Here is a list addressing the issues that I also emailed to Lauren Light&Kim Ogle:
A. Changes to the Plat- See updated plat map
B. Address issues on memorandum from Lauren Light
1. Dust abatement plan: Speed limit 5-10 mph. Existing driveway is a crushed rock over-layer.
2. Waste handling plan: I will be utilizing my covered dump trailers for all generated wastes. Office
supplies(paper, cardboard trash)only generated on site. I will have no hazardous wastes
generated on site. The only types of chemicals to be stored would be roofing asphalt tar and less
than 50 gallons. The waste handler that I dispose of my waste is Buffalo ridge Landfill at 11655
WCR#59, in Keenesburg,CO 80643, (303) 732-0218.
3. Vehicle Washing: Not Applicable
4. Existing Septic: Have reviewed with Todd Schroder with High Plains Engineering,and there
• seems to be no issues with the existing septic. This can be done if this is the only option.
5. Existing water well: enclosed is a letter from the Division of Water resources limiting my options
for water useage. I would like to be able to utilize any other means possible than to re-classify my
well for commercial only, because it will not allow me to outside water. If this is my only option
for approval then I will do so and the appearance from the outside of the property will suffer from
it.
6. Underground Injection Control: Not Applicable
7. All other requirements are obviously to be planned on&complied with
C. Contact Building Dept: I contacted the Building Dept. in regards to the change of use for the existing
buildings. I will re-permit and provide information necessary for this change.
D. I contacted the Division of Water resources regarding the water usage for the additional people. Again See
the letter from the Division of Water resources which limits my options. I would prefer not to re-classify
my well for commercial use,as this limits my water usage. I would not be allowed to do any outside
watering of my lawn and trees. I would prefer almost any other options that would satisfy the county, but
if this is the only option I will do it. The outside of the property will suffer as a result of not being able to
water my yard.
E. Letter addressing the conditions in Landscape referral from Kim Ogle:
1. I had sent over an email to Kim and as discussed you said that you had a copy of my responses sent
from Kim. If you need anything else concerning this area let me know.
I am mailing out the mineral notification October 14, 2008, as required—please see copy enclosed for your records.
I have not yet received a letter addressing our meeting scheduled for November 18'b, 2008. I only ask this because I
received a letter with information pertaining to our meeting that was originally scheduled for October. If you have

Re: Water Well permit no.241019-A
Dear Mr. Aberle:
I have reviewed your letter dated September 22, 2008. Your letter requests that well permit
no. 241019-A be reclassified, at least on a limited basis, to allow for minimal commercial use while still
allowing for use in a single family home and landscape watering.
Under existing statutes commercial well permits can be issued under C.R.S. 37-90-137
("commercial non exempt") and C.R.S. 37-92-602("commercial exempt").
Commercial exempt wells are limited to drinking and sanitary purposes only in a commercial
business. Water from such wells cannot be used outside for any purpose, including landscape
watering. Therefore if the existing well was re-permitted as a commercial exempt well, water pumped
• from the well could not be used for the requested landscape watering.
Commercial non exempt wells can be used for more uses, however such wells have
additional requirements that must be satisfied before such permits can be obtained. In this situation
the existing well is constructed into the tributary alluvial aquifer. Therefore, prior to re-permitting the
existing well as a commercial non-exempt well, a court approved augmentation plan would be
required.
In our phone conversation you also asked what the possibility would be to obtain a second
well that could be used for commercial purposes.
Since commercial exempt wells are issued as the only well on the tract of land, it would not be
possible to keep the existing well and obtain a second well permit for commercial exempt purposes.
The requirements to obtain a commercial non exempt well would vary depending on the
aquifer into which the well would be constructed. Underlying the property there are three distinct
aquifers, the tributary alluvial aquifer, the not nontributary Lower Arapahoe aquifer and the nontributary
Laramie-Fox Hills aquifer. As stated above, a commercial non-exempt well constructed into the
tributary alluvial aquifer would require a court approved augmentation plan. A court approved
augmentation plan would also be required for a commercial non-exempt well constructed into the not
nontributary Lower Arapahoe aquifer. The Laramie-Fox Hills aquifer is nontributary and therefore
does not require a court approved augmentation plan. However based on a review of the information
available in the State Engineer's Office, the water in the nontributary Laramie-Fox Hills aquifer
underlying your parcel is claimed by an existing pre-213 well. Therefore, you would not be able to
obtain a commercial non exempt well into the Laramie-Fox Hills aquifer since all of the water in that
source, underlying your property, is currently claimed.
