RE: APPROVE LETTER OF AGREEMENT FOR STEPS TO A HEALTHIER WELD COUNTY
PROGRAM AND AUTHORIZE CHAIR TO SIGN - GREELEY-EVANS SCHOOL
DISTRICT 6
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Letter of Agreement for the Steps to a
Healthier Weld County Program between the County of Weld, State of Colorado, by and through
the Board of County Commissioners of Weld County, on behalf of the Weld County Department
of Public Health and Environment, and Greeley-Evans School District 6, commencing
September 22, 2007, and ending September 21, 2008, with further terms and conditions being as
stated in said agreement, and
WHEREAS, after review, the Board deems it advisable to approve said agreement, a copy
of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Letter of Agreement for the Steps to a Healthier Weld County Program
between the County of Weld, State of Colorado, by and through the Board of County
Commissioners of Weld County, on behalf of the Weld County Department of Public Health and
Environment, and Greeley-Evans School District 6 be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to
sign said agreement.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 7th day of January, A.D., 2008, nunc pro tunc September 22, 2007.

SUBJECT: Steps to a Healthier Weld County
Agreement with Weld County School
District Six
Enclosed for Board review and approval is a letter of agreement between Weld County
Department of Public Health and Environment and Weld County School District Six for a 1.0
FTE School Health Coordinator for the Steps to a Healthier Weld County Program. The total
amount payable to School District Six for salary and fringe benefits is $50,992.00 for the time
period September 22, 2007 through September 21, 2008.
The Weld County Department of Public Health and Environment was awarded $491,155.00 for
year five of the Health and Human Services initiative to reduce the burden of diabetes, asthma,
and obesity through the promotion of nutrition, physical activity and tobacco cessation in Weld
County. This agreement delineates the responsibilities of the School Health Coordinator for
completing the objectives of the program. I recommend your approval.

Letter of Agreement
Between the Weld County Board of County Commissioners for the County of Weld, State of
Colorado, on behalf of the Weld County Department of Public Health and Environment
(WCDPHE) and the Greeley-Evans School District 6 (WCSD6).
Name of Contractor:
Greeley-Evans School District 6 (sometimes hereinafter referred to as "WCSD6").
Term of Agreement:
September 22, 2007- September 21, 2008.
General Purpose:
The purpose of this Agreement is to foster and facilitate collaboration in cooperative service
delivery. The parties intend to follow the guidelines set forth in the Steps to a HealthierUS.
Scope of Work:
Steps to a Healthier Colorado (Steps) is a project meeting the Steps to HealthierUS requirements
for State-Coordinated Small City and Rural Community Applicants. The Colorado Department
of Public Health& Environment(CDPHE)has coordinated community level interventions,
environmental interventions, and educational interventions. The Colorado Steps project's
planned short-term outcomes include: increased exposure of community members, educators,
health care professionals, and school-aged children to education about disease prevention and
self-management,healthy lifestyles, increased availability of health care services and screening,
and increased access to and consumption of healthy foods. Major planned intermediate
outcomes include: increased awareness of the benefits of a healthy lifestyle, the risks of diseases
and the advantages of proper treatment for chronic diseases; more community residents engaging
in a healthier lifestyle; increased access to healthier environments; and increased correct
diagnosis of and appropriate care for people with chronic diseases.
Approved Work Plan Year 5 for the School Section of the Steps Work plan:
Reduce asthma, diabetes and obesity through the promotion of nutrition, physical activity and
tobacco cessation, and prevention of tobacco use and exposure in SCHOOLS.

Annual School Objective 4A: By September 21, 2008, ensure complete implementation of the seven
mandated nutrition standards adopted in the School Wellness Policy (SWP) in Weld County School
District 6 (Baseline: Six of the seven mandated standards met)
1. Maintain the District Coordinated School Health Team(DCSHT)with at least fifteen members.
2.Partner with key stakeholders to implement nutrition standards and ensure compliance with SWP
standards.
