SUBJECT: RE: abandonment of Septic System

The attached information is regarding abandonment of a septic system on the SW Chambers
(RS-1133) property. They did a resubdivision to vacate out of Lupton Meadows in 2006. The
Health Department had no records of a septic permit onsite. They have provided the following
information to indicate that the septic system had been properly abandoned. If you need
anything else in regards to this let me know, the plat has not yet been recorded.

RS-1133 Conditions of Approval

1. Was the septic system properly abandoned when the house was demolished?
• Ryan McCaw contacted the State of Colorado Department of Public Health and Environment and
spoke to Kent Kuster. Mr. Kuster referred him to Pam Smith at the Weld County Department of
Public Health and Environment for residential sized septic system abandonment requirements.
Ms. Smith stated that Weld County wanted a statement from whomever did the work(demolished
the house and abandoned the septic system)outlining how the septic system was abandoned(i.e.
Was it abandoned in place? Removed?). Please refer to attached letter stating that the septic
system has been removed.
Prior to recording the RS-1133 plat:
A. Indicate existing access points.
Existing and proposed access points are shown on the plat.
B. Surveyor's certificate should match Appendix 24-F of the Weld County Code.
The Surveyor's Certificate now matches the Weld County Code.

COMMENTS:
Ultimate Concrete was awarded the bid for a job site clean up and demo work at Weld Co Rd 22
and Rd 25(SW Heit). I was the Construction Site Manager assigned to oversee the job through
its completions The job has been complete and the contract has been satisfied by all parties.
Questions arose concerning the removal of the septic tank from the said property. I myself was
not present during its removal but by verbal contact with Mike Toedtli of Ultimate Concrete, it was
stated clearly that indeed the septic tank had been removed.

Dear Mr.Gathman:
On behalf of SW Investments, LLC,we are respectfully submitting two paper copies of the RE 4554 and 2
signed mylars of the RS-1133 plats for review and approval. Upon your approval,the RE-4554 and RS-
1133 plats will be submitted for recording. Enclosed with this letter is evidence that all conditions required to
be met prior to recording the plats have been completed.
RE-4554 Conditions of Approval
1. Lot A shall use the existing agricultural access point for residential purposes as no additional
accesses shall be.granted:The applicant will be required to verify that adequate site distance
exists for the access point off of County Road 20.25 with the Department of Public Works.
Evidence of;Department.of.Public Works approval shall beprovided to the Department of Planning

C. The easement certificate shall be removed(a new residential access easement is not being
dedicated through this plat).
The easement certificate block has been removed.
D. The reference to"Lot 1, RS-1133, Resubdivision of Lupton Meadows Land Company
Subdivision"shall be removed from the plat.
The reference to Lot I has been removed from the plat.
E. Surveyor's Certificate should match Appendix 24-F of the Weld County Code.

Hello
