RE: APPROVAL OF CONDITIONAL USE PERMIT NO. 63 : 80: 11 FOR EXPANSION
OF EXISTING CHURCH FACILITIES FOR MOUNTAIN VIEW EVANGELICAL
FREE CHURCH.
WHEREAS, the Board of County Commissioners of Weld. County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado held a public meeting on the 17th day of November, 1980
at the hour of 9 : 00 o' clock a.m. for the purpose of hearing the
application of Mountain View Evangelical Free Church for a Con-
ditional Use Permit for expansion of existing church facilities
on the following described real estate, to-wit :
Westridge Subdivision, Block 1, Lots 5 ,
6 , 7 , 8 , 9 and 10 . City of Greeley,
County of Weld, State of Colorado.
WHEREAS, a representative of the petitioner was present,
and
WHEREAS, evidence was presented in support of the granting
of the Conditional Use Permit for expansion of the existing
church facilities, and
WHEREAS, Section 3 . 3.D. of the Weld County Zoning Resolution
authorizes such a use in an Agricultural District upon approval
of a Conditional Use Permit by the Board of County Commissioners ,
and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado heard all of the testimony and statements of those pre-
sent, has studied the request of the petitioner and the .recommenda-
tions of the Weld County Planning Commission and all of the exhi-
bits and evidence presented in this matter, and having been fully
informed, is satisfied that the request for a Conditional Use
Permit for expansion of the existing church facilities on the
hereinabove described real estate complies with all of the condi-
tions as set out in Section 3. 3 .D . (2) of the Weld County Zoning
Resolution.

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commis-
sioners of Weld County, Colorado that the application of Mountain
View Evangelical Free Church for a Conditional Use Permit for
expansion of the existing church facilities on the hereinabove
described tract of land be, and hereby is, granted subject to the
following (condition #4 has been amended as stated below) :
1. The Conditional Use Permit plat being amended to
to show an additional 12 . 5 feet of right-of-way
reservation along the north side of U. S . Highway
34 Bypass.
2 . The Development Standards contained in the Condi-
tional Use Permit.
3. The Development Standards for the Conditional Use
Permit and the property owner' s signature shall
be placed on the Conditional Use Permit plat and
the plat shall be delivered to the office of the
Department of Planning Services.
4 . Prior to the issuance of the Certificate of Occu-
pancy for Phase I , the applicant shall submit a
statement indicating compliance with Development
Standard #7 and that prior to proceeding with
Phase II, a drainage plan for the entire site
shall be presented which is to be reviewed by
the City of Greeley Planning Department and the
Weld County Engineering Department.
5. The Conditional Use Permit plat shall be amended
to show a minimum of 10 foot of landscaping and
berming around the perimeter of the parking areas .
6 . Prior to issuance of the final certificate of
occupancy for the Christian Education expansion,
the applicant shall install a fire hydrant within
250 feet of the church property. The Greeley
Fire Department has suggested that this hydrant
be located on the Northeast corner of 63rd
Avenue and 27th Street.
BE IT FURTHER RESOLVED by the Board of County Commissioners
of Weld County, Colorado that the reasons for approval contained
in the Planning Commission recommendations dated October 21, 1980
be, and hereby are, adopted as the findings of fact of the Board
of County Commissioners in this matter.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 17th day of
November, A.D. , 1980.

1. It is the opinion of the Planning Commission that this request is in compliance
with the provisions of Section 3.3.D. (2) of the Weld County Zoning Resolution.
2. It is the opinion of the Planning Commission that the adoption of the attached
Development Standards will minimize impacts on surrounding uses and the area
to the greatest extent possible and provide adequate protection of the health,
safety and welfare of the inhabitants of the area and the County.
These determinations are based, in part, upon a review of the information submitted
by the applicant, other relevant information regarding the request and the responses
of the referral entities which have reviewed this request.
The Planning Commission recommendation for approval is conditional upon the

