HomeMy WebLinkAbout20080782.tiff RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST ERIC HOUSEMAN FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Eric Houseman, ZCV#0701184, is allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 11th day of March, 2008, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Eric Houseman, property owner, and Martin Stock, representative, were present at said hearing, and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until May 11, 2008, to allow adequate time for the property owner to submit a Use by Special Review application to bring the subject property into compliance and for an inspection of the property by the Department of Planning Services staff. He indicated that his business has approximately 2 tractors, a few trucks and 8 trucks. He stated that when he purchased this property he did so with the intent to store a few pieces of his equipment on this lot. He asked what he needed to do. He said he owns the land but has a renter in the house. He said the renter is a plumber but does not have anything related to his business on this property. I explained that he was looking at a Use by Special Review. I advised him that I would mail it to him along with a 60 day letter. We had a brief discussion as to if he would be capable of processing the application himself and if not who should he call. I advised him that he could look under the yellow pages(under planner/land use) or use a land use attorney. He said he"d peak at the application first.