3.Train Nutrition Services staff in evaluating the mandated nutrition standards outlined in the SWP.
Annual School Objective 4A2:By September 21, 2008, increase compliance of policy guidelines that are
encouraged in the Weld County School District 6 School Wellness Policy by 20%. (Baselines: Establish
for fundraising, student stores, and after school concession stands; increase classroom nutrition
education from 117 classrooms to 157 classrooms)
1.Promote SWP guidelines for fundraising,student stores,and after-school concession stands to administrators and
staff.
2. Increase parent awareness of SWP classroom party guidelines.
3.Provide and/or promote at least two professional development opportunities to health education and PE teachers
to increase compliance of nutrition education component of SWP.
4.Provide nutrition,physical activity,and health education resources to non-CSH WCSD6 schools as requested to
increase compliance with health education guidelines outlined in the SWP.
5. Report 2007 Youth Risk Behavior Survey(YRBS)results to at least three district committees as part of the SWP
evaluation.
6.Train high school health advocates in promoting nutrition,physical activity,and smoking prevention messages in
WCSD6 schools as part of the student and parent health education component of the SWP.
7. Partner with WCSD6 School-Based Health Centers to increase compliance with SWP health education
guidelines.
8.Increase Harvest of the Month(HOTM)nutrition education program from 117 to 157 elementary school
classrooms to increase compliance with SWP nutrition education guidelines.
Annual School Objective 4B: By September 21, 2008, Weld County School District 6 (WCSD6) will
maintain eight Coordinated School Health Teams. (Baseline:Eight Coordinated School Health Teams
with at least six members per team)
1. Support and assist eight Coordinated School Health(CSH)teams with the development and implementation of
their School Health Improvement Plans.
2.Host quarterly meetings for the CSH co-leaders.
3.Promote at least two professional development opportunities to CSH teams.
4.Collect necessary documentation from the CSH teams and forward to CDPHE-Steps staff according to the
mandated timelines
Annual Community Objective 4C: By September 21, 2008, WCSD6 Wellness Committee
implement at least four new worksite wellness benchmarks for "Well Workplace"designation
irocess. (Baseline: Two benchmarks implemented)
1.Maintain the WCSD6 Worksite Wellness Committee(W WC)with at least five members.
2.Implement four WELCOA benchmarks during the 2007-2008 school year.
Method of Accountability:
On-going evaluation of the progress and achievements of the Steps program will play a key role
in each program implemented within WCSD6. In order to ensure open communication the
Project Coordinator and the School Health Coordinator will meet bi-weekly with the Steps team
to share information and assure collaborative efforts between the WCDPHE and WCSD6.
Progress reports will be due to the Steps Project Coordinator on: March 31, 2008 and September
21, 2008 (last day of Steps funding).
Personnel:
WCSD6 agrees to provide a School Health Coordinator(SHC)to work toward the objectives set
forth in the Steps grant and in this Agreement with responsibilities including but not limited to:
1. Coordinate K-12 health, physical education, and nutrition programs and curriculum
specific to the project objectives.
2. Work closely with and report to the Nutrition Services and Procurement Director.
3. Represent WCSD6 on related community committees.
4. Participate in Steps Consortium and Coalition Meetings.
5. Coordinate staff development.
6. Assist in the evaluation of program objectives by completing required reports.
7. Ensure inclusion of diverse communities to include Hispanic, low-income, at-risk, and
other disparate populations.
8. Perform any and all other duties as assigned by the Nutrition Services and Procurement
Director.
Compensation:
WCDPHE agrees to pay WCSD6 (not to exceed) $50,992 for the SHC salary and/or fringe
benefits. Final budget(approved by the CDC on 8/27/07)will provide the guide to the resources
available to complete said objectives and strategies above. WCDS6 will invoice on or before the
15`h of the month for the previous month expenses. Payment by WCDPHE will be in the form of
reimbursement of submitted WCSD6 invoices, and will be made in equal monthly payments over
the course of this Agreement. If there are no disputes concerning the billing statement,
WCDPHE will pay the reimbursement billed within thirty(30) days of receipt. In the event of
any dispute concerning any billing statement, the parties will use timely and good faith effort to
resolve any such disputes within thirty(30)days. Final invoice for this grant year must be
submitted on or before October 15, 2008 to ensure timely budget balance at year's end.
