COLORADO - 80644 GREELEY OFFICE SEP 2 6 7nnft RECEIVED September 23, 2008 Weld County Board of County Commissioners PO Box 758 Greeley, Colorado 80632 Attention:Ester Dear Sir/Madden Loloff Construction Inc owns and holds property permit #M-1985-112 in the state of Colorado. • We are sending this letter to inform the State Of Colorado and Weld County that the property directly to the East across Balsam Ave is in violation of Mining laws. Said property is under application for a mining permit and Use by Special Review Permit #1660. Said property for the last month has been digging exposing surface water and hauling material off of said property. Loloff Construction is requesting a cease and desist order to stop this until and actual permit by the State of Colorado and USR permit is issued. Evidence of such shall be submitted in writing to the Weld County Department of Planning Services. (Greeley/Weld County Airport Authority) 1.S The applicant shall submit a copy of a traffic study to the Weld County Department of Public Works. The Traffic Study shall include triggers and require improvements to be constructed on Balsam Avenue at the gravel pit access and at the Balsam Avenue and 8ch Street (SH-263) intersection. It should also address the timing of these improvements. (Public Works) • 1.A.10. The applicant shall show on the plat how the proposed access will function with the proposed scale house and internal site circulations with parking and semi truck staging. There will need to be at least one hundred feet of entrance roadway into the site perpendicular to Balsam Avenue; this is to ensure no stacking or staging of vehicles on any County Roadway. (Public Works) ,', 14111 J&T Consulting, Inc, • Memorandum Date: September 28, 2008 JT Project No. 07-123 To: Michelle Martin—Weld County Planning and Zoning Subject: USR 1660 Proposed Derr Pit Operations From: J.C. York, P.E. Michelle: Per our meeting on September 25, 2008 I am providing more description and detail on the proposed Derr Pit operations for USR 1660. Portable Processing Plant The portable processing plant that is proposed for the Derr Pit will enable the operator to move the processing facility to different locations within the proposed pit during mining. Initially the plant will be placed in the southeast corner of the pit to begin mining. The first phase of the mining as described in the Division of Mining, Reclamation, and Safety application (Exhibit D) is approximately 27 acres where the area will be mined to depth of six feet. No groundwater will be exposed during this phase. The portable plant will move as mining of this phase progresses from east to west and then back to the east. Once the plant is back on the east side of the pit it • will move north and then back to the west to complete the first phase of the mining. During the mining stockpiles of overburden and topsoil will be placed on the north side of the pit outside the 100-year floodplain. Product stockpiles will remain close to the processing facility. As mining progresses to the next phases of mining the plant will be placed on the pit floor and move within each phase to complete the mining of each phase. The plant will remain at least 500 feet from the County Road 41.5 (Balsam Avenue)during all phases of the mining. Water Source and Sewage Disposal The water source proposed for the facility will be a well. The well will be used for the scale house restroom facility only. It will not be used for drinking water. Drinking water will be supplied by using bottled water at the scale house. The scale house will also have a septic tank that will not have a leach field as no discharges will be allowed from the tank. The septic tank will be equipped with a high level alarm at which time the septic tank will be pumped by a licensed sewage disposal contractor. The scale house will not be built during the initial phases of the mining as the operator will utilize loader scales to determine the amount of material leaving the site.
