RE : APPROVAL OF RECORDED EXEMPTION NO. 525 - J. MOODY
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , it has been determined by the Board of County
Commissioners at a public meeting held on the 23rd day of
December, 1981, in the Chambers of the Board, that the division
into two parcels of land, as shown on the plat known as
Recorded Exemption No. 525 , being the property of J. Moody,
described as part of the East half of Section 17 , Township
3 North, Range 68 West of the 6th P .M. , Weld County, Colorado,
being more particularly described as follows :
A parcel of land situate in the East : of Section
17 , Township 3 North, Range 68 West of the 6th P.M. ,
County of Weld, State of Colorado, being more
particularly described as follows :
Considering the South line of the Southeast a of
said Section as bearing N 90°00 ' 00" E . , and with
all bearings contained herein relative thereto;
Beginning at the Southeast corner of said Section;
thence along the East line of the Southeast a of
said Section N 00°08 ' 24" E . , a distance of 1025. 88
feet; thence S 90°00 ' 00" W. , a distance of 1289. 75
feet; thence N 01°11' 34" W. , a distance of 2572 . 59
feet to the South bank of the Highland ditch as
existing; thence along said South bank the
following nine (9) courses :
S 60°26 ' 20" W. , a distance of 124 . 68 feet; and again
S 65°34 ' 57" W. , a distance of 219 . 33 feet; and again
S 57 °21 ' 53" W. , a distance of 115 . 91 feet; and again
S 75°26 ' 41" W. , a distance of 93. 21 feet; and again
N 84°59 ' 38" W. , a distance of 181. 86 feet; and again

thence along the South line of the Southeast 4 of said Section

Beginning.
Subject to a 30 foot right-of-way for County Road purposes along
the South and East lines of the Southeast a of said Section and
subject to all other Rights-of-way, Easements , and Restrictions
as now in use or of record.
Said parcel contains 136. 865 acres more or less, gross .

does not come within the purview of the definition of the terms ,
"subdivision" and "subdivided land" , pursuant to its authority
under Section 30-28-101 (10) (d) , CRS 1973, as amended.
NOW, THEREFORE , BE IT RESOLVED by the Board of County
Commissioners that the hereinabove described parcel of land
owned by J. Moody be, and hereby is , exempt from the definition
of the terms "subdivision" and "subdivided land" .
The above and foregoing Resolution was, on motion duly
made and seconded, adopted by the following vote on the 23rd
day of December, A.D. , 1981.

Dear Commissioners :
The attached application , plat and related items are in reference
to a request by J . Moody for a recorded exemption . The parcel
of land under consideration is described as part of the E1/2,
Section 17 , T3N , R68W of the 6th P . M . , Weld County , Colorado .
This property is located west of County Road 5 and north of
County Road 32 , approximately 1 mile southwest of the Town of
Mead . The property contains 136 . 865 acres of Class II and III
irrigated soils and Class III and IV non- irrigated soils in the
Agricultural Zone District . The request is to split the property
into parcels of 30 . 094 acres and 106 . 771 acres .
The 30 . 094 acres ( Lot A) will be retained by the owner where two
principal dwelling units , three sheds and a barn are presently
located . The applicant wishes to sell the remaining 106 . 771 acres
of irrigated farmland .
Based upon the information submitted and the adopted policies
in the County , the Department of Planning Services staff recommends
the request be approved for the following reasons :
1 . The proposed request is in compliance with the intent clause
of the Recorded exemption procedure , the Weld County Comprehensive
plan , and the Intent Clause of the Agricultural Zone District
in that the proposed use of the property will be compatible
with the surrounding agricultural land uses . There will be
no reduction in the amount of land used for agricultural
production at the present time . The request will be encouraging
agriculture and related uses to continue as the predominant
land uses .

of the Weld County Subdivision Regulations .

Dear Mr. Oxenfeld:
As per your request for a letter indicating what my intentions will be for
the ground which we are applying for an exemption on, more precisely the
137 acres Southwest of Mead.
They are as follows:
1. To create a parcel approximately 30 acres which all of the
improvements are located on. Said improvements will be rented to
relatives and sold at a later date.
2. To maintain a straight property line North and South between
the 30 acres and 106 acres ±.
3. By not selling the required 35 acres with the improvements
we will help maintain the size of the present beet fields
and shall keep it more conducive to irrigating.
4. To create a parcel in excess of the required 80 acres to