1. The permitted uses on the hereon described parcel of land shall be a church facility
which includes an existing church building, existing .arking area and two phases of
future expansion. Phase one permits a Christ=ian Education facility, administrative
offices, and additional parking spaces. Phase two permits a new sanctury, admin-
istrative offices and additional parking spaces. All other uses permitted by right
in the Agricultural Zone District of the Weld County Zoning Resolution shall be
allowed.
2. The Conditional Use Permit area shall be maintained in such a manner so as to prevent
soil erosion, fugitive dust, and the growth of noxious weeds.
3. All uses on the property shall comply with all County and State Health Standards
and Regulations pertaining to air quality, water quality, noise emission, and
sanitary disposal systems.
4. All accesses shall have the approval of the Weld County Engineering Department. All
accesses shall be constructed in accordance with the recommendations and/or require-
ments of the Weld County Engineering Department.
5. Lighting provided on the property shall be arranged so as to minimize illumination
onto adjoining property.
6. All design criteria and recommendations contained in the Soil and Foundation
Investigation by GN Soils Engineering Service, Inc. Project Number 80-1063-A dated
May 20, 1980 shall be complied with.
7. On site measures shall be taken to insure that surface runoff from the property
shall not exceed that amount which has historically existed.
8. A minimnmi of 10 foot of landscaping and berai:ng shall be provided and maintained
around the perimeter of the parking areas.
9. The Conditional Use Permit shall be limited to the plans shown hereon and governed
by the Development Standards stated above and all applicable Weld County Regulations.
Any material deviations from the plans and/or Development Standards as shown or
stated above shall require the approval of an amendment to the Conditional Use Permit
by the Planning Commission and the Board of County Commissioners before such changes
from the plans and/or Development Standards shall be permitted. Any other changes
from the plans and/or Development Standards shall be filed in the office of the
Department of Planning Services.
10. The property owner and/or operator of this operation shall be responsible for
complying with all of the above stated Development Standards. Non-compliance with
any of the above stated Development Standards may be reason for revocation of the
Conditional Use Permit by the Board of County Commissioners.

The City of Greeley Planning Commission has in a letter dated Octnher 16, 1980
indicated that an improvement district should be implemented to provide for
upgrading of dirt streets in the area as a condition for approval for the
Conditional Use Permit.
Weld County would be responsible for implementing an improvement district
with property owners in the area to improve the roads. It is the Staff's
opinion that this decision be reached by the Board of County Commissioners.
The Greeley Planning Commission also indicated that they would like to review
Phase II when the time comes for construction of this phase.

Commissioner Cummins made a motion to approve the vacation of the
utility easement at 2645 Sunset Lane . Commissioner Roeth seconded
the motion . Vote was taken and the motion carried unanimously .
IV. WELD COUNTY REFERRAL: CONDITIONAL USE PERMIT FOR THE MOUNTAIN
VIEW EVANGELICAL FREE CHURCH
LOCATION: Northwest of 28th Street and 62nd Avenue
Ken McWilliams indicated that this was a request to expand the Mountain
View Evangelical Free church located to the west of 65th Avenue and
north of the U. S. 34 Bypass . He explained that this is a two phase
proposal, the first being an educational wing and phase two being
a new sanctuary with a seating capacity of approximately 600 . Upon
completion of the new sanctuary, the existing sanctuary would be
converted to a fellowship hall . Mr . McWilliams explained that the
staff ' s primary concern relates to the second phase of the proposed
expansion. With the seating capacity increased from 150 to 600 , the
staff is concerned with the anticipated negative impacts on the
surrounding neighborhood which would result from the increased traffic .
He indicated that there are three ways to enter and exit from the
property and that some of the surrounding streets are , as yet , unimproved .
The outlet off of the 34 Bypass allows traffic to make right turns only .
They must enter from the east and exit to the west on the Bypass . The
congregation can also access the church property via 28th Street (frontage
road) which is one of the unimproved streets . However , he pointed out
that the intersection of 28th Street and 65th Avenue is not designed
for a heavy traffic load because of the close proximity of the Frontage
Road with the Bypass. The third entrance to the church would be through
the residential streets of Westridge Subdivision and Ken-Wil Acres ,
Mr. McWilliams again indicated that the staff ' s main concern is with
the potential negative traffic impacts which could be created in those
residential areas and, for this reason, recommended denial of phase two .
Mr. McWilliams indicated that the staff had no objections to phase
one of the expansion proposal with the following stipulations :
1) Landscaping should be provided within the parking lot ; 2) Land-
scaping and berming should be provided around the parking areas to
buffer them from surrounding residential development ; 3) A drainage
report should be provided for the entire site; 4) The church should
be required to improve the streets adjacent to the church property;
5) The State Highway Department has requested that the church dedicate
an additional 12 . 5 feet of right-of-way for the frontage road along
34 Bypass. This would provide the standard 50' frontage road right-
of-way; and 6) A fire hydrant should be installed within 250 feet of
the church to provide fire protection .
Commissioner Cummins asked if stipulation 5 was an absolute condition
for approval . Mr . McWilliams indicated that the staff is recommending
that this stipulation be a condition of approval .
Loren Bley, architect for the church, had a few comments regarding
the expansion proposal . He explained that the total plan represents
• the comprehensive development plan established by the church and that
they are looking at a time frame of two to five years for full develop-
ment of the plan . He indicated that the church membership had voted
on the Comprehensive Plan and would like the Commission to consider the
entire package as one unit . He further indicated that phase one was
currently under way as the County Commissioners had already approved
the issuance of a building permit to complete the foundation and
footings for the educational wing . He pointed out that 90 percent of
the people attending this church entered the property from the 34
Bypass access . They would probably continue to use this access so he
felt that the traffic impact on the surrounding area would he minimal .

