ARIX, a Professional Corporation, under the
direction of Arthur F. Uhrich.
c. No Certificate of Occupancy shall be granted
until such time that the actual excavation
and of compaction fill as proposed in the
Building Permit plans have been completed
and certified by a registered engineer with
the State of Colorado.
d. Top of footings of all structures shall be at
least 1 foot above the 1973 100 year flood
elevation of 4658.4 as referenced in the
November 14, 1979 letter from the Colorado
Water Conservation Board.
e. Limits of the 100 year floodplain shall be
delineated on the final plat.
f. Limits of the landfill area shall be placed
on the final plat as identified in the Sub-
soil Investigation for the Linder Subdivision
Project No. 791 MTL 0184 prepared by ARIX,
a Professional Corporation, under the direc-
tion of Arthur F. Uhrich.
7. The Board of County Commissioners acting upon the
following requests for variances by the applicant:
a. Section 8-2A. (5) - Collector streets shall have
a minimum right-of-way width of 80 feet. Local
streets shall have at least 60 feet of right-
of-way width. The developer has proposed a
right-of-way width of 60 feet for Latham Drive
(a colletor) and right-of-way widths for 2nd
Avenue, 3rd Avenue and Platte Drive of 40 feet.
b. Section 8-2A. (g) - Cul-de-sac streets must be
provided with a right-of-way at the turn around
of 65 feet radius or more and the outside curb
or pavement edge radius must be 55 feet or more.
The developer proposes a paved radius of 35
feet.
WHEREAS, with regard to condition #7 as stated above, the
Board desires to grant a variance from Section 8-2A. (5) and to
deny a variance from Secticn 8-2A. (g) , and
WHEREAS, the Board of County Commissioners, after studying
the Preliminary Plan and all of the evidence and testimony pre-
sented, deems it advisable to approve said Preliminary Plan.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the Preliminary Plan of
The Bluffs Subdivision for the real estate described herein be,
and hereby is, approved subject to the conditions as stated
above.
BE IT FURTHER RESOLVED by the Board of County Commissioners
that a variance from Section 8-2A. (5) is hereby granted and a
variance from Section 8-2A. (g) is hereby denied.
BE IT FURTHER RESOLVED by the Board that the reasons for
approval contained in the Planning Commission recommendations dated
January 15, 1980 be, and hereby are, incorporated as the findings
of fact of the Board of County Commissioners in this matter.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the followingivote on the 23rd day of
January, A.D. , 1980.

2. The Town of LaSalle has no objections provided the developer
excavate under all garages, forndations and street right-of-ways
located in the landfill area.
3. The Weld County Utilities Advisory Review Board on December 20, B79
recommended approval of the Utilities Plan for the Preliminary
Plan advising the Planning Commission that there are still
unanswered questions regarding the road right-of-ways , the function
of the road maintenance easements and the governmental body
responsible for the maintenance of the water and sewer lines.

4. The LaSalle Fire Protection District has indicated that they have
no objections to the approval of the preliminary plan provided the
applicant include provisions for a 55 foot paved radius for the
cul-de-sac at the end of Latham Drive.
5. The Weld County Health Department has set forth no objections provided
the applicant is served by the Town of LaSalle water and sewer
districts as stated in the application materials .
6. The Weld County Engineering Department has set forth no objections.
7. The West Greeley Soil Conservation Service has set forth no
objections to this subdivision request.
The Planning Commission recommendation for approval is conditional upon
the following items being included in the application for the final plat:
1. A proposal for the maintenance of the outlot and drainage area around
the cul-de-sac at the end of Latham Drive until annexation by the
Town of LaSalle.

Based upon the response from the Town of LaSalle, the Planning Commission
recommends that the above variances be approved except for variance
request b. (the paved radius requirement for cul-de-sacs) . The LaSalle
Fire Protection District has requested that the paved radius of the
cul-de-sac at the end of Latham Drive be 55 feet as required in the Weld
County Subdivision Regulations rather than the proposed 35 feet requested
by the developer.

The RE-1 School District has not responded to the referral sent to
that office October 31, 1979.
To date our office has not received any letters of opposition to this
preliminary plan from surrounding property owners.
Based upon the open space formula in Section 8-15 B of the Weld County
Subdivision Regulations, the amount of land that can be considered
for public dedication or equivalent payment in lieu of dedication shall
be 1. 14 acres.

