(Ordinance 2005-8 Section 5-8-40) Q)/ WELD COUNTY'S RIGHT TO FARM: Weld County is one of the most productive agricultural counties in the United States, ranking fifth in total market value of agricultural products sold. The rural areas of Weld County may be open and spacious, but they are intensively used for agriculture. Persons moving into a rural area must recognize and accept there are drawbacks, including conflicts with longstanding agricultural practices and a lower level of services than in town. Along with the drawbacks come the incentives which attract urban dwellers to relocate to rural area: open views, spaciousness, wildlife, lack of city noise and congestion, and the rural atmosphere and way of life. Without neighboring farms, those features which attract urban dwellers to rural Weld County would quickly be gone forever. Agricultural users of the land should not be expected to change their long-established agricultural practices to accommodate the intrusions of urban users into a rural area. Well run agricultural activities will generate off-site impacts, including noise from tractors and equipment; slow-moving farm vehicles on rural roads; dust from animal pens, field work, harvest, and gravel roads; odor from animal confinement, silage, and manure; smoke from ditch burning; flies and mosquitoes; and the use of pesticides and fertilizers in the fields, including the use of aerial spraying. Ditches and reservoirs cannot simply be moved out of the way of residential development without threatening the efficient delivery of irrigation to fields which is essential to farm production. Section 35-3.5-102, C. R. S., provides that an agricultural operation shall not be found to be a public or private nuisance if the agricultural operation alleged to be a nuisance employs methods or practices that are commonly or reasonably associated with agricultural production. Weld County covers a land area of over 4,000 square miles in size (twice the State of Delaware) with more than 3,700 miles of state and County roads outside of municipalities. The sheer magnitude of the area to be served stretches available resources. Law enforcement is based on responses to complaints more than on patrols of the county and the distances which must be traveled may delay all emergency responses, including law enforcement, ambulance, and fire. Fire protection is usually provided by volunteers who must leave their jobs and families to respond to emergencies. County gravel roads, no matter how often they are bladed, will not provide the same kind of surface expected from a paved road. Snow removal priorities mean that roads from subdivisions to arterials may not be cleared for several days after a major snowstorm. Snow removal for roads within subdivisions are of the lowest priority for public works or may be the private responsibility of the homeowners. Services in rural areas, in many cases, will not be equivalent to municipal services. Rural dwellers must, by necessity, be more self-sufficient than urban dwellers. Children are exposed to different hazards in the county than in an urban or suburban setting. Farm equipment and oil field equipment, ponds and irrigation ditches, electrical power for pumps and center pivot operations, high speed traffic, sand burs, puncture vines, territorial farm dogs, and livestock present real threats to children. Controlling children's activities is important, not only for their safety, but also for the protection of the farmer's livelihood. Parents are responsible for their children. 3. The applicant shall submit two (2) paper copies of the plat for preliminary approval to the Weld County Department of Planning Services. Upon approval of the paper copies the applicant shall submit a Mylar plat along with all other documentation required as conditions of approval. The Mylar plat shall be recorded in the office of the Weld County Clerk and Recorder by Department of Planning Services' Staff. The plat shall be prepared in accordance with the requirements of Section 24-8-60 of the Weld County Code. The Mylar plat and additional requirements shall be submitted within sixty (60) days from the date the Administrative Review was signed. The applicant shall be responsible for paying the recording fee. • 4. In accordance with Weld County Code Ordinance 2005-7 approvedJne 1, 2005, should the plat not be recorded within the required sixty (60) days from the date this Administrative Review was signed a $50.00 recording continuance charge may be added for each additional 3 month period. 5. Weld County Public Works recommends sharing an access point to the lots and that the access be placed in a location with appropriate site distance. Road Access Policy: (Policy Established Sec. 8-2-10) Direct access from a public road will be limited to one (1) per legal parcel, except as further limited or restricted by zoning or subdivision regulations. A plan review is required for each new building except for buildings that meet the definition of Ag Exempt buildings. Plans may require the wet stamp of a Colorado registered architect or engineer. 