RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL
ACTION AGAINST ERIC HOUSEMAN FOR VIOLATION OF THE WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Eric Houseman, ZCV#0701184, is allegedly in violation of the Weld County
Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 11th day of March, 2008, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Eric Houseman, property owner, and Martin Stock, representative, were
present at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said violation
to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon
such referral until May 11, 2008, to allow adequate time for the property owner to submit a Use by
Special Review application to bring the subject property into compliance and for an inspection of
the property by the Department of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that ZCV#0701184 be, and hereby is, referred to the Weld County Attorney's
Office for legal action against Eric Houseman to remedy the violation of the Weld County Code,
and any other persons occupying the properties, any persons claiming an interest in the properties,
and any persons acting in active concert with the identified parties, with an instruction for delay of
action upon such referral until May 11, 2008, to allow adequate time for the property owner to
submit a Use by Special Review application to bring the subject property into compliance.

11/09/2007 Property Inspected Upon a visual inspection of the property, the following
items were noted: several commercial trucks and trailers.
Some of which had "Blue Mountain" on the side logo. No

pictures were taken during this inspection.
12/03/2007 Phone Call Eric Houseman (303-356-5179) called. He indicated that
his business has approximately 2 tractors, a few trucks
and 8 trucks. He stated that when he purchased this
property he did so with the intent to store a few pieces of
his equipment on this lot. He asked what he needed to
do. He said he owns the land but has a renter in the
house. He said the renter is a plumber but does not have
anything related to his business on this property. I
explained that he was looking at a Use by Special
Review. I advised him that I would mail it to him along
with a 60 day letter. We had a brief discussion as to if he
would be capable of processing the application himself
and if not who should he call. I advised him that he could
look under the yellow pages(under planner/land use) or
use a land use attorney. He said he"d peak at the
application first. I advised him to call me with any
questions.
02/05/2008 Property Inspected Upon a visual inspection of the property, the following
items were noted: property still has several commercial
vehicles and equipment. There still are apparent piles of
rock and other landscaping materials. No pictures were
taken during this inspection.

Two (2)copies of document showing evidence of adequate water supply (e.g. well permit or letter from water
district).

One (1)original Certificate of Conveyances form and any attachments, completed within thirty(30)days of the

Two (2) copies of Soils Report. Soils Reports are available from local Soil Conservation Service Offices.

number assigned by the Weld County Assessor of the owners' of property(the surface estate)within 500 feet of
property being considered. This list shall be compiled from the records of the Weld County Assessor,the Weld
County Website,www.co.weld.co.us, or a person qualified to do the task, and shall be current as of a date no more
than thirty(30)days prior to the date the application is submitted to the Department of Planning Services.
One (1)copy of affidavit and certified list of the names and addresses of all mineral owners and lessees of mineral
owners on or under the parcel of land being considered. The list shall be prepared from the real property records
by a person qualified to do the task, and shall be current as of a date more than thirty(30)days prior to the date the
application is submitted to the Department of Planning Services. Note: Mineral Notification is in addition to that
required by C.R.S. 24-65.5-102 through 104.
One (1)original Emergency Information Sheet(for Commercial only)
Notice of Inquiry if located within an Intergovernmental Agreement(IGA) boundary.
