dumping of manure water on a field near the dairy. Aurora Organic Dairy plows up field where dumping of
manure water has taken place for more than 3 weeks. Contact states: Mr. Haren indicated this activity
was a mistake.
September 10, 2007— Environmental Health staff contact Tom Haren, AgPro about the dumping of the
manure water on the Aurora Organic Dairy property. According to Mr. Haren the manure water was
pumped into the vac-truck and dumped on the property. Upon learning this activity was taking place, a
check of the area found flies and a breeding ground for flies. It was decided to plow under this field to
eliminate the breeding habitat for the flies. The vac-truck dumping was undertaken by an employee who
thought this was a good idea. This activity has been stopped and the field is irrigated with ditch water, no
effluent lines are plumbed to this pivot. Staff requested application rates for the manure water dumping.

Development Standard#16: The facility shall be operated and maintained in a manner to prevent
nuisance conditions and operate in accordance with the approved Management Plan for Nuisance
Control.
Development Standard #19: The facility shall be operated in a manner to control flies. The facility shall
be operated in accordance, at all times, with their current approved Management Plan for Nuisance
Control. Additional fly control measures shall be implemented at the request of the Weld County
Department of Public Health and Environment in the event that flies (which can be determined to be
associated with the facility) are in such a number to be considered a nuisance condition. Additional
controls shall also be implemented in the event the Weld County Department of Public Health and
Environment receives a significant number of fly(associated with facility)complaints, and in the judgment
of the Weld County Health Officer, there exists a fly condition requiring abatement.
Department of Planning Services Recommendation: The Department of Planning Services
recommends that USR-1602 not be revoked. The Department of Environmental Health has visited
adjacent properties to the Aurora Dairy site on more than one occasion in the summer of 2008 and has
not witnessed nuisance conditions in regards to flies. Without evidence of a nuisance condition existing in
regards to flies there is no cause/reason to revoke the USR-1602 permit.

had previously been dumped. Flies are less bothersome than in the past. Only one fly is found inside of
vehicle as opposed to six or seven. Slight breeze.
Condition of Approval # 6. The Use by Special Review activity shall not occur, nor shall any Building or
Electrical Permits shall be issued on the property, until the Use by Special Review plat is ready to be
recorded in the office of the Weld County Clerk and Recorder.
The applicants have addressed all conditions of approval prior to recording the plat. The applicants have
submitted correspondence of their attempts to finalize an oil and gas agreement: (Condition 1.G: the
applicant shall either submit, to the Weld County Department of Planning Services, a copy of an
agreement with the property's mineral owners/operators(Anadarko and Noble Energy) stipulating that oil
and gas activities have been adequately incorporated into the design of the site, or show evidence that an
adequate attempt has been made to mitigate the concerns of mineral owners). Even though a surface
use agreement has not been finalized, Planning Staff feels that the applicants have demonstrated an
adequate to mitigate the concerns of mineral owners. Should this USR not be revoked, the plat is ready
to be recorded.

Department of Public Health and Environment Recommendation: The Department of Environmental
Health has reviewed the Revised Management Plan for Nuisance Control, dated October 2007. The
revised plan includes increased detail concerning control measures and record keeping. The Department
recommends that the BOCC approve the revised plan.
Department of Planning Services Recommendation: The Department of Planning Services
recommends that USR-1602 not be revoked. The Department of Planning Services originally
recommended at the probable cause hearing that should the plat not be submitted for recording and the
number of cattle on site is not reduced to 2,364 head by November 8, 2007, the Department of Planning
Services recommends that USR-1602 be immediately scheduled for a show cause hearing. The plat has
been submitted for recording and all conditions of approval prior to recording the plat have been satisfied.

Condition of Approval # 6. The Use by Special Review activity shall not occur, nor shall any Building or

recorded in the office of the Weld County Clerk and Recorder.
Facts: As of September 18, 2007, the Use by Special Review plat has not been recorded. On September
4, 2007, the facility manager indicated that the operation has animal units in excess of the units allowed
as a use by right.
Facts: A nuisance condition, due to excess flies, exists in the vicinity of the facility. Both the Department
• of Health and Planning received numerous inquiries and complaints concerning fly conditions in the
vicinity of the facility. Staff observed the area and the facility on September 4, 2007, and confirmed that a
significant number of flies appear to be originating from the facility. Based upon a discussion with Randy
Checketts — General Manager for the Aurora Organic Dairy facility, the facility is not complying with its