Default or Termination
If either party is in default under any of the terms and provisions contained herein, the non-
defaulting party shall notify the defaulting party of the default. The defaulting party shall then
have 15 days after such notice in which to cure any default. If any default is not capable of being
cured within the requisite period of time, then so long as the party charged with the default has
diligently pursued such cure of the default within the prescribed period of time, the defaulting
party shall be given the necessary time to cure the default.
If the default continues after the period for cure passes, and the defaulting party has not
diligently pursued a cure of such default,the non-defaulting party may terminate this Agreement
by giving ten(10) days written notice of the non-defaulting party's intent to terminate.
In any case,this Agreement may be tenninated by either party by giving the other party written
notice of intent to terminate the Agreement at least thirty(30) days prior to the annual
termination date. Upon termination, WCDPHE shall pay to WCSD6 any amounts not yet paid
which are due and owing as reimbursement for services previously rendered.
Miscellaneous
(1) No Third Party Beneficiaries. No third party may claim any right or benefit under this
Agreement and the obligations of the Agreement shall be for the benefit of the parties
hereto, their successors and assigns.
(2) Non-Discrimination. The parties agree that all actions and activities of the within
Agreement shall be accomplished without discrimination on the basis of race, creed,
color, national, origin, gender, disability or age.
(3) Entire Agreement. This Agreement constitutes the entire agreement between the parties
for the subject matter hereof. This Agreement may be modified only by a writing
executed by the parties.
(4) Independent Contractors. Each party is an independent contractor of the other and
neither shall be liable for the actions of the other. Employees of the WCDPHE do not
become employees of WCSD6 by reason of this contract and employees of the WCSD6
do not become employees of the WCDPHE by this contract.
(5) No Assignment. Neither party shall assign or transfer this Agreement to any third party
without the prior written consent of the other party.
(6) Severability. If any term or condition of this Agreement shall be held to be invalid,
illegal, or unenforceable, this Agreement shall be construed and enforced without such a
provision, to the extent this Agreement is then capable of execution within the original
intent of the parties.
(7) Liability. The WCSD6 shall be solely liable for any and all claims, costs, and expenses
arising of any act or omission of School District employees in performing services under
this Agreement. WCDPHE shall be solely liable for any and all claims, costs and
expenses arising out of any act or omission of employees of WCDPHE in performing
services under this Agreement.
(8) Immunities. No portion of this Agreement shall be deemed to constitute a waiver of any
immunities the parties or their officers or employees may possess,nor shall any portions
of this Agreement be deemed to have created a duty of care with respect to any persons
not a party to this Agreement.
(9) Budget Restraints. No portion of this Agreement shall be deemed to create an
obligation on the part of the County of Weld, State of Colorado, or upon the Weld
County Department of Public Health and Environment to expend funds not otherwise
appropriated in any relevant year.
(10) Law Governing. Except to the extent that the within contract shall be performed in
accordance with the Steps to a HealthierUS and other applicable federal law,the
interpretation of this contract will be governed by the laws of the State of Colorado,
including its choice of law rules. This contract is executed and will be performed in
Weld County, Colorado.
(11) Notices. Any notice to be given under this Agreement shall either be hand delivered,
with signed receipt, sent by facsimile with confirmed receipt, or mailed to the party to be
notified with return receipt, at the address set forth below,until such time as written
notice of a changes is received from the party wishing to make a change of address or
facsimile number. Any notice so mailed, served by facsimile, or any notice served by
personal delivery shall be deemed delivered and effective upon receipt or upon attempted
delivery. This method of notification will be used in all instances, except for emergency
situations when immediate notification to the parties is required.
IN WITNESS WHEREOF,the parties have executed this Agreement this 11*' day of