(LINDER SUBDIVISION)
Following our letter of December 19, 1979, we received some additional information
from Arix Corporation addressing our concerns regarding the potential for hydro-
compaction on the property. Based upon this information, it appears that adequate
mitigation measures will be taken to prevent hydrocompaction of yards, streets,
driveways, and sidewalks.
Arix also notes that sand and gravel extraction have generally been abandoned in this
area due to lack of coarse aggregates. Based upon other reserves in Weld County,
we see no problem with this evaluation.
Our concerns regarding potential flooding of some lots during a 100-year event were
not addressed by the developer. We should also point out that not only will flooding
occur on a number of lots (even though homes themselves will not be flooded), but
access will also be denied to several lots that use Latham Drive for access
(lots 13-17).
An alternative to placing additional fill to remove building sites and yard areasfrom
the 100-year floodplain is to raise Latham Drive above the 100-year flood elevation.
This would form a protective dike for all lots in this subdivision. Although the
cost of damages from flooding are minimized by placing first floor elevations above
the 100-year flood elevation, we feel that access and deposition of mud and debris
on yards and driveways are also factors that need to be considered.
Although the majority of our concerns have been adequately addressed, we still
cannot recommend approval of this subdivision until the above issues regarding
flooding have been resolved.

AT LA SALLE (LINDER SUBDIVISION)
We have reviewed the preliminary plat, grading plan, and supporting documents for
the proposed Linder Subdivision. The Preliminary Drainage Report by Otto and
Culver (Project No. 796105, October 18, 1979) indicates that a portion of the site
lies in the Cache La Poudre River flood plain. This should be changed to read the
South Platte River flood plain.
The preliminary grading plan also indicates that lots 17-19 will still be within the
100-year flood plain after grading operations are completed. Although first floor
elevations are to be at least one foot above the 4658.4 ft flood elevation, this does
not protect the remainder of these lots from deposition of mud and debris during a
major flood. Therefore, we feel that the grading plan should be revised to bring these
lots above the 100-year flood elevation.
The grading plan also has certain drainage arrows directed down ridges rather than
down swales (see lot 1 and between lots 28 and 29). This should be corrected on
subsequent grading plans.
Finally, the Subsoil Investigation Report by Arix Corporation (Project No. 79-1-
MTL-0184, October 8, 1979) indicates that burned trash overlain by fill exists beneath
a portion of the site. Their recommendation that all trash and fill be removed in
foundation excavations should be closely observed. However, blow counts in the
existing fill material are extremely low (T.B. #2 and #5), and wesispect that this
material is highly susceptible to hydrocompaction. Such a condition could result in
excessive differential settlement in areas where significant amounts of water are
applied. Lawn and garden areas with streets, driveways, and sidewalks adjacent to
them could experience settlement unless appropriate precautions are taken. Therefore,
we recommend that Arix Corporation address: 1) the susceptibility of this fill
material to hydrocompaction; and 2) what measures, if needed, will be used to prevent
hydrocompaction of this material .

Finally, the subsurface information supplied by Arix Corporation indicates that
at least 15 ft of sand and gravel underlie the majority of this site. The proposed
use of this property should not conflict with the county's regulations regarding
Resource Conservation Areas in the Mineral Resource Extraction Plan (1975).

It has been called to my attention by Mr. Larry Linder that you interpreted
our soils report to mean that the entire area occupied by the dump is to be
removed and replaced with select backfill material .
Our intention was for the removal of the trash and debris from each excavated
building site only. We feel that there is no need for removal of the trash
from the grassed and paved areas of the subdivision. Street areas should be
checked during construction as a thin upper layer of compacted soil over
debris may prove too unstable. We do not know the final grading of the
streets; therefore, we can only caution the engineer and the developer.

Two additional test excavations were dug in the vicinity of 2d Avenue.
Trash in debris in the first excavation was observed to a depth of 4.5
feet. The second excavation was approximately 80 feet north of the
intersection of 2d Avenue and Platte; trash and debris were encountered
to a depth of 9 feet.
It is our opinion that the trash should be removed to a depth of at least
5 feet below the finished grade. Trash and debris below this depth should
be wetted and compacted thoroughly with vibratory equipment until stabil-
ity is achieved. When the Owner and/or Engineer are satisfied as to the
stability, then imported granular material should be laid in loose lifts
not to exceed 8 inches and compacted to at least 95 percent of maximum
dry density as established in accordance with ASTM D698.
Any areas that become unstable during backfilling should be excavated and
stabilized prior to continuing backfilling.