approved Management Plan for Nuisance Control. Specifically, the facility is not utilizing biological
• treatments nor baits and chemical treatments
Facts: The facility is not being operated in a manner to control flies and is not complying with its
approved Management Plan for Nuisance Control (see above). On two separate occasions staff notified
the facility's representative/consultant, AgPro, to make them aware of concerns regarding fly populations.
Department of Public Health and Environment Recommendation: The Department recommends that
the BOCC require that the nuisance condition be remedied no later than October 1, 2007. Should the
nuisance not be abated by October 1, 2007, we recommend that the BOCC direct the Health Department
to secure a contractor to remedy the nuisance and bill back the cost of the contractor to the property
owner, tenant dairy, and Aurora Organic Dairy. Additionally, we recommend that the BOCC direct Aurora
Organic Dairy to develop and submit a revised and more detailed fly management plan that will be
followed for preventing future fly nuisance conditions. The fly management plan should include, at a
miniumum, the following: strategies for land application of manure and wastewater, the type and use of
appropriate pesticides for an organic dairy, use of parasitic wasps, weed management, manure
stockpiling and storage, and emergency aerial applications.
Department of Planning Services Recommendation: The Board approved USR-1602 on July 11,
2007. A condition of approval for USR-1602 was that the mylar plat and additional requirements shall be
submitted within one hundred twenty(120)days from the date of the Board of County Commissioners
resolution. The one-hundred twenty day(120) deadline to submit the mylar for recording is November 8,
2007. Conversations with the site manager of the dairy(Randy Checketts) on September 4, 2007
indicated that the dairy was operating out of compliance in regards to animal numbers. The Department
of Planning Services recommends that either: 1)all conditions of approval shall be finalized and the plat
shall be submitted for recording by November 8, 2007 or 2)the animal numbers be reduced to an amount
not to exceed the use by right amount of 2,364 head by November 8, 2007.
• Should the plat not be submitted for recording and the number of cattle on site is not reduced to 2,364
head by November 8, 2007, the Department of Planning Services recommends that USR-1602 be
immediately scheduled for a show cause hearing.

Dear Sirs,
Notice is hereby given that on Monday, September 24, 2007, at 9:00 a.m, or as soon thereafter
as the agenda of the Board of County Commissioners permits, the Board of County
Commissioners of Weld County will hold a Probable Cause public hearing pursuant to Chapter
23, Article 11(2), Division 4, Section 23-2-270 of the Weld County Code. This meeting will take
place in the Commissioner's Hearing Room, Weld County Centennial Center, 915 10`" Street,
Greeley, Colorado.
The purpose of this public hearing will be to review case number USR-1602 for compliance with
the Conditions of Approval and Development Standards as approved by the Board of County
Commissioners on July 11, 2007 to determine if probable cause exists to hold a hearing of
revocation of USR-1602.
In response to several complaints and inquiries, representatives of the Weld County Departments
of Planning Services and Health have determined that your facility is creating a nuisance
condition in regard to excess flies. As a result of not controlling flies associated with the facility,
and operating a dairy with animal units in excess of a use allowed by right you are not in
compliance with the following Conditions of Approval:

soon as possible.

AURORA ORGANIC DAIRY TIMELINE
August 8, 2007— Environmental Health investigates a potential fly nuisance condition at
Aurora Organic Dairy. No nuisance condition exists at this time at the dairy or nearby
residents of CR 57.
August 23, 2007—Environmental Health contacted about serious fly problem at Aurora
Organic Dairy. Courtesy Call to AgPro informing them of potential fly problems.
August 28, 2007 —AgPro e-mail outlining plan to correct current fly problem at Aurora
Organic Dairy.
August 28, 2007—Neighbor(CR 57) contacts Environmental Health concerned about
how bad flies are.
August 30, 2007 — Neighbor (CR 57) invites Planning to check out the fly problem at
residence.
August 31, 2007—Site visit scheduled with Planning and Environmental Health for
September 4, 2007.
September 4, 2007 — Chris Gathman, Planning and Laurie Exby, Environmental Health
• conduct a site and visit area residents and determine a fly nuisance condition exists. At
neighbors residence a terrible fly problem was evident. Aurora Organic Dairy property
had a fly problem both inside (milking parlor and offices) and outside the facility. Met
with Aurora Organic Dairy General Manager, Randy Cheketts to address fly problem and
control methods currently in place.
September 4, 2007—Neighbor (CR 57) registers formal complaint with Environmental
Health in regards to flies and dumping of liquid manure on fields farmed by Aurora
Organic Dairy.
September 5, 2007 —Neighbor (CR 57) registers formal Complaint with Environmental
Health.
September 5, 2007—Probable Cause lettered drafted.
September 5, 2007—e-mail from neighbor(CR 57) stating Aurora Organic Dairy"might
agree" to pay for spraying of neighbors homes.
September 6, 2007 —Neighbor contacts Environmental Health in regards to a fly problem
from Aurora Organic Dairy.
September 6, 2007 —Neighbor (CR 57) contacts Environmental Health on status of fly
• control at Aurora Organic Dairy.
• September 7, 2007 —AgPro notified of Probable Cause hearing on September 24, 2007.
Complainants are notified by telephone or e-mail of date and time of hearing.
September 7, 2007 — Environmental Health contact Tom Haren, AgPro to discuss
problems and intent to abate the fly problem at Aurora Organic Dairy.
September 8 & 9, 2007 —Tom Haren , AgPro and Randy Cheketts, General Manager of
Aurora Organic Dairy visit with neighbors and explain plan to eradicate the current fly
problem.
September 10, 2007 —Neighbor contacts Environmental Health to discuss the problem of
flies and dumping of manure water on a field near the dairy. Aurora Organic Dairy plows
up field where dumping of manure water has taken place for more than 3 weeks. Contact
states: Mr. Haren indicated this activity was a mistake.
September 10, 2007 — Environmental Health staff contact Tom Haren, AgPro about the
dumping of the manure water on the Aurora Organic Dairy property. According to Mr.
Haren the manure water was pumped into the vac-truck and dumped on the property.
Upon learning this activity was taking place, a check of the area found flies and a
breeding ground for flies. It was decided to plow under this field to eliminate the
breeding habitat for the flies. The vac-truck dumping was undertaken by an employee
who thought this was a good idea. This activity has been stopped and the field is irrigated
with ditch water, no effluent lines are plumbed to this pivot. Staff requested application

rates for the manure water dumping.
