RE: APPROVE ADDENDUM TO INTERGOVERNMENTAL AGREEMENT FOR
IMPROVEMENTS TO COUNTY ROAD 29 (71ST AVENUE) BETWEEN C STREET AND
COUNTY ROAD 64 AND AUTHORIZE CHAIR TO SIGN - CITY OF GREELEY
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an Addendum to the Intergovernmental
Agreement for Improvements to County Road 29 (71st Avenue) between C Street and County
Road 64, between the County of Weld, State of Colorado, by and through the Board of County
Commissioners of Weld County, on behalf of the Department of Public Works, and the City of
Greeley, commencing upon full execution,with further terms and conditions being as stated in said
addendum, and
WHEREAS, after review, the Board deems it advisable to approve said addendum, a copy
of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Addendum to the Intergovernmental Agreement for Improvements to
County Road 29 (71st Avenue) between C Street and County Road 64, between the County of
Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on
behalf of the Department of Public Works, and the City of Greeley be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to
sign said addendum.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 24th day of March, A.D., 2008.

SUBJECT: Agenda Item
Weld County has entered into an IGA with the City of Greeley for Road Improvements
for WCR 29 between C St. and WCR 64. At the time of signing the IGA, Weld County
was the lead agency with respect to designing the improvements and the IGA was
worded accordingly.
Since then, Greeley staff has requested that they design the improvements with city
staff. PW has no problem with this change but the original IGA language needs to be
modified accordingly. The addendum to the IGA addresses these modifications.
ADDENDUM TO THE INTERGOVERNMENTAL
AGREEMENT FOR IMPROVEMENTS TO
WELD COUNTY ROAD 29 (71ST AVENUE)
BETWEEN C STREET and WELD COUNTY ROAD 64
This First Addendum to the Intergovernmental Agreement is made and entered into this_
4" day of Sar v.a.a , 2008 by and between the City of Greeley, State of
Colorado, by and through the Cit}�Council of Greeley, Colorado, hereinafter referred to as
"CITY," with offices located at 1000 10`h Street, Greeley, Colorado 80631, and the County of
Weld, State of Colorado, by and through the Board of County Commissioners of Weld County,
Colorado, hereinafter referred to as "COUNTY," with offices located at 915 10`h Street, Greeley,
Colorado 80631.
WHEREAS, the parties entered into an Intergovernmental Agreement on January 7,
2008, recorded in the Weld County Clerk and Recorder's office hereinafter called the
"AGREEMENT"; and
WHEREAS, it has been determined by the parties that specific work tasks associated
with the design of the project should be performed by the CITY, and other specific work tasks
associated with the design of the project should be performed by the COUNTY, with the cost
thereof to be borne by each agency according to the terms of this Addendum;
NOW, THEREFORE, it is agreed by the parties that the following changes are made to
the aforementioned AGREEMENT as follows:
Delete the following language located in paragraph 1:
"including reimbursement of a proportionate share of design costs incurred by COUNTY:"
Delete the original language located in paragraph 5.b. and replace with the following:
b. COUNTY to be responsible for the construction. COUNTY to be responsible for the
following engineering services: surveying, mapping, geotechnical investigation, utilities
locating, construction inspection, materials testing, and administration.
Delete the original language located in paragraph 6.a. and replace with the following:
a. CITY to be responsible for paying its share of the construction costs ($252,000)to the
COUNTY. CITY to be responsible for the following engineering services: design and
plans preparation.
All other terms and conditions set forth in the AGREEMENT shall remain the same.

RESOLUTION 12,2008
A RESOLUTION OF THE CITY OF GREELEY COUNCIL AUTHORIZING THE
MAYOR TO EXECUTE AN ADDENDUM TO THE INTERGOVERNMENTAL AGREEMENT
WITH WELD COUNTY,COLORADO FOR IMPROVEMENTS TO WELD COUNTY ROAD 29
(71ST AVENUE) BETWEEN "C" STREET AND WELD COUNTY ROAD 64.
WHEREAS,the CITY and COUNTY share the jurisdiction of Weld County Road(WCR)29
also known as 71 sI Avenue between C Street and WCR 64,hereafter referred to as the"PROJECT",
and
WHEREAS,both parties wish to make improvements to the PROJECT and share the costs of
such improvements, and
WHEREAS, both parties have entered into an Agreement for the purpose of defining their
respective roles and responsibilities regarding the completion of this PROJECT, and
WHEREAS,modifications to the original Intergovernmental Agreement are necessary;said
modifications require an addendum to the original Agreement; and
WHEREAS, it is in the best interest of the citizens of the City of Greeley to execute this
Addendum.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
GREELEY, COLORADO:
Section 1. The City Council hereby authorizes the Mayor to execute an addendum to the
Intergovernmental Agreement for improvements to Weld County Road 29 171s1 Avenue)between C
Street and Weld County Road 64, attached hereto and incorporated herein as Exhibit A.
Section 2. This Resolution shall become effective immediately upon its passage.
PASSED AND ADOPTED, SIGNED AND APPROVED THIS 4`h day of March, 2008.