This is a deep , excehsively drained soil on terrace breaks and escarp-
ments at elevations of 4450 to 5100 feet . It formad in gravelly
alluvium on slopes of 9 to 25 percent.
Included in this unit arc sour: soils with pockets of sandy loam and
• loam in the underlying material.
Typically the surface layer is pale brown gravelly sand about 10 inches
thick. The underlying material, to a depth of 60 inches is pale
brown gravelly sand.
Permeability is rapid. Available water capacity is low. Effective
rooting depth is 60 inches or more. Surface runoff is medium and
moderate.erosion hazard is
The potential native vegetation on this site is dominated by little
bluestem, sideoats grama, sand reedgrass, blue grama , hairy grama ,
switchgrass and needle-and-thread. Potential production ranges from
700 pounds per acre in favorable years to 200 pounds per acre in unfa-
vorable years. When range condition deteriorates , the tall and mid-
grasses decrease , blue grama and hairy grama increase and production
drops.
Management of vegetation should be based on taking half or less of the
total annual production. Since this site does not readily lend itself
to seeding or any mechanical treatment , deferred grazing is a practical
method of improving range condition.

Dear Mr. Fortner,
Pursuant to Sec. 5-2-E, County Subdivision Stqndards,
please find below a summary statement concerning the proposed
subdivision:
It is felt that the highest and best use for this subject
property is as a residential subdivision , and that the proposed
Linder Subdivision embraces the best planning cnncepts and
designs allowed by this site.
This 34 lot proposal-on 8.84 acres has been designed to
be compatable with both County and Town standards, but where
variances exist deference has been given to La Salle Town
standards.
La Salle Town water and sewer facilities are proposed
for this project and the developer has agreed to extend both
water and sewer mains as per Town requests. Estimates for
site improvements are:
Sewer $18,000. ; Water $36,000.; Paving,Sidewalks ,
Curb and Gutter $48,000. ; Grading, Misc . work $44,200.
TOTAL= $146,200.
The United Bank of La Salle has approved a construction
loan for $220,000. to fund these improvements.
Certain specific issues should be cited:
1. For the on-site drainage pond area, it is proposed
that the Developer retain title and assume maintenance
responsibility until such time as tie Town of La Salle annexes
the subdivision. At that time this combination drainage pond-
open space area will be dedicated to La Salle. A covenant
for dedication will be placed upon the deed.
2. Concerning the radius at the end of Latham Drive,
the developer proposes a paved radius of 40 feed and an
emergency vehicle turning radius of 140 feet. La Salle
standards require a 70' radius. Latham Drive is intended
to be a portion of a northwesterly collector street shown
on the La Salle Master plan and it is anticipated that the
Town will continue with this road in the future.

3. There are four lots (16,17,18 and 19 ) whose finish
grade elevations will be 4/10ths of a foot below the B zone
flood plain elevation of 4658.4.
The houses constructed on these lots will have
foundations especially flood treated and whose "top of
foundation" elevation will be at least one ( 1) foot above the
• flood plain elevation.
4. The Deeds for each lot created in this subdivision
will have a covenant which offers each lot for annexation to
the Town of La Salle when eligible and initiated by the Town.
5. The preliminary plat does require certain requests
for variances:
a. Street widths - Variance from County Standard
1. Latham Drive is proposed as a Collector;
Town standard is 60' roadway width.
2. All other streets are local; Town requires
a 40' roadway width.

1. Four lbts ( 1,2,3,4) are proposed to front
on West 1st Avenue. This street, under County
jursdiction, functions as a collector but the
County has consistently allowed dwelling units
on the north side of this street to take access
directly on this street.
In summary this proposal represents both an attractive
and functional asset to the Town of La Salle and to the
overall neighborhood.