3. The current owner of the property is Robert A. Roth. The current service provides a 3/4" meter. The current Water Allocation Class is 1 (228,000 gallons) and the Current Plant Investment Class is 1 (228,000 gallons). The District has reviewed the application submitted on Mr. Roth's behalf by Alles and Associates and finds no conflict with the Proposed Lot Line Amendment. Water tap/service is placed on the physical property, defined by a legal description. In case of a Recorded Exemption, the water tap shall only serve the parcel that the water tap is located on. Service shall NOT cross the legal description of one parcel to serve the other parcel, unless an easement has been recorded for the water service and has been approved by the District. The District guarantees treatment and delivery of water purchased. All water that is delivered with surcharge is subject to water availability. Water purchased through the District shall be 70% delivery of an Acre-Foot of water (228,000 gallons), if the allotment for Colorado-Big Thompson (CBT) project water, which is determined by the Northern Colorado Water Conservancy District, is 50% or greater. North Weld County Water District will restrict the delivery as necessary when the CBT allotment is less than 50%. A portion of the Raw Water Fee is utilized by the District to construct storage reservoirs. The Plant Investment Fee pays for the infrastructure required to deliver 1 AFU (228,000 gallons). If usage exceeds the number of Plant Investments that were purchased, an additional Plant Investment Surcharge will be applied to your account. Plant Investments may be purchased to increase the amount of water to be delivered and avoid the Plant Investment Surcharge. Refer to table below for current Plant Investment Surcharge schedule. Water Surcharge Surcharge will be assessed when an account's year to date usage exceeds their annual allotment. Currently surcharge is $0.10 per 1,000 gallons. Should the permittee or applicant chose to object to any of the terms or conditions of the permit placed therein by the Department,an appeal must be filed with the Colorado Transportation Commission within 60 days of transmittal of the permit for permittee signature.The request for the hearing shall be filed in writing and submitted to the Colorado Transportation Commission,4201 East Arkansas Avenue, Denver, Colorado 80222.The request shall include reasons for the appeal and may include recommendations by the permittee or applicant that would be acceptable to him. 2. The Department may consider any objections and requested revisions at the request of the applicant or permittee. If agreement is reached,the Department,with the approval of the local issuing authority(if applicable),may revise the permit accordingly,or issue a new permit,or require the applicant to submit a new application for reconsideration.Changes in the original application, proposed design or access use will normally require submittal of a new application. 3. Regardless of any communications,meetings,or negotiations with the Department regarding revisions and objections to the permit,if the permittee or applicant wis hes to appeal the Department's decision to the Commission,the appeal must be brought to the Commission within 60 days of transmittal of the permit. 4. Any appeal by the applicant or permittee of action by the local issuing authority when it is the appropriate local authority (under subsection 2.4), shall be filed with the local authority and be consistent with the appeal procedures of the local authority. 5. If the final action is not further appealed,the Department or local authority may record the decision with the County Clerk and Recorder. II Construction standards and requirements 1. The access must be under construction within one year of the permit date. However, under certain conditions a one year time extension may be granted if requested in writing prior to permit expiration. 2. The applicant shall notify the office specified on the permit at least 48 hours prior to construction.A copy of the permit shall be available for review at the construction site. Inspections will be made during construction. 3. The access construction within highway right-of-way must be completed within 45 days. 4. It is the responsibility of the permittee to complete the construction of the access according to the terms and conditions of the permit. If the permittee wishes to use the access prior to completion, arrangements must be approved by the issuing authority and Department and included on the permit. The Department or issuing authority may order a halt to any unauthorized use of the access. Reconstruction or improvements to the access may be required when the permittee has failed to meet required specifications of design or materials. If any construction element fails within two years due to improper construction or material specifications, the permittee is responsible for all repairs. 5. In the event it becomes necessary to remove any right-of-way fence,the posts on either side of the access shall be securely braced with an approved end post before the fence is cut to prevent any slacking of the remaining fence.All posts and wire removed are Department property and shall be turned over to a representative of the Department. 6. A copy of the permit shall be available for review at the construction site.If necessary,minor changes and additions shall be ordered by the Department or local authority field inspector to meet unanticipated site conditions. 7. The access shall be constructed and maintained in a manner that shall not cause water to enter onto the roadway,and shall not interfere with the drainage system in the right-of-way. 8. Where necessary to remove,relocate,or repair a traffic control device or public or private utilities for the construction of a permitted access,the work shall be accomplished by the permittee without cost to the Department or issuing authority,and at the direction of the Department or utility company.Any damage to the state highway or other public right-of-way beyond that which is allowed in the permit shall be repaired immediately. 