Dear Mr. Ogle:
We have reviewed the above referenced proposal for a Site Specific Development Plan and Use
by Special Review for a commercial business and secondary residence on a 14.94 acre parcel. Since
the submitted material does not appear to qualify as a "subdivision" as defined in Section § 30-28-
101(10)(a), C.R.S., pursuant to the State Engineer's March 4, 2005 memorandum to county planning
directors, this office will only perform a cursory review of the referral information and provide comments.
The comments will not address the adequacy of the water supply plan for this development or the ability
of the water supply plan to satisfy any County regulations or requirements.• From the information in the materials submitted, the water supply for the property is provided by
the Little Thompson Water District ("District"), though a letter from the District confirming that it currently
provides water service to the property was not included in the submitted materials. We recommend that
the County obtain a signed copy of the water service agreement from the District prior to the final
approval of the proposal. As long as the District operates within the terms and conditions of its water
rights and decrees, this office has no objection to the District continuing to provide water to the subject
property.

I have reviewed the above referral,and find the following concerns for the Johnsto F'
Protection District.
• The proposed location is approximately(3)three miles from the Fire Station d )two
miles from the nearest fire hydrant.
• The proposed 11,880 sq foot building would require a water supply to extin 'sh there
• were a fire. The building construction type is currently undetermined and wi gi the
determination of the needed fire flow for extinguishment.
• This needed fire flow may be achieved through the placement of fire hydran ab ve or
below ground water tanks,or some other static water supply.
• The long(1,000 ft)access to the building south of C.R. 46 will need to have around
point

Prior to the start of any construction, alterations, or change of occupancy;
1 A building permit application must be completed and two complete sets of plans including
engineered foundation plans bearing the wet stamp of a Colorado registered architect or
engineer must be submitted for review. A geotechnical engineering report preformed by a
registered State of Colorado engineer shall be required.
2 A plan review shall be approved and a permit must be issued prior to the start of construction.
3 Setback and offset distances shall be determined by the 2006 International Building Code
(Offset and setback distances are measured from the farthest projection from the structure).
4 Buildings located within a 100 year flood plain require a Flood Hazard Development Plan.
5 A letter from the Fire District to ascertain if a FPD permit is required.

Environmental Health Services has reviewed this proposal to assemble wall
components for Laundromats and allow a 2nd residence on a 14.9 acre parcel. Water
service is proposed from Little Thompson Water District however a "will serve" letter
was not included in this Departments packet. An Individual Sewage Disposal System
(ISDS) will serve the site.
The application indicates there will be a maximum of six employees. An 11,880 square
foot building will be used for the business and also will contain the apartment. A septic
system, designed by an engineer, is required for the commercial use.
The application states that there is some wood cutting that occurs. Depending on the

emissions from the facility, an Air Pollution Emission Notice (APEN )from the State may
be required.
We have no objections to the proposal, however, we do recommend that the following
conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The applicant shall submit a dust abatement plan (vehicle traffic) for review and
approval, to the Environmental Health Services, Weld County Department of
Public Health & Environment.
2. The applicant shall submit evidence of an Air Pollution Emission Notice
(A.P.E.N.) and Emissions Permit application from the Air Pollution Control
Division, Colorado Department of Health and Environment, if applicable.
Alternately, the applicant can provide evidence from the APCD that they are not
subject to these requirements.

• 3. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
4. The applicant shall submit evidence to the Department of Planning Services and
the Environmental Health Department, from Little Thompson Water District,
demonstrating that water is available for the business and for a second
residence.
We recommend that the following requirements be incorporated into the permit as
conditions that must be met one month prior to construction activities:
1. The applicant shall submit evidence of a Colorado Discharge Permit System or
CDPS permit from the Colorado Department of Public Health and Environment
(CDPH&E), Water Quality Control Division, to cover stormwater discharges from
•
construction sites (5 CCR-1002-61) Alternately, the applicant can provide
evidence from CDPH&E that they are not subject to the CDPS requirements.
We recommend that the following requirement be incorporated into the permit as a
condition that must be met prior to the issuance of the Certificate of Occupancy:
1. An individual sewage disposal system is required for the proposed facility and is
required to be designed by a Colorado Registered Professional Engineer. The
system shall be designed and installed according to the Weld County Individual
Sewage Disposal Regulations.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,

• as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. The applicant shall operate in accordance with the approved "waste handling
plan".
5. The facility shall be operated in accordance with the approved "dust abatement
plan" at all times.
6. If applicable, the applicant shall obtain a stormwater discharge permit from the
Colorado Department of Public Health & Environment, Water Quality Control
Division.
7. This facility shall adhere to the maximum permissible noise level allowed in the
Commercial Zone as delineated in Section 14-9-10 of the Weld County Code.
8. Adequate handwashing and toilet facilities shall be provided for employees of the
facility, at all times.
9. Sewage disposal for the facility shall be by septic system. Any septic system
•
located on the property must comply with all provisions of the Weld County Code,
pertaining to Individual Sewage Disposal Systems.
10.A permanent, adequate water supply shall be provided for drinking purposes.
11.The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.

The Weld County Public Works Department has reviewed this proposal. Our comments and requirements are
as follows:
COMMENTS:
Weld County Road Classification Plan (FHU): (June 2002)
WCR 46 is a collector road and requires an 80-foot right-of-way at full build out. There is presently a 60-foot
right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld
County Zoning (23-1-90), the required setback is measured from the future right-of-way line.
REQUIREMENTS:
Direct access from a public road will be limited to one (1) per legal parcel, except as further limited or restricted
by zoning or subdivision regulations. Additional accesses may be approved by the Department of Public
•orks or the Board of County Commissioners. This policy shall apply to all new and existing accesses within
e unincorporated areas of the County. Properties within municipalities or other counties which access
County roads are subject to this policy.
A 40' radius is required on all accesses to public roads for accesses designed to accommodate truck traffic. {A
minimum effective turning radius of forty (40) feet shall be used for accesses intended to accommodate truck
traffic. (Weld County Codification Ordinance 2000-1)} Sec. 8-2-40 B.Road access design standards.
The USR area IS NOT in a Special Flood Hazard Area (SFHA) as determined by the Federal Emergency
Management Agency (FEMA).
Please provide all drainage/stormwater calculations for the proposed pond and channel. Mentioned drainage
report was not included in this submittal.
The applicant must take into consideration storm water quantity capture and provide accordingly for best
management practices.
