HomeMy WebLinkAbout20083075.tiff RESOLUTION RE: APPROVE LEASE AGREEMENT FOR STORAGE SPACE AND AUTHORIZE CHAIR TO SIGN - ENFEOFFMENT, LLC WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Lease Agreement for Storage Space between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County,on behalf of the Department of Human Services,and Enfeoffment, LLC, commencing November 15, 2008, with further terms and conditions being as stated in said lease agreement, and WHEREAS, after review, the Board deems it advisable to approve said lease agreement, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County,Colorado,that the Lease Agreement for Storage Space between the County of Weld,State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Human Services, and Enfeoffment, LLC, be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign said lease agreement. Griego, Director, Human Servi ' , eYit '"; Y� D COLORADO RE: Lease Agreement between the Weld County Department of Human Services and Enfeoffment, LLC Enclosed for Board approval is a Lease Agreement between the Weld County Department of Human Services and Enfeoffment, LLC. The major provisions of this Lease Agreement are as follows: 1. The Lease will benefit the AmeriCorp Program that was displaced by the impending demolition of the Transportation Building. 2. The Lease is for approximately 500 sq. ft of basement storage space located at 914 8th Avenue, Greeley, Colorado. 3. The rent will be $50.00 per month. 4. The term of this Lease Agreement is from November 15, 2008, for a term of six months and shall continue thereafter on a month to month basis. The term will complement the long term storage plans for the County. If you have questions, please give me a call at extension 6510. 2008-3075 LEASE THIS LEASE, made and entered into this 15`" day of November, 2008, by and between Enfeoffment LLC, whose address is 912 Eighth Avenue, Greeley, Colorado 80631, hereinafter referred to as "Lessor, " and the Board of County Board of County Commissioners, Weld County, State of Colorado, by and on behalf of The Weld County Department of Human Services, whose address is 915 Tenth Street, Greeley, Colorado 80631, hereinafter referred to as "Lessee. " WITNESSETH: LEASED PREMISES That in consideration of monthly rent of Fifty Dollars ($50 . 00) per month, payable monthly on the 15' of each month, and other good and valuable consideration, and in the keeping and performance of the covenants and agreements by Lessee, hereinafter set forth, Lessor hereby leases unto Lessee the following described property: Approximately five hundred square feet of basement storage space located at 914 Eighth Avenue, Greeley, Colorado 80631 . FINANCIAL OBLIGATIONS OF THE PARTIES A. The above building space shall be leased to the Lessee from on or about 15 November 2008, for a term of six months and shall continue thereafter on a month to month basis . B. Lessor has agreed to lease the aforementioned space for the use and benefit of Lessee in accordance with the terms set forth in this lease . C. Lessee shall maintain the property in reasonable condition and shall ensure that items stored therein do not entice vermin or other insects into the storage space. Further, it is understood that no power equipment shall be routinely used in the storage space, except as necessary to maintain the storage space. During the term of this Lease, Lessee, at its sole cost and expense, for the mutual benefit of Lessor and Lessee, shall carry and maintain the following type of insurance : (a) worker ' s compensation insurance insuring Lessee from all claims for personal injury and death in such amounts as may from time to time be sufficient to pay the maximum accumulated award allowed by Colorado law; (b) personal property insurance for the benefit of Lessee covering Lessee' s personal property situated within the Premises; (c) commercial general liability insurance written on an occurrence form, including blanket contractual liability coverage against claims for bodily injury, death and property damage occurring in or about the leased property, affording single limit protection of Five Hundred Thousand Dollars ($500, 000 . 00) per occurrence, and One Million Dollars ($1, 000, 000 . 00) in the aggregate. Lessee will, upon written request by Lessor, provide Lessor with a certificate of insurance properly executed by its insurance company evidencing such coverage. The Lessor will not be held liable for any loss of or damage to Lessee' s personal property located on the Premises except as caused by the gross negligence or omission of Lessor. D. Lessor shall be responsible for the payment of all utilities, taxes, maintenance, building insurance, (at a minimum, against loss or damage by fire, with extended-or "all risk"-coverage endorsement, vandalism, and malicious mischief coverage for the repair and/or replacement of the building) , janitorial, (for space not leased by Lessee, and for the exterior of the building) , and all other building operating costs . Lessee agrees not to adjust the temperature of the leased space . ADDITIONAL COVENANTS OF THE PARTIES A. Lessee agrees to keep any improvements upon leased real property and all other property covered by this Lease in good repair at the expense of the Lessee; B. At the expiration of this Lease, Lessee agrees to surrender and deliver up said property in as good order and condition as when the same where first provided, loss by fire, inevitable accident, or ordinary wear and tear excepted; C. Lessee agrees to sublet no part of the real property covered by this Lease, nor assign this Lease or any interest herein, without the prior written consent of the Lessor; D. Lessee agrees to keep the real property covered by this Lease clean and in the sanitary condition required by the ordinances and the health and police regulations of the local jurisdiction in which the property is located. E. Lessor and Lessee agree that at the end of the six month term (April 14, 2009) , this lease may be terminated by either party upon providing the other party with a thirty (30) day written notice. F. Lessee shall not keep or maintain any storage on the outside of the building. Vehicles used by the Lessee shall be parked to permit Lessor (or its assigns) to perform snow removal and maintenance activities as needed on the outside of the building.