9. Adequate advance warning is required at all times during access construction,in conformance with the Manual on Uniform Traffic Control Devices for Streets and Highways.This may include the use of signs,flashers,barricades and naggers.This is also required by section 42-4-501,C.R.S. as amended. The issuing authority, the Department and their duly appointed agents and employees shall be held harmless against any action for personal injury or property damage sustained by reason of the exercise of the permit. III Changes in use and violations 1. If there are changes in the use of the access,the access permit-issuing authority must be notified of the change.A change In property use which makes the existing access design or use in non-conformance with the Access Code or the terms and conditions of the permit,may require the reconstruction or relocation of the access.Examples of changes in access use are; an increase in vehicular volume by 20 percent,or an increase by 20 percent of a directional characteristic such as a left turn. The issuing authority will review the original permit;it may decide it is adequate or request that you apply for a new permit. 2. All terms and conditions of the permit are binding upon all assigns,successors-in-interest and heirs. 3. When a permitted driveway is constructed or used irtviolation of the Access Code,the local government or Department may obtain a court order to halt the violation. Such access permits may be revoked by the issuing authority. IV Further information 1. This Permit is issued in accordance with the State Highway Access Code (2 CCR 601-1) , and is based in part upon the information submitted by the Permittee. This Permit is only for the use and purpose stated in the Application and Permit. Any changes in traffic volumes or type, drainage, or other operational aspects may render this permit void, requiring a new permit to be applied for based upon existing and anticipated future conditions . 5 . If necessary, minor changes, corrections and/or additions to this permit may be ordered by the Department inspector, other Department representative, or local authority to meet unanticipated site conditions. Changes may not be in violation of the Code. All major changes to the plans must be approved in writing by the Department prior to commencement of any work within the State Highway right-of-way. 6 . Reconstruction or improvements to the access may be required when the Permittee has failed to meet the required design and/or materials specifications. If any construction element fails within two years due to improper construction or material specifications, the Permittee is responsible for all such repairs. (1985 Code) 7. Eastmost access to the property shall be removed immediately. Removal shall include, but not limited to, the return of highway right-of-way side slopes, ditches and fences to match existing adjacent conditions, including removal of asphalt aprons . Any asphalt removed from the highway shall result in a smooth finished edge. 8 . The Permittee is responsible for obtaining any necessary additional federal, state and/or City/County permits or clearances required for construction of the access . In the event any changes are made to this highway in the future that would necessitate utility removal, adjustment, or relocation of any installation, the Permittee will arrange for those changes promptly upon written notice from CDOT, and at no cost to CDOT except as provided by law. 13 . Survey markers or monuments must be preserved in their original positions. Notify the Department at (970) 350-2173 immediately upon damage to or discovery of any such markers or monuments at the work site . Any survey markers or monuments disturbed during the execution of this permit shall be repaired and/or replaced immediately at the expense of the Permittee . 14 . The Permittee or the contractor shall notify your inspector Bob Broyles at (970) 834-1458 or pager (970) 350-8476 at least two working days prior to beginning any access improvements or construction of any kind within the State Highway right-of-way. Failure to comply with this requirement may result in revocation of this permit . 15 . It shall be the responsibility of the Permittee to verify the location of the existing utilities and notify all utility owners or operators of any work that might involve utilities within the State Highway right-of-way. Removal, adjustment, or relocation of an existing utility requires the Permittee to obtain a utility permit . Any work necessary to protect existing permitted utilities, such as an encasement, will be the responsibility of the Permittee. Any damage or disruption to any utilities during the construction shall be the Permittee ' s responsibility and shall be repaired or replaced at no cost to the Department . 16 . The access shall be constructed 25 feet wide, with 25 foot radii, as per Exhibit "A" . 17. The access shall be constructed perpendicular to the travel lanes of the State Highway for a minimum distance of 40 feet, and shall slope down and away from the adjacent pavement edge at a rate of 2% grade for a minimum of 20 feet . 18 . The access shall be completed in an expeditious and safe manner and shall be finished within 45 days from initiation of construction within State Highway right-of-way. 19 . Any access that has a gate across it shall be constructed so that the longest vehicle using the access can completely clear the traveled way when the gate is closed. If the gate is set back, the permittee shall assume full responsibility for the gate and fence necessary for the set back. 20 .
