HomeMy WebLinkAbout20083179.tiff RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST JULIAN AND ANGELA MARTINEZ FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Julian and Angela Martinez, ZCV#0800273, are allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS,on the 9th day of December,2008,a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Paul Martinez, property owner's son, was present at said hearing, and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until March 9,2009,to allow adequate time for the property owners to restore, remove or screen the noncommercial junkyard from all adjacent properties and public rights-of-way to bring the subject property into compliance and for an inspection of the property by the Department of Planning Services staff. A SCREENING PLAN shall be submitted and approved by the Department of Planning Services. 2008-3179 Violation Summary Report REMEDY As I indicated in my initial letter, while the presence of a NONCOMMERCIAL JUNKYARD consisting of DERELICT VEHICLES, appliances and miscellaneous debris is an allowed use within an Agriculturally zoned subdivision, such as Wattenburg, it must be completely SCREENED from all adjacent properties and public rights-of-ways; otherwise, any Derelict Vehicles shall be operational at all times and evidence of current registrations shall be submitted to this office. Also, as I discussed with Paul, if you feel you have brought the property into compliance before the hearing, please call me to schedule a final inspection. If it is verified that the property is indeed in compliance, the Violation case would be closed and the Hearing would be cancelled. RECOMMENDATION The Department of Planning Services recommends this case to be referred to the County Attorney's Office for immediate legal action. He said he was calling regarding his father's property. He was hoping he could have an extension. I asked how much time he thought they needed. He said he thought he could have it done in 30 days. I explained that I would grant his extension request, but I was doing it, by going ahead and scheduling the property for a Violation Hearing for December 9, 2008. I explained if the property was brought into compliance before the hearing, the hearing would be cancelled. If not, he would need to attend the hearing and request additional time from the Board. He said he understood. I explained that I just needed him to call me as soon as he thought he was done and I would conduct an inspection.