Commissioner miller asked if it was anticipated that the State would
ever block off the access at 62nd Avenue . flr . fcW'illiams stated that
the State Highway Department had indicated that closure of the 62nd
Avenue access was a possibility in the distant future if the design
of the intersection at 65th Avenue and the Bypass was improved .
Commissioner Miller pointed out that the Commission was really in a
bind and that the church had been misled by the County since they
had already issued a building permit for phase one . Should the
Planning Commission decide to deny phase two, the church would probably
not want to complete phase one without being able to build a new
sanctuary later. If this is the case , the church would be out the
time and money they have already spent on whatever construction has
been done on the educational wing . Sam Sasaki pointed out that any
expansion of the church beyond the existing structure must go through
an hearing process (Conditional Use Permit ) . He questioned whether the
County had the right to turn down the church ' s request now that they
have already issued a building permit to begin construction for phase
one . Mr . Sasaki explained that if you approve the overall master plan ,
the church can go ahead at any time with the building . Commissioner
Cummins indicated that the Planning Commission should have had the
referral before phase one was ever initiated .
Mr. Bley indicated that he didn ' t feel that external factors such
as traffic impacts on surrounding residential areas should be a con-
sideration in their request for the church expansion . Ken McWilliams
indicated that one criteria included in the County ' s Conditional Use
Permit is the impact of the request on the surrounding areas .
The discussion then turned to phase one .. Chairman Dietz asked if the
church had any comments regarding the six stipulations set forth .
Mr . Bley explained that the plans already called for landscaping and
berming and that a drainage report was being prepared by Norton, Under-
wood, and Lamb. He felt there would be no problem with granting the
State another 12 . 5 feet of right-of-way as the building would still
meet all setback requirements without the additional 12. 5 foot strip
of land. Mr. Bley further indicated that the church would most defi-
nitely want to comply with the fire hydrant request . However , he did
seem to think that stipulation 4 requiring the church to improve the
streets adjacent to the property would require further consideration.
Mike Byrd, pastor of Mountain View Evangelical Church, stated that the
church would be willing to improve the streets if the other property
owners would be willing to improve thier share as well .
Commissioner Cummins asked if the streets were dedicated and if there
were private property owners facing on the same streets. Ken McWilliams
indicated that the roads on the north and south are both dedicated
streets. The staff is recommending that the church improve the entire
street width on the south and a half street on the north for those
sections of the streets adjacent to the church property . Commissioner
Miller felt that this stipulation should be handled with an Improvement
District instead of as part of the development process .
Chairman Dietz then called for a motion . Commissioner Roeth made a
motion to indicate to the County that the Commission had no objections
on Phase one with the stated six stipulations and would like to review
Phase two when the time comes for construction of this phase. The
motion was seconded by Commissioner Kerines . Commissioner Cummins
indicated that he intended to vote against the motion because it did
not take a strong enough position on Phase two of the plan . Chairman
Dietz indicated that he was going to vote against the motion for the
same reason.

After further discussion , Commissioner Miller made a motion to
amend the previous motion to indicate that improving the streets
should be done with an Improvement District instead of through the
development process. Commissioner Cummins seconded the motion . Vote
was taken and the amendment to the original motion was carried
unanimously .
A roll call vote was then taken on the entire motion . Commissioner
Cummins - Nay; Commissioner Roeth - Aye; Commissioner Miller - Aye ;
Commissioner Dietz - Nay ; Commissioner Keirnes - Aye . The motion
carried 3 to 2.

