This center will have a negative impact on the surrounding area and residents. The current infrastructure is not capable of handling the intensity of this use and is not compatible with the area. As a private road owned by the current land owners on the north side this use will impact the existing transportation and service by emergency services such as fire, police and ambulance. Also there is minimal infrastructure in place to handle utilities. No sewer exists and the water line also dead ends in this road. The extra water use will take even more pressure away from the already low pressure experienced by the last user on the line. In section 22-2-60 of the Weld County County Comprehensive Plan it clearly states that urban—scale residential, • commercial and industrial development will be discouraged in areas where adequate services and infrastructure are not currently available. It states in goal 4 that commercial uses will be accommodated when the site is in an area that can support it and will be compatible with the region. In goal 6 it states that public facilities and services such as sewer, water, roads must be provided to support the transition of agricultural land to other development uses. These items are stressed and repeated over and over through out the entire comp plan. The comp plan also clearly states in several places that growth and commercial uses should pay for it own way yet the Cambodian Cultural Center want the current residents to pick up the tab to maintain the road equally so they can use it commercially for thier financial gain. They are trying to force easements across the northern land owner's properties to tie our private road into Sheridan Parkway. This creates two very large intrusive and obnoxious problems. The first one deals with irrigation rights. The area in which they want to place this road travels right over all the head gates and irrigation ditches that supplies our neighbor to the east irrigation water to his farm fields and any irrigation water used to fill up our pond and our next door neighbors pond. The comp plan states that supporting agriculture will continue to be a significant goal of the County. When agricultural tradition is being changed to accommodate residential, commercial and industrial development and as these new land uses evolve, it is important that the established Ag business and associated infrastructures are allowed to continue to operate • EXHIBIT hr '�BI! without additional constraints. Individuals who move into these areas must realize • that they will experience conditions and services unlike urban settings and must be willing to accept this lifestyle. This is also reiterated in Weld County's Right to Farm Statement. The second issue addresses the road itself. The road used for access to the Center is privately owned and maintained by the residents that live there. My Father maintained the road for several years until he wasn't able to any further. Both my parents were instrumental in up- grading our road and getting gravel in place, where the Stables and the Cambodian Center clientele tear it up, from an agreement with the proposed dumps that were trying to locate in what is Vista Ridge. Mr. Graber took over from my Dad and continued to maintain the road and currently the most recent residents the Davis's and there children maintain the road. Not once has Legacy Stables or the Cambodian Center has ever contributed to either the maintenance or financially to maintain the road. Yet the Cambodian Center and Legacy Stables and their clientele are the main users and abusers of the road and they both profit from the income of the special use at the current residents expense. Their clientele use it hundreds of times more then all the residents to the west of them put together. With the special use granted to the Stables it has over impacted the road. More commercial use will limit the ingress/egress and severely deteriorate the road. Especially during the winter and rainy season. Clientele using the stables currently park alongside the road making the ingress/egress very limited to the property owners to the west. When they run special events the traffic and parking on the road is a nightmare. The same happens when the Cambodian Center has activities the over flow parks on the • other side of the road. This makes the road a barely passable one lane. In cases of emergency this could impede any emergency vehicles from reaching the residents that live along this road. If emergency vehicles can't get through neither can the farm equipment. Another major problem arises from the result of special use if the road is extended to intersect into Sheridan Parkway The increase in traffic on our road would be significant and the cost to the current residants to maintain it would be a considerable. Everyone from Vista Ridge and other outside communities will use it as a short cut to reach their subdivision to avoid the grid lock and traffic lights on the major artieials. They already try to drive across our private property even with no trespassing signs posted , tearing it up with their vehicles, and then act stupid when they are caught and run off. It will also become a thorogh fare for commercial traffic to the dumps. Myself and my family fought with several other citizens in the Tri-Towns in opposition of the proposed dumps. We were successful in stopping all but the one that is located directly north of our property. When Vista Ridge was built they couldn't have dump trucks driving through Vista Ridge to the dump so Weld County allowed them to put Sheridan Parkway right down our property line. The impact and noise from this road is unbearable now. With a connection into Sheridan it will be detrimental to the quality of life and devalue our home even further. We currently have over 3,000 commercial dump trucks going past our house twice daily starting at 4 am to access one of the two dumps. This count does not include the number of commercial vehicles traveling to the second dump nor any of the private • vehicles accessing either dump. • Due to population growth rate in this area being over triple the national average and 73% of the counties population being in the 800 square miles in the southwestern part of the county we need all remaining Ag lands for open space and buffer zones to stop the encroaching developers which have already overdeveloped the area, not for commercial uses. My family is a 4` generation Coloradoans and 3`d generation Weld Countians. We have owned and lived on this road for 37 years. It is stated in the Weld county Comp Plan sec 22-2-20 Weld county is to encourage the conservation of Ag lands including open space and promote quality planning that is sensitive to surrounding land uses, respectful of the natural environment, protective of health, safety and welfare of the citizens of the county, is regionally linked by roadways and trails and is aesthetically pleasing. Section 22-2- 120 and 22-2-130 of the comp state that it is the Counties goal is to maintain the rural character of these settlements and that further development in unincorporated communities will be encouraged only when adequate services and infrastructure are currently available. Article II states land use categories supporting agriculture will continue to be a significant goal of the County and will be supported and continue as a mainstay of the county. The cumulative effect of the goals and policies described in Article II will result in: a. Maintaining the prominence of agriculture in the county b. Urbanization occurring in and around cities and towns within the County • c. Property owners' rights and responsibilities being balanced d. The quality of land uses remaining high This commercial use doesn't fit into any number of areas in the comprehensive plan nor is it compatible with the community. After many conversations with my neighbors to the east and their attorney I have found no one in favor of it. I encourage the council to deny the request for special use.
