RE : APPROVAL OF RECORDED EXEMPTION NO. 629 - HOWARD AND ELAINE
BINDER
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners at a public meeting held in the Chambers of the Board,
that the division into two parcels of land, as shown on the plat
known as Recorded Exemption No. 629 , being the property of Howard
and Elaine Binder, described as the East 1/3 South 1/2 , Section 3
Township 1 North, Range 67 West of the 6th P .M. , Weld County,
Colorado, being more particularly described in the plat which
shall be provided by the applicant and known as Exhibit "A" , said
plat to be recorded, does not come within the purview of the defi-
nition of the terms, "subdivision" and "subdivided land" , pursuant
to its authority under Section 30-28-101 (10) (d) , CRS 1973 , as
amended.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the hereinabove described
parcel of land owned by Howard and Elaine Binder be, and hereby
is, exempt from the definition of the terms, "subdivision" and
"subdivided land" .
BE IT FURTHER RESOLVED by the Board that this approval is
conditional upon the applicant submitting a mylar plat to the
Department of Planning Services Office to be recorded in the
office of the Clerk and Recorder. The plat shall be drawn in
accordance with the requirements of Section 9-2 C. (4) of the
Weld County Subdivision Regulations . The plat shall be sub-
mitted within ninety (90) days from the date of approval by the
Board of County Commissioners

Dear Commissioners:
The attached application, plat and related items are in reference to a
request from Howard and Elaine Binder for a recorded exemption. The
parcel of land on which this request is being made is described as the
E 1/3 S1, Section 3, T1N, R67W of the 6th P.M. , Weld County, Colorado.
The property is located approximately 2.5 miles west of Fort Lupton and contains
approximately 102.662 acres of Class IIe (Prime) and IIIe (Prime)
irrigated soils.
The request is to divide the property into parcels of 13 acres and 89
acres, more or less. It is the intent of the applicant to provide his
brother with a residential site with ample acrage for the grazing of a
few horses, cows and/or calves.
Based upon the submitted information and policies of the County, the
Department of Planning Services staff recommends the request be approved
for the following reasons:
1. The request complies with Section 9-2 C. of the Weld County
Subdivision Regulations submission requirements.
2. The request complies with Section 9-2 E. of the Subdivision
Regulations as follows:
The 102 acres, more or less, under consideration will allow
uses which are consistent with the intent clause of the
Agricultural Zone District. The uses will be compatible
with existing surrounding uses.

- The proposal was reviewed by the city of Fort Lupton
and was found to comply with their long-range compre-
hensive plan;
- The proposal is in compliance with Section 1-3 of the
Weld County Subdivision Regulations and the proposed
land division complies with the Weld County Compre-
hensive Plan; therefore, the proposed use is consistent
with efficient and orderly development;
- The proposal does not exist in an overlay district area;
- The proposed lots meet minimum lot size requirements for
land division;
- The Central Weld County Water District has indicated
adequate water service is available for this proposal;
- The proposed lots are not part of a recorded exemption
within the last five (5) years;
- The two lots proposed will have adequate access from
Colorado Highway 52;
- The Weld County Health Department has indicated, in a
letter dated July 26, 1983, that both lots will have
adequate sewage capacity.
The Department of Planning Services staff recommendation for approval is
conditionsal upon the applicant submitting a mylar plat to the Department
of Planning Services office to be recorded in the office of the Clerk and
Recorder. The plat shall be drawn in accordance with the requirements of
Section 9-2 C. (4) of the Weld County Subdivision Regulations. The plat
shall be submitted within ninety (90) days from the date of approval by
the Board of County Commissioners.

A shared driveway would provide access for both lots to Highway 52. The driveway is
paved up to the proposed smaller lot.

Gentlemen:
Pursuant to your recent request for more information as related to the
above referenced application, please let this letter serve as a response to your
request.
Enclosed is a copy from Central Weld County Water District correcting
their property description as contained in their letter of May 27, 1983.
Currently located upon the property on Lot B are two homes, a milking
barn, various loafing sheds, corrals, garages, septic tanks and leach lines for the
two homes, hay shed, garage and domestic water well. Lot A has one home, the
water tap with Central Weld County Water District, and a septic tank and leach
line which is located to the west of the existing home and is all contained upon
the acreage listed for Lot A. Enclosed with this letter is a copy of an aerial
photograph showing the existing property and the approximate division lines
between Lots A and B.
In reviewing this recorded Exemption Application Request with Mr. and
Mrs. Binder, as well as Mr. Binder's brother who will be purchasing Lot A, it is
my understanding that Lot A will be used for a residence as well as pasture
grazing of not more than 20 horses, cows, and or calves. There is not
contemplated construction of dairy facilities upon Lot A as all of those facilities
are located upon Lot B. It is contemplated that a pole barn or shed will be
constructed for the three horses which the prospective purchaser desires to have
upon the property. Again, the main request is to divide the property for
financial reasons. It should also be noted that as Lot A currently has a residence
there will be no increase in density or use of the property.
I trust that the enclosed fulfills your questions concerning the property,
and I would request that this exemption now be docketed with the County
Commissioners.

Gentlemen:
Attached to this letter please find an application for a recorded exemption,
check in the amount of $95.00 for your application fee, plat map, certificate of
conveyances and a copy of the deed showing current ownership. Addtionally,
please let this letter serve as support for the exemption application.
Basically, this recorded exemption application is presented on behalf of the
owners of the property who intend to sell the property to Bruce Binder who is
the brother of the applicant and landowner.
Mr. Bruce Binder currently works with the landowners in their dairy
business, and due to financing requirements as well as mortgage purposes, it has
become necessary for Mr. Bruce Binder to own his homestead separate and apart
from the property of Howard Binder. The total farm is currently used for farm
and specifically dairy purposes, and the future use will remain the same, both
on the larger as well as smaller parcel. The main reason for the request of the
exemption is based upon the fact that a financial institution will require Mr.
Bruce Binder to own his own property and Mr. Bruce Binder does not desire to
continue "renting" the home for residential purposes.
Both parcels are currently within the A Zone District, and the Weld County
Comprehensive Plan indicates that this area shall remain as agricultural in
nature. As both parcels are currently used for farming and dairy purposes, and
both parcels will be used for that in the future both uses are consistent with the
intent of the district. Additionally, all surrounding land is used for farm, dairy
and related residential purposes. It should also be stated that these uses are
compatible with the expected future development of the area as that is deemed
to be agricultural.

Both parcels currently have residences located upon them with the main
residence being located upon the smaller parcel (Lot A). There will be no basic
changes to the property either upon the small or large parcel and therefore it
is not inconsistent with any type of efficient and or orderly development as none
will take place except possibly the construction of some holding pens upon the
smaller parcel for holding dairy cattle. The property is not within any overlay
district.
We would request that this exemption be granted as it is consistent with
both current and future uses of the property and is totally consistent with the
area surrounding the property. Thank you for your consideration.
