HEARING CERTIFICATION DOCKET NO. 2008-84 RE: SITE SPECIFIC DEVELOPMENT PLAN AND PLANNED UNIT DEVELOPMENT FINAL PLAN, PF #1048, FOR EIGHT (8) LOTS WITH E (ESTATE) ZONE USES (24.1 ACRES) AND THREE (3) NON-RESIDENTIAL OUTLOTS (18.9 ACRES) FOR OPEN SPACE, MOOREA MANOR NORTH - WELD 45 ACRE, LLC A public hearing was conducted on November 5, 2008, at 10:00 a.m., with the following present: Commissioner William H. Jerke, Chair Commissioner Robert D. Masden, Pro-Tem - EXCUSED Commissioner William F. Garcia Commissioner David E. Long Commissioner Douglas Rademacher Also present: Acting Clerk to the Board, Esther Gesick County Attorney, Bruce Barker Planning Department representative, Jacqueline Hatch-Drouillard Health Department representative, Lauren Light Public Works representative, David Snyder The following business was transacted: I hereby certify that pursuant to a notice dated October 10, 2008, and duly published October 17, 2008, in the Greeley Tribune, a public hearing was conducted to consider the request of Weld 45 Acre, LLC, for a Site Specific Development Plan and Planned Unit Development Final Plan, PF #1048, for eight (8) lots with E (Estate) Zone uses (36.4 acres) and one (1) non-residential outlot(6.8 acres)for open space-Moorea Manor North. Bruce Barker, County Attorney, made this a matter of record. Chair Jerke advised the applicant's representative,James Loonan, Loonan and Associates, that he has the option of continuing this matter to a date when the full Board will be present. However, if he decides to proceed today, it will require three affirmative votes, or in the case of a tie vote, Commissioner Masden will listen to the record and make the determining vote. Mr. Loonan indicated he would like to proceed today. Jacqueline Hatch-Drouillard, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Department of Planning Services into the record as written. She gave a brief description of the location of the site, and stated the Change of Zone was approved by the Board on January 11, 2006. Since that time, the applicant worked with a surveyor and determined the original plans would have resulted in three non-buildable lots, due to drainage issues,therefore, the layout has been redesigned with eight(8) lots, and three (3) non-residential outlots for open space to address drainage issues. Ms. Hatch- Drouillard stated Section 27-7-40.B.3 of the Weld County Code allows for review by the Board of Commissioners if the Final Plan is not consistent with the Change of Zone submittal. She stated the site is not within an Intergovernmental Agreement area; however, it is within the three-mile referral area for the Towns of Firestone and Frederick,which did not submit referral responses,and the Town of Platteville, which indicated no conflict with its interests. She further stated the site will be serviced by the Central Weld County Water District and septic systems, she gave a brief review 2008-3158 PL1811 ��(� ; iG / �� //-1- i -ia �S' HEARING CERTIFICATION - WELD 45 ACRE, LLC (PF #1048) PAGE 2 of the surrounding land uses, and explained the proposed development will utilize the existing access for Moorea Manor to the south. Ms. Hatch-Drouillard stated 16 referral agencies reviewed the proposal, nine responded favorably or provided comments which have been addressed in the Conditions of Approval, and no response was received from the Colorado Oil and Gas Conservation Commission, the Weld County Sheriffs Office, Colorado Division of Wildlife, School District RE-1, or the Lupton Meadows Ditch Company. In response to Chair Jerke, Ms. Hatch- Drouillard stated Lot 1 will be accessed from Harpenden Lane to the south. David Snyder, Department of Public Works, stated County Road 21.5 is classified as a collector status road, the applicant will be required to designate additional right-of-way, and the average daily traffic count taken in 2006 indicated approximately 350 vehicles. Mr. Snyder explained County Road 21.5 is constructed on a natural ridge line east of the property,which results in limited drainage from the site, and 1,100 surrounding acres also drain to the area. He stated the existing subdivision would be inundated with up to five feet of water during a 100-year storm,therefore, the proposed eight-foot pond design will address drainage issues for both developments. In response to Chair Jerke, Mr. Snyder reiterated the subject site is a low area which receives drainage from approximately 1,100 surrounding acres, and the Lupton Meadows Ditch does run through the property. Responding to Commissioner Rademacher, Mr. Snyder stated the only other way to drain the area is to install a pipe, which would be very cost prohibitive. Chair Jerke stated although the Board is only considering the design for Moorea Manor North, it is good to note the new design will also help address drainage issues for the adjacent development. Lauren Light, Department of Public Health and Environment, stated the site will be served by the Central Weld County Water District and septic systems, the overall density is one septic system per 5.82 acres, the smallest lot is 2.1 acres, the applicant has designated primary and secondary envelopes on the lots, and staff has no concerns with the proposal. Lee Petrides, Manager of Weld 45 Acre, LLC, started he started this project five years ago, and planned for eight (8) home sites. He stated, although the current economy is poor, he desires to complete the project. In response to Chair Jerke, Mr. Petrides stated the interior road will be paved to County standards. He further stated Lot 1 is 2.2 acres in size; however, the average lot size is 4.5 acres Mr. Loonan stated the lots will be elevated above the ridge to ensure they remain dry during a large storm event, and the drainage is designed with the intent of allowing stormwater to flow from the pond to the borrow ditch. No public testimony was offered concerning this matter. In response to Chair Jerke, Mr. Petrides and Mr. Loonan each indicated they have reviewed, and concur with, the Conditions of Approval, as proposed. Commissioner Garcia moved to approve the request of Weld 45 Acre, LLC, for a Site Specific Development Plan and Planned Unit Development Final Plan, PF #1048, for eight (8) lots with E(Estate)Zone uses(24.1 acres)and three(3)non-residential outlots(18.9 acres)for open space -Moorea Manor North, based on the recommendation of the Planning staff,with the Conditions of Approval as entered into the record. The motion was seconded by Commissioner Long,who stated he appreciates the additional time invested by the applicant to complete the project and ensure the issues were adequately addressed.