We have reviewed the site plan and Soils and Foundation Investigation
by GN Soils Engineering Service, Inc. for the above referenced ad-
dition. The subsurface investigation indicates that development in
this area may be affected by variable subsurface conditions , swelling
soils or compacting soils.
The recommendations made by GN Engineering concerning foundation
selection, slab construction, a drain system, fill and backfill place-
ment, surface drainage and lawn irrigation should be closely observed.
These precautions will prevent damage from adverse soil conditions.
If these recommendations are followed, we have no objection to approval
of this application.

Dear Chuck:
The Planning Commission of the City of Greeley reviewed the Conditional
Use Permit for the Mountain View Evangelical Free Church at its October
14, 1980, meeting . The Commission recommended no objection to Phase I
with the following stipulations : 1) Landscaping should be provided
within the parking lot; 2 ) Landscaping and berming should be provided
around the parking areas to buffer them from surrounding residential
development; 3) A drainage report should be provided for the entire
site; 4) An improvement district should be implemented to provide for
upgrading of dirt streets in the area; 5) The church should provide
the additional 12 . 5 feet of right-of-way for the frontage road as
requested by the State Highway Department ; and 6) A fire hydrant should
be provided within 250 feet of the church property . (The Fire Depart-
ment suggests that this hydrant be located on the northeast corner
of 63rd Avenue and 27th Street) , The Commission also indicated that
they would like to review Phase II when the time comes for construction
of this phase.

ditions, the church building committee has reviewed the
W information and responds as follows:

O In regard to Item No. 1 - the Church would prefer to exer-
} cise the option to sell the right of way property at the
appropriate time. -

W In regard to Items No. 2 , 3, and 5 , the building committee
O concurs to comply as requested.
W In regard to Item No. 4 - the building committee requests
W that the final drainage report be waived until Phase II -
F construction drawings (Sanctuary Expansion) are submitted
W for construction approval. Phase I building construction
I shall include landscaping 20 ' around the new construction_
W The north parking lot shall be graveled with a 3/4" aggre-
r gate rock and sloped to the west for proper drainage.

O feels that the cost for installing a new fire hydrant on

dation work while the weather appears advantageous in the early fall

O foundation work. The comprehensive plan for the entire 3 . 5 acre

The 3 . 5 acre site includes provision for the initial Chris-
W tian education building expansion and provisions for a new

sanctuary expansion at a later date. Provisions for park-
I- ing expansion (130 cars) are included in the eventual ex-
0 panion program - 74 additional stalls to the present 72
I stalls; 56 parking stalls are projected for Phase II. Both
co building expansions are within the setback limits-75 ' set-
r back on the south property line; 20 ' utility easement on
the north boundary and approximately 75 ' setback from the
O west property line on the proposed Phase II expansion. A
O minimum of two additional vehicular access points onto 27th
Mand 28th Street are proposed for the final phased completion.

Dear Mr. Cunliffe:
We have reviewed the application from Mountain View Evangelical Free Church for
an expansion of existing church facilities. We reaffirm the comments contained in
the enclosed copy of a previous letter concerning this site. The additional 12.5
feet of right of way would permit the construction of an improved frontage road with
greater separation between that road and the U.S. 34 Bypass right of way. This
frontage road is an important element of the street system in this area.
The proposed tcpographical contours indicate that surface runoff will continue
to flow toward the highway. We ask that on-site measures be taken to insure that
the surface runoff from this property will not exceed that which has historically
existed.

We have reviewed our right-of-way needs on State Highway 34 Bypass in
relation to a pro2osed expansion of the Mountain View Evangelical Church in
the West Ridge Su3division. The existing right of way north of the highway
centerline is 75 feet. We have built on half of this right of way, and thus
there is 37.5 feet of presently unused right of way.
In addition to this unused right of way, we feel that a 12.5-foot strip
of land should be protected. This would result in a 50-foot strip which would
be available in t'ne event that a frontage road were to be constructed. The
additional 12.5 feet should be dedicated or reserved for this purpose, as
local zoning laws permit.
Therefore, we foresee the need for only 12.5 feet of the 75-foot setback
area, contrary to what had been originally assumed. Please let us know if
you have any further questions on this matter.