Upon review of the preliminary plat of the proposed Linder
Subdivision the LaSalle Fire Protection District has the
following recommendation. The paved radius of the cul-
de-sac at the end of Latham Drive should be enlarged to
a 65 foot radius and the outside curb or pavement edge
radius must be 55 feet to comply with the subdivision
regulations set up by the Weld County Planning Commission.
We feel this is necessary to insure that our fire trucks
will be able to turn on a solid surface. It was the
feeling of the entire board that the proposed grass turn
around, shown on the preliminary plat, would be to soft
to withstand the weight of a fire truck.
We would also like to add that we would accept the place-
ment of the fire hydrants as indicated on the preliminary
plat.

Dear Vickie:
The LaSalle Planning Commission and the Town Board have reviewed
the preliminary plat for the Linder subdivision. The plat is
quite satisfactory in most respects and should, whenever annexed,
become a pleasing addition to the Town. We do not find the major
portion in conflict with the Town of LaSalle . We do, however,
have some concern about the area over a previously existing dump
site.
Our major concern is with the streets, curb and gutter, and the
utility lines which will lay over the dump site area. The depth
of the remaining trash which may exist at the center of the site
could cause a situation whereby a street at some point in the
future sinks or have water and sewer lines be deemed inoperable
because of settling.
Since Mr. Linder has committed himself to remove all trash from
under 2nd Avenue, Platte Drive, and a portion of 3rd Avenue and
the curb and gutter in this area, he has alleviated our concern
somewhat.

Dear Ms. Traxler:
The following evaluation applies to the Linder Subdivision
Preliminary Plat and should also be a follow-up to the initial
zoning change evaluation request.
As stated, the potential sources of flooding here are the
South Platte River and local drainage from less than 1 square
mile of drainage area. The South Platte River floodplain and
related water surface elevations are described in the April,
1977 U.S. Army Corps of Engineers report "Special Flood Hazard
Information Report, South Platte River, Volume 1, Weld County,
Colorado". This report was designated by the Colorado Water
Conservation Board on November 15, 1977 and thus 'is available
to local governments for regulation purposes.
The Corps'report describes the 1973 flood as approximately
a 100-year event. However, at this location the 1973 high water
mark (point 71) is 1.3 feet higher than the 100-year water surface
elevation computed in the profiles for cross-section 60.

stream station on the profiles. Thus, some confusion exists.

Thus, 4657.1 feet above ESL should have been recommended i our
September 5, 1979 letter rather than the 1973 high water mark
of 4658.4' MSL. To further clarify the situation, the following
data is taken from the Corp's profiles:
100-year Elevation at upstream end of property - 4657.1' MSL
100-year Elevation at downstream end of property - 4655.8' MSL
Based on the Corp' s report and the topography now provided
on the preliminary plat, the following additional findings are
made:
1. Lots 14,15,16,17,18,19,20 and 21 lie either totally or
partially in the 100-year floodplain.
2. An obstruction to flow may exist as indicated in the report
that might protect the subdivision; however, this has not
been verified.
Thus, the recommendations here remain the same as in our
September 5, 1979 letter except that recommendation 3. should
read as follows: "All first floor elevations of structures
should be raised one foot above the 100-year flood elevations
described in the Corp's report-as determined by field surveys."
Please note that raising to the 1973 high water mark of 4658.4'
MSL satisfies this recommendation. Thus, if the developer
proceeds as planned and takes the necessary floodproofing pre-
cautions he indicates by following through with sound engineering
there should be no conflict with the boards floodplain interests.

RE : "THE BLUFFS AT LASALLE" -
The LaSalle Town Board at their December 11th, 1979 meeting has granted
the following to Larry Linder:
1 A variance allowing direct access to be taken, via driveways, from
lots 1 , ' 2 , 3, and-4-of the preliminary plat at submitted.
2 That the current sixty foot right-of-way for West First Avenue is
adequate for traffic circulation needs, currently and in the fore-
seeable future. The Master Plan is intended to show general con-
cept relationships and not specific design standards . However,
the problem of a county "road outside the currdnt right-of-way could -
be satisfactorily resolved by allowing sidewalk, curb, and gutter
to be designed adjacent to existing asphalt. In addition, the land
under the asphalt which is not outside the current right-of-way
shall also be dedicated.
3 The proposed interior circulation system on the proposed Linder
Sub-division preliminary plat . Specifically, sixty foot and forty
foot right-of-way dedication with a fifteen foot utility and
street maintenence easement next to the right-of-way dedication.
In this application it is acceptable to put curb and gutter within
. _ - = the right-of-way and sidewalk in the adjacent easement.
Where the right-of-way for street purposes abuts an outer project
property line, LaSalle would grant a variance allowing only curb
and gutter within the right-of-way, and no utility easement .
4 Variances for: .
a lot configuration for lots 33 and 34 .
b radius of sixty-five feet at proposed cul-de-sac .
c somewhat less than ninety degree angle of intersection.
d frontage area of lots 5 , 6, 25 , and 28 to be less than seventy
feet ; these lots more than meet- the minimum square footage per '
lot requirement .

