RE: ACTION OF THE BOARD CONCERNING REVOCATION OF COLORADO RETAIL
FOOD ESTABLISHMENT LICENSE - EL RODEO MEXICAN FOOD
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, El Rodeo Mexican Food, located at 1029 9th Street, Greeley, Colorado 80631,
as well as operating a mobile unit, is allegedly in violation of the Colorado Retail Food
Establishment Rules and Regulations, and
WHEREAS, despite efforts by the Weld County Department of Public Health and
Environment staff to resolve said matter, the violations have not been corrected, and
WHEREAS, on the 6th day of October, 2008, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violations, and
WHEREAS,Alfonso Perez,owner,was notified of said hearing by the Department of Public
Health and Environment, and was present at said hearing, and
WHEREAS, after hearing testimony from all present, the Board of County Commissioners
deems it advisable to revoke said license based on the history of ongoing critical violations as
presented by staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Colorado Retail Food Establishment License for El Rodeo Mexican
Food, located at 1029 9th Street, Greeley, Colorado 80631, as well as the mobile unit, be and
hereby is, revoked.

SUBJECT: El Rodeo Mexican Food
El Rodeo Mexican Food, located at 1029 9th Street, Greeley, Colorado has failed to
maintain compliance with the Colorado Retail Food Establishment Rules and Regulations
(please see attached time line). The Weld County Department of Public Health and
Environment has given the facility all opportunities to come into compliance as afforded to
them in the Colorado Revised Statutes.
Unfortunately, staff continues to observe violations that have the potential to directly result
in illnesses of patrons dining at the establishment. The Weld County Department of Public
Health and Environment recommends the Board of County Commissioners (BOCC)
revoke El Rodeo's Retail Food Establishment License.

Dear Mr. Perez:
You, Alfonso Perez, are hereby notified that the Weld County Department of Public Health and
Environment has determined that El Rodeo Mexican Food located at 1029 9th Street, in Greeley,
Colorado,has been found in violation of the provisions of Part 16, Title 25, Article 4 of the
Colorado Revised Statutes and the Colorado Retail Food Establishment Rules and Regulations..
You have been notified of the violations (3a- improper cooling, 3c- improper hot holding, and
3e- improper cold holding) in writing, have been given an opportunity to comply and you remain
in violation.

To Whom It May Concern,
My name is Alfonso Perez and I am the proprietor of El Rodeo Mexican Restaurant in
Greeley, Colorado. This year has been extremely tough for myself as well as small business
owners everywhere. The most important obstacle my business has is acquiring and maintaining
quality employees. The economics of running a small business coupled with the struggling
economy,does not allow me to give my employees enough hours adequate for them to maintain
financially. This has resulted in employees leaving to acquire employment elsewhere. With
employees leaving for better pay and more hours,this has placed a huge strain on my ability to
train. There is no money in our budget to do any advertising(radio/television)that would make
a significant difference. The only advertising I am able to do is through face to face
communication. I speak to other business owners,construction site foreman's, etc. in order to
establish new business. This requires my wife and myself to be away from the restaurant
significant amounts of time. This of course leaves employees to oversee the operations of the
restaurant in our absence. The violations I come before you being accused of I believe is a
direct result of things aforementioned. The constant training of different employees I believe has
led to certain instructions not being given-due to being busy or not realizing that the individual
employee has not yet been given those instructions. Over the last few months,business has
steadily improved. More customers,means more money and more time for my wife and myself
to be at the restaurant assuring that all rules and regulations are adhered to in a strict and
consistent manner. I plan to institute a daily check list that all employees will be required to fill
out before each work day begins. In addition to that,I will do a monthly check on all equipment
to ensure that everything is in proper working order. 1 believe that we will be able to avoid these
types of situations moving forward. I respectfully ask that I be allowed to continue doing
business with a strict focus on proper procedures to ensure a healthy operation.