5 Water and sewer service to this project in return for deeded re-
strictions committing to annexation when the project is eligible
for annexation based upon contiguity and municipal best interests.
In that regard the Tcwn requires that :
a _tap fees of $800 for three quarter inch water taps and $800 for
sewer taps .to be assessed by the County and forwarded to the Town
of LaSalle at the time of issuance of building permits.
b water dedication shall be based on . 78 feet of Northern Colcrado
Water Conservancy District Water per lot . At the time that each
building permit is obtained, the developer will pay, in lieu of a
water dedication, the , sum equal to . 78 times the then market value
of Northern Colorado Water Conservancy District Water. If the
Town and the developer cannot agree on the value of Northern Colo-
rado Conservancy District Water, they will appoint an individual
familiar with water to determine the value and his determination
shall be binding.
c„„ that-the._;utility-Rlan,be-approved requiring extension-of -an eight - -
ihch water main in West First Avenue and looped within the pro-
ject via a six inch circulation line and a six inch line from
North Fourth Avenue flowing West in Town easement to the property.
6 That Linder fulfill the request and meet certain conditions intended
, to ,cgrrect concerns with soil stability:
a that all rubbish from the extinct trash dump be removed from under-
neath the footings of all garages and foundations proposed to be
sited within the dump area as identified by the ARIX soil tests .
b that the rubbish be removed from all street right-of-ways proposed
...: : ..whi,ch_apelwithin . the identified-dump -area. . This is -to insure-that -
potential settlement will not significantly effect any public im-
provement dedication for public maintenence .
c that the proposed settlement pond is acceptable and would be as-
sumed by the Town as public dedication when annexed.

Dear Mr. Linder:
After reviewing Town of LaSalle subdivision and zoning regulations,
I find that the subdivision "The Bluffs at- LaSalle" is in conflict
with these regulations in several areas. The following is a list
of. the sections from which you must request a variance from the
Town 'of LaSalle Planning Commission and Town Board _
1 . Section 16.06.02.C - Right-of-way required for 1st Avenue is
100 feet. Right-of-way request for Latham Drive is 80 feet.
Right-of-way required for 2nd Avenue, Platte Drive, and 3rd
Avenue is 60 feet.
2. Section 16.06. 02.D - Dead-end streets shall not be more than
400 feet in length with a minimum radius of 70 feet.
Conflicts: Latham Drive - length-757 feet
Cul-de-sac radius (paved) 35 feet
3. Section 16.06.02.E - Streets shall intersect at right angles
Conflict: Platte Drive and 3rd Avenue do not intersect at
right angles

The Weld County Utilities Coordinating Advisory Committee held a
regularly scheduled meeting on December 20,- 1979 in the Blue Flame Room
of the Greeley Gas Company, 1200 11th Avenue, Greeley, Colorado.

DISCUSSION: Vickie Traxler first brought the Utility Board up-to-date
regarding the Town of LaSalle' s requests for the plan. There was a
great deal of discussion regarding road maintenance and who will be
-----responsible -for maintainiat he -sewer--system. The TWwn---,oL -LaSalle :has, _-_-
stated that they will serve and maintain the system. The Town has
also stated that they have no other problems with the utilities, etc.
MOTION: Mr. Rae made a motion to approve the preliminary plat advising
the Planning Commission that there are still unanswered questions
regarding the road right-of-ways, the function of the road maintenance

of the water and sewer:: lines. They also requested additional review
if there are any changes to the plat. His motion was seconded by Bill
Kistler. A vote of "aye" was cast by all with the exception of Mr.
